NOTICE OF FORECLOSURE SALE
Default has occurred on that Mortgage Loan No. 07420063227 dated July 26, 2007 (“July 26, 2007 Mortgage”) given by Brandon W. Kinnamon and Deborah D. Kinnamon, husband and wife, to the Rocky Mountain Bank, which was recorded in the Sublette County Clerk’s office on July 27, 2007, in Book 152 mtg, Page 51. This Mortgage contains a power of sale clause now in effect by Mortgagors’ default.
The Mortgage was given to secure the original principal sum of $174,534.00, which total payoff amount is now $187,325.66. Nonpayment and other default exists, acceleration of the debt secured by the Mortgage has been declared, and the entire remaining balance of the debt is now due and payable. No lawsuit has been filed to collect the debt or any portion thereof.
Take notice that the Mortgage will be foreclosed and the property encumbered by the Mortgage will be sold by the Sheriff of Sublette County to the highest bidder for cash at public auction. The sale will be held on the front steps of the Sublette County Courthouse, 21 South Tyler, Pinedale, Wyoming at 10:00 a.m. on May 8, 2009. The principal coupled with accrued interest in the amount of $10,292.62, and late charges and other fees in the amount of $3,764.64, brings the total payoff amount to $187,325.66, plus attorney’s fees, costs and expenses of the foreclosure. Interest accrues at $28.28 per diem.
The property encumbered by the July 26, 2007 Mortgage will be offered for sale and is described as follows:
Lot 7, Block 5 of the Eiden Third Addition to the Town of Marbleton, Wyoming, Sublette County, Wyoming, as the same appears on the official plat thereof filed for record in the office of the County Clerk, Sublette, County, Wyoming.
Which has an address of 913 East First Street, Marbleton, Sublette County, Wyoming 83113.
Notice of Intention to Foreclose the Mortgage was sent in accordance with W.S. §34-4-103(a)(iv) on March 12, 2009.
The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.

Motion by Councilman House to approve the minutes of the March 23rd meeting as written. Motion seconded. Mayor Pro-Temp Kunard voted aye, Councilman House voted aye and Councilman Hohl abstained. Motion carried.
Mike Peterson, representing the Sublette County Sheriff’s Office, reported the monthly activities of the sheriff’s office.
Jennifer Gocke, Municipal Code Officer, excused.
Ruth Neely, Municipal Judge, reported the monthly activities of the municipal court.
Julie Early, Animal Control Officer, reported the
monthly activities of the animal control department.
Randy Hubbard, representing the Public Works Department, reported the monthly activities of the public works department. After discussion motion by Councilman House to allow the Public Works Department to put out to bid a 50KW backup generator for the west chemical feed building as specified. Motion seconded. Motion carried unanimously. Hubbard presented Stantec’s Change Order Number One: revise video monitoring system, price decrease $15,600.00; and network extension to shop, price increase $3,350.00; net change in contract price a decrease of $12,250.00. Motion by Councilman House to approve Stantec’s Change Order Number One as presented. Motion seconded. Motion carried unanimously.
Jim Parker, Airport Manager, presented the Airport Board’s February Treasurer’s Report, draft minutes of the March Meeting and reported the monthly activities of the airport. After discussion motion by Councilman Hohl to approve Ed Wood, Town Attorney, doing a resolution for the transfer of the 1992 International Dump Truck and snow plow to the Big Piney-Marbleton Airport. Motion seconded. Motion carried unanimously.
Eugene Ninnie, Town Engineer, reported the monthly activities of the engineering department. After discussion motion by Councilman Hohl to authorize the Mayor Pro-Temp to sign the State Loan and Investment Board applications for Phase IV and V, Sewer and Water Line Replacement and UV System. Motion seconded. Motion carried unanimously.
Kate Grimes, Planning and Zoning Administrator, reported the monthly activities of the Planning and Zoning Department. After discussion motion by Councilman Hohl to allow Planning and Zoning to work with Worthington, Lenhart and Carpenter updating the zoning ordinances not to exceed $4,800.00. Motion seconded. Motion carried unanimously. 
Mary Hogarty, Mayor’s Assistant, reported her monthly activities.
After discussion motion by Councilman House to authorize Rivera Lodge Bed & Breakfast to remove trees on town property and reimburse not to exceed $350.00. Motion seconded. Motion carried unanimously.
After discussion motion by Council Hohl to allow the Mayor Pro-Temp to sign the Wyoming Wildlife and Natural Resource Trust Grant Application for stream restoration in the town park. Motion seconded. Motion carried unanimously.
Susan Kramer, Project Manager, discussed the pending Application for Funding through the Jonah Interagency Mitigation & Reclamation Office for the proposed wood stove change out program.
Carmel Kail and Pam Curry discussed the pending Application for Funding through the Jonah Interagency Mitigation & Reclamation Office for the proposed Pinedale Homeowner Tree Planting Project, and requested $5,000.00 contribution from the town for the proposed project. After discussion motion by Councilman Hohl to approve the $5,000.00 for the proposed Tree Planting Project contingent of finding that it is constitutional to place on private property for public benefit. Motion seconded. Motion carried unanimously.
Public hearing for the renewal of retail, microbrewery, limited and restaurant liquor licenses was opened for discussion. Katy Anderson, representing the Sublette County Drug Court, discussed her concerns with the recent citations for the sale of liquor to minors and discussed the TIPS Program offered free through the State of Wyoming. Ed Wood, Town Attorney, stated one incident is one incident and it’s not a series of behavior or a course of behavior. Mike Gilmore, representing Country Lane Liquor, stated he has had his licence for over six years and this is his first offense. After discussion motion by Councilman Hohl to approve the renewals of the liquor licenses as presented: Stockman’s Bar and Lounge, Charlie and Lila Golden dba Cowboy Bar, Bozner, Inc. dba Corral Bar, Patriot Enterprises, LLC dba Country Lane Liquors and Ridley’s Family Market retail liquor licenses; Liles Inc. dba Patio Grill, Wrangler Café, Wind River Brewing Co., Placido’s Inc. dba Los Cabos Mexican Restaurant, Wind River Pizzeria and Pasta, Rocking K 9 dba Café on Pine, China Gourmet, Inc. And Rock Rabbit, Inc. restaurant ; VFW Post #4801, limited retail liquor license and Wind River Brewing Co. microbrewery. Motion seconded. Motion carried unanimously.
Public hearing for the issuance of a new restaurant liquor license to Moose Creek Catering, Inc. was opened for discussion. No comments received. Motion by Councilman House to approve the new restaurant liquor license to Kathy Lee for Moose Creek Catering, Inc.. Motion seconded. Motion carried unanimously. 
Maggie Palmer and Pat Poletti, representing Pinedale Farmers Market, discussed closing North Tyler Avenue from Pine Street to Magnolia Street on Sundays from mid-May to mid-October for the market. After discussion Council was supportive but requested they return after they secure appropriate property insurance.
Mark Eatinger, representing Rio Verde Engineering, presented Vista Properties, LLC’s request for alley vacation in Block 4 of the Original Townsite. Ed Wood, Town Attorney, stated the vacation would have to be done by ordinance. After discussion Council requested the request go before the Planning and Zoning Board.
Mark Eatinger, representing Rio Verde Engineering, presented Wind River Resorts, Inc. request for remodel and second floor addition to existing store front property located at 240 East Pine Street. After discussion motion by Councilman Hohl to approve the site plan and building permit for Wind River Resorts, Inc. contingent on the satisfaction of the Town Engineer. Motion seconded. Motion carried unanimously.
Mark Eatinger, representing Rio Verde Engineering, presented Rocky Mountain Wash’s request for construction of a two bay car wash with office located at 935 Highway 191. After discussion motion by Councilman Hohl to approve the building permit for the addition to Rocky Mountain Wash. Motion seconded. Motion carried unanimously.
William W. Wheatley, representing Plan One/Architects, presented Wyoming Department of Transportation’s request for construction of an addition to the existing structure located at 1551 Highway 191. After discussion motion by Councilman Hohl to approve the building permit for the addition to the WYDOT Facility. Motion seconded. Motion carried unanimously. Bob Maxam, Wyoming Department of Transportation Engineer, discussed the installation of the two pedestrian crossing lights at the intersections of Pine Street and Tyler Avenue and Pine Street and Lake Avenue. Maxam discussed the town’s frozen ground conditions and when the contractors would be able to dig. Council advised Maxam to meet with the public works department. 
James Rogers, representing Gambling Mountain, LLC, presented JJ Minor Subdivision for plat approval, which lies within one mile of the town limits. Motion by Councilman House to approve JJ Minor Subdivision. Motion seconded. Motion carried unanimously. 
Gary Heuck, a concerned citizen, discussed concerns with Mayor Stephan Smith’s use of the town credit card and vehicle while out of town. Heuck also questioned the legality of the executive session held on March 9th and asked for the minutes of that session. Paul Rock, a concerned citizen, questioned the executive session held on March 9th. Ed Wood, Town Attorney, stated he say no problem with the use of the town vehicle with compensation in full to the town, adding the executive session was not illegal in his opinion. After lengthy discussion Mayor Pro-Temp Kunard asked to continue with the discussion at the next council meeting when the Mayor and full council are present.
Motion by Councilman Hohl to approve Ordinance 446, an ordinance of the Town of Pinedale, Wyoming amending Section 13.04.020 of the Pinedale Municipal Code by modifying the manner of computing the water and sewer connection fee, on the third reading. Motion seconded. Motion carried unanimously.
Council discussed Resolution 2009-03,a resolution establishing a procedure to address reimbursement for thawing expenses in the Shanley and Quartz Avenues areas. Council agreed to wait until the full council was present to approve the resolution.

CONSERVATION COMMISSION OF THE STATE OF WYOMING
The following matters will come before this Commission on TUESDAY, MAY 19, 2009, at 9:00 A.M., or as soon thereafter as the matters may be heard, or between the hours of 8:00 A.M. and 5:00 P.M. on any of the subsequent days during which the Commission remains in session at the office of the State Oil and Gas Supervisor, 2211 King Boulevard, Casper, Wyoming.
Cause No. 4, Order No. 1, DOCKET NO. 162-2009, brought on the application of EOG Resources, Inc., for an order authorizing the surface commingling of production and approving an allocation methodology for certain wells drilled with the NW1/4 SE1/4, SW1/4 NE1/4 of Section 16, Township 27 North, Range 113 West, 6th P.M., North LaBarge Field, Sublette County, Wyoming.
Cause No. 4, Order No. 1, DOCKET NO. 163-2009, brought on the application of EOG Resources, Inc., for an order authorizing the surface commingling of production and approving an allocation methodology for certain wells drilled on portions of Sections 2, 10, 11, 14, 15 and 22, Township 29 North, Range 113 West, 6th P.M., Big Piney Field, Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 164-2009, brought on the application of EOG Resources, Inc., for an order authorizing up to two (2) Frontier Formation wells in existing 80-acre drilling and spacing units; authorizing up to four (4) Frontier Formation wells in existing 160-acre drilling and spacing units; and authorizing up to eight (8) Frontier Formation wells in existing 320-acre drilling and spacing units; all in Sections 4, 8, 9 and 16, Township 26 North, Range 113 West, 6th P.M., and Sections 28 and 33, Township 27 North, Range 113 West, 6th P.M., South Hogsback/South LaBarge Field, Lincoln and Sublette Counties, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 165-2009, brought on the application of EOG Resources, Inc., for an order authorizing up to seven (7) vertical and and one (1) horizontal Frontier Formation wells in an existing approximate 391.65-acre drilling and spacing unit in Lots 1, 2, 5, NE1/4 NE1/4, NW1/4 SE1/4 of Section 20 and Lots 2 through 6, NW1/4 NW1/4 of Section 21, Township 27 North, Range 112 West, 6th P.M., Big Piney/LaBarge Field, Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 167-2009, brought on the application of EOG Resources, Inc., for an order authorizing up to two (2) Baxter, Frontier and Bear River Formation wells in an existing 80-acre drilling and spacing unit in the SE1/4 NE1/4, NE1/4 SE1/4 of Section 29, Township 27 North, Range 113 West, 6th P.M., Hogsback Field, Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 169-2009, brought on the application of EOG Resources, Inc., for an order authorizing up to two (2) Frontier Formation wells in existing 80-acre drilling and spacing units in the N1/2 NE1/4; SW1/4 NE1/4, NW1/4 SE1/4; and S1/2 SE1/4 of Section 32, Township 27 North, Range 113 West, 6th P.M., Hogsback South Field, Sublette County, Wyoming.
Any interested party is entitled to appear at the aforesaid time and place to be heard by the Commission. The applications may be inspected in the office of the undersigned, 2211 King Boulevard, Casper, Wyoming, or on the Oil & Gas Conservation Commission website at http://wogcc.state.wy.us.
If there are any protests, please make such known to the State Oil and Gas Supervisor at least ten (10) working days before the hearing by filing a written protest. Pursuant to Chapter 5, Section 12 of the Wyoming Oil & Gas Conservation Commission Rules & Regulations, the written protest must state the grounds of the protest and include information and evidence to demonstrate that: (A) The protestant is a party entitled to notice or relief under Wyo. Stat. Ann. §§ 30-5-101 through 30-5-410; (B) The protestant seeks a remedy that is within the jurisdiction and authority of the Commission. No action shall be taken on an objection or protest that is not timely filed.
