A pre-bid meeting will be conducted at 10:00 A.M. local time on Wednesday, June 10, 2009, at which time an on-site inspection of the proposed work will be conducted and special considerations will be discussed. OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
MAY 18, 2009
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with John Linn, Joel Bousman, Cat Urbigkit, Jonathan Van Dyke of the Pinedale Roundup, and Mary Lankford, County Clerk present. Chairman Bill Cramer was absent. Acting Chairman John Linn assumed the chair.
The minutes of the preceding regular meeting of May 5, 2009, were approved and ordered filed on motion by Commissioner Bousman and seconded by Vice Chairman Linn. The motion carried.
Chairman Linn began the meeting with a moment of silence in memory of former County Commissioner Gordon Johnston, and his family, who passed away on May 15, 2009. It was moved by Commissioner Bousman and seconded by Chairman Linn to fly the flag on the Courthouse at half mast on May 20, 2009, in honor of Gordon Johnston. The motion carried.
The Board recognized the passing of Don Calhoun, employee of the Road and Bridge Department.
Chairman Linn thanked Commissioner Bousman for his work on House Bill 980, the Northern Rockies Ecosystem Protection Act, and for testifying before the House Natural Resources Subcommittee on May 5th.
Butch Penton, Road & Bridge Superintendent, reported on a meeting with the BLM on the East Green River Road, and the Fisherman Creek gravel pit.
Mike Jackson, representing Rio Verde Engineering, presented the bid for the Small Asphalt Projects. It was moved by Commissioner Bousman and seconded by Chairman Linn to award the bid to Teletractors, Inc. for the amount of $174,019.00. The motion carried.
Jackson discussed concrete damage at the Skateboard Park and letters in opposition to relocating the Upper Hoback River Road.
John Eddins, WYODOT District Engineer, and Bob Maxam, Resident Engineer, discussed the State Transportation Improvement Program and updated the Board on the legislative session. It was reported that the Industrial Road Project funds have been increased to $2 million, requiring a $2 million local match. Chairman Linn expressed his continued concern about the trees on State Highway 351 and the Green River Bridge.
In accordance with the public notice published in the Sublette Examiner on April 23, 30, May 7, and 14, 2009, a public hearing was held for the renewal of the following liquor licenses and permits:
It was moved by Commissioner Bousman and seconded by Chairman Linn to approve the renewal applications for the following retail liquor licenses: Green River Bar, Boulder Liquors, (transfer and renewal), The Elkhorn, (transfer and renewal), White Pine Ski Area & Resort, Lakeside Lodge, and Daniel Junction. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Linn to allow, in accordance with W.S. 12-5-203(ii), persons under the age of eighteen (18) in a dining or waiting area, with an adult, not later than 10:00 p.m., if the dining or waiting area is part of the licensed room, at Lakeside Lodge. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Linn to approve the renewal applications for the following restaurant liquor license: Boulder Lake Lodge. The motion carried.
The Board received protests against the renewal of the malt beverage permit for Rim Station, Inc. from Kevin Roche, Jody Roche, and Matt Meeng. George and Cheri McReynolds, owners of the Rim Station reported on property improvements, discussed zoning and proposed business practices. Chairman Linn expressed his opposition to the renewal.
County Planner Bart Myers reported that the Rim Station was zoned for a campground, service station, and store.
It was moved by Commissioner Bousman to approve the renewal with the condition that no on site drinking is allowed. The motion died, due to lack of a second.

It was moved by Commissioner Bousman and seconded by Chairman Linn to approve the renewal application for the following malt beverage permit: Hoback Village. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Linn to approve the renewal application for a limited retail liquor license to the Pinedale Golf Club, Inc. The motion carried.
Brian Gray, representing WLC, presented the bid tabulation for the Marbleton Senior Center Infrastructure Project. There were four bids. It was moved by Commissioner Bousman and seconded by Chairman Linn to award the bid to Hettinger, LLC in the amount of $864,765.00. The motion carried.
Don Van Matre, Director of Veterans Services, reported on long range planning by the Wyoming Veterans Commission. Van Matre reported on data collection and budget for the Sublette County program.
In accordance with the public notice published in the Sublette Examiner on April 30, 2009, public hearing was held for the following:
1. It was moved by Commissioner Bousman and seconded by Chairman Linn to approve the Final Plat for the East 40 Subdivision with the following conditions:
The approved Final Plat shall not be recorded until engineering comments regarding subdivision road design and construction are addressed and a cost estimate and acceptable financial surety are provided for subdivision roads.
The plat for East 40 Subdivision shall not be recorded until all deficiencies have been corrected to the satisfaction of the County Planning Department, and the Town of Pinedale has reviewed and signed the plat.
A note shall be placed on the plat requiring all new or replacement subdivision perimeter fencing to be wildlife friendly, as recommended by the Wyoming Game and Fish Department.
The motion carried.
2. It was moved by Commissioner Bousman and seconded by Chairman Linn to approve andact upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:

A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF SCHOOL DISTRICT #1 TO RECLASSIFY AND REZONE 10.38 ACRES, MORE OR LESS, FROM R-R 10 MH DISTRICT TO MFR DISTRICT BEING LOT 29, BIG COUNTRY RANCHES SUBDIVISION, THIRD FILING.
3. It was moved by Commissioner Bousman and seconded by Chairman Linn to approve andact upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:

A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION BY SUBLETTE COUNTY TO AMEND THE SUBLETTE COUNTY ZONING AND DEVELOPMENT REGULATIONS RESOLUTION.
County Planner Bart Myers reviewed several complaints and ongoing violations.
Allan Radke informed the Board of potential zoning violations in Green River Ranches Subdivision pertaining to travel trailers.
It was moved by Commissioner Bousman and seconded by Chairman Linn to recess the meeting for an Executive Session with Sheriff Bardy Bardin to discuss a personnel issue. The motion carried.

The motion carried.
Sheriff Bardin presented three asset forfeiture checks and discussed the future addition of a Resource Officer.
Larry Berlin, representing Berlin Architecture, reviewed a plan for remodeling the Old Pinedale Clinic. The Board referred him back to the agencies included in the plan and requested an estimate for the proposed remodel.
Kathy Anderson, Treatment Court Coordinator, presented a five year comparison of expenditures for human services agencies in the County.
Brad Clingman, Waste Management Superintendent, discussed the Integrated Solid Waste Management Plan, the cost of uncovered loads, and wood disposal.
The following petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Craig and Teresa Trulock, $98.74; Chevron USA, Inc., $417.19; Stephen W. Dunning, $146.43; and Robin and Denise Woffinden, $265.00.
Deputy County Attorney Tony Reyes reviewed a proposed contract from GSG Architecture. It was moved by Commissioner Bousman and seconded by Chairman Linn to approve and sign a contract with GSG Architecture in the amount of $676,096.00 for the Fairgrounds Project. The motion carried.
