NOTICE OF FINAL PAYMENT TO CONTRACTOR
Notice is hereby given that the Pinedale Airport Board, Sublette County, Wyoming, has accepted work as completed according to the plans and specifications set forth in the Agreement between the Pinedale Airport Board and Signal Hill Resources, Inc. dba Capron Construction pursuant to the Project Manual for Ralph Wenz Field Snow Removal Equipment Building, AIP No. 3-56-0021-09, State Project No. 2156, and that Signal Hill Resources, Inc. dba Capron Construction is entitled to final settlement therefore. On June 18, 2008, being the forty-first day after the first publication of this Notice, the Pinedale Airport Board will pay to Signal Hill Resources, Inc. dba Capron Construction, all amounts and balance due under said Agreement.

Magnolia - Jackson Pathway
Description of Work: Install an 8’ to 10’ wide asphalt pathway from Magnolia Street to Valley Road to Jackson Avenue in Pinedale, Wyoming. This work also includes the installation of a 100 foot prefabricated steel bridge over Pine Creek.
Bids must be in one sealed envelope with statement thereon “BID ENCLOSED Magnolia-Jackson Pathway “ and submitted to WLC Engineer, Surveying, and Planning, 58 South Tyler Street, PO Box 1519, Pinedale, Wyoming, at or before the above stated time. Notice is hereby given that preference will be granted to Wyoming contractors, subcontractors, laborers, and materials, supplies, equipment, machinery, and provisions produced, manufactured, supplied, or grown in Wyoming, as required by W.S. Section 16-6-101 et seq.

PUBLIC NOTICE
Chambers Design-Build (CDBI) the Architect and Construction Manager, Sublette County, and the Marbleton-Big Piney Joint Powers Board are seeking SUBCONTRACTORS to pre-qualify for bidding the Marbleton-Big Piney Recreation Center, 619 E First Street, Marbleton, WY. The new two story building will be 47,930sf, steel moment frame and steel stud construction: elevator, gyms, running track, climbing wall, racquet ball court, bowling alley, stage/movie screen, thin stone wainscot, and manufactured log work. Any Subcontractor may be required to post a performance bond.  Electrical, Mechanical, and Concrete Subcontractors will be required to be bonded. The Steel package is not part of this solicitation for bids. Prequalification forms are available at Chambers Design-Build Inc. office listed below.  Prequalification forms will be due in the office of CDBI by June 10, 2008 at 4:00 PM to be eligible for bidding. BEFORE THE OIL AND GAS CONSERVATION COMMISSION OF THE STATE OF WYOMING
The following matters will come before this Commission on TUESDAY, JUNE 10, 2008, at 9:00 A.M., or as soon thereafter as the matters may be heard, or between the hours of 8:00 A.M. and 5:00 P.M. on any of the subsequent days during which the Commission remains in session at the office of the State Oil and Gas Supervisor, 2211 King Boulevard, Casper, Wyoming.
Cause No. 1, Order No. 3, DOCKET NO. 156-2008, brought on the application of EOG Resources, Inc., for an order establishing an approximate 80-acre drilling and spacing unit for the Mesaverde/Transition Formation, and authorizing up to two (2) Mesaverde/Transition Formation wells in such drilling and spacing unit located in the E1/2 NW1/4 of Section 33, Township 30 North, Range 113 West, 6th P.M., Big Piney Field, Sublette County, Wyoming.
Cause No. 11, Order No. 1, DOCKET NO. 241-2008, brought on the Commission’s own motion to ask Production Consulting LLC to show cause as to why fines and penalties should not be levied for failure to submit Conservation Tax Reports on Form OG-001 for the period from July 2006 to present, as required by Chapter 3, Section 42(a) of the Commission’s Rules & Regulations; Sublette County, Wyoming.
Cause No. 2, Order No. 1, DOCKET NO. 244-2008, pursuant to the Wyoming Administrative Procedures Act, §16-3-101 et seq., and brought on the Commission’s own motion to consider amendments to Chapter 3, Section 4(c) of the Rules and Regulations of the Wyoming Oil and Gas Conservation Commission. The proposed changes are: Chapter 3, Section 4(c): Changes the amount of the bonding level and footages from three dollars ($3.00) to ten dollars ($10) per foot for idle wells and amending footages from 8,300 feet to 2,500 feet and 25,000 feet to 7,500 feet with an increase in the bonding level every three years. An Owner/Operator may request the Supervisor to set a different bonding level based on an evaluation of the specific well conditions and circumstances. The Operator shall submit a written cost estimate to provide plugging, abandonment and site remediation, prepared by a Wyoming contractor with expertise in well plugging, abandonment and site remediation.
Cause No. 12, Order No. 1, DOCKET NO. 263-2008, brought on the Commission’s own motion to consider increasing the mill levy charge from the current rate of .0003 (3/10) of a mill on the fair market cash value of all oil and gas produced, sold, or transported from the premises in Wyoming to .0006 (6/10) of a mill effective July 1, 2008.
Any interested party is entitled to appear at the aforesaid time and place to be heard by the Commission. The applications may be inspected in the office of the undersigned, 2211 King Boulevard, Casper, Wyoming, or on the Oil & Gas Conservation Commission website at http://wogcc.state.wy.us. If there are any protests, please make such known to the State Oil and Gas Supervisor at least ten (10) working days before the hearing by filing a written objection.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
MAY 6, 2008
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Jonathan Van Dyke of the Pinedale Roundup, Tiffany Turner of the Sublette Examiner, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of April 16, 2008, were approved and ordered filed on motion by Commissioner Bousman and seconded by Commissioner Linn. The motion carried.
The official bonds for Peggy Winters, Treasurer for the Mosquito Abatement District #1, in the amount of $1,000; and Robert W. Maxam, Secretary/Treasurer for the Pinedale Volunteer Fire Department, in the amount of $25,000, were approved and ordered filed with the County Treasurer.
Ed Wood, representing the Town of Pinedale, discussed the construction at the Pinedale Airport and future possible vacation of Runway Lane.
The Board discussed a road license proposed by Bob Harrower for the LaBarge Creek Road.
Butch Penton, Road and Bridge Superintendent, discussed crushing and BLM stipulations on gravel pits. Speed limits and enforcement was discussed.
Mark Eatinger, Rio Verde Engineering, reported that construction of the Industrial Site Road is still waiting for a BLM release.
Jay McGinnis protested the improvement of the Dry Piney Road. Since the road divides his property, he requested that the Board move the road to his south property line and fence it.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to adopt Resolution No. 08-10044C authorizing the Board of County Commissioners to apply for an enlargement of the right of way from the BLM for the East Green River County Road No. 23-110. The motion carried.
It was moved by Commissioner Linn to purchase the Ball property adjacent to the proposed Senior Center in Marbleton. The motion died, due to lack of the second.
Lew Gage thanked the Board and Road and Bridge for the maintenance on the Boulder Lake Road.
Supreme Court Chief Justice Barton Voight, District Judge Norman Young, District Judge Nancy Guthrie, Circuit Court Judge Curt Hawes, and Representative Monte Olsen discussed the full-time district judge position approved by the Legislature in the past session. Chief Justice Voight informed the Board that he would be certifying to the Legislature that Sublette County had the space and security available for the new position.
Kathy Raper, representing the Sublette County Conservation District, reviewed the water sampling project.
Laurie Latta and Jeffrey Jacquet, representing the Sublette Community Partners, reported that Jacquet will be leaving the County in September and discussed continuing the position.
Jonathan Forman, Deputy County Attorney, reviewed the Callaghan Cabinets, Wyoming Business Council documents.
Carmel Kail expressed her concerns about socio-economic impacts and the Board’s communication with the public.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to recess the meeting for an Executive Session with County Planner Bart Myers and Deputy County Attorney Forman to discuss potential litigation. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to reconvene the meeting. The motion carried.
Rick Johnson, Kristel Blair, and Bob McCarty, representing the Class II Road Committee, recommended inspection for Little Mountain Road. It was moved by Commissioner Linn and seconded by Commissioner Bousman to accept and authorize the inspection. The motion carried.
The Board discussed easement issues on Meadowlark Lane.
It was reported that Hoback Ranches will be applying for an easement from the Forest Service for their access road.
Joe Sampson discussed a BLM easement to be assigned to the County in the Marsh Creek area.
Angie Smith, representing the BPM Joint Powers Board, and Bonnie Chambers, representing Chambers Design-Build, presented the final plans and bidding documents for the BPM Recreation Center. The total estimated cost is $20,704,101. The Joint Powers Board requested $13,539,101 from the County. It was reported that the Towns of Big Piney and Marbleton have committed to providing the operating funds until an endowment can be established for operations, at a cost of approximately $500,000 per year. Possible funding sources were discussed, such as, grants, loans, and a Capital Facilities tax. Tony Chambers discussed phasing the construction of the project. The Board advised the group that its funding is uncertain, at this time, and that there is not enough money committed to the project to go to bid.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the maintenance agreement for the easement adjacent to the proposed Facilities Maintenance Building. The motion carried.
Andy O’Neal, Maintenance Superintendent, discussed the Courthouse boilers.
Rick Hoffman, Waste Management Superintendent, and Frank Grimes, representing Nelson Engineering, discussed water monitoring at the Pinedale Transfer Station.
The Board recessed the meeting and reconvened at 2:30 p.m. on Wednesday, May 7, 2008.
The Board approved and signed the FY08 CMAQ agreement with the Department of Transportation in the amount of $212,370.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 08-10047C appointing Stephen K. Palmer, as a special prosecutor, to undertake the further prosecution of a criminal complaint against Norman Campbell; Resolution No. 08-10048C appointing Mike D. Fuller, as a special prosecutor, to undertake the further prosecution of a criminal complaint against Eric J. Sullivan; and Resolution No. 08-10049C appointing Mike D. Fuller, as a special prosecutor, to undertake the further prosecution of a criminal complaint against Timothy Williams. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to issue catering permits to Wheel Inn Liquors for Ducks Unlimited on May 17, 2008, and Kickin Cancer on June 13, 2008, at the Sublette County Ice Arena. The motion carried.
The Board signed the Memorandum of Understanding with the State of Wyoming, Department of Aging for continuing Public Health Nurse evaluations.
The Board approved and signed the right of way extension from the BLM for the McKinley County Road No. 23-193.
The following petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: EOG Resources, $112.61; Chevron USA, Inc., $787.94; Andrew & Lynne Fech, $56.60; Louis J. & Lori A. Sweet, $1,181.39; and Michael R. & Pamela A. Olson, $84.75.
The Board approved and signed two Memorandums of Understanding with the Department of Transportation for reclaimed asphalt pavement.
It was moved by Commissioner Linn and seconded by Commissioner Cramer to award the County Commissioners scholarships, being full tuition waivers to Kendra Williams, Hannah Gunderman, Ahna McKee, Stephanie Pape, and Hailey Kogianes of Pinedale High School, and Clint Beiermann, Sierra Johnson, Jacie Rose, Allison Wenz, and Drew Guenthner of Big Piney High School. The motion carried.

Order Setting Hearing
Kip Alexander, Madeleine S. Murdock, Floyd L. Briggs, Jr., Tina M. Nelson and Kurt W. Krech, the duly elected, qualified and acting commissioners of New Fork Lake Irrigation District, having filed their report pursuant to the requirements of W.S. 41-7-402 (1977), showing the each landowner in the District should be assessed a minimum of $10.00 for the current expenses and a further assessment of $.40 per acre upon the benefited lands of the District for the purpose of raising funds for new work, maintenance and current expenses of said District, in the fiscal year beginning July 1, 2008;
IT IS ORDERED THAT the hour of 10:00 a.m. on the 27 day of May, 2008 in the courtroom of the Sublette County Courthouse at Pinedale, Wyoming, be fixed as the time and place for examination of said annual report and for the hearing of objections thereto
IT IS FURTHER ORDERED THAT notice of such hearing be published one (1) time in the Sublette Examiner.
