The Town Council of the Town of Pinedale met in regular session, Monday, March 24, 2008 at 5:30 p.m. in the Town Hall. Those present: Ron Hanson, representing the Public Works Department; Meghan Jacquet, Planning and Zoning Administrator; Eugene Ninnie, Town Engineer; Ruth Neely, Municipal Judge; Jennifer Gocke, Municipal Code Officer; Betty Hunt; Lauren McKeever, MayorÕs Assistant; Julie Early, Animal Control Officer; Scott Geiser; Les Margo; John Fogerty, Planning and Zoning Board Member; Judy Harmon; Alecia Warren, representing the Pinedale Roundup; and Tiffany Turner, representing the Sublette Examiner.
Mayor Smith brought the meeting to order. Present on Roll Call: Gary Heuck, David Hohl excused, Stephen Smith, Nylla Kunard and Chris House excused.
Sublette County SheriffÕs Office not present at scheduled time.
Julie Early, Animal Control Officer, reported the monthly activities of the animal control department.
Ron Hanson, representing the Public Works, reported the monthly activities of the public works department. Heuck questioned reducing the two year period to one year that the Application for Excavation within Streets and Alleys within the Town Limits requires holding the $2,500.00 letter of credit, security bond, cash or certified check. Hanson stated he preferred the two year requirement. After discussion motion by Kunard to allow Public Works to order sodium silicate for the water system not to exceed $25,000.00. Motion seconded. Motion carried unanimously.
Eugene Ninnie, Town Engineer, reported the monthly activities of the engineering department. After discussion motion by Kunard to sign a contract with Stantec for engineering the sewer aeration lagoon specifics regarding specifications, performance standards, drawings and details in the removal of the sludge, proper land filling it and liner installation. Motion seconded. Motion carried unanimously. Motion by Kunard to approve Worthington, Lenhart and CarpenterÕs proposal for a grant writer to proceed in obtaining the necessary State Land Investment Board funding with an estimated fee between $5,000.00 to $7,500.00. Motion seconded. Motion carried unanimously.

Public Hearing for the renewal of retail, microbrewery, limited and restaurant liquor licenses was opened for discussion. No comments received. Motion by Heuck to accept the renewals of the liquor licences as presented: StockmanÕs Bar and Lounge, Cowboy Bar, Corral Bar, Country Lane, and RidleyÕs Family Market retail liquor licenses; Patio Grill, Wrangler CafŽ, Bottoms Up Brewery and Grill, Los Cabos Mexican Restaurant, Wind River Pizzeria, Cafe on Pine, China Gourmet, restaurant liquor license; VFW Post #4801, limited retail liquor license. Motion seconded. Motion carried unanimously. Motion by Heuck to approve Bottoms Up Brewery & Grill microbrewery license contingent on verification of production through records submitted to the U.S. Alcohol and Tobacco Tax and Trade Bureau. Motion seconded. Motion carried unanimously.
Motion by Heuck to approve the Application for 24 Hour Catering Malt Beverage Permit for the Corral Bar for the Sublette County Rocky Mountain Elk Foundation on April 12, 2008, at the Sublette County Ice Arena. Motion seconded. Motion carried unanimously. Motion by Heuck to approve the Application for 24 Hour Catering Malt Beverage Permit for Bottoms Up Brewery and Grill for the Sublette County Rocky Mountain Elk Foundation on April 12, 2008, at the Sublette County Ice Arena. Motion seconded. Motion carried unanimously.
John Fogerty, Planning and Zoning Board Member, discussed his concerns with the recent ozone warnings for the county and informing the local residents about the alerts.
Les Margo, a concerned resident, discussed her concerns with the ozone concerns and health issues regarding the air quality.
Motion by Kunard to approve Ordinance 437, an Ordinance of the Town of Pinedale, Wyoming amending Section 15.04.040 of Chapter 15.04 of the Pinedale Municipal Code to establish a time frame for filing building permit applications which must be referred to the Planning and Zoning Commission of the Town of Pinedale, on the second reading. Motion seconded. Motion carried unanimously.Ê
Motion by Heuck to approve Ordinance 438, an Ordinance of the Town of Pinedale, Wyoming amending Section 17.65.070 of Chapter 17.65 of the Pinedale Municipal Code to establish a time frame for filing development plans for multi-family structures, on the second reading. Motion seconded. Motion carried unanimously.

NOTICE TO AIRPORT CONSULTANTS
The Town of Pinedale, Wyoming is soliciting Statements of Qualifications and Experience from consulting firms to provide professional aviation planning services for Ralph Wenz Field, PinedaleÕs airport, located near Pinedale. Using relevant FAA Advisory Circulars, Orders and other appropriate guidance, the consultant will perform the tasks normally associated with conducting aviation planning to meet the goals and needs of the FAA, State and Sponsor. At the airport projects may include:
Airport Master Plan Updates
Terminal Area Plan Updates
Environmental Overviews and Phase I and II Studies
Other aviation related incidental, minor planning as required by the sponsor, including meetings, presentations or other public relations

All proposals received will be evaluated based on FAA Advisory Circular 150/5100-14D (available at: http://www.faa.gov/arp/publications/acs/5100_14d.pdf), and on compliance with the request. The selection will be qualifications based.
Fees for individual projects will be negotiated as funding is obtained. Projects funded through FAA grants will be subject to the provisions of Executive Order 11246 (Affirmative Action to Ensure Equal Employment Opportunity) and to the provisions of the Department of Transportation Regulations 49 CFR Part 26 (Disadvantaged Business Enterprise Participation) and to foreign trade restrictions. DBE firms are encouraged to apply.
The Consultant must supply all information required by the Request for Statements of Qualifications and Experience. The Town reserves the right to waive any informalities and minor irregularities in the submittals and to select the Consultant deemed, in the opinion of the Town to be in the best interest of the Town and airport.
Statements of Qualifications and Experience shall be limited to a maximum of 30 pages, inclusive of all pre-printed or other promotional material. Interested consultants are to submit seven (7) complete copies of the Statements of Qualifications and Experience by 5:00 pm local time on May 15, 2008, to the above address.

NOTICE OF PUBLIC MEETING
RULES AND REGULATIONS OF THE
WYOMING OIL AND
GAS CONSERVATION COMMISSION
Pursuant to the provisions of the Wyoming Administrative Procedures Act, ¤16-3-101 et seq., notice is hereby given that the Wyoming Oil and Gas Conservation Commission staff will hold a public meeting on MONDAY, MAY 12, 2008, AT 9:00 A.M. in the Conference Room of the Office of the State Oil and Gas Supervisor, 2211 King Boulevard, Casper, Wyoming, to consider additional comments, if any, regarding amendments to Chapter 3, Section 4(c) of the Rules and Regulations of the Wyoming Oil and Gas Conservation Commission. The proposed changes are:
Chapter 3, Section 4(c): Changes the amount of the bonding level and footages from three dollars ($3.00) to ten dollars ($10) per foot for idle wells and amending footages from 8,300 feet to 2,500 feet and 25,000 feet to 7,500 feet with an increase in the bonding level every three years.
Copies of the proposed changes are available on the CommissionÕs website at http://wogcc.state.wy.us, by e-mail request to lsechr@state.wy.us, by fax at 307-234-5306, or by contacting Llysia Sechrist at 307-234-7147. Any interested firm, person, or corporation shall be entitled to appear at the time and place aforesaid and encouraged to provide comments on the proposed rules. Please submit all written statements no later than 5:00 p.m. on May 9, 2008.
Any person may urge the agency not to adopt the rules as proposed to be amended and also request the agency to state its reasons for overruling the consideration urged against adoption. Requests for an agency response must be made in writing prior to or within thirty (30) days after adoption of the rule and addressed to: Don J. These rules are not adopted, amended or repealed to comply with federal law or regulatory requirements.
The proposed rule changes meet minimum substantive state statutory requirements.

PUBLIC NOTICE
The regularly scheduled meeting of the Sublette County Board of Commissioners will be held on Monday, May 19, 2008 at 1:00 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
Request for a Variance, pursuant to Chapter VI of the Sublette County Zoning and Development Regulations, entitled Variances by Donna Steele. The application proposes a reduced setback of 7.12Õ where 50Õ is required from a highway right-of-way for a new fuel pump canopy. The parcel subject to the proposed Variance is owned by Donna Steele Trustee and is located in the SE1/4, NW1/4, NE1/4 of Sec. 16, R108W, T32N; generally described as the Boulder Store located at the intersection of Highway 191 and Highway 353.
2. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; Deanne Bradley applicant. The application proposes a change of zoning district boundary for a 7.13 acre parcel from Agricultural to Heavy Industrial in order to divide the parcel into a 2 lot industrial subdivision. The Bradley property subject to the application for a Change of Zoning District Boundary is located in Section 20, Township 30N, Range 111W; generally described as being on the east side of U.S. Highway 189, approximately 1/2 mile north of the Marbleton town boundary and immediately east of Sleepy Hollow Industrial Park Subdivision.
3. Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; Planning and Zoning Staff proposes an amendment to the text of the Sublette County Zoning and Development Regulations to reduce the setbacks standards for Gravel Pits, as contained in Chapter III, Section 38 of the Sublette County Zoning and Development Regulations.
4. Pursuant to Chapter IV Section 4 of the Sublette County Subdivision resolution; entitled Vacations/Modifications to Filed Plats, an application for a partial vacation and amended plat has been filed by Kendall Cross. The application proposes to partially vacate and amend the plat for Lots 12 and 13 Mountain View Ranches Subdivision. The three parcels subject to this application have been combined by deed; with the proposed partial vacation and amended plat establishing the two lots (Lots 12 and 13) that existed prior to the combination by deed, with the metes and bounds parcel to the north being merged into the two subdivision lots with this proposal. The application proposes reconfiguring the property line for what was Lots 12 and 13 prior to the combination of those lots and merging the 5.02 acre parcel north of Lots 12 and 13 into the two proposed lots (2.06 acres will be merged with proposed Lot 31 and 2.96 acres will be merged with proposed Lot 32). The existing lots are zoned Rural Residential 10 and the 5 acre parcel to the north to be merged is zoned Agricultural, with the reconfigured lots to become Lots 31 and 32 Ð each of which will have dual zoning. The Cross parcel(s) are located in Section 22, Township 33N, Range 111W and being located at 62 Forty Rod Road (on the south side of Forty Rod Road approximately 0.5 miles east of the intersection of Highway 189-191 and Forty Rod Road).
5. Request for Final Plat approval; pursuant to Chapter V of the Sublette County Subdivision Resolution, entitled Final Plat; for the OÕNeal Subdivision; Andrew OÕNeal applicant. The application for Preliminary Plat proposes the subdivision of 20 acres within the Rural Residential 10 (ten acre minimum lot size) zoning district into two lots. The proposed OÕNeal Subdivision is located in Section 2, Township 33N, Range 111W; generally described as 12886 US Highway 189 (Lot E Ð OÕNeal Lot Division) and being located in the Daniel area approximately 2.7 miles south of the intersection of US Highways 191 and 189.
