The Board of County Commissioners of the County of Sublette has decided to vacate part of the PARADISE COUNTY ROAD NO. 23-136 commencing at Station 71+67.7 on the south line of Section 29, T31N, R109W;
thence running northerly to Station 151+88.3 in the NE1/4SE1/4, Section 20, T31N, R109W; and
BEGINNING at Station 177+81.7 in the NW1/4NW1/4 of Section 21;
thence running northeasterly to Station 190+61.0 on the north line of said Section 21;
All objections thereto or claims for damages by reason thereof must be filed in writing with the County Clerk, before noon on the 16th day of March, 2009, or such road will be vacated without reference to such objections or claims for damages.

NOTICE OF FINAL PAYMENT TO CONTRACTOR
 Notice is hereby given that the Board of County Commissioners of Sublette County, Wyoming has accepted work as completed according to the plans, specifications and rules set forth in the contract between Sublette County and Chambers Design-Build, Inc, 167 S. Cole Ave., P.O. Box 1360, Pinedale, Wyoming, for the Sublette County Maintenance Facility in Pinedale Wyoming, and that Chambers Design-Build Inc. is entitled to final settlement therefore.  On the 6th day of April 2009, being the thirtieth day after the first publication of the Notice, Sublette County will pay the above mentioned Contractor, the full amount due under said Contract.

Notice is hereby given, pursuant to Wyoming Statute Section 15-1-113, that the Sublette County Recreation Board, will receive sealed bids until 10:00 AM., Local Time, April 2, 2009, for the following:
Ehman Lane Pathway
Description of Work: Install an 8’ wide asphalt pathway from US 191 to Murdock Lane in Sublette County, Wyoming along Ehman Lane, County Road 23-144.
Bids must be in one sealed envelope with statement thereon “BID ENCLOSED Ehman Lane Pathway” and submitted to WLC Engineer, Surveying, and Planning, 58 South Tyler Street, PO Box 1519, Pinedale, Wyoming, at or before the above stated time. Bids will be opened publicly, read aloud, and tabulated by the WLC in the Commissioner’s Room at the Sublette County Courthouse at the above stated time. No bid may be withdrawn for a period of thirty (30) days after the date set for opening thereof. The Sublette County Rec Board, reserves the right to reject any or all bids and to waive any informalities or technicalities in the bidding; provided, however, that any bid received after the time specified or without accompanying Bid Guaranty, as stated below, will not be considered.
Bidding Documents, including specifications, will be available on March 12, 2009 from the ENGINEER, WLC Engineering, Surveying, and Planning; 58 South Tyler; PO Box 1519; Pinedale, Wyoming (307) 367-6548. PUBLIC NOTICE
The Sublette County Planning & Zoning Commission will meet on Thursday, April 16, 2009 at 6:30 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
1.Request for change of zoning district boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; Sublette County School District #1, applicant. The application proposes a change of zoning district boundary for a 10.38 acre parcel from Rural Residential 10 Mobile Home (10 acre minimum lot size – mobile home allowed) to Multiple Family Residential (multiple family residences allowed) in order to develop a duplex dwelling on the parcel. The School District parcel subject to the application for a change of zoning district boundary is located in Section 32, Township 33N, Range 108W; generally described as Lot 29 Big Country Ranches Third Filing and being located at 2 Meadow Lark Lane.
2.Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; the Sublette County Planning Department proposes an amendment to the Sublette County Zoning and Development Regulations in order to allow utilities as conditional uses in all zoning districts The proposed amendment would apply on a Countywide basis.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
FEBRUARY 23, 2009
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Jonathan Van Dyke, representing the Pinedale Roundup, Tiffany Turner, representing the Sublette Examiner, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meetings of January 27 and February 3, 2009, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Bousman. The motion carried.
The official bonds were approved for Martha Seipp, Treasurer for the Sublette County Recreation Board, in the amount of $5,000; John Markle, Treasurer for the Redstone Upper Green River Road Improvement District, in the amount of $10,000; and Adrianne Peterson, Treasurer for the Sublette County Weed & Pest District, in the amount of $3,000, were approved and ordered filed with the County Treasurer.
Butch Penton, Road & Bridge Superintendent, discussed the Snow Cross Race, straightening the switchbacks on the Upper Hoback Road, and gravel.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to allow the donation of 16 hours of sick leave by County employees to Robin Woffinden. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting into Executive Session with Deputy County Attorney Jonathan Foreman and County Planner Bart Myers to discuss possible litigation. The motion carried.

It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting into Executive Session with Butch Penton, Mark Eatinger, Paul Scherbel, and Billy Pape to discuss the possible purchase of real estate. The motion carried.

It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 09-10087C setting forth the conditions for the acceptance of Broken Hills County Road No. 23-229 as a County Road. The motion carried.
The Board discussed the maintenance and plowing costs for Skyline Drive.
Ken Shriver, Dave Racich, and Andy McGinnis, representing the Rural Health Care District, requested space in the Old Pinedale Clinic for medical records, office space, and a break room. Commissioner Linn informed them that space planning is underway for the Old Pinedale Clinic for County needs. The Old Marbleton Clinic was discussed, and it was determined that its demolition be halted until the next meeting.
Steve Corsi, representing High Country Counseling, presented a program update.
In accordance with the public notice published in the Sublette Examiner on January 29, February 5, 12, & 19, 2009, public hearing was held for the application for a County Retail Malt Beverage Permit by Rim Station, Inc., dba The Rim Station, located at 12930 U.S. Highway 191. It was reported that no protests had been received, and no one, in opposition to the application, was present. The applicants were not present to represent the application. It was moved by Commissioner Bousman to approve the application. Commissioner Linn expressed his opposition to the application, as it is not a destination site, there is no support from the public, the convenience store is currently not open, and there is no population to serve, but the traveling public. Commissioner Bousman withdrew his motion. It was moved by Commissioner Bousman and seconded by Commissioner Linn to table the application to allow the applicants to represent the application. The motion failed, with the vote being: Bousman-aye, Cramer-nay, and Linn-nay. It was moved by Commissioner Linn and seconded by Chairman Cramer to deny the application. The motion failed, with the vote being: Linn-aye, Cramer-nay, and Bousman-nay. It was moved by Commissioner Bousman and seconded by Chairman Cramer to table the application until the next meeting on March 3. The motion carried, with the vote being: Cramer-aye, Bousman-aye, and Linn-nay.
Chopper Grassell, representing Callaghan Cabinets and Deputy County Attorney Jonathan Foreman, discussed the commencement date for the Wyoming Business Council grant. It was decided that the term of the project should be 18 months, with the applicable commencement date.
Tony Chambers, representing Chambers Design-Build, Brad Waters, representing Providence Architecture, and Andy O’Neal, Maintenance Superintendent, discussed the final punch list for the Facilities Maintenance Building and the Fire Marshall’s inspection.
Chambers reported that the Marbleton Airport project will have its final Fire Marshall inspection tomorrow.
Laurie Latta discussed using existing funds for the development of Community Plans for Big Piney and Marbleton. The Board approved the request.
Sheriff Bardy Bardin, and Jason Ray and Tony Chambers, representing Tip Top Search and Rescue, discussed the implementation of the 3n Paging System. Sheriff Bardin discussed the IRIS public safety system and a proposal from Teton County Search & Rescue for the purchase of a rescue helicopter.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting into Executive Session with Sheriff Bardy Bardin, County Attorney Lucky McMahon, and Deputy County Attorney Jonathan Foreman to discuss personnel. The motion carried.

Frank James, Fairgrounds Manager, presented an update on activities at the Fairgrounds.
Tim Schenk and Luis Martinez, representing GSG Architecture, reviewed the Fairgrounds Master Plan and the Phase I work. Comments were received from Frank James and Nancy Espenscheid.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to recess the meeting into Executive Session with Deputy County Attorney Jonathan Foreman and Kirk Johnson to discuss personnel. The motion carried.

Dave Finley, representing the Department of Environmental Quality, Air Quality Division, discussed Ambient Air Quality Monitoring in Sublette County.
Bob Dockter and Deb Harris, representing the Department of Environmental Quality, Solid Waste Division, discussed water quality testing at the Marbleton Landfill and the need for lining. Teton County Commission Chairman Hank Phibbs and County Engineer Jeff Hermansky participated by conference call. Appealing the DEQ requirement was discussed.
Commissioner John Linn left the meeting.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to approve Change Order #2 for Trihydro Corporation, in the amount of $68,516.41 and extend the completion date to January 31, 2010, for environmental monitoring, sampling, and testing at the five Sublette County landfill sites. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to affirm the appointments of Randy Bolgiano from December 2003 through December 2006, and reappointment from December 2006 through December 2009, and of John Andrikopoulos from December 2007 through December 2010 to the Upper Green River Water Basin Joint Powers Board.
The motion carried.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
MARCH 3, 2009
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Tiffany Turner of the Sublette Examiner, Jonathan Van Dyke of the Pinedale Roundup, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
Billy Pape, Assistant Road & Bridge Superintendent, reported on plowing, thawing culverts and moving the crusher to the Harrower Pit. It was moved by Commissioner Bousman and seconded by Commissioner Linn to accept a quote for a liner for the evaporation pond at the County Shop with revisions. The motion carried.
Mark Eatinger, representing Rio Verde Engineering, presented and recommended Option #2 for the BLM for the East Green River Road dug way, and reported on meeting with the Forest Service on Skyline Drive.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to adopt a resolution recommending to the U.S. Board on Geographic Names, the name Aiken Butte for a geographic site in southern Sublette County. The motion carried.
Aaron Seehafer, representing Rio Verde Engineering, discussed culvert installation on Class II projects. It was decided that if the culverts were on site at the time of construction, their installation would be included in the project.
The Board continued the discussion of the County Malt Beverage Permit application by Rim Station, Inc. tabled at the February 23, 2009 meeting. Owners George and Cheri McReynolds were present to represent the application. The McReynolds responded to questions from the Board and informed the Board that they are developing a travel park and plan to reopen the convenience store. It was moved by Commissioner Bousman and seconded by Chairman Cramer to issue the permit. The motion carried, with the vote being: Cramer-aye, Bousman-aye, and Linn-nay.
Jackie Cushing, State Public Health Nurse, introduced Dereth Gehlhausen as the new manager for Public Health Nursing. Cushing reported that the State is advertising for a staff nurse position to fill the position vacated by Gehlhausen. The Board discussed the request for the donation of a County vehicle and informed Cushing that a vehicle could be donated to the State, but would not be supported by the County, or the County would continue to reimburse mileage for the use of personal vehicles.
Sealed bids were opened for the loading and hauling of solid waste at the Pinedale Transfer Station. Three bids were received. The bids were referred to Rick Hoffman for review and recommendation. Upon review and recommendation, it was moved by Commissioner Linn and seconded by Commissioner Bousman to award the bid to M & M Transfer for the amount of $2.75 per loaded mile and $43.79 per hour for labor. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to appoint Tracy Pape to the Recreation Board for a term ending December 31, 2013. The motion carried.
Commissioner Linn discussed the need for a person to inform Senior Citizens about programs available to them. The Board took no action.
Chopper Grassell, representing Callaghan Cabinets and Millworks, Inc., updated the Board on the Wyoming Business Council grant. Grassell informed the Board that one Request for Qualifications for a Construction Manager at Risk had been received.
Anna Shafer was honored for receiving the Prudential Spirit Award. Shafer has performed 500 hours of community service to receive the award.
Erin Losik discussed the use of the Southwest Sublette Pioneers building as a daycare, once it is vacated. The Board was supportive of its use as a daycare.
Cat Urbigkit discussed advertising the Commissioners blog. No action was taken, at this time.
The Board directed Urbigkit to solicit comments from the County agencies and departments for the completion of the Public Lands Use Policy.
TJ Hunt, County Fire Warden, presented the draft 2009 Wildland Fire Management Operating Plan for review.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to recess the meeting into Executive Session to discuss personnel and litigation. The motion carried.

Ken Shriver, Dave Racich, and Cindy Van, representing the Rural Health Care District, discussed the new legislation allowing the District to tax up to 4 mills, with the approval of the voters. County Clerk Mary Lankford reviewed the legislation and election timetable. Jason Zakotnik, representing WLC, discussed the demolition of the Old Marbleton Clinic and its possible use for District administrative offices. The Board decided to wait until the end of March to decide on the demolition.
Robin Clover, SAFV Director, discussed the completion of the Safe House, change orders, and the commercial sprinkler system. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve Change Orders 2 through 5 in the amount of $3,586.00. The motion carried. The Board agreed to discuss the sprinkler system cost, at the completion of the project.
The following abatement petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Direct TV, $3,417.93; Direct TV, $1,914.75; Direct TV, $552.91; Direct TV, $998.17; Two River Designs, $85.02; Jaime Burgess, $357.71; Golden Eagle Towing & Salvage, $27.12; Golden Eagle Towing & Salvage, $25.64; Anthony B. & Bonnie Chambers, $200.14; Questar Exploration & Production Company, $3.33; and Questar Exploration & Production Company, $6,765.75.
The meeting was recessed and reconvened at 10:00 a.m. on Wednesday, March 4, 2009, for a conference call with the Teton County Commissioners and staff to discuss the DEQ landfill lining requirement. It was decided to not appeal the decision, at this time, and gather more information from DEQ and other landfill sites in the State.
The Board interviewed three firms for a construction monitoring position for the County. After the interviews, it was moved by Commissioner Linn and seconded by Commissioner Bousman to hire Groathouse Construction. The motion carried.
