Sealed bids will be received by the Transportation Commission of Wyoming until 11:00 a.m. MST, March 3, 2009, at the office of the Purchasing agent at the Wyoming Department of Transportation in Cheyenne, Wyoming for the construction of Wyoming Department of Transportation Ð Pinedale Patrol & Driver Services Addition, 1551 West Pine Street, Pinedale, Wyoming.
Immediately thereafter the Bids will be publicly opened and read.
Any bids received after 11:00 a.m. MST, on the prescribed date will be returned to the Bidder(s) unopened.
Bids will be considered by the Transportation Commission of Wyoming at its meeting on March 19, 2009.
Contractors are alerted to the fact that there will be a MANDATORY PRE-BID CONFERENCE. A pre-bid conference will be held on February 24, 2009 at 10:00 a.m. MST for all Contractors and Subcontractors at 1551 W. Pine Street, Pinedale, Wyoming. The Pre-Bid Conference is MANDATORY for all prospective bidders (general contractors) and is voluntary for all others. Individual job showings will not be provided.
The work consists of furnishing all labor, materials, services and equipment required for the fabrication, delivery and erection of all items of work in the following general project description: For the construction of an addition to the existing building to house the Highway Patrol and Driver Services which will include but not limited to excavation, earthwork, parking lots, landscaping, concrete, masonry, structural steel, steel studs, finishes, specialties, plumbing, HVAC and electrical systems.

Contract Documents may be obtained at the above listed office, by depositing a check in the amount of $100.00 each for a maximum of two sets of documents issued to general contractors and one set to all subcontractors and material suppliers. If such documents are returned to the Architect in good condition within 10 days after the bid opening date, the deposit will be refunded. The planholder shall also include with his deposit one stamped self addressed envelope. The envelope will be used to return the planholders deposit check upon receipt of the Contract Documents by the Architect. Deposits for damaged or unreturned sets of Contract Documents will not be refunded. No individual sheets of drawings or specifications will be made available to bidders. Full sets of documents are necessary to help eliminate errors of omission in bidding.
GENERAL CONTRACTOR QUALIFICATIONS TO RECEIVE A BIDDER'S PACKET:
1. All prospective bidders shall obtain prequalification as a building contractor with the Wyoming Department of Transportation for this specific project. Prospective bidders shall contact the Prequalification Officer, Construction Program, Wyoming Department of Transportation, 5300 Bishop Blvd., Cheyenne, WY 82009, (307)777-4057 for prequalification procedures. All required documentation must be submitted to WYDOT's Prequalification Officer no sooner than 30 calendar days and no less than 5 calendar days before the bid letting.
a. All prospective bidders shall submit proof that they can be bonded for the type and amount of work they are proposing to bid.
b. All prospective bidders shall submit satisfactory evidence of compliance with the Wyoming Worker's Compensation Act (W.S. 27-14-101, et seq.) by providing a current certification of good standing or proof of a worker's compensation insurance policy.
c. All prospective bidders shall comply with all additional requirements (if any).
2. All prospective bidders must have attended the MANDATORY PRE-BID CONFERENCE to be eligible for bidding this project.
The Architect will provide a bidding packet consisting of the WYDOT Bid Envelope, Blank Bid Proposal Form and Blank Bid Bond Form to any prospective bidder only after all the above qualification items have been completed.

The Town Council of the Town of Pinedale met in regular session Monday, January 26, 2009, at 5:30 p.m., in the Town Hall. Those present: Pat Bozner, representing the Corral Bar; Steve Mackey; Paul Rock; Dawn Ballou, representing Pinedale Online; Brian Gray and Jeff Hosea, representing Worthington, Lenhart and Carpenter; Mark Eatinger, representing Rio Verde Engineering; James Thomas; Brian Ketterhagen and Mike Peterson, representing the Sublette County Sheriff's Office; Ron Hanson, representing the Public Works Department; Ed Wood, Town Attorney; Jim Parker, Airport Manager; John Fogerty, representing the Pinedale Planning and Zoning Board; Eugene Ninnie, Town Engineer; Jennifer Gocke, Municipal Code Officer; Ruth Neely, Municipal Judge; Julie Early, Animal Control Officer; Stephan Crane, representing the Pinedale Roundup; and Tiffany Turner, representing the Sublette Examiner.
Mayor Smith brought the meeting to order. Present on roll call: Councilman David Smith, Councilwoman Nylla Kunard, Mayor Stephen Smith, Councilman David Hohl and Councilman Chris House.
Motion by Councilwoman Kunard to approve the minutes of the January 12th meeting as written. Motion seconded. Motion carried unanimously.
Brian Ketterhagen, representing the Sublette County Sheriff's Office, reported the monthly activities of the sheriff's office.
Jennifer Gocke, Municipal Code Officer, reported her monthly activities. Council discussed the complaints regarding Ridley's Family Market.
Ruth Neely, Municipal Judge, reported the monthly activities of the municipal court.
Julie Early, Animal Control Officer, reported the monthly activities of the animal control department.
Ron Hanson, representing the Public Works Department, reported the monthly activities of the public works department. Motion by Councilman Smith to approve the purchase approximately $24,000.00 for sodium silicate and approximately $16,000.00 for magnesium hydroxide. Motion seconded. Motion carried unanimously.
Jim Parker, Airport Manager, presented the December Treasurer's Report, the draft minutes of the January 21st airport board meeting and reported the monthly activities of the airport.
Mary Hogarty, Mayor's Assistant, excused.
Eugene Ninnie, Town Engineer, reported the monthly activities of the engineering department. Pat Bozner, representing the Corral Bar, requested March 15th, St. Patrick's Day, July 12th, Rendevous Weekend, October 31st, Halloween and December 31st, New Year's Eve, as the four days each calendar year that licensees may operate their dispensing rooms for a period of twenty-four hours. Motion by Councilman Smith to approve as presented. Motion seconded. Motion carried unanimously.
The Public Hearing for the Pinedale Campground Annexation was opened for discussion. No comments were received. Mayor Smith stated this was the last county in-holding. Motion by Councilman Hohl to approve Resolution 2009-01, finding compliance with WYO. STAT. 15-1-402 in the matter of the Annexation Petition of Kay Pfisterer Buston for the Pinedale Campground Annexation. Motion seconded. Motion carried unanimously. Motion by Councilman Hohl to approve Ordinance 443, an ordinance annexing adjacent and contiguous land (Pinedale Campground Annexation) to the Town of Pinedale, Wyoming and establishing zoning therefor, on the first reading. Motion seconded. Motion carried unanimously.
Steve Mackey, a concerned citizen, discussed the present ordinances regarding town zoning. Mackey questioned proposed Ordinance 442 as amendment to the present zoning ordinances. Ed Wood, Town Attorney, stated in his option it was an addition not amendment.
Paul Rock, concerned citizen, discussed his concerns with the town not getting a county building permit for the shop/dog pound facility prior to beginning of the construction. The Council admitted to the oversight and that the town was acting in good faith.
Motion by Councilwoman Kunard to approve Ordinance 444, an ordinance of the Town of Pinedale, Wyoming amending Section 213.04.030 relating to payment schedules for water and sewer service, on the first reading. Motion seconded. Motion carried unanimously.
Motion by Councilwoman Kunard to approve Ordinance 445, an ordinance of the Town of Pinedale, Wyoming amending Section 13.04.025 relating to where billings for water and sewer service shall be directed, on the first reading. Motion seconded. Motion carried unanimously.
Motion by Councilman Smith to go into executive session to discuss personnel and property acquisition. Motion seconded. Motion carried unanimously.
Motion by Councilwoman Kunard to return to regular session. Motion seconded. Motion carried unanimously.
Council discussed the Community Impact Joint Powers Board funding.
After discussion motion by Councilman House to accept the Trails Creek Infrastructure and release WYBAL'S Bond. Motion seconded. Councilwoman Kunard voted aye, Councilman Hohl voted aye, Councilman House voted aye and Councilman Smith voted nay. Motion carried.

AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING AMENDING SECTION 13.04.030 RELATING TO PAYMENT SCHEDULES FOR WATER AND SEWER SERVICE.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT SECTION 13.04.030 IS HEREBY AMENDED TO READ AS FOLLOWS:
13.04.030 Payment schedule; service fees. Except as provided otherwise, the owner of the property or premises shall reimburse the Town in advance for any and all water and sewer services on a quarterly basis commencing on the first days of January, April, July, and October of each year. Fee(s) for water and sewer service or special services shall be established and prescribed by ordinance. Those fees may be adjusted from time to time as the council determines.
This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

ORDINANCE NO. 2009-445
AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING AMENDING SECTION 13.04.025 RELATING TO WHERE BILLINGS FOR WATER AND SEWER SERVICE SHALL BE DIRECTED.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT SECTION 13.04.025 IS HEREBY AMENDED TO READ AS FOLLOWS:
13.04.025 Responsibility for payment. The Town provides water and sewer services to properties and premises within the Town's service area. Responsibility for payment of connection fees, service fees, and special assessments applicable to the provision of those services shall rest, in each instance, with the owner of the property or premises to which said service is provided. All such connection fees, service fees, and special assessments shall be billed to the property or premises owner. Where billing is sent to someone other than the owner, the fact that such owner shall not have been directly advised of amounts owed shall not relieve said owner of the responsibility to pay such amounts when due.
This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

WHEREAS, all the owners of the real estate described herein, have signed and filed with the Town a petition requesting annexation and zoning of said real estate; and
WHEREAS, after notice and hearing as required by law, the Town Council has, by resolution duly adopted on 1/26/09 found and certified that the conditions required by W.S. Sections 15-1-402 and 15-1-403 exist, and that annexation of the real estate is authorized by law;
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE:
SECTION 1. The following described real estate located in Sublette County,Wyoming, is hereby added to, taken into, annexed to and made a part of the Town ofPinedale, Wyoming, to-wit:
A Parcel located in and being a portions of Lot 3, Section 4, T.33N., R.109W., Sixth Principal Meridian, Sublette County, Wyoming and being more particularly described by metes and bounds as follows:
Beginning at the southeasterly corner of the Pinedale Campground Parcel, and from which point the CN1/16 corner of Section 4 bears N.89¡32'15ÓE., 30.40 feet; thence from said point of beginning and along the current northerly line of Washington Street, and the southerly line of said Lot 3 and the Parcel being described, S.89¡32'15ÓW., 432.55 feet to the southwesterly corner of said Parcel; thence along the westerly line of said Parcel, and the easterly line of the Redstone Sixth Addition, N.0¡30'16ÓE., 482.41 feet to the northwesterly corner of said Parcel and the southwesterly corner of Rocky Mountain Power; thence easterly along the southerly line of Rocky Mountain Power and northerly line of said Parcel, S.89¡48'36ÓE., 434.19 feet to the northeasterly corner of said Parcel, and southeasterly corner of Rocky Mountain Power; thence southerly along the westerly line of Jackson Avenue (70') to the southeasterly corner of said Parcel, S.0¡42'25ÓW., 477.50' to the Point of Beginning, and containing 4.774 acres, more or less.
SECTION 2. Upon the effective date of this ordinance, the corporate limits and boundary lines of the Town of Pinedale, Wyoming, shall be extended to include and embrace the property described in Section 1.
SECTION 3. The annexed property is hereby zoned C-1.
SECTION 4. The zoning map is hereby amended to reflect the zoning classification of the annexed property.
This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.
