TAKE NOTICE that Homey Siems and Angela Siems have filed a Complaint in the District Court in and for Sublette county, Wyoming, Ninth Judicial district, to quiet title to real property located in Sublette County, Wyoming and more particularly described as follows:
Township 35 North, Range 113 West of the 6th P.M., Sublette County, Wyoming
Section 11: S/2 SE/4; and

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JANUARY 6, 2009
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with County Clerk Mary Lankford officiating at the swearing-in of John Linn, County Commissioner.
After the swearing-in, the meeting convened with Bill Cramer, John Linn, and Joel Bousman, Tiffany Turner of the Sublette Examiner, Jonathan Van Dyke of Pinedale Roundup, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The Board conducted Election of Officers for the upcoming two-year term. It was moved by Commissioner Bousman and seconded by Commissioner Linn to re-elect Commissioner Cramer, chairman. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to re-elect Commissioner Linn, vice-chairman. The motion carried.
The minutes of the preceding regular meeting of December 16, 2008, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Bousman. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to adopt W.S. 8-4-101 establishing the holidays for 2009. The following holidays were adopted: Monday, January 19, Martin Luther King, Jr. Birthday and Wyoming Equality Day; Monday, February 16, PresidentÕs Day; Monday, May 25, Memorial Day; Friday, July 3, Independence Day; Monday, September 7, Labor Day; Wednesday, November 11, VeteranÕs Day; Thursday and Friday, November 26 & 27, Thanksgiving; Friday, December 25, Christmas; and Friday, January 1, 2010, New YearÕs. The motion carried.
Butch Penton, Road and Bridge Superintendent, reported on plowing, snow catchers, and shop maintenance. Penton discussed the Middle Piney Road and Fremont Lake Road.
Paul Scherbel discussed Pinedale Airport County Road No. 23-226.
Mark Eatinger, representing Rio Verde Engineering, reported on the East Green River Road.
Transportation planning in the County was discussed.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to waive the interest, due to the late assessment on parcels 01-08-08254 and 09-08-08247, and extend the deadline for the payment of the first half of taxes to January 31st for Mountain Gas Resources, Inc. The motion carried.
The official bonds were approved for Mark E. Pape, Treasurer for School District #1, in the amount of $5,000; and Cat Urbigkit, Secretary/Treasurer for the Predatory Board, in the amount of $1,000 were approved and ordered filed with the County Treasurer.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to designate Wells Fargo Bank, NA, as a depository of County funds. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to appoint the following Board members:
Fair Board: Margie Braun, 5-year term
Nancy Espenscheid, 5-year term
Recreation Board: Dave Bell, 5-year term
Certified Local Government: Laurie Hartwig, 3-year term
Predator Management District: Cash Rich, 3-year term
Class II Road Committee: Brad Mariner, 3-year term
The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve and authorize the chairman to sign the Cooperative Law Enforcement Agreement with the Bridger-Teton National Forest, in the amount of $12,833.00. The motion carried.
The Board reviewed the two petitions received for appointment to the Weed & Pest District Board, it was noted that there were three vacancies, and discussed mosquito abatement in the County. The County Clerk was directed to invite the Board members to the February 3rd meeting. It was moved by Commissioner Linn and seconded by Commissioner Bousman to re-appoint Judi Adler and Monte Skinner, for 45 days, to the Weed & Pest District Board of Directors. The motion carried.
The following abatement petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Devon Energy Production Company, $6,991.17; EOG Resources, Inc., $23,188.94; Petrogulf Corporation, $0.12; Petrogulf Corporation, $340.76; Petrogulf Corporation, $56.60; Chevron USA, Inc., $67.93; Chevron USA, Inc., $5,709.63; Gabriel G. Casley, $25.27; Cowboy Court, $14.70; Cory & Janae Gale, $27.95; Ralph E. West, $174.85; and BP American Production Company, $5,930.02.
Annie Sondgeroth and Jackie Cushing, representing Public Health Nursing, reported on the posting of SondgerothÕs job, due to her upcoming retirement, and the anticipated increase in hours for that position. Sondgeroth presented a proposed vehicle agreement, which was referred to the County Attorney for review.
Undersheriff Mike Peterson discussed snow plowing in Bargerville for County employees to report to work, and the snow storm over the Christmas weekend. The Board advised Peterson that it is the employeesÕ responsibility to report for work, and that the County will only consider extra plowing in emergency situations. It was determined that the Christmas storm was not an emergency, and that Search and Rescue was available for any emergency. Wil Gay expressed his concern about ambulance access. Tim Wells, President of the High Meadow Homeowners Association, reported that no plowing was performed on Christmas Day.
Frank Grimes, representing Nelson Engineering, Rick Hoffman, and Kirk Johnson, Waste Management Superintendent, presented an annual report on various landfill issues. Johnson discussed oil separation.
Rick Johnson, Kristel Blair, and Bob McCarty, representing the Class II Road Committee, and Aaron Seehafer, representing Rio Verde Engineering, presented four items for consideration. It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve Wind River Peaks Drive, Leigh Drive, and Tanner Drive, for feasibility study; and Buck Road for designation as a Class II Road. The motion carried. The winter maintenance on Meadowlark Lane was discussed and snow plowing was approved by the Board.
Larry Berlin, representing Berlin Architects, discussed the remodeling of the old Pinedale Clinic. It was moved by Commissioner Linn and seconded by Commissioner Bousman to enter into a contract, not to exceed $15,000 for space needs analysis of the facility. The motion carried.
Representative-elect Jim Roscoe and Senator-elect Dan Dockstader discussed proposed legislation. Issues discussed were ad valorem tax on helium, mineral counties coalition, property tax relief, County-funded homestead exemption, roads, and wolves.
Gregory Kennett, Rosemary Moore, and Dianne Burke, representing ERG, reviewed their work on Phase II of socio-economic impacts and discussed mitigation.
It was moved by Commissioner Linn and seconded by Chairman Cramer to adopt Resolution 09-10081C appointing Eric Phillips, of the Lincoln County AttorneyÕs Office to undertake the further representation of the Sublette County SheriffÕs Office in the administrative hearing in the Hayes Randol personnel matter. The motion carried.
It was moved by Commissioner Linn and seconded by Chairman Cramer to adopt Resolution 09-10082C appointing Mike D. Fuller, as a Special Prosecutor, to undertake the further prosecution of a criminal complaint against Esther Judge. The motion carried.
