OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
APRIL 1, 2008
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 11:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Tiffany Turner of the Sublette Examiner, Jonathan Van Dyke of the Pinedale Roundup, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of March 18, 2008, were approved and ordered filed on motion by Commissioner Bousman and seconded by Commissioner Linn. The motion carried.
Butch Penton, Road and Bridge Superintendent, discussed the East Fork-Big Sandy Road and possible improvements to accommodate heavy truck traffic. The Board discussed possible gravel pit properties and Penton reported on shoulder work, crushing and road openings.
Mark Eatinger, representing Rio Verde Engineering, discussed the easements and platting for Meadowlark Lane and the Industrial Site Project.
Vern McAdams and Dennis Seipp, representing School District #1, discussed the construction of the Tyler Street Skateboard Park and requested funding for the paving of the interior parking spaces. The Board agreed to plow the snow in the area, but advised that it would not fund the restroom request that has been presented to the Recreation Board. Janet Bellis discussed the proposed park and its location. Chairman Cramer advised Bellis to attend the upcoming School Board Meeting.
Phillip Smith, Mayor of Big Piney, expressed his support for the extension of the Reardon Draw Road.
Phillip Smith, representing Leftovers, Inc., requested that the Board consider amending the Marbleton Landfill DEQ permit to allow LaBarge garbage at the Landfill.
In accordance with the public notice published in the Sublette Examiner on March 6, 13, 20, and 27, 2008, public hearing was held for the transfer of the Retail Liquor License formerly held by The Place, Inc. to B.J. Hill dba Green River Guest Ranch. There being no objections, it was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the transfer. The motion carried.
The Board approved and signed the Cooperative Agreement for Responsibilities Between the Wyoming Department of Family Services, Child Support Enforcement Unit and the Sublette County Clerk of District Court.
The Board rescheduled the second May meeting from Tuesday, May 20 to Monday, May 19 for the Western Interstate Regional Meetings in St. George, Utah.
The Board signed the Revival Agreement for the CDBG grant for an extension of the SAFV grant.
In accordance with W.S. 22-7-101, it was moved by Commissioner Linn and seconded by Commissioner Bousman to retain the election districts and precincts established on April 2, 2002, for the 2008 election year. The motion carried.

In accordance with the public notice published in the Sublette Examiner on March 13, 2008, public hearing was held for the following:
It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the Preliminary Plat for Alpine Hills Subdivision, Highline LLC, applicant; being Tract 1, Glacier Ridge Large Tract Development, with the following conditions:
A note is placed on the Final Plat regarding small waste water systems and water systems, as recommended by the Wyoming Department of Environmental Quality. The motion carried.
Fencing of individual lots shall not be allowed, as recommended b the Wyoming Game and Fish Department.
Covenants, conditions and restrictions applicable to Alpine Hills Subdivision shall be established prior to submittal of an application for Final Plat and shall contain provisions for an owners association and maintenance of subdivision roads. Language shall be placed in the covenants, conditions and restrictions stating that provisions related to the maintenance of subdivision roads shall not be amended without prior Board of County Commissioner approval.
The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 08-10040C
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND
ZONING COMMISSION AND APPROVING THE APPLICATION BY SUBLETTE COUNTY TO AFFIRM A DETERMINATION BY PLANNING STAFF TO ISSUE BUILDING PERMITS TO PARCELS THROUGHOUT THE COUNTY WHICH ARE LEGALLY NON-CONFORMING WITH RESPECT TO MINIMUM LOT SIZES ESTABLISHED BYTHE SUBLETTE COUNTY ZONING AND DEVELOPMENT REGULATIONS RESOLUTION.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the Final Plat for Blackburn Subdivision, Allen and Robyn Blackburn, applicants, located in Section 30, T33N, R108W, with the following conditions:
Prior to recording of the approved Final Plat, a turn lane design and cost estimate shall be submitted to the Wyoming Department of Transportation for review. Upon review and approval by the Department of Transportation, the applicant shall include 150% of the cost of the turn lane construction in the financial surety provided to the County for subdivision improvement.
The approved Final Plat shall not be recorded until a cost estimate and acceptable financial surety are provided for subdivision improvements (subdivision road, power and telephone), as required by County regulations.
The motion carried, with the vote being: Bousman-aye, Linn-aye, and Cramer-nay.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the Final Plat for Hidden Hills Subdivision, Melvin Bagley, General Partner of the CR#2 Family Limited Partnership, applicant, being Tract 2, Glacier Ridge Large Tract Development , with the following condition:
The approved Final Plat shall not be recorded until a cost estimate and acceptable financial surety are provided for subdivision improvements (subdivision road, power and telephone), as required by County regulations.
The motion carried.
Cat Urbigkit discussed the Draft Public Land Policy. Urbigkit reported that comments had not been received from Connie Brooks and Dave Allison, as requested by Commissioner Linn. The Board scheduled a workshop of Wednesday, May 7, 2008, at 9 a.m. in the Commissioners Meeting Room to review the Draft.
Miles Hopkins, resident of Shelter Park, discussed the lack of members for the Shelter Park Service and Improvement District Board. The Board referred Hopkins to the County Attorney.
The following petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: High Country Counseling, $943.20 and Carpet Solutions, $36.70.
Frank James, Fairgrounds Manager, discussed improvements at the Fairgrounds.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to recess the meeting for an Executive Session with Butch Penton to discuss property.

After reviewing the County's practice concerning sick leave for National Guard employees who are deployed for active duty, it was moved by Commissioner Linn and seconded by Commissioner Bousman to reinstate sick leave that was accrued prior to deployment to these employees upon their return and reemployment with the County. The motion carried.
