NOTICE OF FINAL SETTLEMENT WITH AND PAYMENT TO CONTRACTOR
Notice is hereby given that Sublette County Recreation Board (Owner) has accepted the Magnolia-Jackson Pathway project as completed according to the plans and specifications and rules set forth in the contract between Owner and Teletractors, Inc. (Contractor), and that Contractor is entitled to final settlement therefore. On or after the 27th day of December, 2008, being the 41st day after the first publication of this notice, Owner will pay to Contractor the full amount due under the contract.

OFFICIAL COUNTY COMMISSIONERS
PROCEEDINGS
NOVEMBER 18, 2008
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with John Linn, Joel Bousman, Jonathan Van Dyke of the Pinedale Roundup, and Mary Lankford, County Clerk present. Chairman Bill Cramer was absent. Acting Chairman John Linn assumed the chair.
Chairman Linn led those present in the Pledge of Allegiance.
Chairman Linn began the meeting with a moment of silence in memory of former County Commissioner and State Legislator Louie Tomassi, and his family, who passed away on November 16, 2008. It was moved by Commissioner Bousman and seconded by Chairman Linn to fly the flag on the Courthouse at half mast on November 19, 2008, in honor of Louie Tomassi. The motion carried.
The minutes of the preceding regular meeting of November 7, 2008, were approved and ordered filed on motion by Commissioner Bousman and seconded by Chairman Linn. The motion carried.
Butch Penton, Road & Bridge Superintendent, reported on the completion of the Industrial Site Road, with striping to be completed in the spring.
Paul Scherbel reported on the Dry Piney Road. Chairman Linn discussed compiling an inventory of Forest Service Roads.
It was moved by Commissioner Bousman and seconded by Chairman Linn to authorize the Department of Transportation to award the bids for the turn lane at the Bloomfield Development and the bike path.
The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Linn to adopt Resolution No. 08-10075C authorizing the application for CMAQ funds for dust suppression. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Linn to renew the BLM right of way for County Road No. 23-144. The motion carried.
The following abatement petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Eric Juel, $25,152 (assessed value), Shell Rocky Mountain Production, $59,157 (assessed value), Shell Rocky Mountain Production, $439, 995 (assessed value), Scott Murdock, $1,805 (assessed value), and Reneau Construction, $3,169 (assessed value).
The Board travelled to McDowell Ditch to meet Chauncey Goodrich, representing Trout Unlimited, with Mark Noble, and Tom Noble, and two representatives of the Forest Service to discuss fish habitat in the ditch. The Board agreed to allow the development of fish habitat in the ditch. Goodrich will provide the necessary documents.
In accordance with the public notice published in the Sublette Examiner on September 18, 2008, public hearing was held for the following:
It was moved by Commissioner Bousman and seconded by Chairman Linn to approve the Preliminary plat for the Calpet Road Industrial Subdivision, John and Penny Chrisman, applicants, with the following conditions:
The application for Final Plat shall include Covenants, Conditions and Restrictions for the subdivision establishing a Lot Owners Association to provide for the maintenance of subdivision roads; with language contained in the Covenants, Conditions and Restrictions that provisions related to the maintenance of subdivision roads shall not be amended without County Commissioner approval.
Prior to the Planning Department issuing building permit(s), the owner of any lot within Calpet Road Industrial Subdivision proposing a use which utilizes water for human consumption shall be required to drill a well, with a licensed engineer testing water from the well to assure the water is safe for human consumption. For water not safe for human consumption, a treatment system shall be designed by a licensed engineer prior to issuance of the building permit.
A weed management plan shall be in place prior to approval of the Final Plat and commencement of land disturbing activities.
Note(s) recommended by the Department of Environmental Quality shall be placed on the approved plat.

Rick Johnson, Kristel Blair, and Bob McCarty representing the Class II Road Committee, presented inspection requests for Wind River Peaks Drive, Leigh Drive and Tanner Lane. It was moved by Commissioner Bousman and seconded by Chairman Linn to approve the inspection requests. The motion carried. The installation of culverts was discussed, and it was decided that if the culvert was on site, it would be installed by the contractor.
Aaron Seehafer, representing Rio Verde Engineering, reported on Meadowlark Lane.
Garry Eiden discussed activities at the Pinedale Transfer Station and the upcoming contract renewal.
The Board participated in a conference call with Dave Finley, of the Department of Environmental Quality, to discuss the Air Toxic Study contract. Dr. Tom Johnston and Perry Walker participated in the discussion. Phasing the proposed project was recommended. It was moved by Commissioner Bousman and seconded by Chairman Linn to authorize the Chairman to sign the contract, to be amended to allow phasing of the project, once it is received by email from DEQ. The motion carried.

PUBLIC NOTICE
The Sublette County Planning & Zoning Commission will meet on Thursday, January 15, 2009 at 6:30 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
Request for change of zoning district boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration and conditional use approval pursuant to Chapter V of the Sublette County Zoning and Development Regulations, entitled Conditional Uses; E2 Environmental LLC, applicant. The application proposes a change of zoning district boundary for a 40 acre parcel from Agricultural to Light Industrial in order to develop an oil and gas production waste facility on the parcel as a Conditional Use. The proposed E2 Environmental parcel subject to the application(s) seeking change of zoning district boundary and conditional use approval is located in Section 6, Township 28N, Range 107W; generally described as being 2.8 miles west of US Highway 191 and 2.2 miles south of Luman Road.
Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; the Sublette County Fire Board proposes amending the Sublette County Subdivision Resolution in order to add a Fire Protection Resolution to the subdivision requirements. The proposed amendment requires a minimum water source, for fire protection purposes for all new subdivisions proposing the development of 3 or more lots. The proposed amendment would apply on a Countywide basis.
