PUBLIC NOTICE
Koch Construction, Inc. has filed a mining permit expansion application with the Land Quality Division of the Wyoming Department of Environmental Quality. Approval of this application will allow the current ten-acre disturbance to expand to 40 acres. This mining operation is located in T34N, R111W Sections 21 and 28, north of Highway 354; near the town of Daniel in Sublette County, Wyoming. The application may be viewed at the Cheyenne or Lander Office of the DEQ Land Quality Division. The application will be re-advertised for public comment prior to approval by the Department of Environmental Quality.

NOTICE OF FINAL PAYMENT
Pursuant to W.S. ¤ 16-6-116, notice is hereby given that Pinedale Airport Board has accepted the work on the Runway Extension Project, as substantially completed according to the plans and specifications and rules set forth in the Contract and that HK Contractors, Inc. is entitled to final settlement therefore. Upon the 41st day, after the first publication of this notice, (December 23, 2008), that Pinedale Airport Board, under whose direction of supervision the work has been carried out will pay to HK Contractors, Inc. the full amount due under the Contract. All persons, firms, or corporations who have any claims for work done or materials furnished on said public work are hereby notified that final payment will be made to HK Contractors, Inc. in accordance with the terms of the Contract on December 24, 2008. This section does not relieve HK Contractors, Inc. and the sureties on his bond from any claims of work or labor done or materials or supplies furnished in the execution of the Contract.

NOTICE OF PUBLIC MEETING
Notice is hereby given that the Town of Pinedale, of Pinedale Wyoming will hold a public meeting as required by the Town of Pinedale Zoning Ordinance on Monday December 1, 2008 at 5:30pm or thereabouts at Town of Pinedale Town Hall 210 W. Pine St. Pinedale, Wyoming on the subject action of a proposed rezone of Tax Grid Number 02-00-04015 a.k.a. Property Partners, LLC located at 639 S. Pine St, Pinedale Wyoming 82941, from R-2A to C-1 as shown on drawings prepared by WLC Engineering, PO Box 1519, 58 S. Tyler St., Pinedale WY 82941.
The purpose of this public meeting is to allow Public Input into the proposed action on the part of the local citizens and any other interested parties, governmental agencies or groups. All persons interested in the proposed action are invited to appear and express their view.
Maps, drawings, and other pertinent data will be available upon request for public inspection by contacting the Town of Pinedale Town Hall. Notice is hereby given that Sublette County Ð Recreation Board (Owner) has accepted the Magnolia-Jackson Pathway project as completed according to the plans and specifications and rules set forth in the contract between Owner and Teletractors, Inc. (Contractor), and that Contractor is entitled to final settlement therefore. On or after the 27th day of December, 2008, being the 41st day after the first publication of this notice, Owner will pay to Contractor the full amount due under the contract.

The Town Council of the Town of Pinedale met in regular session Monday, October 27, 2008, at 5:30 p.m., in the town hall. Those present: Tim Crawford, representing Sublette County Sexual Assault and Family Violence Task Force Board of Directors; Jim Parker, Airport Manager; Alicia Scheevel, representing Wells Fargo; Brian Gray and Jason Zakotnik, representing Worthington, Lenhart and Carpenter; Mike Grove, representing Rocky Mountain Home Center; Mark Eatinger, Aaron Seehafer and Michael Jackson representing Rio Verde Engineering; Bob Jones; Jessie Whiteley, representing Reiman

Mayor Smith brought the meeting to order. Present on roll call: Councilman David Smith, Councilwoman Nylla Kunard, Mayor Stephen Smith, Councilman David Hohl and Councilman Chris House. Motion by Kunard to approve the minutes of the October 13th meeting as presented. Motion seconded. Councilman House voted aye, Councilwoman Kunard voted aye, Mayor Smith aye, Councilman Hohl abstained and Councilman Smith abstained. Motion carried.
Mike Peterson, representing the Sublette County Sheriff's Office, reported the activities of the sheriff's office.
Jennifer Gocke, Municipal Code Officer, reported her month activities.
Julie Early, Animal Control Officer, excused.
Randy Hubbard, representing the Public Works Department, reported the monthly activities of the public works department. After lengthy discussion motion by Councilman Smith to suspend the date for determining frozen ground conditions and allow the discretion of the public works department to allow digging. Motion seconded. Motion carried unanimously. After discussion motion by Councilman Smith to approve the purchases of a computer and IFIX software upgrade for the SCADA system not to exceed $5,500.00. Motion seconded. Motion carried unanimously.
Eugene Ninnie, Town Engineer, reported the monthly activities of the engineering department. John Fixter, representing Fixter Construction, requested a change in the original variance request for the library's parking of 220 parking spaces to 198 with the addition of 37 spaces in the skate board park for library parking. After discussion motion by Councilman Smith to grant a change in the library parking from 220 parking spaces to 198 with the addition of 37 spaces inside the skate board park. Motion seconded. Councilman Smith voted aye, Councilwoman Kunard voted aye, Councilman House voted aye and Councilman Hohl abstained. Motion carried.
Jim Parker, Airport Manager, presented the draft minutes of the October Airport Board Meeting and the September Treasurer's Report. After discussion motion by Councilman Smith to approve the Hangar Lot Ground Lease Agreement for Lot 30 between the Pinedale Airport Board and Biffle Investments. Motion seconded. Motion carried unanimously.
Ruth Neely, Municipal Judge, excused.
Mary Hogarty, Mayor's Assistant, excused.
Brian Gray, representing Worthington, Lenhart and Carpenter, presented Pinedale Campground's property proposal to the Town of Pinedale for the expansion of Washington Street. After discussion motion by Councilman Smith to accept the property proposal in the amount of $129,590.00 with the condition of moving forward with the annexation of the property. Motion seconded. Motion carried unanimously.
Tony Kervitsky, representing Wolf's Dodge, discussed concerns with parking at 153 South Entertainment Lane. Council discussed the ordinances requiring off street parking and no parking longer than 48 hours at any time on any street or alley within the town. No action taken.
Tim Crawford, representing the Sublette County Sexual Assault and Family Violence Task Force Board of Directors, discussed the water connection and service for the new office space and single family residence to be operated as a Òsafe facility.Ó After lengthy discussion Council agreed the water and sewer connection fees for the new facility had been waived.
Alicia Scheevel, representing the Wells Fargo Bank, requested permission to close North Fremont Avenue from Pine Street to Magnolia Street on November 5th for their grand opening. Motion by Councilman Hohl to allow Wells Fargo to close North Fremont Avenue from Pine Street to Magnolia Street contingent on High Mountain Real Estate not being opposed to the closure. Motion seconded. Motion carried unanimously.
Tony Kervitsky, a concerned citizen, discussed his concerns with the construction on the west side of town the South Main Sewer Project.
Bob Jones, a concerned citizen, discussed his concerns with the west side construction the South Main Sewer Project.
Eugene Ninnie, Town Engineer, stated he would look at the concerns.
Motion by Councilman Smith to approve Ordinance 441, an ordinance vacating that portion of Half Moon Avenue between Hennick Street and Skyline Street, on the third reading. Motion seconded. Motion carried unanimously.
Motion by Councilman House to approve Resolution 2008-16, a resolution approving and authorizing the execution of an Energy Performance Contract between McKinstry Essention, Inc. And the Town of Pinedale regarding in part the construction on a new municipal garage facility. Motion seconded. Councilman Hohl voted aye, Councilman House voted aye, Councilwoman Kunard voted aye, Mayor Smith voted aye and Councilman Smith voted nay. Motion carried.

Notice is hereby given that on the tenth day of December, 2008, final settlement will be made with R.S. Bennett Construction Company by the Big Piney-Marbleton Airport Board for A.I.P. No. 3-56-0002-08, WY.D.O.T. No. BPI-03X and WY.D.O.T. No. BPI-04X, and that any person, co-partnership, association or corporation who has an unpaid claim against said R.S. Bennett Construction Company for or on account of the furnishing of labor, materials, team hire, sustenance, provision, provender or other supplies used or consumed by such Contractor or any of the Subcontractors in or about the performance of said work, may at any time up to the close of business on December 5, 2008 file a verified statement of the amount due and unpaid on account of such claim with the Big Piney-Marbleton Airport Board.
