NOTICE OF SUBSTANTIAL COMPLETION OF CONTRACT
To all persons, firms, or corporations who have any claim for any work done, or any material furnished to, Groathouse Construction, 1349 Sheridan Avenue, Suite 200 Cody, Wyoming 82414 for LaBarge Elementary School.
You are hereby notified that Sublette County School District Number Nine, Big Piney, Wyoming, has accepted substantial completion according to the Contract Documents and rules set forth in the contract between Sublette County School District Number Nine and the aforesaid Contractor of the work in connection with the LaBarge Elementary School, and that said Contractor is entitled to final settlement thereof.
You are further notified that upon the Tenth day of December, 2008, being the 41st day after the first publication of the notice, said Sublette County School District Number Nine will pay Groathouse Construction the full amount due under said contract, and in the event your claim is not filed with Sublette County School District Number Nine prior to said Tenth day of December, 2008, same shall be waived.
This notice is given pursuant to Section 16-6116, Wyoming Statutes, 1982.

The Town Council of the Town of Pinedale met in regular session Monday, October 13, 2008, at 5:30 p.m., in the town hall. Those present: Mark Eatinger, Dennis Fornstrom and Mike Jackson, representing Rio Verde Engineering; Shawn Gustafson and Brian Gray, representing Worthington, Lenhart and Carpenter; Mary Ann Menster, representing Split Diamond Development; Scott Grove, representing Rocky Mountain Home Center; Barbara Boyce; John Fogerty, representing the Planning and Zoning Board; James Bowles; Gaston Gosar, Attorney at Law; Ed Wood, Town Attorney; Mary Hogarty, MayorŐs Assistant; Eugene Ninnie, Town Engineer; Stephen Crane, representing the Pinedale Roundup; and Tiffany Turner, representing the Sublette Examiner.
Mayor Smith brought the meeting to order. Present on roll call: Councilman Smith excused, Councilwoman Kunard, Mayor Smith, Councilman House and Councilman Hohl excused.
Motion by Councilman House to approve the minutes of the September 8th and 22nd meetings as written. Motion seconded. Motion carried unanimously.
Brian Gray, representing Worthington, Lenhart and Carpenter, presented WYBALŐs expenditures for Trails Creek SubdivisionŐs park costs of $62,289.00. After discussion motion by Councilwoman Kunard to approve the cost share of the park costs in the amount of $31,145.00. Motion seconded. Motion carried unanimously.
Jorg Petty not present.
Dennis Fornstrom, representing Rio Verde Engineering, presented Split Diamond SubdivisionŐs request for approval of the infrastructure. Eugene Ninnie, Town Engineer, stated the only issue outstanding is the final coat of chip seal and Split Diamond Development, Inc. had filed an irrevocable letter of credit with the town for the second coat of chip seal and he recommended the acceptance of the infrastructure. Motion by Councilman House to accept the infrastructure of Split Diamond Subdivision. Motion seconded. Motion carried unanimously.
Dennis Fornstrom, representing Rio Verde Engineering, presented Roy and Dorothy Ann RadakovichŐs, Trustees of the Radakovich Family Trust Agreement, request for plat approval of Amended Plat of the Redstone Fourth Addition to the Town of Pinedale, Wyoming vacating Lot 18, Block 1 and creating Lot 19, Block 1. Motion by House to accept the final plat of the Amended Plat of the Redstone Fourth Addition to the Town of Pinedale, Wyoming vacating Lot 18, Block 1 and creating Lot 19, Block 1. Motion seconded. Motion carried unanimously.
Dennis Fornstrom, representing Rio Verde Engineering, presented James E. BowlesŐs building permit application for the construction of a two story mixed-use building. Eugene Ninnie, Town Engineer, reported all concerns had been addressed and he recommended the approval of the request. Motion by Councilman House to approve the request for Lot 13, Block 14 Hennick First Amended for James Bowles and CompanyŐs proposed mixed use building.
Scott Grove, representing Rocky Mountain Home Center, discussed his concerns with the cost of water and sewer connection fees for the proposed furniture store at 1552 Highway 191. After lengthy discussion Council agreed the rates need to be looked at and agreed to take it under advisement and Mr. Grove could continue with his infrastructure. Motion by Councilman House to approve the commercial building permit for Thornton and Donna Grove at Lot 1 Block 5 Grove Addition for the proposed furniture store. Motion seconded.
Motion carried unanimously.
Barbara Boyce, a concerned citizen living on South Shanley, discussed her concerns with the sewer and water project and the width of Shanley Street.
Brian Gray, representing Worthington, Lenhart and Carpenter, discussed the Park Lot Annexation and a Town Park Master Plan for the South Tyler area of the park. Council stated it was looking at moving forward.
Motion by Councilwoman Kunard to approve Resolution 2008-13, a resolution approving the Amended Plat Vacating Lot 18, Block 1 of the Redstone Fourth Addition and Creating Lot 19, Block 1 and authorizing the execution thereof and approving the execution of a Deed conveying said Lot 19, Block 1 to Roy Radakovich and Dorothy Ann Radakovich Trustees of the Radakovich Family Trust Agreement, Dated 12/1/85. Motion seconded. Motion carried unanimously.
Motion by Councilman House to approve Ordinance 441, an ordinance vacating that portion of Half Moon Avenue between Hennick Street and Skyline Street, on the second reading. Motion seconded. Motion carried unanimously.
Motion by Councilwoman Kunard to approve the Law Enforcement Services Contract between the Town of Pinedale and the Sublette County SheriffŐs Office. Motion seconded. Motion carried unanimously.
Motion by Councilwoman Kunard to accept and sign the Acceptance Certificate of the Lee Ditch Bridge Replace as completed in accordance with plans and specifications of the Wyoming Department of Transportation. Motion seconded. Motion carried unanimously,
Motion by Councilman House to sign the Contract to Order to allow Alvin Mitchell to order apparatus and equipment from Rosenbauer Firefighting Technology. Motion seconded. Motion carried unanimously.
Council agreed to allow the Senior Class to hold itŐs requested fundraiser haunted woods in the Boyd Skinner Park on Halloween.
