A public hearing will be held on 10 November 2008 at 7:00 p.m. at the Town Hall of the Town of Marbleton in accordance with Wyoming Statutes, 2007, as amended, Section 15-1-405 (a) for the proposed Sage Annexation to the Town of Marbleton. This notice includes a copy of the ÒProposed Annexation ReportÓ required by Section 15-1-402(c) as follows:

In accordance with said Statue, the following may be reported:
A map of the area proposed to be annexed is attached.
The total estimated cost of infrastructure improvements required of all landowners by the annexing municipality related to the Annexation.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
OCTOBER 7, 2008
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Jonathan Van Dyke of the Pinedale Roundup, Tiffany Turner of the Sublette Examiner, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of September 23, 2008, were approved and ordered filed on motion by Commissioner Bousman and seconded by Commissioner Linn. The motion carried.
The official bonds for Deborah Morley, Treasurer for Mosquito Abatement District #2, in the amount of $25,000; and Dave Racich, Treasurer for the Sublette County Rural Health Care District, in the amount of $5,000; were approved and ordered filed with the County Treasurer.
Butch Penton, Road and Bridge Superintendent, and Paul Scherbel discussed the abandonment of a portion of the Paradise County Road owned by Bob Sims and partners. Sims assured the Board that he would give a new easement to the County. Scherbel informed the Board that he had been pursuing this easement for seven years. The Board advised Sims that once the replacement easement is received, it will advertise for the abandonment.
Penton reported on road maintenance.
Ed Wood presented the proposed license from Bob Harrower for the LaBarge Creek Road. It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the license and authorize the Chairman to sign the license. The motion carried. Scherbel was directed to prepare the resolution to adopt the additional section of road.
Scherbel reported that he had met with Jay McGinnis about the Dry Piney Road.
Brad Waters, representing Providence Architecture, Inc., presented the needs assessment prepared for Law Enforcement, Detention, Fire, District Court, and Circuit Court. Estimated cost of the total project is approximately $60 million. The Board took no action on the assessment.
Joe Ahlstrom and Nikki Cowley, representing Wyoming Community Youth Services, discussed the establishment of a youth group home in the County. Ahlstrom informed the Board that a non-profit has been formed, and that a temporary location will be approved in Marbleton. Ahlstrom requested $400,000 from the Board for the purchase of a 4,000 square foot incomplete house on 45 acres, for a permanent location. The Board referred them to Kathy Anderson to review the proposal.
Bonnie Chambers and Tony Chambers, representing Chambers Design-Build, Inc., and Joan Mitchell, Director of the Southwest Sublette Pioneers, reviewed the bids for the construction of a new Senior Center in Marbleton. It was moved by Commissioner Linn and seconded by Commissioner Bousman to accept and award the bids in the amount of $7.3 million. The motion carried.
Chopper Grassell and Kelly Nielson, representing CallaghanÕs Cabinets, discussed advertising for the Request for Qualifications for Construction Management and General Contractor Professional Services.
Sheriff Bardy Bardin discussed the Court Facility Survey, the cost of a Sublette County Law Enforcement Officer, and remodeling the Marbleton Annex.
Mary Hogarty, the Pinedale MayorÕs Assistant, was introduced to the Board.

RESOLUTION NO. 08-10071C
A RESOLUTION REJECTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION TO DENY THE APPLICATION BY LIONEL LIEBERMAN TO RECLASSIFY AND REZONE 40 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R 20 DISTRICT LOCATED IN SECTIONS 2 & 3, T33N, R111W.
2. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:

A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION BY KENNETH SMITH TO RECLASSIFY AND REZONE 3.9 ACRES, MORE OR LESS, FROM RM DISTRICT TO GC DISTRICT LOCATED IN SECTION 26, T34N, R111W.
3. It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 08-10073C
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION BY GAMBLING MOUNTAIN LLC TO RECLASSIFY AND REZONE 3.47 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R DISTRICT LOCATED IN SECTIONS 28 & 29, T34N, R109W.
4. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the Packsaddle Minor Subdivision, Carney Ranch Company, applicant, zoned R-R, and located in Section 26, T37N, R110W. The motion carried.
5. It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the Preliminary Plat application by C.R. #2 Family Limited Partnership for Calico Trails Subdivision, zoned R-R 10, and located in Section 33, T35N, R110W, with the following conditions:
a. The application for final plat shall include Covenants, Conditions and Restrictions for the subdivision establishing a HomeownerÕs Association to provide for the maintenance of subdivision roads; with language contained in the Covenants, Conditions and Restrictions that provisions related to the maintenance of subdivision roads shall not be amended without County Commissioner approval. In addition, the Covenants, Conditions and Restrictions shall include language to prevent the overgrazing of lots.
b. It shall be noted on the plat that compliance with the zoning and development standards for Rural Residential 10 parcels shall apply to lots within Calico Trails Subdivision.
c. It shall be noted on the plat that any dogs within the Subdivision must at all times be under the control of their owner and/or remain upon their respective lots.
The motion carried.
6. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the Preliminary Plat application by Big Loop LLC for Antelope Ridge Estates Subdivision, zoned R-R and R-R 5, and located in Sections 20, 21, and 29, T34N, R109W, with the following conditions:
a. The application for final plat shall include Covenants, Conditions and Restrictions for the subdivision establishing a HomeownerÕs Association to provide for the maintenance of subdivision roads; with language contained in the Covenants, Conditions and Restrictions that provisions related to the maintenance of subdivision roads shall not be amended without County Commissioner approval.
b. It shall be noted on the plat that development on slopes in excess of 15% is prohibited and requirements contained in the County Zoning and Development Regulations shall apply to development on lots with slopes in excess of 8%.
c. All new or replacement fencing shall be wildlife friendly and in compliance with Wyoming Game and Fish Department standards.
The motion carried.
7. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the variance request by Schlumberger for 3 silos in excess of 60 feet and a conveyor system not to exceed 99 feet, where the I-L District restricts structure heights to a maximum of 35 feet, located on Lots 3 & 4, Sand Draw Industrial Park. The motion carried.
8. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the Preliminary Plat application by PDM Land Company, LLC for East 40 Subdivision, zoned R-R, and located in Section 2, T33N, R110W, with the following conditions:
a. A note shall be placed on the plat stating that Sublette County will not allow small non-discharging waste stabilization ponds on any of the lots proposed. The only septic system(s) to be permitted shall be enhanced systems, which shall be designed by a Wyoming licensed engineer and permitted by the Department of Environmental Quality or County Sanitarian. Each small enhanced wastewater treatment system must continually achieve the minimum treatment standards required by Chapter 23, Section 7 as contained in the non-adverse recommendation from the Department of Environmental Quality.
b. A note is placed on the plat requiring all new or replacement fencing to be wildlife friendly, as recommended by the Wyoming Game and Fish Department.
c. A note shall be placed on the plat stating that utility easements of 10 feet in width are along all front, side and rear lot lines.
d. A note on the plat stating ÒNo road slopes to exceed 15%Ó shall be changed to state ÒNo road slopes to exceed 8%Ó.
e. A dry fire hydrant shall be shown on the application for final plat and if not installed prior to recording of the final plat the hydrant shall be included in the cost estimate and financial surety provided for subdivision improvements.
f. A note shall be placed on the plat stating County Zoning and Development Regulations shall apply to development on lots with slopes in excess of 8%.
The motion carried.
9. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve an application for a partial vacation and plat amendment for Lots 19 and 20, Emigration Ranches, Phase I Subdivision, by Thomas and Margaret Hawley, to reconfigure the existing lot lines between Lot 19 and 20 from a north/south configuration to an east/west configuration, with the acreages of the two lots remaining the same. The motion carried.
Chauncey Goodrich, representing Trout Unlimited, requested ditch owner approval for the McDowell Ditch to allow fish passage. The Board directed Goodrich to provide the appropriate approval document for the Board to consider.
Betty Fear and Lynda Vickrey, representing the Fairgrounds Master Plan Committee, participated in a conference call with Tim Shank to discuss the need for a construction manager for the Fairgrounds project. It was moved by Commissioner Bousman and seconded by Commissioner Linn to contract Shank to direct the process. The motion carried.
Tim Hill, representing Petroleum Geo Services, inquired if the Board would consider approving a permit to conduct a geophysical survey on Rendezvous Meadows Golf Course. The Board requested a permit to review.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for an Executive Session with Janet Montgomery, Jay Fear, and James Thomas to discuss the possible purchase of real estate. The motion carried.

Representative Dan Dockstader discussed the upcoming Legislative Session and requested quarterly meetings with the Board.

NOTICE OF SUBSTANTIAL COMPLETION OF CONTRACT
To all persons, firms, or corporations who have any claim for any work done, or any material furnished to, Groathouse Construction, 1349 Sheridan Avenue, Suite 200 Cody, Wyoming 82414 for LaBarge Elementary School.
You are hereby notified that Sublette County School District Number Nine, Big Piney, Wyoming, has accepted substantial completion according to the Contract Documents and rules set forth in the contract between Sublette County School District Number Nine and the aforesaid Contractor of the work in connection with the LaBarge Elementary School, and that said Contractor is entitled to final settlement thereof.
You are further notified that upon the Tenth day of December, 2008, being the 41st day after the first publication of the notice, said Sublette County School District Number Nine will pay Groathouse Construction the full amount due under said contract, and in the event your claim is not filed with Sublette County School District Number Nine prior to said Tenth day of December, 2008, same shall be waived.
This notice is given pursuant to Section 16-6116, Wyoming Statutes, 1982.
