NOTICE OF FORECLOSURE SALE
Default has occurred on that secured Promissory Note No. 119968 dated May 21, 2007. That Note is secured by that certain Mortgage dated January 4, 2008 ('January 4, 2008 Mortgage') given by Craig W. Lederer and Deborah Lederer, husband and wife, to the Bank of Jackson Hole, fsb, which was recorded in the Sublette County ClerkÕs office on January 8, 2008, in Book 158 mtg Page 3. That Note is also secured by that certain Mortgage dated May 21, 2007 ('May 21, 2007 Mortgage') given by Craig W. Lederer and Deborah Lederer, husband and wife, to the Bank of Jackson Hole, fsb, which was recorded in the Sublette County ClerkÕs office on May 31, 2007, in Book 149 mtg Page 1. The January 4, 2008 Mortgage and the May 21, 2007 Mortgage are collectively referred to as the 'Mortgages.' Each of the Mortgages contains a power of sale.
The Mortgages were given to secure the original principal sum of $712,500.00 which was modified on January 4, 2008 to $782,400.00. Nonpayment and other default exists, acceleration of the debt secured by the Mortgages has been declared, and the entire remaining balance of the debt is now due and payable. No lawsuit has been filed to collect the debt or any portion thereof.
Take notice that the Note and Mortgages will be foreclosed and the property encumbered by the Mortgage will be sold by the Sheriff of Sublette County to the highest bidder for cash at public auction. The sale will be held on the front steps of the Sublette County Courthouse, 21 South Tyler, Pinedale, Wyoming at 10:00 a.m. on Thursday, October 30, 2008. The amount due and owing is $791,809.12 unpaid principal, and $20,753.10 in accrued and unpaid interest, late fees and, and other fees and charges, for a total of $812,562.22, plus attorneysÕ fees, costs and expenses of the foreclosure. Interest accrues at $131.97 per diem.
The property encumbered by the January 4, 2008 Mortgage will be offered for sale and is described as follows:
73 Lazy 'L' Lane, said property being located in the northwest quarter of the southwest quarter (NW1/4SW1/4) and the southwest quarter of the northwest quarter (SW1/4NW1/4), Section 5, Township 34 North, Range 109 West of the Sixth Principal Meridian, Sublette County, Wyoming.
The property encumbered by the May 21, 2007 Mortgage will be offered for sale and is described as follows:
11 Old Brazzill Trail, said property being located at Lot Thirteen (13) of the Old Brazzill Ranch Subdivision, Second Filing, Sublette County, Wyoming as the same appears on the official map or plat thereof as filed for record in the office of the County Clerk and Ex-Officio Register for Deeds for Sublette County, Wyoming.
Notice of Intention to Foreclose the Mortgages was sent in accordance with ¤34-4-103(a)(iv) on September 9, 2008.
The properties being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.

NOTICE OF CHANGE OF HEARING SCHEDULE
The November 2008 hearings of the Wyoming Oil & Gas Conservation Commission have been rescheduled to Wednesday, November 12, 2008, and/or on any of the subsequent days during which the Commission remains in session.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
SEPTEMBER 23, 2008
The Board of County Commissioners met in the Commissioners Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Jonathan Van Dyke of the Pinedale Roundup, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of September 9, 2008, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Bousman. The motion carried.
Butch Penton, Road & Bridge Superintendent, reported gravel sources, the Industrial Road construction project, and paving.
The Board approved a request from Darrell Snyder, Area Maintenance Foreman for WYDOT, to stockpile snow on the CountyÕs property located south of the Sewer Lagoon.
The Board reviewed a letter from Karen Budd-Falen, representing Dan H. Budd and Sons, Inc., about maintenance on South Piney Fish Creek CR 23-142. The Board directed Deputy County Attorney Jonathan Foreman to prepare a response.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for an Executive Session with Butch Penton and Paul Scherbel to discuss real estate. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to reconvene the meeting. The motion carried.
The Board discussed Runway Lane. Scherbel reported the monuments need to be set and a plat presented to establish the County road.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to adopt Resolution No. 08-10070C declaring Monte Vista County Road No. 23-500 as a Class II County Road. The motion carried.
Jonathan Van Dyke, representing the Pinedale Roundup, inquired about a transportation plan for the Ehman Lane area.
Sealed bids were opened for the purchase of pickups and SUVÕs for the SheriffÕs Department. Bids were received from three dealers. The Board referred the bids to Sheriff Bardy Bardin to review and make recommendations.
The Board approved a request for donations of sick leave, for Cheryl Spall, limited to 16 hours per employee.
Kathy Anderson, Treatment Court Coordinator, discussed social service programs in the County. The Board directed Anderson to prepare a letter to contact the social service agencies, currently funded by the County, and request information to assist the Board with funding decisions.
Anderson reported that the Treatment Court had recently undergone a review by the Department of Health, and that a report will be forthcoming.
The Board signed a lease agreement with Pape Ranches, Inc. for the location of a radio tower on Aspen Ridge in the amount of $12,000 per year, for one year.
The Board participated in a conference call with Todd Bishop of Kaiser and Company to discuss the Special Purpose Excise Tax election.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to provide a letter to the BPM Joint Powers Board, stating that the BPM Rec. Center will be the first project, if the Special Purpose Excise Tax passes. The motion carried.
The Board discussed the need for a needs assessment for the old Pinedale Clinic.
Steve Corsi, new High Country Counseling Director, introduced himself to the Board.
Rick Hoffman, Waste Management Superintendent, presented a proposal to move the fence at the Pinedale Transfer Station. The Board approved the proposal. Hoffman reported on the installation of the scales at the Pinedale Transfer Station. Drilling a well and building a scale house was discussed.
Kristel Blair and Bob McCarty, representing the Class II Road Committee, and Aaron Seehafer, representing Rio Verde Engineering, presented the following:
Bid for Meadowlark Lane. Four bids were received for this project. It was moved by Commissioner Linn and seconded by Commissioner Bousman to award the bid of $454,680.00 to R.S. Bennett Construction. The motion carried.
Lone Pine easement. The Board discussed the BLM easement that was issued to Redstone Corporation, its assignment, and that it is not a permanent easement. Joe Sampson discussed his maintenance of a public road and the liability. Commissioner Bousman will discuss the issue with the BLM.
James Helm, representing the Sublette County Chamber of Commerce, and Greg Ptasnik and Mary Thompson, representing the Joint Powers Lodging Tax Board, discussed the funding of the Visitors Center. Deputy County Attorney John Foremen reported on attempting to mediate the funding issues between the two agencies for the operation of the Visitors Center, but that the issues still remain unsolved.
Various operational issues and use of the lodging tax money were discussed. Chairman Cramer directed the parties to reach a solution to the funding shortfall.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for an Executive Session with Jo Crandall and Rex Poulson to discuss real estate. The motion carried.

Mayor Smith brought the meeting to order. Present on roll call: Councilman David Smith, Councilwoman Kunard, Mayor Stephen Smith, Councilman Hohl and Councilman House.
Motion by Councilman Smith to approve the minutes of the August 25th meeting as written. Motion seconded.
Mayor Smith presented Ordinance 440, an ordinance of the Town of Pinedale, Wyoming creating Chapter 5.02 of the Pinedale Municipal Code relating to the requirement of business licenses, Smith asked the Council to consider the termination of the ordinance. After discussion motion by Councilman Smith to abandoned Ordinance 440, relating to the requirement of business licenses, on the second reading. Motion seconded. Motion carried unanimously.
Janet Montgomery, representing the Museum of the Mountain Man, discussed the vacation of Halfmoon Street from Hennick StreetÕs south right of way line to the north right of way line of Pinedale East Road. After discussion Council agreed to have Ed Wood, Town Attorney, draw up an ordinance for vacating Halfmoon Street as presented.
Marquessa Brown, Morgan Holz and Mariah McKay, representing the Senior Class 2008-2009 Halloween Fundraiser, requested permission to hold a haunted woods theme fundraiser in the Boyd Skinner Park for Halloween. After discussion Council was agreeable with the idea and recommended the organizers speak with the SheriffÕs Department, Fire Department and the School District and return to the town council meeting later in the month.
Jim Engstrom and Michael Kudar, representing Pinedale Centerpoint, LLC and Brian Gray, representing Worthington, Lenhart and Carpenter, discussed a commercial building permit for Block 1, Triangle Addition, a possible single two-story unit in place of the previous request for log cabins. Council discussed concerns with the drainage and liability if flooding or property damage took place due to the town not fixing the streets. After lengthy discussion motion by Hohl to approve the building permit contingent upon a cost sharing contract for a 50-50 split of the drainage and streets improvements not to exceed $200,000.00. Motion seconded. Councilman Hohl voted aye, Councilwoman Kunard voted aye, Mayor Smith voted aye, Councilman House voted aye and Councilman Smith voted nay. Motion carried.
Scott Grove, representing Rocky Mountain Home Center, discussed a commercial building permit application to rebuild at 1552 Highway 191. Eugene Ninnie, Town Engineer, stated he had given Mr. Grove a checklists informing them what was required for the building permit application. Ninnie stated he was still waiting for a site plan. After discussion Mayor Smith stated the town would work with the Groves in expediting the building permit but the site plan is needed. Mr. Grove agreed to get a site plan to the Town Engineer as soon as possible.
Robena Downie, representing the Sublette County Prevention Coalition, requested permission to insert a Wyoming Quit Tobacco Program information bookmark in the next quarterly sewer and water billing being mailed October 1, 2008. Council was agreeable.
Motion by Councilman Hohl to approve Resolution 2008-10, a resolution amending the Annual Budget for the fiscal year ending June 30, 2009. Motion seconded. Motion carried unanimously.
Motion by Councilman Smith to approve Resolution 2008-11, a resolution authorizing submission of a Federal Mineral Royalty Capital Construction Account Grant Application to the State Loan and Investment Board on behalf of the Governing Body for the Town of Pinedale. Motion seconded. Motion carried unanimously.
Motion by Councilwoman Kunard to appoint Miriam Carlson to the Planning and Zoning Board. Motion seconded. Motion carried unanimously.
After lengthy motion by Councilman Smith to waive the noise ordinance for two weeks and allow 24 hour operation of the construction on Pine Street and request the contractors be as respectful as possible. Motion seconded. Motion carried unanimously.

INVITATION TO BID
Date: September 25, 2008
Sealed Bids from qualified contractors will be received by the Town of Pinedale (hereinafter referred to as Owner), at 210 West Pine Street, Pinedale, Wyoming 82941 until 2:00 P.M., our clock, on October 24, 2008 for the Pinedale Water Supply SCADA System Project.
At said place and time, and promptly thereafter, all Bids that have been duly received will be publicly opened and read aloud.
The Contract generally provides for the construction of a Supervisory Control and Data Acquisition System (SCADA) for the Town of Pinedale Water Supply System. The SCADA System mainly includes installation of hardware and software components with configuration and programming of SCADA System controls, and data exchange systems at the Chlorination Facility located at Fremont Lake, the East Side Chemical Feed System Facility located on Fremont Lake Road, the West Side Chemical Feed System Facility located on Willow Lake Road and the Wastewater Treatment Facility located on County Road 23/123.
All Bids must be in accordance with the Contract Documents on file with the owner. Questions by Bidders should be addressed to the Engineer for resolution as early as possible. Contract documents can be viewed at the following plan rooms:

Substantial Completion of the Work is required as specified in the Agreement.
The successful Bidder will be required to furnish a Performance Bond and a Payment Bond guaranteeing faithful performance and the payment of all bills and obligations arising from the performance of the Contract.
No Bid may be withdrawn within a period of forty-five (45) days after the date fixed for opening Bids.
The OWNER reserves the right to reject any and all bids, and to waive any informalities and irregularities therein.
Bid security in the amount of not less than 5% of the total bids must accompany each Bid in the form specified in the Instructions to Bidders.
Pursuant to W.S. 16-6-106, 'preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state.'
