JUNE 30, 2008
The Board of County Commissioners met in special session for budget preparation on this date at 1 p.m. with Bill Cramer, John Linn, Joel Bousman, and Mary Lankford, County Clerk present.
The Board reviewed the Road & Bridge, Waste Management, Transfer Station, and Maintenance budgets.
The Board discussed possible Reserve accounts.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for a conference call in Executive Session with David Evans, of Hickey and Evans, to discuss a personnel matter. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to reconvene the meeting.
There being no further business, the meeting was adjourned at 5:00 p.m.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JULY 1, 2008
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Jonathan Van Dyke of the Pinedale Roundup, Janet Montgomery of the Sublette Examiner, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meetings of June 9, 10, 11, 12, and 17, 2008, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Bousman. The motion carried.
Butch Penton, Road & Bridge Superintendent, discussed the paving and gravel pit stipulations. It was moved by Commissioner Bousman and seconded by Commissioner Linn to adopt Resolution No. 07-996C to alter New Fork Bridge County Road No. 23-175. The motion carried.
Dave Hohl commented on the Big Sandy area roads.
Commissioner Linn discussed County Road No. 23-179 to Johnny Wardell's property and the Swain bridge.
Mark Eatinger reported on the wetlands mitigation for Mickelson Lane and the Industrial Site Road.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 08-10056C to vacate a portion of Mathis Lane County Road No. 23-126. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting into Executive Session with Mark Eatinger, Paul Scherbel, Steve Smith, TJ Hunt, John Ball, Dave Hohl, Hays Randol, Undersheriff Jim Whinnery, and Butch Penton to discuss the possible purchase of property. The motion carried. The group left the meeting to tour possible sites.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to reconvene the meeting.
Chopper Grassell and Shawn Choate, representing Callaghan Cabinets, discussed architects, land, and construction.
Jon Boroff, representing the Wyoming Stock Growers Association, discussed potential litigation which would directly affect Sublette County ranching. The Board agreed to support the WSGA up to $20,000.

In accordance with the public notice published in the Sublette Examiner on June 12, 2008, a public hearing was held for the following:
It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the conditional use permit for a gravel pit by Green River Rock, on a 10 acre parcel owned by Michael Schaffer, zoned A-1, located in the SE1/4SW1/4, Section 23, T28N, R112W, with the following conditions:
a. The hours of operation are restricted to daylight hours.
b. The conditional use permit shall expire in 5 years from the issuance of said permit.
c. Sublette County Weed & Pest shall be allowed to inspect the storage area throughout the year(s) to insure the storage area is free of noxious weeds and designated weeds, according to the Wyoming Weed & Pest Control Act of 1973 regional forage certification standards.
d. Pets brought to the site shall be restrained from November 30 to May 1.

Sleeping Indian Outfitters for July 5 and August 2, 2008, in Bondurant area.
Daniel Community Center, July 20, 2008, at Daniel Schoolhouse.
Pinedale Lions Club, July 13, 2008, at the Rendezvous Grounds.

It was moved by Commissioner Bousman and seconded by Commissioner Linn to transfer the Retail Liquor License from BJ Hill to Green River Guest Ranch-The Place. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to waive the Temporary Merchant's fee for Rendezvous Weekend of July 10, 11, & 12, 2008. The motion carried.
The following petition and affidavit of abatement of taxes was presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Tom & Sherri Taylor, $28.18; and Sam Taylor, $12.62.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve and sign the Memorandum of Understanding Between the Office of the Public Defender and Sublette County for the Guardian ad Litem Program. The motion carried.
The Board received bids from the two local newspapers for the ensuing year's designation as the County's official newspaper. Due to the prices bid, it was moved by Commissioner Bousman and seconded by Commissioner Linn to postpone a decision until the July 22nd meeting and refer the publication requirements to the County Attorney for review, and to continue with the Sublette Examiner until the next meeting. The motion carried.

County Clerk Mary Lankford reported that Miles Hopkins had delivered the Shelter Park Improvement and Service District records to her. The Board directed that the Department of Audit be informed.

JULY 17, 2008
The Board of County Commissioners met in special session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 3 p.m. with Bill Cramer, John Linn, Joel Bousman and Mary Lankford, County Clerk present. The purpose of the special session was to appoint a new Prosecuting and County Attorney.
It was noted that the Sublette Examiner, Pinedale Roundup, and Pinedale Online had been notified of the meeting on July 11, 2008, by email.
The Board reviewed a letter, dated July 14, 2008, from Sublette County Republican Party Chairman Cat Urbigkit reporting that Michael Crosson, Lucky McMahon, and Marilyn Filkins had been selected by the Party and forwarded to the Board.
Chairman Bill Cramer explained that the Board will conduct individual interviews in Executive Session, reconvene the meeting, and vote for the new County Attorney.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for an Executive Session to interview the candidates. The motion carried.

The Board voted by secret ballot, with County Clerk Mary Lankford counting the ballots and announcing the results.
Lucky McMahon was appointed Sublette County Attorney for a period of 30 months.
The meeting was recessed until 5 p.m., at which time, McMahon was sworn in.
There being no further business, the meeting was adjourned at 5:05 p.m.

The Town Council of the Town of Pinedale met in regular session Monday, July 14, 2008, at 5:30 p.m., in the Town Hall. Those present: Bob, Laurie and Andy Jones; Mary Lynn Worl; James Thomas, Clint Gilchrist and Jay Fear, representing the Museum of the Mountain Man; Ron Hanson, representing Public Works; Brian Gray, Worthington, Lenhart and Carpenter; Bob Wilkes, representing Bob's Intermountain RV and Marine; Greg Ptasnik, representing PDM, LLC; Paul Rock; Susan Kramer, Pinedale Anticline Working Group Member; Michael Kudar and Jim Engstrom, representing Pinedale Centerpoint; Jim Washam, representing the V.F.W.; Mike Jackson, Mark Eatinger and Dennis Fornstrom, representing Rio Verde Engineering; Joselyn Moore; Janet Bellis; Connie Snow; Meghan Jacquet, Planning and Zoning Administrator; Eugene Ninnie, Town Engineer; Ruth Neely; Stephen Crane, representing the Pinedale Roundup.
Mayor Smith brought the meeting to order. Present on roll call: Councilman David Smith, Councilwoman Nylla Kunard, Mayor Stephen Smith, Councilman Hohl and Councilman Chris House.
Motion by Kunard to approve the minutes of the June 9th, 23rd and July 8th meetings as written. Motion seconded. Motion carried unanimously.
Susan Kramer, a Pinedale Anticline Working Group Member, reported at the last meeting of the Pinedale Anticline Working Group one of the recommendations was to ask the BLM to support a no net increase in permitted nitrogen oxide and volatile organic compounds in accordance with the accepted limits stated in the 2000 Record of Decision. Kramer reported the Pinedale Anticline Working Group was asking the Town of Pinedale to endorse the recommendation to the WDEQ and BLM by saying that the town support's a าno net increaseำ in permitted nitrogen oxide and volatile organic compounds. Council agreed to take the request under consideration.
Jay Fear and Clint Gilchrist, representing the Museum of the Mountain Man Historical Board, requested vacating Halfmoon Street from Hennick Avenue to Pinedale East Road. Council requested additional information from the Historical Board and the Council agreed to contact the Town Attorney. No action taken.
Brian Gray, representing Worthington, Lenhart and Carpenter, presented Glenn C. and Roseva Van Patten's request for final plat approval of vacation and replat of Lots 4 and 5, Redstone Seventh Addition as Lots 13, 14, 15 and 16, Redstone Seventh Addition. Motion by Councilwoman Kunard to approve Glenn C. And Roseva Van Patten's final plat. Motion seconded. Motion carried unanimously.
Brian Gray, representing Worthington, Lenhart and Carpenter, presented Centerpoint, LLC's commercial building permit for Phase I, 12 - 13' x 24' cabins and 12 - 16' x 24' cabins located on Lots 1-17, Block 1, Triangle Addition. Meghan Jacquet, Planning and Zoning Administrator, reported the Planning and Zoning Board recommended approval of the building permit on the condition that the structures and site plans, regarding off-street parking and traffic control meet the Municipal Codes. Eugene Ninnie, Town Engineer, discussed concerns with the streets and drainage. After lengthy discussion Council asked Centerpoint, LLC to return when these concerns are addressed. No action taken.
John C. Walters Real Estate Specialist for the United States Postal Service not present.
Mike Jackson, representing Rio Verde Engineering, presented Sublette County's request for preliminary and final plat approval for a lot split, Block 1 Cooley First Addition. After discussion motion by Councilman Smith to approve the preliminary and final plat for a lot split, Block 1 Cooley First Addition. Motion seconded. Motion carried unanimously.
Dennis Fornstrom, representing Rio Verde Engineering, presented Shane and Michele Costello's commercial building permit for a laundromat located on Lot 3, Country Club Meadows Addition. After lengthy discussion Council agreed more supportive information was need. No action taken.
Greg Ptasnik, representing PDM, LLC, presented East 40 Subdivision's request for preliminary plat approval, located in the S1/2 SW1/4 & SW1/4 SE1/4 Section 2 T33N., R109W, which lies within one mile of the town limits. After lengthy discussion motion by Councilman Hohl to approve East 40 Subdivision's preliminary plat. Motion seconded. Councilman Smith voted aye, Councilman House voted aye, Councilman Hohl voted aye and Councilwoman Kunard voted nay. Motion carried.
Gambling Mountain, LLC not present.
Connie Snow, representing 349 North Franklin Avenue, requested a street closure to through traffic from North Street to Hennick Street for a block party July 19th. After discussion motion by Councilman Smith to allow a semi-hard street closure for July 19th excluding emergency traffic. Motion seconded. Motion carried unanimously.
Bob Wilkes, representing Bob's Intermountain RV & Marine, presented an Application for Temporary Use Permit for the sale of boats located at 1552 Pine Street until August 1st . After lengthy discussion motion by Councilman Hohl to allow the temporary use at 1552 Pine Street until August 1st and allow the trailers for camping while activity with the business. Motion died for a second. Council agreed no further business and 7 days to remove the business.
Bob Jones, representing 207 Tee Circle, requested permission to live in a camper while building his home. After discussion motion by Councilman Smith to allow Bob Jones to live in his licensed RV while building his home. Motion seconded. Motion carried unanimously.
Jim Washam, representing the V.F.W., gave an update on the Pinedale Veterans' Project located in the American Legion Park and reported the dedication would be July 26th. Motion by Councilwoman Kunard to approve the Service Contract between R and E Computer Service and the Town of Pinedale, in the amount of $4,800.00 and the Service Agreement with Electrical Systems Consultants, Inc., for time and material project work to be billed. Motion seconded. Motion carried unanimously.
Motion by Councilman Smith to approve the Contract for Services with SAFV, the Learning Center, the Discovery Center, Pinedale Fine Arts Council, Big Brothers Big Sisters, The American Red Cross and Rendezvous Pointe. Motion seconded. Motion carried unanimously.
Motion by Councilman Hohl to sign the Professional Services Agreement between the Town of Pinedale and WLC Engineering, Surveying & Planning, Inc. for Geographical Information System Database (GIS) not to exceed $90,000.00. Motion seconded. Motion carried unanimously.
Motion by Councilwoman Kunard to go into executive session for personnel. Motion seconded. Motion carried unanimously.
Motion by Councilman Hohl to return to regular session. Motion seconded. Motion carried unanimously.
Motion by Councilwoman Kunard to appoint Mayor Smith to the Pinedale Aquatic Center Joint Powers Board for the unexpired term of Gary Heuck. Motion seconded. Motion carried unanimously.
Motion by Councilman Smith to give Eugene Ninnie a salary increase as specified, $100,000.00 annually effective immediately. Motion seconded. Motion carried unanimously.
Motion by Councilman Smith to give Liz Dailey the 6% annual salary increase and benefits. Motion seconded. Motion carried unanimously.

PUBLIC NOTICE
The regularly scheduled meeting of the Sublette County Board of Commissioners will be held on Friday, August 22, 2008 at 1:00 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
1. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; High Sierra Energy LP, dba Anticline Disposal LLC applicant. The application proposes a change of zoning district boundary for 40 acres from the current Agricultural zoning to Light Industrial to store a tank battery for clean recycled water storage and other additional equipment. The parcel subject to the proposed Change of Zoning District Boundary is located in NE ผ of the SE ผ of Section 13, Township 31N, Range 109W; generally described as being apart of the Anticline Disposal Complex located near the intersection of Boulder South CR 23-106 and South Anticline Road.
Request for Conditional Use approval for a workers camp, pursuant to Chapter V of the Sublette County Zoning and Development Regulations, entitled Conditional Uses, by IXP, Inc. The application is for a 12 unit RV mancamp on a 2.59 acre parcel in the heavy industrial zoning district. The parcel subject to the proposed Conditional Use is owned by IXP, Inc. and is located on Lot 66 of Sand Draw Industrial Park Second Filing; generally described as 66 Jarrod Road in Sand Draw at the intersection of Highways 351 & 191.
3. Request for Minor Subdivision approval, pursuant to Chapter VI of the Sublette County Subdivision Resolution, entitled Minor Subdivision; for the Sleepy Hollow Industrial Park Third Filing Minor Subdivision; Deanne Bradley, applicant. The application for Minor Subdivision proposes the subdivision of 8.58 acres within the Heavy Industrial zoning district into two lots (Lot 6 - 2.76 acres and Lot 7 - 5.82 acres). The proposed Sleepy Hollow Industrial Park Third Filing Minor Subdivision is located in Section 20, Township 30N, Range 111W; generally described as being on the east side of U.S. Highway 189, approximately 0.5 miles north of the Marbleton town boundary and immediately east of Sleepy Hollow Industrial Park Subdivision.
4. Request for Minor Subdivision approval, pursuant to Chapter VI of the Sublette County Subdivision Resolution, entitled Minor Subdivision; for the Losik Minor Subdivision; Stephen Losik, applicant. The application for Minor Subdivision proposes the subdivision of 68.85 acres within the Rural Mixed (three acre minimum lot size) zoning district into two lots of 16.9 acres each (the remnant portion of the subject property will remain 35 acres in size). The proposed Losik Minor Subdivision is located in Sections 10 and 11, Township 30N, Range 111W; generally described being in the located Marbleton area, east of U.S. Highway 191 and immediately west of Emigration Ranches Subdivision.
