The Town of Pinedale will be accepting sealed bids for a new 2009 5-yard dump truck with a snowplow with the following MINIMUM specifications:

The Town of Pinedale reserves the right to waive minor defects and irregularities in the bidding to base its award on factors other than price, and to reject any and all bids.

BEGINNING at station 40+800 on the south line of said Section 5, S89-35’W, 1865 feet from the southeast corner of said Section found as described in the Corner Record filed in the Office of the Clerk of Sublette County;
Thence N48-48’E, 800 feet, more or less, to an intersection with the east line of said SW1/4SE1/4.

The Town Council of the Town of Pinedale met in regular session, Monday, June 9, 2008, at 5:30 p.m., in the Town Hall. Those present: Julie Land, representing Happy Endings Animal Rescue; Chris Land, representing The Cozy Home Company, LLC; Brian Gray, representing Worthington, Lenhart and Carpenter; Paul Rock; Dennis Fornstrom and Mark Eatinger, representing Rio Verde Engineering; Janet Bellis; Steve Mackey; Ed Wood, Town Attorney; John Fogarty; Matt Harber, representing Haymaker Land Holding Company; Eugene Ninnie, Town Engineer; Meghan Jacquet, Planning and Zoning Administrator; Ruth Neely; Stephanie Reiprish; Alecia Warren, representing the Pinedale Roundup; and Trey Wilkinson, representing the Sublette Examiner.
Mayor Smith brought the meeting to order. Present on roll call: Councilman David Smith, Councilwoman Nylla Kunard, Mayor Stephen Smith, Councilman David Hohl and Councilman Chris House. Mayor Smith welcomed David Smith and Nylla Kunard to the council.
Motion by Hohl to approve the minutes of the May 27th meeting as written. Motion seconded. Councilman Hohl voted aye, Councilwoman Kunard voted aye and Councilman House voted aye and Councilman Smith abstained. Motion carried.
Julie Land, representing Happy Endings Animal Rescue, discussed concerns with the animal control department. Land requested documentation of last year’s through the present time of intake and disposition statics to help assert whether any abuses have occurred. Council agreed to have the information available by the June 23rd Council Meeting.
Dennis Fornstrom, representing Rio Verde Engineering, presented C & A Investments, LLC’s, request for residential multi-family building permits on Lot 12 and Lot 13, Redstone Ninth Addition. Meghan Jacquet, Planning and Zoning Administrator, reported the Planning and Zoning Board had recommended the approval of the residential multi-family building permits. Paul Rock, Planning and Zoning Board Member, stated the items were reluctantly passed because the Planning and Zoning Board received very little information prior to their meeting. Eugene Ninnie, Town Engineer, stated the documents are submitted to the Town Council, the approval board, they are not required by ordinance to provide the documents to the Planning and Zoning Commission. Meghan Jacquet, Planning and Zoning Administrator, stated she felt the staff reports were not appreciated. Mayor Smith encouraged the staff to provide all requested information to the Planning and Zoning Commission. After lengthy discussion motion by Councilwoman Kunard to approve C & A Investments’ request for a residential multi-family building permit for Lot 12, Redstone Ninth Addition. Motion seconded. Councilman Hohl voted aye, Councilman House voted aye and Councilwoman Kunard voted aye, and Councilman Smith voted nay. Motion carried. Motion by Councilwoman Kunard to approve C & A Investments’ request for a residential multi-family building permit for Lot 13, Redstone Ninth Addition. Motion seconded. Councilman Hohl voted aye, Councilman House voted aye, Councilwoman Kunard aye and Councilman Smith voted nay. Motion carried.
Brian Gray, representing Worthington, Lenhart and Carpenter, presented Kurt Durrant’s request to to relocate a tree on North Franklin Avenue which would be in line with other exiting trees which are within the town’s easement. After discussion motion by Councilman Smith to approve the tree relocation pending an encroachment agreement written by Ed Wood, the Town Attorney. Motion seconded. Motion carried unanimously.
Paul Rock, Planning and Zoning Board Member, questioned the proposed workshop for the Planning and Zoning Board and Town Council on June 23rd. Concerns with the Planning and Zoning Board, the Town Engineer and Planning and Zoning Administrator were discussed. Council agreed to have a workshop after the next Council Meeting on June 23rd with the Planning and Zoning Board.
Chris Land, representing The Cozy Home Company, LLC, discussed a multi-family lot he purchased at the corner of Sublette Avenue and Washington Street where water and sewer services were unavailable at the property line. Land questioned the responsibility of putting the services in. Council agreed to take it under consideration.
Councilman Smith asked Eugene Ninnie, Town Engineer, if he felt he had conflict of interest with Haymaker Land Holding Company because his wife works at Pinedale Properties, the realtors involved in the project. Stephanie Reiprish stated she was not Ninnie’s wife. Ninnie stated no, adding Mr. Rock is continually going around the community and polarizing this, there is no conflict of interest.
Councilman Smith asked Ed Wood, Town Attorney, if he felt he had any ethical issues or conflict of interest drafting the annexation agreement for the Bloomfield Project or a conflict of interest since he had represented the Harber Family in the past. Wood stated he did not have a conflict of interest.
Councilman Smith asked Co­uncilman David Hohl and Janet Bellis, a council candidate for the May 6th Municipal Election, if they had met with town employees during work hours prior to the May 6th Municipal Election. Councilman Hohl and Bellis stated no.
Paul Rock, Planning and Zoning Board Member, questioned the status with the possible conflict of interest concerning Ed Wood, Town Attorney and the BloomField Addition. After lengthy discussion the majority of the Town Council agreed that there was not a conflict of interest and they didn’t want to pursue the investigation of conflict further. Rock stated he would take it to the state bar.

Agreement
The Sublette County Board of Commissioners (Commissioners) and Ralph Boynton, Sublette County Attorney (County Attorney), hereby agree as follows:
WHEREAS, for personal and professional reasons, it is in the County Attorney’s best interests to resign from his position as Sublette County attorney effective July 3, 2008, and
WHEREAS, it is in the best interests of Sublette County for the Sublette County Commissioners to effectuate the resignation, now, therefore,
1. The County Attorney hereby tenders his resignition as Sublette County Attorney effective July 3, 2008.
2. The Commissioners agree to pay the County attorney the balance of his wages due through the end of 2008, as wages, plus the full retirement contribution normally paid by Sublette County on his behalf, immediately and in a lump sum. The amount of wages is $42,500.00 in salary, plus $4,781.25 in recognition of said retirement contibution. 3. The parties hereto will cooperate in both assisting the County Attorney in moving out of the Sublette County attorney’s Office, and in transisting active cases to existing office personnel.
4. By this Agreement, the Commissioners hereby accept said resignation.
5. The Commissioners and the county Attorney hereby release each other from any causes of actions or claims they may presently have against each other.
6. This Agreement may be executed in one or more counterparts (including by facsimile), each of which shall be deemed and original, but all which together shall consitute on and the same instrument.
