A public hearing will be held on 14 July 2008 at 7 p.m. at the Town Hall of the Town of Marbleton in accordance with Wyoming Statutes, 2007, as amended, Section 15-1-405 (a). This notice includes a copy of the ÒProposed Annexation ReportÓ required by section 15-1-402 (c) as follows:

(i) A map of the area proposed to be annexed is attached..
(ii) The total estimated cost of infrastructure improvements required of all landowners by the annexing municipality related to the Annexation.

(iii) A list of basic and other services customarily available to the residents of the Town and a timetable when these services will reasonably be available to the area proposed to be annexed.
Water, streets and police extant are immediately available.

The Board of County Commissioners met in special session in the Commissioners Meeting Room of the Sublette County Courthouse on this date for preparation of the FY08 budget at 9 a.m. with Bill Cramer, John Linn, Joel Bousman, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JUNE 10, 2008
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Janet Montgomery of the Sublette Examiner, Jonathan VanDyke of the Pinedale Roundup, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The official bonds for John Markle, Treasurer for the Redstone Upper Green River Road Improvement District, in the amount of $10,000; Betty Lou McLoughlin, Treasurer for the Upper Green River Cemetery District, in the amount of $1,000; Jim Malkowski, Treasurer for School District #1, in the amount of $25,000; Peggy Winters, Treasurer for Mosquito Abatement District #1, in the amount of $1,000; and Anita Mae Bartosh, Treasurer for the Town of Marbleton, in the amount of $50,000 were approved and ordered filed with the County Treasurer.
Butch Penton, Road & Bridge Superintendent, reported on crack sealing, crushing, and shoulder work.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for an Executive Session with Butch Penton, Paul Scherbel, and Mark Eatinger to discuss real estate. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to reconvene the meeting.
Mark Eatinger, representing Rio Verde Engineering, reported on the partial grant from the BLM to start construction on the Industrial Road and advertising for bids for Class II Roads.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 08-10052C declaring the Extension of the McKinley County Road No. 23-193, a County Road. The motion carried.
Michael Schrotz, Tom Peters, and Steve Hayden, representing the Forest Service, discussed a Pledge of Support for the Pronghorn Migration Corridor Forest Plan Amendment. The Board declined signing the Pledge until all private property owners along the migration route are notified of the impacts of the amendment.
Schrotz requested a Letter of Support for the 40 acre Wilson inholding and its proposed purchase by the Forest Service in the Willow Creek area. Schrotz reported that the appraisal was complete and that there would be no net gain or loss with the purchase. It was moved by Commissioner Linn and seconded by Commissioner Bousman to sign a Letter of Support for the Wilson sale. The motion carried.
Tom Peters, District Ranger, discussed the Skyline Drive road project. Peters reported that the Regional Office had extended the funding of $800,000 for one year. Steve Hayden, Forest Service Engineer, reported on project design and increased cost estimates, with completion of design by November. The Board discussed snow removal, bike paths, future maintenance, and the need for considerable additional funding to complete the project.
Peters reported that the Rainbow Family Gathering will be held in Wyoming this year and five sites are being considered in Sublette County.
Leo Schueler and Mary Borgeson discussed mosquito abatement in the Daniel area, and reported that they do not plan to form an improvement and service district. Chairman Cramer referred them to Mosquito Abatement District #2 to discuss contracting for spraying.
Albert and Jonita Sommers, Maggie Miller, with John Kennedy, representing the Wyoming Game and Fish, and John McKinley, of Davis and Cannon, presented the Sommers Ranch and Grindstone Cattle Company Conservation Project consisting of three distinct conservation projects being the Sommers/Todd Place, Scott Place, and the Duke Place encompasses approximately 19,000 deeded acres along the Green River in northern Sublette County. The families plan to continue ranching and preservation of the river corridor. The Board commended the project and agreed to provide letters of support for funding requests.
Laurie Latta, representing the Sublette Community Partners, presented a proposal from Dr. Harold Bergman of the Ruckelshaus Institute of Environment and Natural Resources at the University of Wyoming to conduct an Ozone Educational Forum. The Institute currently has Dr. Robert A. Field, who is an Ozone expert, on staff. The Board approved the proposal and directed Latta to facilitate two forums in the County, in coordination with DEQ.
Jim Washam reported on the progress of the Veterans Memorial.
Paul Scherbel commented on the public roads in Sand Draw Industrial Park, Phase Three.
Commissioner Linn left the meeting.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to re-appoint Michael Klaren to the Museum Board for three-year terms. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to re-appoint Judy Andrikopoulos for a three-year term to the Library Board. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to re-appoint Albert Sommers and Dennis Seipp three-year terms to the Planning and Zoning Commission. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to appoint Kelly Tegeler and Michael Orham for three-year terms, and appoint Donna Lozier to an unexpired one-year term, to the Golf Committee. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to appoint Daneka Ewert for a three-year term to the Sublette Citzens for Recycling Board. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to appoint Rob Stone for a three-year term on the Tri-Town Recycling Board. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to appoint Kim Andrews for an unexpired two-year term on the Certified Local Government Board. The motion carried.
The Board decided to reactivate the County Housing and Development Committee.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to recess the meeting for an Executive Session with County Planner Bart Myers and Deputy County Attorney Jonathan Foreman to discuss potential litigation. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to reconvene the meeting.
Rick Johnson, Bob McCarty, and Aaron Seehafer, representing Rio Verde Engineering, recommended the amendment of the Meadow Lark Lane application to reduce the length, which would require re-inspection. It was moved by Commissioner Bousman and seconded by Chairman Cramer to approve the re-inspection of Meadow Lark Lane, upon amendment of the application. The motion carried.
It was decided to hold the Iroquois Trail application until the plat for Meadow Lark Lane is signed and recorded.
Lone Pine and the Hoback Ranches easement were referred to Class II Road Attorney John McKinley.
Lynda Vickrey and Betty Fear, Co-Chairwomen of the Fairgrounds Master Plan Committee, with Charlie Smith of HOK Smith Forkner, presented a master plan and schematic design for the Fairgrounds. The master plan includes the construction of four new buildings, renovation of two existing buildings, with property improvements and site additions. The estimated cost is $30,210,930.
Tony Chambers, representing Chambers Design-Build, Inc. presented Change Order #1 for the Facilities Maintenance Building in the amount of $17,651.09. It was moved by Commissioner Bousman and seconded by Chairman Cramer to approve the Change Order. The motion carried.
Chambers reported that the Kendall Valley Fire Hall will have its final Fire Marshal Inspection on June 17th and that the Marbleton Hangar will be completed in the next three weeks.
Chopper Grassell and Shawn Choate, representing Callaghan Cabinets and Millworks, Inc., reported that the Wyoming Business Council had recommended approval of their funding application to the State Land and Investments Board. Possible building sites were discussed.
The following petition and affidavit of abatement of taxes was presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Turlock Irrigation District $1,495.53; Shell Rocky Mountain Production LLC, $118.35; McMurry Oil Company, $44,622.83; Chevron USA, Inc., $1,773.35; Michael T. & Jonnie M. Stevie, $141.90; Eugene & Judith Seehafer, $472.20; BPM Joint Powers Board, $1,686.27; Gregory Welding, $41.89; Integrated Production Services, $69.94; and nine corrections to the 2008 taxroll with an assessed value of $18,304.00.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to approve the renewal of the Boulder Lake Lodge Restaurant Liquor License. The motion carried.
The Board denied a request from the Pinedale Rifle and Pistol Club for indemnification of the Club.
The Board approved and the Chairman signed the Cooperative Law Enforcement Agreement with the Forest Service for the amount of $12,833.00.
An anonymous letter from Residents of the Cora Y concerning the use of Jake brakes was referred to the Wyoming Department of Transportation.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to adopt Resolution No. 08-10051C authorizing the purchase of property to expand the Sublette County Fairgrounds and authorizing the Chairman to execute the necessary application. The motion carried.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to approve and sign a Memorandum of Agreement with the Department of Environmental Quality, the Wyoming Department of Health, and the Town of Pinedale to participate in performing a Community Health Risk Assessment. The motion carried.

The Board of County Commissioners met in the Meeting Room of the Marbleton Town Hall, in Marbleton, Wyoming, in special session for preparation of the FY09 budget on this date at 9 a.m. with Bill Cramer, Joel Bousman, and Mary Lankford, County Clerk present. Commissioner John Linn was absent.
Chairman Cramer led those present in the Pledge of Allegiance.
The Board received the following budget requests, subject to final approval:

Big Piney Marbleton Airport Board 65,996
Sue Hoefer, Marbleton Councilperson, and Anita Bartosh, Marbleton Town Clerk, discussed the Airport well and sewer project, and other Town paving projects. The Board agreed to pay for the Columbine Waterline Loop project in the amount of $54,865.00 to accommodate the Senior Center property.
Angie Smith, representing the BPM Rec. Center Board, requested the Board to consider reserving funds for the construction of the Rec. Center, in case the Capital Facilities Optional Tax, which the municipalities are considering, should fail.
Phil Smith, Mayor of Big Piney, discussed Town projects.
There being no further business, the meeting was adjourned at 3:00 p.m.
The Board met with representatives of all three Towns to discuss possible projects for a Capital Facilities Optional Sales Tax proposition for the November General Election.

The Board of County Commissioners met in special session in the Commissioners Meeting Room of the Sublette County Courthouse on this date for preparation of the FY08 budget at 9 a.m. with Bill Cramer, John Linn, Joel Bousman, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
In accordance with the public notice published in the Sublette Examiner on May 29, 2008, public hearing was held for the following:
It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the Final Plat for Sand Draw Industrial Park, Phase Three, with the following conditions:
The approved Final Plat shall not be recorded until a cost estimate and acceptable financial surety are provided for subdivision improvements (Subdivision road, power and telephone), as required by County regulations.
The approved Final Plat shall not be recorded until Covenants, Conditions and Restrictions addressing road maintenance are provided to staff for review and upon acceptance by staff, the Covenants, Conditions and Restrictions shall be recorded with the plat.
All outstanding review fees shall be paid prior to recording of the plat, subject to final review of fees by Mark Eatinger of Rio Verde Engineering.
There was discussion about the County reserving the right for specified subdivision roads to be dedicated to the public, with the County reserving the right to designate these roads as county roads in the future.
The Deputy County Attorney was directed to review the plat language, with respect to subdivision roads, prior to the plat being signed.

The Board received a request from the Sublette County Chamber of Commerce. After discussion with representatives of the Chamber of Commerce Board and John Godfrey, Tourism Board member, concerning County funding for the operation of the Visitors Center, the Board assigned Jonathan Foreman, Deputy County Attorney, to mediate the matter between the Chamber of Commerce and Tourism Boards.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to recess the meeting for an Executive Session with David F. Evans, of Hickey & Evans, LLP, to discuss a personnel matter. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to reconvene the meeting.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to engage the services of David F. Evans, of Hickey & Evans, LLP, for a personnel matter, in which, the County Attorney is unable to assist. The motion carried.

The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse, Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Jonathan Van Dyke of the Pinedale Roundup, and Mary Lankford, County Clerk.

It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for an Executive Session with Butch Penton, Paul Scherbel, and Mark Eatinger to discuss real estate. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to reconvene the meeting.
The official bond for Patty Racich, Clerk Treasurer for the Town of Pinedale, in the amount of $50,000 was approved and ordered filed with the County Treasurer.
Butch Penton, Road & Bridge Superintendent, Paul Scherbel, and Mark Eatinger, representing Rio Verde Engineering, discussed paving.
Eatinger reported on the Mickelson Lane project and an upcoming meeting with the Army Corps of Engineers, and the pre-construction meeting with HK Construction for the Industrial Road Project.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 08-10053C establishing the Mesa County Road No. 23-230. The motion carried.
Brandon Spurlock and Brian Nesvik, representing the Wyoming Game and Fish, reviewed the past year’s brucellosis test and slaughter program. It was moved by Commissioner Bousman and seconded by Commissioner Linn to continue to support the program by plowing to the Muddy, the Fall Creek, and the Scab Creek Feedgrounds, in exchange for assistance with exceptions on wildlife issues pertaining to County road construction and gravel pits. The motion carried.
Undersheriff Jim Whinnery requested donated sick leave for Dee Barta. It was moved by Commissioner Bousman and seconded by Commissioner Linn to allow the donation of a maximum of 16 hours per employee to Barta, upon the use of her sick leave and vacation. The motion carried.

A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF JERRY AND BRENDA WISMER TO RECLASSIFY AND REZONE 3.07 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R DISTRICT LOCATED WITHIN SECTION 27, T34N, R110W.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the application by Brad and Amy Mariner for the Mariner Minor Subdivision, being 8.3 acres, located in Section 28, T33N, R108W, being Lot 54, Barger Subdivision, Third Filing. The motion carried.
The Board reviewed the changes pertaining to the roads on the plat of the Sand Draw Industrial Park, Phase Three Subdivision. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the changes, as requested, and sign the plat. The motion carried.
Commissioner Bousman reported on a conference call concerning swapping BLM lands in Lincoln County for Sublette County lands.
John Eddins, WYDOT District Engineer, discussed Sublette County State Highways and WYDOT programs.
The Board received a budget request from Barbara Burrough and Sara Mizner of The Learning Center. The Board requested more information.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to recess the meeting for an Executive Session conference call with David Evans of Hickey and Evans, LLP, to discuss a personnel issue. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to reconvene the meeting.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to issue malt beverage permits to the Pinedale Lions Club for the Rendezvous Pageant on July 13, 2008 at the Rendezvous Grounds and to the Daniel Community Center for the Old Timer’s Picnic on July 20, 2008 at the Daniel Community Center. The motion carried.
The Board approved and the Chairman signed a Homeland Security Grant in the amount of $41,648.00 for Emergency Management.
