STANDARD ADVERTISEMENT FOR BIDS
FOR Phase III Sewer and Water Rehabilitation Project
PINEDALE, WYOMING
Notice is hereby given, pursuant to Wyoming Statute Section 15-1-113, that the Town of Pinedale, Wyoming, will receive sealed bids until 2:00 PM., Local Time, March 6, 2008, for the following:
Town of Pinedale Phase III Sewer and Water Rehabilitation Project
Description of Work: Replacement of existing sewer and water mains and services. Installation of asphalt, pavement and concrete curb and
gutters.
Bids must be in one sealed envelope with statement thereon "BID ENCLOSED Phase III Sewer and Water Rehabilitation Project " and submitted to the Town Hall, 210 West Pine Street, PO Box 709, Pinedale, Wyoming, at or before the above stated time. Bids will be opened publicly, read aloud, and tabulated by the Town Engineer, or his or her Designee, at the above stated time and place, unless an alternative site is designated in writing which is posted at the Town Hall prior to the time of Bid Opening. No bid may be withdrawn for a period of thirty (30) days after the date set for opening thereof. The Town of Pinedale, Wyoming, reserves the right to reject any or all bids and to waive any informalities or technicalities in the bidding; provided, however, that any bid received after the time specified or without accompanying Bid Guaranty, as stated below, will not be considered.
Bidding Documents, including specifications, will be available on January 24, 2008 from the ENGINEER, WLC Engineering, Surveying, and Planning; 58 South Tyler; PO Box 1519; Pinedale, Wyoming (307) 367-6548. Bidders may obtain one set of plans for free. Partial sets are not available.
A Bid Guaranty in the form of a properly executed Bid Bond payable to the Town in the amount of not less than 5% of the total base bid amount must accompany each bid. (NOTE: If your bid is less than $100,000.00 you may submit a Cashier's Check for not less than 5% of the total base bid amount.) The successful Bidder will be required to execute an Agreement with the Town, in the form supplied in the bidding documents, within thirty (30) days after Notice of Award is issued. The Notice of Award shall serve as notice that the Agreement is ready for execution. The Bid Guaranty shall be forfeited as liquidated damages if the Bidder fails to execute the Agreement within thirty (30) days after such Notice is issued, or fails to provide proper Bond or other form of Guaranty, as approved. The Bid Guaranty, if a Bid Bond, shall be executed by a surety or guarantee company authorized to do business in Wyoming. The Attorney-in-Fact who executes the Bond on behalf of the surety shall affix a certified and current copy of its Power of Attorney from the surety. No other type of Bid Guaranty will be accepted. The Town may proceed against a Bid Guaranty unless either: a) the Agreement has been executed by Contractor and Performance, and Labor and Material Payment Bonds have been furnished, as required; or, b) the specified time has elapsed so that Bids may be withdrawn; or, c) the Bid has been rejected.
Notice is hereby given that preference will be granted to Wyoming contractors, subcontractors, laborers, and materials, supplies, equipment, machinery, and provisions produced, manufactured, supplied, or grown in Wyoming, as required by W.S. Section 16-6-101 et seq.
A Pre-Bid Conference will be held at 2:00 PM., Local Time, Wednesday February 27, 2008 in the Pinedale Town Hall. A site tour will be held to review the Project following this conference.
Attendance in the Pre-Bid Conference is mandatory for Contractors who wish to be considered qualified and/or responsible.

INVITATION FOR BIDS
2008 SOUTH MAIN SEWER PROJECT
TOWN OF PINEDALE, WYOMING
Sealed BIDS are requested for work described in the Project Manual for the 2008 South Main Sewer Project for the Town of Pinedale, dated January 31, 2008, prepared by Rio Verde Engineering, 201 West Pine Street, P.O. Box 642, Pinedale, Wyoming 82941.
Bids will be received by the Town of Pinedale at 210 W. Pine Street, P.O. Box 709, Pinedale, Wyoming 82941 until 2:30 PM local time on March 6, 2008, at which time said BIDS will be publicly opened and read aloud.
The work consists of installing 13,500 LF of 24-inch PVC, 555 LF of 10-inch PVC, 50 LF of 8-inch PVC, 37 60-inch diameter manholes, 50 4-inch PVC services, 9,200 LF of 48-inch sidewalk, 9,200 LF of combined curb and gutter, 1,700 TN of asphalt, 210 LF of 6-foot valley pan, and misc. appurtenances.
A mandatory pre-bid meeting will be conducted at 10:00 AM local time on February 27, 2008, at which time an on site inspection of the proposed work will be conducted and special considerations will be discussed. The meeting will be held at the Pinedale Town Hall. All prospective BIDDERS must attend this meeting.
Copies of the Project Manual and the Design Drawings specifying the work to be performed may be obtained from Rio Verde Engineering after January 31, 2008. Please return the plans and specs to Rio Verde Engineering.
BIDDERS shall be required to accompany each bid with a BID Bond with sufficient surety, or a certified check, cashier’s check or bank draft upon some reputable bank payable to the Town of Pinedale for at least 10 percent of the total amount of the BID. The bond, check or bank draft shall be forfeited as liquidated damages, if the BIDDER, upon the letting of the contract to him, fails to enter into the contract within 15 days after it is presented to him for that purpose or fails to proceed with the performance of the contract. The Bid Bond, draft or check shall be retained by the Town of Pinedale until proper bond to secure performance of the contract has been filed and approved. All the above to be in accordance with 15-1-112, Wyoming Statutes, 2007.
The right is reserved by the Town of Pinedale to reject any and all BIDS, and to waive any irregularity or informality in the bidding. BIDS may not be withdrawn for thirty days after the date of opening.

Each bid must be accompanied by a Certified Check or Cashier's Check in an amount not less than five percent of the total bid made payable to Big Piney-Marbleton Airport Board, or by a Bid Bond in like amount executed by a Surety Company.
The Bidder must supply all the information required by the proposal forms and specifications, and he/she must bid on all items of every schedule. Big Piney-Marbleton Airport Board reserves the right to waive any informality in or to reject any or all portions of the various bid items. No proposal may be withdrawn for a period of one-hundred twenty (120) days from the opening thereof.
All bidders are advised to examine the site to become familiar with all site conditions. The project will be shown to interested bidders at 10:00 a.m. MST, on March 5, 2008 at the Miley Memorial Field Airport.
The proposed contract is under and subject to Executive Order 11246 of 24 September 1965, as amended, and to the equal opportunity clause and the Standard Federal Equal Employment Opportunity Construction Contract Specifica-tions, including the goals and timetables for minority and female participation.
A Certification of Nonsegregated Facilities must be submitted prior to the award of the proposed contract, including any subcontracts in excess of $10,000.00.
The proposed contract is subject to the provisions of Department of Transportation Regulations 49 CFR Part 26 (Disadvantaged Business Enterprise Participation).
Minimum wage rates as established by the Secretary of Labor and State of Wyoming are applicable to all schedules awarded for this project.

Public Notice
Shriver Sand and Gravel Pinedale, Wyoming has applied for a REVISION of its existing mining permit (#229c), which was approved in 1974 by the Land Quality Division of the Wyoming Department of Environment Quality. This revision will decrease the permit area from 80 acres to 40 acres and will increase the area to be affected from 10 acres to 40 acres. The mining permit area is located in the SW SE, of Section 20, T34N, R109W, Sublette County, Wyoming. The mine is located one and one half miles west of Pinedale along Hwy 191; specifically, two miles north of Ehman Lane (Co. Rd. 144), and then one half mile east. This area can be found on the Cora USGS quadrangle map. The mining operation began in 1975 and is estimated to continue until 2014. The land, after mining, will be returned to grazing land. Information regarding the proposed revision may be reviewed in the Office of the Land Quality Division, Department of Environmental Quality in Cheyenne and in Lander, Wyoming or the Sublette County Clerk’s Office, Pinedale, Wyoming. Written objections to the proposed permit revision must be received in Cheyenne by the close of business 24th March, 2008. Address comments to: Administrator, LQD, DEQ, Herschler Building, 122 West 25th Street, Cheyenne, WY 82002. Only the revision is open for public review. If an objection is submitted, a public hearing shall be held within twenty (20) days after the final date for filing objections unless a different period is stipulated to by the parties. The Environmental Quality Council or Director shall publish notice of the time, date and location of the hearing in the newspaper of general circulation in the locality of the proposed operation once a week for two (2) consecutive weeks immediately prior to the hearing. The hearing would be conducted as a contested case in accordance with the Wyoming Administrative Procedure Act (W.S. 16-3-101 through 16-3-115), and the right of judicial review shall be afforded as provided in that act. The Wyoming Oil and Gas Conservation Commission will be mailed a copy of the application mine plan map as required in W.S. 35-11-406(j).

The Town Council of the Town of Pinedale met in regular session Monday,
January 28, 2008, at 5:30 p.m., in the Town Hall. Mayor Stephen Smith brought the meeting to order. Present on Roll Call: Gary Heuck, David Hohl, Stephen Smith, Nylla Kunard and Chris House. Motion by to approve the minutes of the January 14th meeting as written. Motion seconded. Motion carried unanimously.
Sublette County Sheriff’s Office not present at scheduled time.
Randy Hubbard, representing the Public Works Department, reported the activities of the public works department.
Eugene Ninnie, Town Engineer, reported the monthly activities of the engineering department. After discussion motion by Hohl to approve Stantec’s comprehensive traffic, road and street evaluation study and authorize the Mayor to sign the Profession Services Agreement between the Town of Pinedale, Wyoming and Stantec Consulting Inc. for Traffic and Maintenance Study. Motion seconded. Motion carried unanimously. Motion by Hohl to authorize proceeding with requesting RFP-RFG’s for design engineering on Phase 4, Phase 5 and Phase 6, the balance of the water and sewer work needed to complete those sections of the town that are still outstanding. Motion seconded. Motion carried unanimously. Ninnie discussed hiring a professional grant writer. Ninnie reported the bid for the addition to the town hall: Barry Bowser of Arrowhead Builders, $115,325.00. After lengthy discussion Ninnie will contact Barry Bowser to discuss the bid. Motion by Kunard to authorize processing with requesting RFP-RFQ’s for contractors to bid on the removal of the sludge and re-line the lagoon. Motion seconded. Motion carried unanimously.
Meghan Jacquet, Planning and Zoning Administrator, reported the monthly activities of the planning and zoning department.
Lauren McKeever, Mayor’s Assistant, reported her monthly activities.
Jim Parker, Airport Manager, reported the monthly activities of the airport and presented the November and December Treasurer’s Reports.
Ruth Neely, Municipal Judge, reported the monthly activities of the municipal court.
Jennifer Gocke, Municipal Code Officer, reported her monthly activities.
Pat Bozner not present at scheduled time.
Jim Ditzler, representing 40 Skyline Street, discussed concerns with the no parking on Skyline Street. Ron Hanson, representing the Public Works Department, stated it was for concerns with traffic safety and snow removal. Council agreed to take it under advisement.
Motion by Hohl to approve the Contract for Service with the Wyoming Senior Winter Games in the amount of $1,500.00. Motion seconded. Motion carried unanimously.
Paul Rock, concerned citizen and Planning and Zoning Board Member, questioned the town’s position on the Bureau of Land Management’s Supplemental Environmental Impact Statement for the Pinedale Anticline. Mayor Smith stated Lauren McKeever, Mayor’s Assistant, had attended meetings and is working on comments for the BLM’s SEIS.
Paul Rock, a concerned citizen and Planning and Zoning Board Member, discussed his concerns with the Bloomfield Annexation master plan proposed zoning, the long term affect and questioned if the town had adequate water for this development as well as other developments. Eugene Ninnie, Town Engineer, stated the town has an adequate water supply and the wastewater treatment facility has plenty of capacity, adding pre- zoning from the engineering stand-point makes good sense. Rock discussed allowing specific zoned areas and keep the remaining land zoned agriculture so future development will be required to bring every new project before the planning and zoning board and town council. John Fogerty, Planning and Zoning Board Member, discussed his concerns with annexing the property pre-zoned, allowing development whether or not it was needed and questioned the town being able to participate in Harber’s decisions with the zoning already laid out. Matt Harber, representing the John B. Harber, personally, and John B. Harber and Sylvia L. Harber as trustees of the Harber Family Trust, stated the point of a master plan is to plan ahead, Harber added through out the process he has met with the community, government entities and held public meetings. Carmel Kail, concerned citizen, discussed her concerns with the annexation. Laurie Latta, representing the Sublette County Partnership, stated she saw the Bloomfield Annexation as a great opportunity for the Pinedale community. Dave Vlcek, a concerned citizen, discussed his concerns with the annexation and he felt that the rush to get the project through was leading to poor planning. Pam Curry, Planning and Zoning Board Member, discussed the annexation. Barbara Boyce, Planning and Zoning Board Member, discussed her concerns with the water supply and the wastewater facility having the capacity and further growth. Ninnie stated studies and plans were underway to improve the public services systems and the more people on the systems drive the costs down. Forest Wakefield, owner of the Log court Motel, stated the annexation was an opportunity for his business to bring in a workforce that could afford to live in the area. Susan Kramer, a concerned citizen, discussed her concerns with the annexation and concerns with the afford ability bringing down property values. Sally Mackey discussed her concerns with the annexation. Ed Wood, Town Attorney, discussed the Bloomfield Annexation Agreement between Haymaker Land Holding Co., LLC and the Town of Pinedale, concerning the terms and conditions of the annexation to be applicable to the Bloomfield Property and the proposed development and/or subdivision. Tina Rock, concerned citizen, discussed her concerns with the annexation and asked the council to slow down on their decision. Rock stated his concerns with the long term ramification of this annexation.
After lengthy discussion motion by Heuck to table the third reading of Ordinance 432, annexing adjacent and contiguous land (Harber Annexation) to the Town of Pinedale. Motion seconded. Heuck voted aye, Hohl voted aye, Kunard voted aye and House voted nay. Motion carried.
After discussion Council supported Nylla Kunard remaining on the Pinedale Anticline Working Group.
Motion by Kunard to go into executive session to discuss personnel. Motion seconded. Motion carried unanimously.
Motion by Hohl to return to regular session. Motion seconded. Motion carried unanimously.

The regularly scheduled meeting of the Sublette County Board of Commissioners will be held on Friday, March 6, 2008 at 1:00 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following application:

Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administra-tion and Conditional Use pursuant to Chapter V of the Sublette County Zoning and Development Regulations, entitled Conditional Uses, by the Calpet LLC. The application proposes a change of zoning district boundary for a 239 acre parcel from Agricultural to Light Industrial in order to develop an oil and gas production waste facility on a portion of the parcel as a Conditional Use. The parcel subject to the proposed Change of Zoning District Boundary and Conditional Use is located in Sections 21 & 27, Township 28N, Range 113W; generally described as being located on the east side of Big Piney Calpet County Road 23-134 approximately 15 miles southwest of the intersection of Big Piney Calpet Road and U.S. Highway 189.

Sealed bids for improvements to the Miley Memorial Field Airport, will be received by the Big Piney-Marbleton Airport Board at the Big Piney Town Hall at 401 Budd Ave, Big Piney, WY until March 12, 2008 at 10:30 a.m. MDT, and then opened and read aloud.
The work involved includes the following:

APRON EXPANSION
A complete set of Plans, Specifications and Contract Documents may be obtained at www.armstrongconsultants.com. A digital copy may be downloaded for $50.00. A hardcopy may be purchased for $100.00 for each set. There will be no refunds.
Each bid must be accompanied by a Certified Check or Cashier's Check in an amount not less than five percent of the total bid made payable to Big Piney-Marbleton Airport Board, or by a Bid Bond in like amount executed by a Surety Company.
The Bidder must supply all the information required by the proposal forms and specifications, and he/she must bid on all items of every schedule. The Big Piney-Marbleton Airport Board reserves the right to waive any informality in or to reject any or all portions of the various bid items. No proposal may be withdrawn for a period of thirty (30) days from the opening thereof.
All bidders are advised to examine the site to become familiar with all site conditions. The project will be shown to interested at 10:00 a.m. MST on March 5, 200 at the Miley Memorial Field Airport.

Public Notice is hereby given of the Sublette County Conservation District Board of Supervisors intent to adopt a New Policy by authority [§11-16-122(xvi); §16-3-103(a)(i)(B).
This Public Land Use Policies Statement reflects the Sublette County Conservation Districts desire to advise Public Land Agencies of the Conservation District’s official policies on Public Lands Management within the boundaries of Sublette County and will be adopted to facilitate the District’s activities in federal land management and land use planning, 43 U.S.C. 1712(c)(9); 43 C.F.R. Part 1600.
There are several Federal Laws and Regulations that provide local governments involvement in the planning, decision making and implementing processes. Federal Land Use Plans are to be consistent with local land use policies. These policies are new and there are no state statutory requirements for the Policies to meet. A copy will be filed in the Sublette County Courthouse.
A public comment period will begin on February 21, 2008 and continue for 45 days scheduled to end on April 05, 2008. The purpose for this comment period is to give the public and public land use agencies adequate time to comment on these policies. Comments may be submitted to the above address either postal, email or hand delivered to the Sublette County Conservation District office located at the above address. Be sure to include the page and line number with your comment.
