Phase III Sewer and Water Rehabilitation Project
PINEDALE, WYOMING
Notice is hereby given, pursuant to Wyoming Statute Section 15-1-113, that the Town of Pinedale, Wyoming, will receive sealed bids until 2:00 PM., Local Time, March 6, 2008, for the following:
Town of Pinedale Phase III Sewer and Water Rehabilitation Project
Description of Work: Replacement of existing sewer and water mains and services. Installation of asphalt pavement and concrete curb and gutters.
Bids must be in one sealed envelope with statement thereon "BID ENCLOSED Phase III Sewer and Water Rehabilitation Project " and submitted to the Town Hall, 210 West Pine Street, PO Box 709, Pinedale, Wyoming, at or before the above stated time. Bids will be opened publicly, read aloud, and tabulated by the Town Engineer, or his or her Designee, at the above stated time and place, unless an alternative site is designated in writing which is posted at the Town Hall prior to the time of Bid Opening. No bid may be withdrawn for a period of thirty (30) days after the date set for opening thereof. The Town of Pinedale, Wyoming, reserves the right to reject any or all bids and to waive any informalities or technicalities in the bidding; provided, however, that any bid received after the time specified or without accompanying Bid Guaranty, as stated below, will not be considered.
Bidding Documents, including specifications, will be available on January 24, 2008 from the ENGINEER, WLC Engineering, Surveying, and Planning; 58 South Tyler; PO Box 1519; Pinedale, Wyoming (307) 367-6548. Bidders may obtain one set of plans for free. Partial sets are not available.
A Bid Guaranty in the form of a properly executed Bid Bond payable to the Town in the amount of not less than 5% of the total base bid amount must accompany each bid. (NOTE: If your bid is less than $100,000.00 you may submit a Cashier's Check for not less than 5% of the total base bid amount.) The successful Bidder will be required to execute an Agreement with the Town, in the form supplied in the bidding documents, within thirty (30) days after Notice of Award is issued. The Notice of Award shall serve as notice that the Agreement is ready for execution. The Bid Guaranty shall be forfeited as liquidated damages if the Bidder fails to execute the Agreement within thirty (30) days after such Notice is issued, or fails to provide proper Bond or other form of Guaranty, as approved. The Bid Guaranty, if a Bid Bond, shall be executed by a surety or guarantee company authorized to do business in Wyoming. The Attorney-in-Fact who executes the Bond on behalf of the surety shall affix a certified and current copy of its Power of Attorney from the surety. No other type of Bid Guaranty will be accepted. The Town may proceed against a Bid Guaranty unless either: a) the Agreement has been executed by Contractor and Performance, and Labor and Material Payment Bonds have been furnished, as required; or, b) the specified time has elapsed so that Bids may be withdrawn; or, c) the Bid has been rejected.
Notice is hereby given that preference will be granted to Wyoming contractors, subcontractors, laborers, and materials, supplies, equipment, machinery, and provisions produced, manufactured, supplied, or grown in Wyoming, as required by W.S. Section 16-6-101 et seq.
A Pre-Bid Conference will be held at 2:00 PM., Local Time, Wednesday February 27, 2008 in the Pinedale Town Hall. A site tour will be held to review the Project following this conference.
Attendance in the Pre-Bid Conference is mandatory for Contractors who wish to be considered qualified and/or responsible.

The Town Council of the Town of Pinedale met in regular session, Monday, January 14, 2008, at 5:30 p.m., in the Town Hall. Those present: Matt Harber and James Rogers, representing Haymaker Land Holding Company; Dennis Fornstrom and Mark Eatinger, representing Rio Verde Engineering; Maureen Hutchinson, representing American Red Cross; Stephen Harmon; Ron Hanson, representing the Public Works Department; Marti Seipp, representing the Wyoming Senior Winter Games; Richie Strom, representing Bottoms Up Brewing Company; Talli Manning; Grace Anderson; Laurie Latta, representing the Sublette County Partnership; Sally Mackey; Sheine Thomas, representing Rocky Mountain Bank; Ed Wood, Town Attorney; Jennifer Gocke, Municipal Code Officer; Meghan Jacquet, Planning and Zoning Administrator; Alecia Warren, representing the Pinedale Roundup; and Trey Wilkinson, representing the Sublette Examiner.
Mayor Stephen Smith brought the meeting to order. Present on Roll Call: Gary Heuck, David Hohl, Stephen Smith, Nylla Kunard and Chris House.
Motion by Kunard to approve the minutes of the December 10th meeting as written. Motion seconded. Motion carried unanimously.
Maureen Hutchinson, representing the American Red Cross, gave an update on the local American Red Cross Program.
Dennis Fornstrom, representing Rio Verde Engineering and Matt Harber, property owner, presented for approval the preliminary and final plat for Split Diamond Meadows Subdivision Second Amendment, vacating Lot 71 and creating Lots 86 and 87. Motion by Heuck to approve the preliminary and final plat for Matthew and Ashley Harber. Motion seconded. Heuck voted aye, Kunard voted aye, House voted aye and Hohl abstained. Motion carried.
Mayor Smith presented the proposal for the Town’s official newspaper. Racich reported the Sublette Examiner was the only paper to present a proposal. After discussion motion by Kunard to designate the Sublette Examiner as the Town’s official newspaper. Motion seconded. Motion carried unanimously.
Jennifer Gocke, Municipal Officer, presented Tom and Sandy Taylor’s request to allow them a temporary permit to live in a trailer at 30 East Charles Street, while they are selling the home located at that address. Locke informed the Council the ordinances do not allow the request. After discussion motion by Heuck to grant the Taylor’s a temporary permit through February 2008. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve the Application for a 24 Hour Catering/Malt Beverage Permit to Bottoms Up Brewing Company on January 27th at Rendezvous Pointe. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve the Application for a 24 Hour Catering/Malt Beverage Permit to Bottoms Up Brewing Company on January 28th at the finish line of the Dog Sled Races. Motion seconded. Motion carried unanimously.
Talli Manning, a Sublette County Resident, discussed her concerns with the Bloomfield Annexation and the proposed development. Grace Anderson, a Sublette County Resident, discussed her concerns with the proposed development of the Bloomfield Annexation.
Stephen Harmon, representing 81 Opal Avenue, requested permission to be allowed to leave his motor home and boat in the town’s right-of-way. Ron Hanson, representing the Public Works Department, discussed his concerns with them being left in the town’s right of-way. After lengthy discussion the Council agreed to have Harmon work with Hanson on a temporary arrangement.
Marti Seipp, representing the Wyoming Senior Winter Games, presented a Contract for Services in the amount of $1500.00. Council agreed to present it for payment at the next meeting.
Motion by House to approve Ordinance 432, an ordinance annexing adjacent and contiguous land (Harber Annexation) to the Town of Pinedale, Wyoming, and stablishing zoning therefor, on the second reading. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve Ordinance 433, an ordinance of the Town of Pinedale, Wyoming creating Chapter 17.39, Section 17.39.031, of the Pinedale Municipal Code to allow limited mixed residential use in the C-1 District as a Condition Use, on the first reading. Motion seconded. Motion carried unanimously.
Motion by Heuck to approve Ordinance 434, an ordinance of the Town of Pinedale, Wyoming deleting and repealing Chapter 17.40, Section 17.40.070, on the first reading. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve Ordinance 435, an ordinance of the Town of Pinedale, Wyoming amending Section 13.04.020 of the Pinedale Municipal Code by modifying the manner of computing the connection fee for businesses, on the first reading. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve Ordinance 436, an ordinance of the Town of Pinedale, Wyoming amending Section 2.04.120 relating to the form of application for Municipal Office, on the first reading. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve Resolution 2008-01, a resolution approving and authorizing the settlement of all claims of the Town of Pinedale against JFK Engineers & Surveyors and all claims of JFK Engineers & Surveyors against the Town of Pinedale. Motion seconded. Motion carried unanimously. After discussion motion by Heuck to approve the Public Works Department spending $7,800.00 to order UV lamps for the wastewater treatment facility. Motion seconded. Motion carried unanimously.

AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING CREATING CHAPTER 17.39, SECTION 17.39.031, OF THE PINEDALE MUNICIPAL CODE TO ALLOW LIMITED MIXED RESIDENTIAL USE IN THE C-1 DISTRICT AS A CONDITIONAL USE.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT CHAPTER 17.39, SECTION 17.39.031, OF THE PINEDALE MUNICIPAL CODE IS HEREBY CREATED TO READ AS FOLLOWS:
17.39.031 Rental Residential Use – Conditional use. Mixed single family residential and commercial use within a structure may be permitted as a condition use subject to the provisions of Section 17.39.030 and the following requirements:
1. Each single family residential unit shall contain at least one complete bathroom, a kitchen and sleeping quarters. A kitchen and sleeping quarters may occupy the same room.
2. Set back requirements for any mixed use structure shall be five feet on the sides and rear. There are no set back requirements from public streets.
3. The residential use is secondary and incidental incidental (amend to: secondary) to the main commercial permitted use on the property.
4. The floor area used for residential use in a mixed use structure shall not exceed 50%40% (amend to: 50%) of the total floor area of the structure.
5. Where there are more than four or more (add in: or more) single family residential units within a mixed use structure, recreational open space shall be provide and shall be no less than eight percent of the area of the zone lot upon which the mixed use structure is located.
6. Single family residential units located in a mixed use structure shall have consistent use throughout the mixed use structure and shall not comprise HOTEL or MOTEL uses where lodging is offered for compensation of weekly or daily rental dwelling units.
This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

INVITATION FOR BIDS
2008 SOUTH MAIN SEWER PROJECT
TOWN OF PINEDALE, WYOMING
Sealed BIDS are requested for work described in the Project Manual for the 2008 South Main Sewer Project for the Town of Pinedale, dated January 31, 2008, prepared by Rio Verde Engineering, 201 West Pine Street, P.O. Box 642, Pinedale, Wyoming 82941.
Bids will be received by the Town of Pinedale at 210 W. Pine Street, P.O. Box 709, Pinedale, Wyoming 82941 until 2:30 PM local time on March 6, 2008, at which time said BIDS will be publicly opened and read aloud.
The work consists of installing 13,500 LF of 24-inch PVC, 555 LF of 10-inch PVC, 50 LF of 8-inch PVC, 37 60-inch diameter manholes, 50 4-inch PVC services, 9,200 LF of 48-inch sidewalk, 9,200 LF of combined curb and gutter, 1,700 TN of asphalt, 210 LF of 6-foot valley pan, and misc. appurtenances.
A mandatory pre-bid meeting will be conducted at 10:00 AM local time on February 27, 2008, at which time an on site inspection of the proposed work will be conducted and special considerations will be discussed. The meeting will be held at the Pinedale Town Hall. All prospective BIDDERS must attend this meeting.
Copies of the Project Manual and the Design Drawings specifying the work to be performed may be obtained from Rio Verde Engineering after January 31, 2008. Please return the plans and specs to Rio Verde Engineering.
BIDDERS shall be required to accompany each bid with a BID Bond with sufficient surety, or a certified check, cashier’s check or bank draft upon some reputable bank payable to the Town of Pinedale for at least 10 percent of the total amount of the BID. The bond, check or bank draft shall be forfeited as liquidated damages, if the BIDDER, upon the letting of the contract to him, fails to enter into the contract within 15 days after it is presented to him for that purpose or fails to proceed with the performance of the contract. The Bid Bond, draft or check shall be retained by the Town of Pinedale until proper bond to secure performance of the contract has been filed and approved. All the above to be in accordance with 15-1-112, Wyoming Statutes, 2007.
The right is reserved by the Town of Pinedale to reject any and all BIDS, and to waive any irregularity or informality in the bidding. BIDS may not be withdrawn for thirty days after the date of opening.
