The Petition further alleges that the value of all property that the decedent had in Wyoming at his death does not exceed $150,000; that the decedent’s estate is being duly probated in the State of Montana in the Fifth Judicial District Court of Jefferson County, Montana, as Probate No. DP-06-3643; that Petitioner is duly appointed and acting domiciliary personal representative of decedent’s estate in the State of Montana; and that the Petitioner seeks to dispose of the decedent’s Last Will and Testament. The Petition reads that the Court enter, in accordance with the provisions of Wyoming Statutes 2-11-202, an order admitting to record in the Court certified copies of the Montana proceedings in the Court and conclusive evidence of the facts shown.
Hearing upon the Petition will be held in the above Court at the courtroom in the Sublette County Courthouse, at Pinedale, Wyoming on 24 January 2008 at 9:30 a.m., at which time all interested persons may appear and object.

Invitation to Bid
Separate sealed BIDS for the construction of the Quealy Avenue and Dodge Street Waterline and Street Reconstruction will be received by the Town of Big Piney, Wyoming at the office of the City Clerk until 3 p.m. local time Feb. 5, 2008 and then at said office publicly opened and read aloud.
The contract documents may be examined at the Big Piney Town Hall and at the Forsgren Associates, Inc; 849 Front Street, Suite 201; Evanston, WY 82930.
The project consists of the following work: The reconstruction and asphalt paving of approximately 12,000 SY of street re-construction along with replacement of associated valley gutters, there is also approximately 2,000 LF of waterline replacement along with associated lines, fire hydrants etc. sub grade preparation and other incidental work within the town limits of Big Piney, Wyoming.
Copies of the Contract Documents may be obtained at the office of Forsgren Associates, Inc at the location noted above, upon payment of $75.00 for each set, non-refundable.
Each BIDDER will be required to submit, with his proposal, a certified check, or Bid Bond made payable without condition to the Town of Marbleton in the amount of not less than five percent (5%) of the BIDDER’s maximum Bid Price as guarantee that such BIDDER will enter into a contract within fifteen (15%) days after the date of the OWNER’s Notice of Award.
Preference will be given to resident Wyoming Contractors in the amount of fiver percent (5%) of the low bi in accordance with Wyoming Statute 16-6-101, et.seq.
The Town of Marbleton reserves the right to reject any or all bids or any part of any bid, to waive formality in any bid, as its best interest may appear.
A pre-bid meeting will be held at 10:00 a.m. of the 24th day of January at 401 Budd Avenue, Big Piney Wyoming 83113. Bidders attendance is non-mandatory.

Bennett Construction Company, Inc., pursuant to the Project Manual for Sublette County Bicycle/Pedestrian North Pathway Extension, and that R. S. Bennett Construction Company, Inc. is entitled to final settlement therefore. OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JANUARY 3, 2008
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Jonathan Van Dyke of the Pinedale Roundup, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of December 18, 2007, were approved and ordered filed on motion by Commissioner Bousman and seconded by Commissioner Linn. The motion carried.
The official bond for Alice Griggs, Clerk for the Big Piney Cemetery District, in the amount of $2,000 was approved and ordered filed with the County Treasurer.
Billy Pape, Assistant Road and Bridge Superintendent, reported on a possible purchase of land in Bondurant, open head gates, new snow melting products used on the Calpet Road, and snow plowing.
Mark Eatinger, representing Rio Verde Engineering, reported on meeting with Jerry Ridley, new owner of Falers, about the completion of Magnolia Street. The Board directed Eatinger to prepare the project for bidding.
Paul Scherbel reported to the Board that he had discussed the purchase of property from Marnie Ball that is adjacent to the Nichols property. The Board decided to review the possible purchase at their next meeting.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 08-10025C authorizing the Town of Marbleton to provide water and sewer services for the Nichols Annexation. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt W.S. 8-4-101 establishing the holidays for 2008. The following holidays were adopted: Monday, January 21, Martin Luther King, Jr. Birthday and Wyoming Equality Day; Monday, February 18, President’s Day; Monday, May 26, Memorial Day; Friday, July 4, Independence Day; Monday, September 1, Labor Day; Tuesday, November 11, Veteran’s Day; Thursday and Friday, November 27 & 28, Thanksgiving; Thursday and Friday, December 25 & 26, Christmas; and Thursday and Friday, January 1 & 2, 2009, New Year’s. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve and sign a lease with the Sublette County Historical Society for a parking area for 10 years for the amount of $160,000.00. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 08-10026C appointing a special prosecutor for James King. The motion carried.
In accordance with the public notice published in the Sublette Examiner on December 27, 2007, public hearing was held for a Business Ready Community Program Grant application for the purchase of property and construction of a manufacturing facility by Chopper Grassell, Callahgan Cabinets & Millworks. No objections were presented. Ray Sarcletti, Regional Director, Southwest Region, Wyoming Business Council, expressed his support for the application. Grassell reviewed the timeframe and expressed his interest in negotiating a lease agreement with the County.

Sue Holz, representing Proactive Rehabilitation, reported on facility usage over the past six months. Instead of the County paying a flat rate of $810 per month, it was moved by Commissioner Linn and seconded by Commissioner Bousman to agree to pay $30 per participant per month for the next six months, with Proactive providing the monthly billing. The motion carried.
Cat Urbigkit discussed her proposal to prepare a Public Land Policy for Sublette County.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve and sign a Memorandum of Understanding for Sublette County Employee Health Care Claims and Expenses. The motion carried.
Randy Johnson and Wil Gay, representing the Rural Health Care District, discussed the design-build proposal from Chambers Design-Build, Inc. for the Marbleton Ambulance Barn. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the proposal. The motion carried.
Rick Johnson, Kristel Blair, and Bob McCarty, representing the Class II Road Committee, discussed the committee’s procedures and availability of applications and assistance with applications. Applications will be available at the Planning and Zoning Office. It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve funding for Second North Road in the amount of $152,060. The motion carried.
Blair discussed the use of funds held by the Meadow Canyon Service and Improvement District.
Rick Hoffman, Waste Management Superintendent, discussed rates for commercial haulers and will present more information at the next meeting.
Sue Eversull requested that the Board install a generator at Rendezvous Pointe to support the kitchen.
Chief Justice Barton Voigt, representing the Wyoming Supreme Court, discussed the placement of a full-time District Judge in Pinedale. Facilities were discussed and determined to be adequate. Rep. Monte Olsen informed the Board that he will sponsor the legislation for the additional positions. It was moved by Commissioner Bousman and seconded by Commissioner Linn to authorize the Chairman to sign a letter of support for the legislation. The motion carried.

PUBLIC NOTICE
The Sublette County Planning & Zoning Commission will meet on Thursday, February 21, 2008 at 6:30 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
1. Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; Liz Sullivan proposes the following amendment to the text of the Sublette County Zoning and Development Regulations: An amendment to add an additional use category in the General Commercial, Highway Commercial, Rural Mixed and Light Industrial zoning districts to allow modular/manufactured home sales and show lots as an authorized use.
2. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by John Sulenta. The application proposes a change of zoning district boundary for a 44.79 acre parcel from Agricultural to Light Industrial in order to divide the parcel into a 16 lot industrial subdivision. The Sulenta property subject to the application for a Change of Zoning District Boundary is located in the north Section 25, Township 33N, Range 109W; generally described as being on the north side of U.S. Highway 191, approximately 1 mile southeast of the intersection of South Bench County Road 23-109 and U.S. Highway 191, across from the Pinedale Airport.
3. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration and Conditional Use pursuant to Chapter V of the Sublette County Zoning and Development Regulations, entitled Conditional Uses, by the Calpet LLC. The application proposes a change of zoning district boundary for a 239 acre parcel from Agricultural to Light Industrial in order to develop an oil and gas production waste facility on a portion of the parcel as a Conditional Use. The parcel subject to the proposed Change of Zoning District Boundary and Conditional Use is located in Section 21, Township 28N, Range 113W; generally described as being located on the east side of Big Piney Calpet County Road 23-134 approximately 15 miles southwest of the intersection of Big Piney Calpet Road and U.S. Highway 189.
4. Request for Conditional Use approval for a gravel pit and temporary camp, pursuant to Chapter V of the Sublette County Zoning and Development Regulations, entitled Conditional Uses, by McMurry Ready Mix Co. The application is for extraction, crushing, screening, and storage of gravel on a 10 acre parcel in the Agricultural zoning district. The request for a workers camp will allow employees to stay onsite during some operations. The parcel subject to the proposed Conditional Use is owned by the EastFork Livestock, Inc. and is located in the SE 1/4, SE ¼, of Sec. 6, R106W, T31N ; generally described as 0.93 miles south on Highway 353 from Pocket Creek County Road 23-127 intersection to a dirt road leading west to an existing gravel pit approximately 0.6 miles.

JAMES H. GARRETT, DECEASED
NOTICE OF PETITION FOR A DECREE OF DISTRIBUTION
FOR TITLE OF REAL PROPERTY
Madelyn Garrett also known as Madelyn D. Garrett, Petitioner, hereby gives notice that she has filed in the District Court, Ninth Judicial District, Sublette County, Wyoming, a Petition requesting entry of an Order to set over distribution of title to Madelyn Garrett also known as Madelyn D. Garrett, all of the Decedent’s full right, title, and interest in all oil, gas, and other minerals in, under and upon the following described real property:
Township 27 North, Range 113 West of the 6th P.M., Section 28: E ½ NE ¼ and E ½ SE ¼, Section 33: NE ¼ NE ¼, Sublette County, Wyoming, subject to any and all valid easements, restrictions, and reservations of record.
Any persons objecting thereto must file a claim within thirty (30) days so objecting; otherwise after publication twice this matter will be brought on before the District Court for Hearing at a time as soon as possible soon thereafter to enter an Order setting over all right title and interest in all oil, gas, and other minerals in, under and upon the aforementioned described real property to Madelyn Garrett also known as Madelyn D. Garrett, as named in said Petition.
