The following matters will come before this Commission on TUESDAY, DECEMBER 11, 2007, at 9:00 A.M., or as soon thereafter as the matters may be heard, or between the hours of 8:00 A.M. and 5:00 P.M. on any of the subsequent days during which the Commission remains in session at the office of the State Oil and Gas Supervisor, 2211 King Boulevard, Casper, Wyoming.

Cause No. 1, Order No. 2, DOCKET NO. 476-2007, brought on the application of Whiting Oil and Gas Corporation for an order establishing approximate 160-acre drilling and spacing units for the Baxter and Frontier Formations underlying all of Sections 22, 23 and 27, Township 28 North, Range 112 West, 6th P.M. ; authorizing up to four (4) wells to be drilled to the Baxter and Frontier Formations within each of these approximate 160-acre drilling and spacing units; and allowing commingling of production from the Baxter and Frontier Formations as to wells drilled on these spacing units; all in Sublette County, Wyoming.

Cause No. 3, Order No. 1, DOCKET NO. 528-2007, brought on the application of Ultra Resources, Inc. for an order authorizing a pilot project to increase density to thirty-two (32) wells per quarter section, for the Lance Pool as defined in Docket No. 136-2003 for the SE1/4 of Section 5, the NW1/4 of Section 9 and the NW1/4, NE1/4 of Section 10, Township 30 North, Range 108 West, 6th P.M., with the authorized bottom hole location of each well to be anywhere within the quarter section but no closer than 100 feet from the boundary of any quarter section in this application and after notice, authorizing the directional drilling of the additional wells; all in the Pinedale Anticline Field area, Sublette County, Wyoming.

Any interested party is entitled to appear at the aforesaid time and place to be heard by the Commission. The applications may be inspected in the office of the undersigned, 2211 King Boulevard, Casper, Wyoming, or on the Oil & Gas Commission website at http://wogcc.state.wy.us. If there are any protests, please make such known to the State Oil and Gas Supervisor at least three (3) working days before the hearing by filing a written objection.

THEREFORE.

WHEREAS, all the owners of the real estate described herein have either signed and filed with the Town a petition requesting annexation and zoning of said real estate or previously consented thereto by acceptance of deed restrictions and/or Covenants, Conditions and Restrictions which requires such annexation; and WHEREAS, after notice and hearing as required by law, the Town Council has, by resolution duly adopted on 10/8/07, found and certified that the conditions required by W.S. AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING AMENDING CHAPTER 17.06, SECTION 17.06.330 TO CHANGE THE DEFINITION OF “MOTEL.”

NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT CHAPTER 17.06, SECTION 17.06.330 OF THE PINEDALE MUNICIPAL CODE IS HEREBY AMENDED READ AS FOLLOWS:

17.06.330 Motel. “Motel” means a building or series of buildings in which lodging is offered for compensation and which is distinguished from a hotel primarily by a reason of providing direct independent access to an adjoining parking for each rental unit. Dwelling units located within the building or series of buildings shall have consistent use as a Motel where lodging is offered for compensation of weekly, daily or hourly rental dwelling units. Motel shall have on site housekeeping services, front desk management services and custodial services for the sole purpose of servicing those guests paying for said lodging.

17.06.245 Hotel. “Hotel” means a building, with or without individual kitchen facilities, occupied by transient guests who are lodged with or without meals, the rooms of which have primary access from interior public halls, and, in which building or portion thereof, there are or may be certain public rooms or halls for the service of food and drink, with or without entertainment, and other facilities intended to provide customary accessory conveniences or services normally incidental to and associated with such a use. Dwelling units located within the Hotel shall have consistent use as a Hotel where lodging is offered for compensation of weekly, daily or hourly rental dwelling units. Hotel shall have on site housekeeping services, front desk management services and custodial services for the sole purpose of servicing those guests paying for said lodging.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS

NOVEMBER 6, 2007

The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, and Mary Lankford, County Clerk present.

Chairman Cramer led those present in the Pledge of Allegiance.

The minutes of the preceding regular meeting of October 16, 2007, were approved and ordered filed on motion by Commissioner Bousman and seconded by Commissioner Linn. The motion carried.

The official bonds for Dave Racich, Treasurer for the Rural Health Care District, in the amount of $5,000; Greg Ptasnik, Treasurer for the Lodging Tax Joint Powers Board, in the amount of $5,000; and Robert C. Hallam, Treasurer for the Pinedale Airport Board, in the amount of $2,500, were approved and ordered filed with the County Treasurer.

Butch Penton, Road and Bridge Superintendent, reported on gravel, cattleguards, wetland mitigation, seeding, and the purchase of a conveyor. Penton and Mark Eatinger, representing Rio Verde Engineering, discussed the Bain Pit variance, East Green River Road, Industrial Site Road construction, Guio Road design, Calpet Road design, Middle Piney Road survey, Ehman Lane, and Reardon Draw.

Commissioner Linn discussed requesting that the speed limit on State Highway 351 be reduced to 55 or 50 miles per hour.

Jeffrey Jacquet discussed the ERG draft report and its executive summary. Jacquet reported on the Public Service Commission Meeting concerning rate increases for Rocky Mountain Power. It was moved by Commissioner Bousman and seconded by Commissioner Linn to authorize the Chairman to sign a request to the BLM for data. The motion carried.

Cat Urbigkit and Sue Sommers reviewed the draft State of the County report. Distribution of the report was discussed.

It was moved by Commissioner Bousman and seconded by Commissioner Linn to extend the Teton County Landfill Agreement for an additional 30 days at the current rate of $18.50 per ton, with any future extensions to be at an increased rate. The motion carried.

Rick Hoffman, Waste Management Superintendent, Frank Grimes and Phil Gyr, representing Nelson Engineering, discussed the State groundwater monitoring program and the requirement for monitoring wells to be drilled at the old landfill sites in Sublette County. Four sites had 3-5 wells drilled per site. Reporting will being completed and application for the State reimbursement will be made within the next month.

The Board approved the development of a Request for Proposal for quarterly well monitoring by Nelson Engineering. Burial of pit liners was discussed.

It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve and sign a lease for additional parking area with the Sublette County Historical Society, north of the Museum of the Mountain Man. The motion carried.

The following petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Ultra Resources, Inc., $20,603.22; McMurry Oil Company, $158,411.38; Encana Oil & Gas (USA) Inc., $3,209.32; Yates Petroleum Corporation, $1,781.70; Questar Exploration & Production Company, $15,165.45; Williams Production Rocky Company, $2,240.44; Pride Energy Company, $762.02; Wexpro Company, $60.59; Michael & Pamela Olson, $155.84; Rio Verde Engineering, $465.73; Kathryn Splane Spencer, $147.99; Stallion Rockies, Ltd., $101.77; Sharon Leigh Harrell, $50.71; David Polito & Emily Herman, $57.69; Christopher McGhee, $65.92; and BP America Production Company, $7,594.47.

It was moved by Commissioner Bousman and seconded by Commissioner Linn to declare December 31st a County holiday and move the first January meeting to Thursday, January 3, 2008. The motion carried.

The Board discussed the proposed Veterans Services Memorandum of Understanding and reviewed additional budget information. The Board took no action on the MOU and will schedule a future meeting with Larry Barrtelbort of the State Veterans Services Commission.

Rick Johnson, Kristel Blair, and Bob McCarty, members of the Class II Road Committee, discussed moving Meadowlark Lane into the road easement. The Board directed Aaron Seehafer of Rio Verde Engineering to determine the cost of moving the road. Johnson informed the Board that the utilities were not in the easement and discussed the cost of their movement.

It was moved by Commissioner Linn and seconded by Commissioner Bousman to establish First West Road and First North Road as Class II Roads and approve the requested funding. The motion carried.

It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve road inspection for Hoback Ranches. The motion carried.

Paul Jensen, Bill Collins and Sara Carroll, representing Collins Planning Associates, presented a senior housing feasibility analysis.

Chairman Cramer appointed Lynda Vickrey and Betty Fear to co-chair the Fairgrounds Master Plan Committee.

Randy Bolgiano, representing the Upper Green River Joint Powers Water Board, reported the on Boulter Lake project completion, enlargement of Viva Naughton, and the Green River Storage Study.

Kenda Tanner requested additional funding to complete three soccer fields in Big Piney. The Board advised Tanner that all funds were committed to other projects.

Ron Gordon represented a proposal for removal of dead animals from County roads. The Board requested a written proposal.

Gordon suggested to the Board to consider suggesting to the industrial companies to change their work shifts from 6 a.m. to 6 p.m. to noon to midnight for safety issues.

It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for an Executive Session with Bart Myers, County Planner, to discuss possible litigation. The motion carried.

TOWN OF PINEDALE

The Town Council of the Town of Pinedale met in regular session Monday October 22, 2007, at 5:30 p.m., in the Town Hall. Those present: John LaBuda, representing Summit Partners, LLC; Julie Early, Animal Control Officer; Steve Pfisterer, representing Stockman’s Restaurant and Bar; Jim Washam, representing the V.F.W.; Jeff Jacquet and Laurie Latta, representing the Sublette Community Partnership; Chris Nelson, representing Rocky Mountain Power; Ron Hanson and Randy Hubbard, representing the Public Works Department; Mike Irwin, representing Vista Properties, LLC; Linda Baker, representing Upper Green River Valley Coalition; Dennis Fornstrom, Aaron Seehafer and Mark Eatinger, representing Rio Verde Engineering; Meghan Jacquet, Planning and Zoning Administrator; Eugene Ninnie, Town Engineer; Ed Wood, Town Attorney; Jim Parker, Airport Manager; Ruth Neely, Municipal Judge; Lauren McKeever, Mayor’s Assistant; and Alecia Warren, representing the Pinedale Roundup.

Mayor Smith called the meeting to order. Present on Roll Call: Gary Heuck, Stephen Smith, David Hohl, Nylla Kunard and Chris House.

Motion by Heuck to approve the minutes of the October 8th meeting as written. Motion seconded. Motion carried unanimously.

Sublette County Sheriff’s Office not present at scheduled at time.

Julie Early, Animal Control Officer, reported the monthly activities of the animal control department.

Randy Hubbard, representing the Public Works Department, reported the monthly activities of the public works department. After discussion motion by Heuck to allow the Public Works Department to order magnesium hydroxide for the wastewater treatment facility not to exceed $5,000.00. Motion seconded. Motion carried unanimously.

Eugene Ninnie, Town Engineer, reported the month activities of the engineering department. After discussion motion by Hohl to approve $80,000.00 to fund an impact fee study and request a contract for services with TishclerBise, Inc.. Motion seconded. Motion carried unanimously. After discussion motion by Kunard to sign a request for design-build contract with McKinstry Service to provide the necessary service for the town garage. Motion seconded. Hohl voted aye, Kunard voted aye, House voted aye and Heuck voted nay. Motion carried.

After discussion motion by House to release Vista, LLC’s Irrevocable Letter of Credit, for installation of utility infrastructure, in the amount of $102,600.00. Motion seconded. Motion carried unanimously.

Meghan Jacquet, Planning and Zoning Administrator, reported the monthly activities of the planning and zoning department.

Lauren McKeever, Mayor’s Assistant, reported her monthly activities.

Jim Parker, Airport Manager, reported the monthly activities of the airport and presented the September Treasurer’s Report.

Ruth Neely, Municipal Court Judge, reported the monthly activities of the municipal court.

Chris Nelson, representing Rocky Mountain Power, discussed the $100.00 permit fee and $2,500.00 security bond or letter of credit for the Application for Excavation within the town streets and alleys. After lengthy discussion motion by Heuck to waive the dig fee and require a permanent bond of $2,500.00 as soon as possible. Motion seconded. Motion carried unanimously.

Laurie Latta and Jeffrey Jacquet, representing the Sublette Community Partnership, gave an update of their activities and the goals they have adopted for the Sublette Community Partnership 2007-2008 year.

The Public Hearing for the Split Diamond Meadows Subdivision Annexation was opened for discussion. Motion by Heuck to approve Resolution 2007-22, finding compliance with Wyo State §15-1-401 in the matter of the Annexation Petition of Split Diamond Development, Inc.. Motion seconded. Motion carried unanimously. Motion by Heuck to approve Ordinance 428, an Ordinance annexing adjacent and contiguous land (Split Diamond Development, Inc.) to the Town of Pinedale, Wyoming, and establishing zoning therefor, on the first reading. Motion seconded. Motion carried unanimously.

John LaBuda, representing Summit Partners, LLC, discussed the town sharing the cost of the valley pan on the north side of the building located at 219 East Pine Street. After discussion motion by Heuck to approve sharing the cost of the valley pan on the north side of the building not to exceed $4,8787.00. Motion seconded. Motion carried unanimously. LaBuda discussed an encroachment of an overhang on the north side of the building. Council directed Labuda to the Planning and Zoning Board.

Jim Washam, representing the Wyoming Veteran’s Commission and the local V.F.W., gave an update on the proposed Pinedale Veterans’ Project to be located in the American Legion Park. Washam informed the Council the Commissioners had paid the required 1/3 down on the project and would be billing the Town for their portion.

Linda Baker, representing the Upper Green River Valley Coalition, discussed her concerns with the Master Land Use Plan.

After discussion motion by Heuck to approve Ordinance 424, an ordinance of the Town of Pinedale, Wyoming amending Title of the Pinedale Municipal Code, Master Land Use Plan, on the third reading. Motion seconded. Motion carried unanimously. Motion by House to approve Ordinance 425, an ordinance of the Town of Pinedale amending Section 17.14.020 to provide that the length of terms of the members of the Planing and Zoning Commission may be adjusted by the Town Council by Resolution or at the time of appointment, on the third reading. Motion seconded. Motion carried unanimously.

Motion by Heuck to approve Resolution 2007-23, a resolution adjusting the terms of the members of the Planning and Zoning Commission Members to provide for a uniform appointment and termination date. Motion seconded. Motion carried unanimously.

Motion by Kunard to approve Ordinance 426, an ordinance of the Town of Pinedale, Wyoming creating Section 10.24.100 to prohibit private signs which attempt to control parking on public streets, on the third reading. Motion seconded. Motion carried unanimously.

Motion by House to approve Ordinance 427, an ordinance of the Town of Pinedale, Wyoming amending Chapter 17.67, Section 17.67.010, of the Pinedale Municipal Code regarding the building and development standards for condominium developments, on the second reading. Motion seconded. Motion carried unanimously.

Motion by Heuck to approve Ordinance 429, an ordinance of the Town of Pinedale, Wyoming amending Chapter 17.65, Section 17.65.040 by adding a restriction that any building having an unit used as an apartment must not have any units in said building used for hotel or motel uses, on the first reading. Motion seconded. Motion carried unanimously.

Motion by Hohl to approve Ordinance 430, an ordinance of the Town of Pinedale, Wyoming amending Chapter 17.06, Section 17.06.330 to change the definition of “Motel”, on the first reading. Motion seconded. Motion carried unanimously.

Motion by Kunard to approve Ordinance 431, an ordinance of the Town of Pinedale, Wyoming amending Chapter 17.06, to create Section 17.06.245 to create a definition of “Hotel”, on the first reading. Motion seconded. Motion carried unanimously.
