The Town Council of the Town of Pinedale met in regular session Monday, September 10, 2007, at 5:30 p. m., in the Town Hall. Those present: Mary Ann Menster, representing Split Diamond Development, Inc.; Marti Seipp, representing Sublette Citizens for Recycling; Sally Mackey; Ed Wood, Town Attorney; Brian Gray, representing Worthington, Lenhart and Carpenter; L. Carson Bise II, representing TischlerBise, Inc. Meghan Jacquet, Planning and Zoning Administrator; Rachelle Ricotta; Randy Hubbard, representing Public Works; Eugene Ninnie, Town Attorney; Chris Land, Julie Land and Susan Kramer, representing Happy Endings Animal Rescue; Kelly Frink, representing Sweetwater County United Way; Mark Eatinger, representing Rio Verde Engineering; Steven Pfisterer; Mike Fitzgerald and Jennie Oemig, representing the Pinedale Roundup; and Tiffany Turner, representing the Sublette Examiner.
Mayor Smith brought the meeting to order. Present on Roll Call: Gary Heuck, David Hohl, Stephen Smith, Nylla Kunard and Chris House.
Motion by House to approve the minutes of the August 28th meeting as amended. Motion seconded. Motion carried unanimously.
Kelly Frink, representing Sweetwater County United Way, presented a proclamation for United Way Week. Motion Heuck to have the Mayor sign the proclamation for United Way Week, September 17 through September 21, 2007. Motion seconded. Motion carried unanimously.
Julie Land, representing Happy Endings Animal Rescue, gave an update on the proposed companion animal rescue and adoption center.
Mary Ann Menster, representing Split Diamond Development, Inc., presented the Petition for Annexation to the Town of Pinedale of the property contained within Split Diamond Meadows Subdivision. Meghan Jacquet, Planing and Zoning Administrator, reported the Board had unanimously recommended the approval of the Petition for Annexation for Split Diamond Meadows Subdivision. Motion by Hohl to approve Resolution 2007-19, finding substantial compliance with Chapter 16.52 (Annexation) of the Ordinance of the Town of Pinedale in the matter of the Petition for Annexation of Split Diamond Development, Inc.. Motion seconded Motion carried unanimously.
L. Carson Bise II, representing TischlerBise, Inc., reviewed the results of the impact fee feasibility study. Bise discussed the findings and recommendations from their evaluation.
Brian Gray, representing Worthington, Lenhart and Carpenter, presented Sublette County Recreation Board’s proposed pathway and requested permission to use the town’s easement on Valley Road to Willow Lake Road. Council supported the use of the easement. Marti Seipp, representing Sublette Citizens for Recycling, presented an invitation to the Council for the christening of the new baler at the recycling center September 13, 2007.
Terry Swift, representing the Sublette County Chamber of Commerce, requested the Council waive the sign permit fee for the temporary sign to be placed at the Sublette County Visitor Center. Motion by Hohl to approve the waiver of the fee for the temporary sign at the Sublette County Visitor Center. Motion seconded. Motion carried unanimously.
Motion by Kunard to approve Ordinance 422, an Ordinance of the Town of Pinedale, Wyoming, amending Chapter 6.04, Sub-Section 6.04.010 (B), of the Pinedale Municipal Code by modifying the definition of “restraint, on the first reading. Motion seconded. Motion carried unanimously.
Motion by Heuck to approve Ordinance 423, an Ordinance of the Town of Pinedale. Wyoming amending Chapter 6.04, Section 6.04.210, of the Pinedale Municipal Code by adding an enhanced penalty provision for nuisance dogs, on the first reading. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve Resolution 2007-20, a resolution approving and authorizing the execution of that certain pathway agreement between the Sublette County Recreation Board, WYBAL, LLC and the Town of Pinedale. Motion seconded. Motion carried unanimously.
Motion by Heuck to appoint John Fogerty to the Pinedale Planning and Zoning Board to fill the unexpired term of Mr. Brito. Motion seconded. Motion carried unanimously.
Motion by Heuck to appoint Susan Kramer to the Sublette Citizens for Recycling Board. Motion seconded. Motion carried unanimously. Ed Wood, Town Attorney, and Brian Gray, representing Worthington, Lenhart and Carpenter, presented the cost estimate of $195,701.00 for the relocation of 14 campsites on the south side of the existing Pinedale Campground to provide right of way to the Town for Washington Street. Council agreed to take it under advisement.
Randy Hubbard, representing Public Works, presented the bid for the Caterpillar IT 14G Loader: Wyoming Machinery, $167,747.00. Council discussed getting more than one bid, especially with such expensive purchases. Motion by Heuck to approve the purchase of the Cat IT-14G from Wyoming machinery Company in the amount of $167,747.00. Motion seconded. Motion carried unanimously.
After discussion motion by Kunard to have the Public Hearing for the Annexation of the Split Diamond Meadows Subdivision on October 22, 2007. Motion seconded. Motion carried unanimously.
Motion by Heuck to approve the purchase of sodium silicate for the water system and enzymes for the waste water system not to exceed $15,000.00. Motion seconded. Motion carried unanimously.
Rachelle Ricotta gave an update on the Master Plan revision.

INVITATION FOR BIDS
CR 23-123 ROAD PROJECT
for
SUBLETTE COUNTY, WYOMING
Sealed BIDS are requested for work described in the project manual for the above named project prepared by Rio Verde Engineering, 201 West Pine Street, P.O. Box 642, Pinedale, Wyoming 82941.
Bids will be received by Rio Verde Engineering, until 3:00 PMlocal time on October 12, 2007, at which time said BIDS will be publicly opened and read aloud.
This project consists of excavating and placing 164,000 cubic yards of compacted fill, 19,000 tons of crushed base, 11,050 tons of asphalt, 16,000 cubic yards of pitrun, and 31,300 cubic yards of topsoil removal for 2.5 miles of new road construction for County Road 23-123 (Pinedale South Road).
A mandatory pre-bid meeting will be conducted at 1:00 P.M. local time on Thursday, October 4, 2007, at which time an on site inspection of the proposed work will be conducted and special considerations will be discussed.The meeting will be held at the office of Rio Verde Engineering.All prospective BIDDERS must attend this meeting.
Copies of the Project Manual and the Design Drawings specifying the work to be performed may be obtained from Rio Verde Engineering.
BIDDERS shall be required to accompany each bid with a BID Bond with sufficient surety, or a certified check, cashier’s check or bank draft upon some reputable bank payable to Sublette County for at least 10 percent of the total amount of the BID.The bond, check or bank draft shall be forfeited as liquidated damages, if the BIDDER, upon the letting of the contract to him, fails to enter into the contract within 7 days after it is presented to him for that purpose or fails to proceed with the performance of the contract.The Bid Bond, draft or check shall be retained by Sublette County until proper bond to secure performance of the contract has been filed and approved.All the above to be in accordance with 15-1-113, Wyoming Statutes, 2007.
The right is reserved by Sublette County to reject any and all BIDS, and to waive any irregularity or informality in the bidding.BIDS may not be withdrawn for thirty days after the date of opening.

PROPOSED ANNEXATION REPORT
SPLIT DIAMOND MEADOWS SUBDIVISION ANNEXATION
In accordance with W.S. 15-402, the following is reported:
1. A map of the area of the proposed Split Diamond Meadows Subdivision Annexation to the Town of Pinedale, Sublette County, Wyoming is attached.
2. The total estimated cost of infrastructure improvements required of all landowners by the annexing municipality:There are no costs required of the landowners as a result of the annexation.Infrastructure improvements have been made within the annexed area.
3. A list of basic and other services customarily available to residents of the Town of Pinedale and a timetable when these services will reasonable be available to the area proposed to be annexed is as follows:Customary services - Water, Sewer, Street maintenance and Police protection.Timetable Ð Water, Sewer and Street Maintenance services will be available in the annexed upon final annexation.Police protection will be extended to the proposed annexed area upon final annexation.
4. The projected annual fee or service cost for services described in Paragraph 3 above is:
Water Ð Residential Hookup Fee - $2,000.00
Minimum Annual Service Fee $236.20
Sewer - Water Ð Residential Hookup Fee - $2,000.00
Minimum Annual Service Fee $133.60
5. The current and project property tax mill levies imposed by the Town of Pinedale:.
