A public hearing on Monday, October 22, 2007, at 5:30 p.m. at the Town Hall of the Town of Pinedale in accordance of the W.S. 15-1-405. This notice includes a copy of the proposed Annexation Report required by W.S. 15-1-402 (c) as follows:
September 20 and September 27.
PROPOSED ANNEXATION REPORT
SPLIT DIAMOND MEADOWS SUBDIVISION ANNEXATION
In accordance with W.S. 15-402, the following is reported:
1. A map of the area of the proposed Split Diamond Meadows Subdivision Annexation to the Town of Pinedale, Sublette County, Wyoming is attached.
2. The total estimated cost of infrastructure improvements required of all landowners by the annexing municipality: There are no costs required of the landowners as a result of the annexation. Infrastructure improvements have been made within the annexed area.
3. A list of basic and other services customarily available to residents of the Town of Pinedale and a timetable when these services will reasonable be available to the area proposed to be annexed is as follows: Customary services - Water, Sewer, Street maintenance and Police protection. Timetable Ð Water, Sewer and Street Maintenance services will be available in the annexed upon final annexation. Police protection will be extended to the proposed annexed area upon final annexation.
4. The projected annual fee or service cost for services described in Paragraph 3 above is:
Water Ð Residential Hookup Fee - $2,000.00
Minimum Annual Service Fee $236.20
Sewer - Water Ð Residential Hookup Fee - $2,000.00
Minimum Annual Service Fee $133.60
5. The current and project property tax mill levies imposed by the Town of Pinedale:.
Mill Levy Ð 8 (statutory maximum)
6. The cost of the infrastructure improvements required within the existing boundaries of the Town of Pinedale to accommodate the proposed annexation: There are no additional infrastructure improvement required within the Town of Pinedale to serve the annexed area.

NOTICE IS HEREBY PUBLISHED that the Town of Marbleton has accepted as completed all work on the Marbleton Streets Phase 1 - according to the plans, specifications and rules set forth between the Town of Marbleton and Concrete Works of Colorado and the Contractor is entitled to settlement thereof.
Final payment will be made after the completion of publication of this Notice. The date of final settlement is September 26, 2007.

The Town Council of the Town of Pinedale met in regular session Monday, August 27, 2007, at 5:30 p.m. in the Town Hall. Those present: Jim Parker, Airport Manager; Dan Ballou, representing Pinedale Online; Jamison Ziegler; Ron Hanson, representing Public Works; Julie Early, Animal Control Officer; Betty Hunt; Robert Brito; Barbara Boyce; Paul and Tina Rock; Bardy Bardin and Jim Whinnery, representing the Sublette County Sheriff's Office; Anne Joseph; Lauren McKeever, Mayor's Assistant; Ruth Neely, Municipal Judge; Ed Wood, Town Attorney; Mike Irwin; Tim McKinney; John Sulenta; Wes Sargent; Mary Ann Menster, representing Split Diamond Development, Inc.; Eugene Ninnie, Town Engineer; Linda Poulson; Bob Rule, representing KPIN; Mike Fitzgerald and Jeannie Oemig, representing the Pinedale Roundup; and Tiffany Turner, representing the Sublette Examiner. Mayor Smith brought the meeting to order. Present on Roll Call: Gary Heuck, David Hohl, Stephen Smith, Nylla Kunard and Chris House. Motion by Hohl to approve the minutes of the August 13th meeting as written. Motion seconded. Motion carried unanimously. Bardy Bardin and Jim Whinnery, representing the Sublette County Sheriffs Office, reported the monthly activities of the sheriff's office. After discussion Council agreed to write a letter of support for a helicopter to be used for law enforcement, search and rescue efforts in conjunction with Fremont, Teton, Park and Sublette Counties. Julie Early, Animal Control Officer, reported the monthly activities of the animal control department. Ron Hanson, representing the Public Works Department, reported the monthly activities of the public works departments. Hanson presented the bid for the truck with a plow and sander unit: Mountain West Truck Center, $94,301.00. Motion by Heuck to approve the bid from Mountain West Truck Center for the truck with a plow and sander unit not to exceed $94,301.00.
Motion seconded. Motion carried unanimously. Eugene Ninnie, Town Engineer, reported the monthly activities of the engineering department. Council agreed to have Ninnie write an RFP-FRQ for a town wide drainage study and investigate grant monies that can be used. Lauren McKeever, Mayor's Assistant, reported her monthly activities. After discussion motion by Kunard to have the Mayor sign the Memorandum of Understanding regarding the Pinedale Resource Management Plan between the Town of Pinedale and the Bureau of Land Management concerning our cooperating agency status. Motion seconded. Motion carried unanimously. Jim Parker, Pinedale Airport Manager, reported the monthly activities of the airport, presented the July Treasurer's Report and draft minutes of the August 22nd Airport Board Meeting. Motion by Hohl to approve the Assignment of Lease for Hangar Lot 1 from Don Chipp to Gary Wight term of expiration December 31, 2010. Motion seconded. Motion carried unanimously Ruth Neely, Municipal Court Judge, reported the monthly activities of the municipal court. Mary Ann Moline, representing Split Diamond Development, Inc., requested the homeowners in the Split Diamond Meadows be allowed to connect sewer and water at the town rate fees due to the delay in the annexation of the property. After discussion motion by Heuck to allow Split Diamond Meadows to connect to sewer and water at the town rate fees. Motion seconded. Motion carried unanimously. Robert Brito questioned if it was still the intent of the Mayor for his termination from the Planning and Zoning Board. Brito also discussed concerns with the Planning and Zoning Administrator, the Planning and Zoning Meetings and how issues are dealt with. Ed Wood, Town Attorney, stated in his opinion the Mayor has the right to terminate Mr. Brito. After discussion motion by Hohl to extend the one mile of the corporate limits for the town for the planning and zoning commission to residing within five miles. Motion seconded. Hohl voted aye, Kunard voted nay, House voted nay and Heuck voted nay. Motion failed. Anne Joseph, concerned citizen, discussed her concerns with ferial cats in town. Mayor Smith informed Joseph that the Animal Control Officer was aware and addressing the problem. Paul Rock asked if he and Barbara Boyce were still on the Planning and Zoning Board and asked why their terms ended. Mayor Smith stated the two board members terms had expired and to meet the town ordinances, the two board appointments needed to be updated. Motion by Kunard to approve the Contract for Services with the Sublette Ski Club in the amount of $750.00. Motion seconded. Motion carried unanimously. Motion by Kunard to approve the purchase of the copier not to exceed $20,000.00. Motion seconded. Motion carried unanimously. After discussion motion by Kunard to work with Jill E. Carter Consulting, LLC, not to exceed $8,600.00. Motion seconded. Motion carried unanimously. Motion by House to go into executive session to discuss personnel. Motion seconded. Motion carried unanimously. Motion by House to return to regular session. Motion seconded. Motion carried unanimously. Mayor Smith recommended the appointment of Barbara Boyce and Paul Rock to the Pinedale Planning and Zoning Board. Motion by Hohl to appoint Barbara Boyce to the Pinedale Planning and Zoning Board as of September 1, 2007 for a three year term. Motion seconded. Motion carried unanimously. Motion by Heuck to appoint Paul Rock to the Pinedale Planning and Zoning Board as of September 1, 2007, for a three year term. Motion seconded. Kunard voted aye, House voted aye and Hohl voted nay. Motion carried. Mayor Smith stated after considering the issue further he was dismissing Robert Brito from the Pinedale Planning and Zoning Board immediately and thanked him for his work on the board. Motion by Heuck to concur with the Mayor on the dismissal of Robert Brito from the Planning and Zoning Board. Motion seconded. Motion carried unanimously.

Cause No. 11, Order No. 1, DOCKET NO. 402-2007, brought on the Commission's own motion to ask Ultra Resources, Inc. to show cause as to why fines and penalties should not be levied for its failure to notify the Commission of its intent to spud, in derogation of Chapter 3, Section 22(c) of the Commission's Rules, the Stud Horse Butte 11D-23 well in Section 23, Township 29 North, Range 108 West, 6th P.M., Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 409-2007, brought on the application of Yates Petroleum Corporation for an order authorizing an exception location for the Blue Rim State #11 well to be located at surface 264 feet FNL and 1290 feet FEL, and bottom hole 60 feet FNL and 2360 feet FWL and drilled to the Lance Formation underlying Section 16, Township 30 North, Range 108 West, 6th P.M., Sublette County, Wyoming.
Any interested party is entitled to appear at the aforesaid time and place to be heard by the Commission. The applications may be inspected in the office of the undersigned, 2211 King Boulevard, Casper, Wyoming, or on the Oil & Gas Commission website at http://wogcc.state.wy.us. OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
SEPTEMBER 4, 2007
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of August 21, 2007, were approved and ordered filed on motion by Commissioner Bousman and seconded by Commissioner Linn. The motion carried.
Butch Penton, Road & Bridge Superintendent, Mark Eatinger, representing Rio Verde Engineering, and Paul Scherbel, representing Surveyor Scherbel, LTD, discussed paving projects, extension of Pinedale South County Road No. 23-123, and the proposed extension of Reardon Draw County Road No. 23-139. Commissioner Linn will arrange a meeting with the energy companies in October to discuss the Reardon Draw extension.
Andy O'Neal, Maintenance Superintendent, discussed underground power at Rendezvous Pointe.
Brad Waters, representing Providence Architecture, reviewed the building plans for the Facilities Maintenance Building, modifications to the Detention Center, and Master Plan update project.
The Board recessed the meeting and convened as the County Board of Equalization.
The Board reviewed the Irv Lozier property tax assessment protest for property located at 552 Willow Creek Road in T35N, R109W. It was moved by Commissioner Linn and seconded by Commissioner Bousman to reduce the value for the land to $9,000 per acre. The motion carried.
There being were no further protests, the County Board of Equalization adjourned.
Dave Bell and Betty Cheeney, representing the Recreation Board, reported that the Rec. Board is pursuing Route G of the pathway plan and that it has decided to dedicate the Pinedale Pathway to Naomi Pape, longtime member of the Recreation Board. The Board agreed with the dedication. Bell informed the Board that Pinedale will host the 2008 Senior Winter Games at White Pine Ski Area, and inquired about possible funding for the event. The Board requested an estimated cost. The Pinedale skateboard park was discussed.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting into Executive Session to discuss possible litigation with County Attorney Ralph Boynton. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to reconvene the meeting.
Bob Hanson, Emergency Management Coordinator, presented a draft evacuation plan. The Board requested corrections to the draft for consideration of adoption at the next meeting.
Robin Clover, SAFV Director, presented a proposal for modular housing for the Safe House project. The proposal was referred to the County Attorney.
The Class II Road Committee presented and recommended two grant applications for approval. It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve funding for the following:
1. Project 1 and 2, High Meadow Ranch, Barger Subdivision, $388.904.00
2. Monte Vista Road, $79,700.00
The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to establish First West Road, which provides access to Wassenberg Subdivision and Meadow Canyon Subdivision, as a Class II Road. The motion carried.
The Committee discussed a BLM easement situation presented to the Committee by Joe Sampson.
The Board informed the Class II Road Committee that all projects will be bid, and directed that bidding documents will be prepared by Rio Verde Engineering.
Sheriff Bardy Bardin and Undersheriff Jim Whinnery discussed the need for larger outdoor impound areas.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve a request from School District #1 for leave for Jim Malkowski on September 25, 26, 30, and 31, 2007, to attend the Wyoming High School Activities Association Director Meetings in Casper, and for Malkowski and ML Baxley on November 13, 14, 15, and 16, 2007, to attend the Wyoming School Board Association State Conference in Casper. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve and authorize the Chairman to sign the Contract for Sale for the purchase of property from Ron Chapin in Marbleton. The motion carried.
Eric Fairbanks discussed dust complaints at Sand Draw.
The Board discussed commenting on the proposed rate increase by Rocky Mountain Power.
It was moved by Commissioner Bousman and seconded by Chairman Cramer to purchase two pickups and one one-ton for Road and Bridge. The motion carried.
It was moved by Chairman Cramer and seconded by Commissioner Bousman to deny vouchers from Casey Baggett and Gerard Wiegand. The motion carried.

PUBLIC NOTICE
The regularly scheduled meeting of the Sublette County Board of Commissioners will be held on October 2, 2007 at 1:00 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
1. Request to remove from the table and schedule an application for Change of Zoning District Boundary by PDM Land Company for the November 6, 2007 Board of County Commissioners Meeting. The PDM application was tabled by the Board of County Commissioners at the regularly scheduled July 18, 2006 Sublette County Board of County Commissioners meeting. The application proposes a change of zoning district boundary for 60.5, acres more or less, from A-1 (Agricultural-35 acre minimum lot size) to RR (Rural Residential-2 net acre minimum lot size), in order to develop a fourteen (14) lot residential subdivision. The property is located in Section 2; Township 33N; Range 110W; generally described as 9809 US Highway 191, being located approximately 1 mile south of Pinedale on the south side of Fayette Pole Creek Road.
2. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by Pinedale Bible Church. The application proposes a change of zoning district boundary for an 11.07 acre parcel from Rural residential 10 (one dwelling unit per 10 acres allowed) to Highway Commercial. The parcel subject to the change of zoning application is currently being developed with the Pinedale Bible Church. The parcel subject to the application for a change of zoning district boundary is located in Section 6; Township 33N; Range 109W; generally described as 219 Industrial Site County Road 23- 190 and being on the south side of U.S. Highway 191 approximately 0.8 miles west of the Pinedale town boundary.
3. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by Paul Harber. The application proposes a change of zoning district boundary for 3.4 acres from Agricultural to Light Industrial in order to develop the parcel with uses allowed in the Light Industrial zoning district. The parcel subject to the application for a change of zoning district boundary is located in Section 26; Township 34N; Range 111W, generally described as 13133 U.S. Highway 189; being located immediately south of U.S. Highway 189-191 and between U.S. Highway 189-191 and Wyoming State Highway 354 in the Daniel Junction area.
4.Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by Harold Merritt. The application proposes a change of zoning district boundary for 29.2 acres from a 47.6 acre parcelfrom Agricultural (one dwelling unit per 35 acres allowed) to Rural Residential 20 (one dwelling unit per 20 acres allowed) in order to subdivide the 29.2 acres into a separate lot. The parcel subject to the application for a change of zoning district boundary is located in Section 31; Township 34N; Range 109W; generally described as being on the north side of U.S. Highway 191 and 1.3 miles west of the Pinedale town boundary.
5.Request for a Variance, pursuant to Chapter VI of the Sublette County Zoning and Development Regulations, entitled Variances, by Big Piney/Marbleton Airport to allow a 43 foot building height for a structure, where Sublette County Zoning and Development Regulations require a 35 foot maximum height in the I-L zoning district. The parcel is located in Sections 7, and 17-20 Township 30N, Range 111 W; generally described being approximately 1.3 miles north on Highway 189 from Marbleton.
6.Pursuant to Chapter IV Section 4 of the Sublette County Subdivision resolution; entitled Vacations/Modifications to Filed Plats, the applicant William Conley Jr. and Lucy Conley, are requesting approval to partially vacate and amend the plat associated with Sheet 7, Tract 27 and Sheet 7, Tract 16-3 of Hoback Ranches Subdivision; in order to reconfigure the shared property line between the existing tracts. The reconfigured lots will be described as Tract 29 and Tract 30 of The Conley Plat of Hoback Ranches Sheet 7; a Subdivision of: Tract 27 and Tract 16-3 of Sheet 7 of The Hoback Ranches Subdivision. The parcel(s) subject to the proposed vacation and amended plat are located in Section 1, Township 36N, Range 113W; generally described as 730 Rim Road and being located within the Hoback ranches Subdivision approximately 7 miles west of U.S. Highway 189-191.
7.Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by Philip Kos. The application proposes a change of zoning district boundary for a 6.3 acre parcel from Agricultural (one dwelling unit per 35 acres allowed) to Rural Residential (one dwelling unit per 2 net acres allowed) in order to divide the 6.3 acres into 2 lots. The parcel subject to the application ­­for change of zoning district boundary is located in Section 29; Township 38N; Range 113W; generally described as 14473 U.S. Highway 189/191, being in the Bondurant area and on the west side of Highway 189/191approximately 0.5 mile(s) south of the intersection of Dell Creek Road and Highway 189/191.

NOTICE OF ACCEPTANCE AND FINAL SETTLEMENT MARBLETON STREETS PHASE 1 TOWN OF MARBLETON
NOTICE IS HEREBY PUBLISHED that the Town of Marbleton has accepted as completed all work on the Marbleton Streets Phase 1 - according to the plans, specifications and rules set forth between the Town of Marbleton and Concrete Works of Colorado and the Contractor is entitled to settlement thereof.
Final payment will be made after the completion of publications of this Notice. The date of final settlement is September 26, 2007.
Any claim or claims for work or labor due, or for materials or supplies furnished, must accordingly be filed with Town of Marbleton, Wyoming prior to the above published date of settlement.
