PUBLIC NOTICE
The Sublette County Planning & Zoning Commission will meet on Thursday, July 19, 2007, at 7:00 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
1. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by CR #2 Family Limited Partnership. The application proposes a change of zoning district boundary for a 131.53 acre parcel from Agricultural (one dwelling unit per 35 acres allowed) to Rural Residential 10 Planned Unit Development (overall density of one dwelling unit per 10 acres allowed) in order to subdivide the 131.53 acres into 13 lots. The parcel subject to the application for a change of zoning district boundary is located in Section 33; Township 35N; Range 110W; generally described as being north of Sievers County Road 23-100 and west of State Highway 352.
2. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by Philip Kos. The application proposes a change of zoning district boundary for a 6.3 acre parcel from Agricultural (one dwelling unit per 35 acres allowed) to Rural Residential (one dwelling unit per 2 net acres allowed) in order to divide the 6.3 acres into 2 lots. The parcel subject to the application for change of zoning district boundary is located in Section 29; Township 38N; Range 113W; generally described as 14473 U.S. Highway 189/191, being in the Bondurant area and on the west side of Highway 189/191approximately 0.5 mile(s) south of the intersection of Dell Creek Road and Highway 189/191.
3. Request for Minor Subdivision approval, pursuant to Chapter VI of the Sublette County Subdivision Resolution, entitled Minor Subdivision; by AMD Holdings LLC. The application proposes a two lot subdivision for a 17.24 acre parcel, which is within the Mobile Home Park and Light Industrial zoning districts. In the proposed Minor Subdivision application Lot 1 is 13.56 in size and will encompass the existing Mobile Home Park zoning district; with Lot 2 being 3.71 acres in size and encompassing the existing Light Industrial zoning district. The parcel subject to the proposed Minor Subdivision is located in Section 7, Township 29N, Range 111W; generally described as the “Daniel Trailer Court” located at 10411 U.S. Highway 189, being in the Big Piney area and on the west side of Highway 189 approximately 0.1 mile(s) south of the intersection of South Piney Road and Highway 189.
4.Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; planning staff proposes the following amendment to the text of the Sublette County Zoning and Development Regulations (deletions to current text contained in the Regulations are shown with a strikethrough and any proposed new language to the text is highlighted).
Planning staff is proposing the following amendment to the text of the Sublette County Zoning and Development Regulations; allowing a lesser setback for parcels zoned A-1 which are nonconforming with respect to the 35 acre minimum lot size applicable in the A-1 zoning district.

Planning staff is proposing the following amendment to the text of the Sublette County Zoning and Development Regulations; establishing a minimum lot size in the Light and Heavy Industrial zoning districts.

Multiple businesses shall be permitted on lots in the Commercial (C-1), Highway Commercial (CH-1), Light Industrial (I-L) and Heavy Industrial (I-H) zoning districts provided all applicable development standards in the Resolution are met.
Accessory residential unit(s) to serve as employee housing shall be permitted in the Commercial (C-1), Highway Commercial (CH-1), Light Industrial (I-L) and Heavy Industrial (I-H) zoning districts. Accessory residential units shall serve as employee housing that is clearly incidental, subordinate and secondary to the primary commercial or industrial use of the property. Accessory residential units shall conform to all applicable development standards contained in this Resolution and no accessory residential unit may exceed eight hundred (800) square feet of habitable floor area.

ORDINANCE NO. 2007-418
AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING AMENDING SECTIONS 5.04.070 THROUGH 5.04.100 AND CREATING SECTION 5.04.110 OF THE PINEDALE MUNICIPAL CODE RELATING TO THE CONTROL OF ALCOHOL AND UNDER AGE PERSONS.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT SECTIONS 5.04.070 THROUGH 5.04.100 OF THE PINEDALE MUNICIPAL CODE ARE HEREBY AMENDED AND SECTION 5.04.110 IS HEREBY CREATED TO READ AS FOLLOWS:
5.04.070 Underage Persons; furnishing to. No person shall sell, furnish, give away or cause to be sold, furnished or given away any alcoholic or malt beverage to any person under the age of twenty-one (21) years who is not his legal ward, medical patient or member of his or her own immediate family. For purposes of this chapter, immediate family shall mean any parent-child, foster parent-child, or stepparent-child relationship.
5.04.080 Underage Persons; possession or consumption. No person under the age of twenty-one (21) years located within the corporate limits of the town of Pinedale shall consume or have in his or her possession any alcoholic or malt beverage. Evidence of consumption of any alcoholic or malt beverage by any person under the age of twenty-one (21) years shall be deemed prima facie evidence that such person is in unlawful possession of alcoholic or malt beverages. This section shall not apply to actual physical possession by a person making delivery pursuant to his or her employment, nor shall it apply to possession or consumption by underage individuals who are in the physical presence of their parent(s), stepparent(s), or legal guardian(s).
5.04.090 Underage Persons; using false identification. No person shall falsify any identification or use any false identification in order to obtain alcoholic or malt beverages. 5.04.100 Violations of Sections 5.04.060 or 5.04.080. Any person who violates any of the provisions of Sections 5.04.060 or 5.04.080, or aids, abets or incites any violation thereof is guilty of a misdemeanor and upon conviction shall be punished as provided in the general penalty section of Chapter 1.16 of this code.
5.04.110 Violations of Sections 5.04.070 or 5.04.090. Any person who violates any of the provisions of Sections 5.04.070 or 5.04.090, or aids, abets or incites any violation thereof is guilty of a misdemeanor and upon conviction shall be liable for a fine of not more than seven hundred fifty dollars, imprisonment of not more than six months or both, to which may be added costs as provided by law.
This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

PUBLIC NOTICE

1. Request for Conditional Use approval for gravel storage, pursuant to Chapter V of the Sublette County Zoning and Development Regulations, entitled Conditional Uses, by Enercrest. The application proposes storage of gravel on a 0.9 acre parcel in the Agricultural zoning district. The parcel subject to the proposed Conditional Use is owned by Alsade Limited and is located in the northeast ¼ of the northeast ¼ of the northeast ¼ of Section 30, Township 30N, Range 111W; generally described as the north end of Main Street in Marbleton.
2. Request for a Variance, pursuant to Chapter VI of the Sublette County Zoning and Development Regulations, entitled Variances, by Craig Scharf to allow a 35 foot setback for a structure, where Sublette County Zoning and Development Regulations require 50 feet in the A-1 zoning district. The parcel is located the northeast quarter of the northeast quarter of Section 22 and the northwest quarter of Section 23, Township 32N, Range 107 W; generally described as 831 State Highway 353 and being approximately 8.4 miles east on State Highway 353 from US Highway 191.
3. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by Harold Merritt. The application proposes a change of zoning district boundary for 29.2 acres from a 47.6 acre parcel from Agricultural (one dwelling unit per 35 acres allowed) to Rural Residential 20 (one dwelling unit per 20 acres allowed) in order to subdivide the 29.2 acres into a separate lot. The parcel subject to the application for a change of zoning district boundary is located in Section 31; Township 34N; Range 109W; generally described as being on the north side of U.S. Highway 191 and 1.3 miles west of the Pinedale town boundary.
4. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by Paul Harber. The application proposes a change of zoning district boundary for 3.4 acres from Agricultural to Light Industrial in order to develop the parcel with uses allowed in the Light Industrial zoning district. The parcel subject to the application for a change of zoning district boundary is located in Section 26; Township 34N; Range 111W, generally described as 13133 U.S. Highway 189; being located immediately south of U.S. Highway 189-191 and between U.S. Highway 189-191 and Wyoming State Highway 354 in the Daniel Junction area.

AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING AMENDING SECTION 6.05.060, RELATING TO UNCLAIMED, INFECTED OR DANGEROUS CATS WITHIN THE TOWN OF PINEDALE.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT OF SECTION 6.05.060, CHAPTER 6.05 OF THE PINEDALE MUNICIPAL CODE IS HEREBY CREATED TO READ AS FOLLOWS.
6.05.060 Unclaimed, infected or dangerous cats. It shall be the duty of the animal control officer to keep all cats which have been impounded for a period of not less than five (5) calendar days, if not sooner claimed by the owner. If, at the expiration of said time frame, the animal has not been claimed, it may be destroyed, and the charges incurred in such destruction, together with impoundment fees as provided by Section 6.05.050 of this chapter, shall be assessed to the owner of the animal and collected along with any fines imposed pursuant to Section 6.05.100 of this chapter. Any animal which appears to be suffering from rabies, mange, feline leukemia, distemper, or other infectious or dangerous disease shall not be released, but may be destroyed immediately. Any animal of a vicious or dangerous nature that cannot be safely confined without danger to the animal control officer may be destroyed prior to the end of the normal impoundment period.

NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT SECTION 2.08.050 IS HEREBY AMENDED TO READ AS FOLLOWS:
2.08.050 Council person’s salary. Those individuals assuming the office of council person on or after June 1, 2008 shall thereafter receive the sum of $150.00 per regular or special council meeting, effective with the commencement of the 2008-2009 fiscal year beginning on July 1, 2008.

NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT SECTION 2.04.040 IS HEREBY AMENDED TO READ AS FOLLOWS:
2.04.040 Officers. Two council persons shall be elected at large at each general municipal election. The term of office of mayor and of council person is four years. Any office which is declared vacant shall appear on the ballot at the next general municipal election. If the term of the office declared vacant does not expire at the next general election, the office shall appear on the ballot for the remainder of the unexpired term.

PUBLIC NOTICE
Chambers Design-Build, Inc (CDBI) and Sublette County are seeking Subcontractor bids for the Big Piney-Marbleton FBO Hangar to be located off Hwy 189 in Big Piney, Wyoming.  The building will be 22,500sf single story building, metal construction with 4,500sf of Office Space and an 18,000sf single bay Hangar. Any Subcontractor may be required to post a performance bond.  Electrical and Mechanical Subcontractors will be required to be bonded. The Steel package is not part of this solicitation for bids.
Contract Documents will be available, from CDBI, and a copy will be available for viewing at their office located at:

The Board of County Commissioners of the County of Sublette has decided to alter a part of the NEW FORK BRIDGE COUNTY ROAD NO. 23-175 commencing at Station 31+61, thence running southerly and easterly and terminating at Station 53+74;
All objections thereto or claims for damages by reason thereof must be filed in writing with the County Clerk of said County, before noon on the 6th day of August 2007, or such road will be altered without reference to such objections or claims for damages.
