INVITATION FOR BIDS FOR IMPROVEMENTS TO MILEY MEMORIAL FIELD AIRPORT
BIG PINEY-MARBLETON, WY
AIP No. 3-56-0002-08
Sealed bids for improvements to the Miley Memorial Field Airport, AIP No. 3-56-0002-08, will be received by Big Piney-Marbleton Airport Board at Big Piney Town Hall at 401 Budd Ave, Big Piney, WY until June 19, 2007 at 10:00 a.m. MDT, and then opened and read aloud.
The work involved includes the following:
SCHEDULE I
REHABILITATE APRON / WIDEN TAXIWAY
A complete set of Plans, Specifications and Contract Documents may be obtained at www.armstrongconsultants.com. A digital copy may be downloaded for $50.00. A hardcopy may be purchased for $100.00 for each set. There will be no refunds.
Each bid must be accompanied by a Certified Check or Cashier's Check in an amount not less than five percent of the total bid made payable to Big Piney-Marbleton Airport Board, or by a Bid Bond in like amount executed by a Surety Company.
The Bidder must supply all the information required by the proposal forms and specifications, and he/she must bid on all items of every schedule. Big Piney-Marbleton Airport Board reserves the right to waive any informality in or to reject any or all portions of the various bid items. No proposal may be withdrawn for a period of one-hundred twenty (120) days from the opening thereof.
All bidders are advised to examine the site to become familiar with all site conditions. The project will be shown to interested bidders at 10:00 a.m. MDT, on June 12, 2007 at the Miley Memorial Field Airport.
The proposed contract is under and subject to Executive Order 11246 of 24 September 1965, as amended, and to the equal opportunity clause and the Standard Federal Equal Employment Opportunity Construction Contract Specifications, including the goals and timetables for minority and female participation.
A Certification of Nonsegregated Facilities must be submitted prior to the award of the proposed contract, including any subcontracts in excess of $10,000.00.
The proposed contract is subject to the provisions of Department of Transportation Regulations 49 CFR Part 26 (Disadvantaged Business Enterprise Participation).
Minimum wage rates as established by the Secretary of Labor and State of Wyoming are applicable to all schedules awarded for this project.

NOTICE OF FINAL SETTLEMENT WITH AND PAYMENT TO CONTRACTOR
Notice is hereby given that the Town of Pinedale (Owner) has accepted the Fremont and Sublette Avenue Drainage project as completed according to the plans and specifications and rules set forth in the contract between Owner and Teletractors, Inc. (Contractor), and that Contractor is entitled to final settlement therefor. On or after the 11th day of July, 2007, being the 41st day after the first publication of this notice, Owner will pay to Contractor the full amount due under the contract.

The Town Council of the Town of Pinedale met in regular session Tuesday, May 29, 2007, at 5:30 p.m., in the Town Hall. Those present: Susie Kramer; Brian Gray, representing Worthington, Lenhart and Carpenter; Hayes Randol, representing Sublette County Sheriff’s Office; Eugene Ninnie, Town Engineer; Julie Early, Animal Control Officer; Wendi Schwartz; Ron Hanson and Randy Hubbard, representing Public Works; Paul and Tina Rock; Julie Land; Lauren McKeever, Mayor’s Assistant; Dennis Fornstrom and Mark Eatinger, presenting Rio Verde Engineering; Mike Fitzgerald, representing the Pinedale Roundup; and Trey Wilkinson, representing the Sublette Examiner.
Mayor Smith brought the meeting to order. Present on Roll Call: Gary Heuck, David Hohl, Stephen Smith, Chris House and Nylla Kunard. Motion by Hohl to approve the minutes of the May 14th meeting as written. Motion seconded. Hohl voted aye, House voted aye, Kunard voted aye and Heuck abstained. Motion carried.
Julie Early, Animal Control Officer, reported the monthly activities of the animal control department.
Ron Hanson and Randy Hubbard, representing Public Works, reported the monthly activities of the public works department. Hubbard discussed purchasing an aerator for the wastewater treatment facility costing $5,400.00 and bugs/bacteria for the ponds at the wastewater treatment facility costing $5,600.00.
Eugene Ninnie, Town Engineer and Meghan Jacquet, Planning and Zoning Administrator, reported the monthly activities of the planning and zoning department and engineering department.
Brian Gray, representing Worthington, Lenhart and Carpenter, gave an update on the Fremont and Sublette Avenue Drainage Improvements Project.
Lauren McKeever, Mayor’s Assistant, reported her monthly activities.
Hayes Randol, representing the Sublette County Sheriff’s Office, reported the monthly activities of the sheriff’s office.
Motion by Hohl to approve the Application for 24 Hour Catering/Malt Beverage Permit for Bottoms Up Brewing Company on June 1st at Rendezvous Point for a school function. Motion seconded. Motion carried unanimously.
After discussion motion by Heuck to amend the language in Ordinance 405, relating to the control of cats within the Town of Pinedale, from an impounded period of twenty-four hours to five days if cats are not infectious or vicious. Motion seconded. Motion carried unanimously.
Susan Kramer, a Pinedale resident, presented information on global warming and participating in the U.S. Conference of Mayors Climate Protection Agreement.
Wendi Schwartz, a concerned citizen, discussed her concerns with the speed of traffic and the need of stop signs along the side streets. After lengthy discussion motion by Hohl to place stop signs at Washington Street and Madison Avenue, Washington Street and Jackson Avenue, Washington Street and Cole Avenue, Jackson Avenue and Wilson Street and Jackson and Entertainment Lane but not limited to these streets at the Mayor’s discretion. Motion seconded. Hohl voted aye, Kunard voted aye, House voted aye and Heuck voted nay. Motion carried.
Motion by Hohl to allow the planning and zoning department and engineering department to pursue a traffic study. Motion seconded. Motion carried unanimously.
Heuck discussed participating with the Sublette County Commissioners and the local V.F.W. in placing a granite wall in the American Legion Park to recognize veterans. Council was agreeable.
Motion by Hohl to approve Ordinance 411, an ordinance annexing adjacent and contiguous land (J.M.O.) to the Town of Pinedale, Wyoming and establishing zoning therefor, on the second reading. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve Ordinance 413, an ordinance granting an electric utility franchise and general utility easement to Rocky Mountain Power, on the second reading. Motion seconded. Motion carried unanimously.
Motion by Hohl to approve Ordinance 414, annual appropriation for the fiscal year ending June 30, 2008, on the first reading. Motion seconded. After discussion motion carried unanimously.
Motion by Hohl to go into executive session to discuss property acquisition. Motion seconded. Motion carried unanimously.
Motion by Kunard to return to regular session. Motion seconded. Motion carried unanimously.
Motion by Kunard to appoint Hohl to the Sublette County/Town of Pinedale Community Impact Joint Powers Board. Motion seconded. Heuck voted aye, House voted aye, Kunard voted aye and Hohl abstained. Motion carried.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JUNE 5, 2007
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Trey Wilkinson of the Sublette Examiner, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
Chairman Cramer began the meeting with a moment of silence in memory of U.S. Senator Craig Thomas who passed away on June 4th.
The minutes of the preceding regular meeting of May 15, 2007, were amended as follows: Page 3, Paragraph 3 instead of “adopt”, “participate in the Integrated Solid Waste Planning Process.” It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the amendment and order the minutes to be filed. The motion carried.
The official bond for John Markle, Treasurer for the Redstone Upper Green River Road Improvement District, in the amount of $10,000 was approved and ordered filed with the County Treasurer.
Butch Penton, Road & Bridge Superintendent, discussed road projects, gravel, and easements restrictions on roads. Penton inquired about vacation pay.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution 07-990C authorizing the County to apply for a right of way from the Bureau of Land Management for Mount Airy County Road No. 23-230, and authorizing the Chairman to sign the application. The motion carried.
Ed Wood, representing Randal H. Reed, Trustee of the Randal H. Reed Revocable Trust dated November 22, 2005, and Connie M. Reed, Trustee of the Connie M. Reed Revocable Trust dated November 22, 2005, presented an Application for the Establishment of a Private Road. Wood reported that historically access has been available, but has been threatened to be denied and requested temporary access during the pendency of the application. Doug Mason represented Respondents Stuart C. Thompson, Mary E. Thompson, and Matthew H. Patton. Len Carlman, representing Respondents Patrick R. Pfister and Cydney Davidson, argued that contrary to the petition, that no offers have been tendered for the purchase of the easement. It was reported that the Sheriff’s Department had been contacted. Denial of access was reported due to danger to Pfisters and their livestock. The Board referred the Parties present to the County Attorney. County Attorney Ralph Boynton reported, by telephone, that the petition was in order.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to accept the petition and grant a temporary access. The motion carried. The hearing for the petition was scheduled for September 4, 2007, at 10 a.m.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to receive the Viewers Report for the Application for the Establishment of a Private Road by Matthew D. Miller and schedule its hearing for July 18, 2007, at 11 a.m. The motion carried.
Garry Eiden, Pinedale Transfer Station operator, presented a gate receipts report, discussed the contract, recycling, dead animals, and requested concrete for the Transfer Station.
Scott Scherbel, representing Camp New Fork, discussed using the Aspen Ridge site for a communication tower. The Board referred Scherbel to the Sheriff’s Department to discuss the future relocation of the site.
Mark Eatinger, representing Rio Verde Engineering, with Butch Penton, reviewed the proposed Mount Airy County Road location on a map plotted by GPS.
Eatinger reported on the work on the Daniel Merna Road and Boulder area.
Commissioner Linn discussed wetlands and moving the County Road at Guios.
Sealed bids were opened for the sale and removal of the large cabin behind Country Lane. Three bids were received. It was moved by Commissioner Linn and seconded by Commissioner Bousman to award the bid to Tia Leo for the amount of $3,600.00. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to renew the retail liquor license for the Green River Bar. The motion carried.
Bart Myers, County Planner, with Keith Raney, County Sanitarian, discussed the application process for building/septic permits, Home Owners Associations signoffs for building permits, updating definitions for “manufactured” and “modular” homes, and regulation changes for non-conforming A-1 tracts. The Board requested Myers prepare proposed regulation changes for these issues. Raney will poll the contractors about the application process. Myers discussed a letter to FEMA and the Board approved the proposal from Bill Collins for a Housing Needs Analysis in the amount of $39,000. The Board requested a contract from Collins.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to recess the meeting for an Executive Session, by conference call, with John McKinley of Davis and Cannon to discuss ongoing and potential litigation. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to reconvene the meeting.
The Board continued discussion with McKinley and requested that he attend the upcoming Joint Revenue Committee Meeting in Casper.
A public hearing was held for the Class II Road program. It was moved by Commissioner Bousman and seconded by Commissioner Linn to adopt Resolution No. 07-989C establishing Class I and Class II Roads. The motion carried.
The Chairman signed Resolution No. 07-988C declaring the intention of Sublette County to participate with Teton, Lincoln, and Uinta Counties to complete a multi-jurisdictional Integrated Solid Waste Management Plan.
The following petition and affidavit of abatement of taxes was presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Chevron USA, Inc., $36,026.88; David & Michelle Bozner, $73.74; and Sublette County, $1,093.72.
The Board reviewed the drainage report from Crank Companies, Inc. for the Faler Easement. The Board referred the report to Rio Verde Engineering.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to award renewal scholarships to Keely Knapp, Jae Bing, and Ashley Kozeal. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 07-991C appointing Mike D. Fuller as a Special Prosecutor, to undertake the further prosecution of a criminal compliant against Esther Hazel Judge. The motion carried.
The Board approved and the Chairman signed the letter of engagement with Leo Riley & Company, in the amount of $26,000.

The Sublette County Planning & Zoning Commission will meet on Thursday, July 19, 2007, at 7:00 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
1. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by CR #2 Family Limited Partnership. The application proposes a change of zoning district boundary for a 131.53 acre parcel from Agricultural (one dwelling unit per 35 acres allowed) to Rural Residential 10 Planned Unit Development (overall density of one dwelling unit per 10 acres allowed) in order to subdivide the 131.53 acres into 13 lots. The parcel subject to the application for a change of zoning district boundary is located in Section 33; Township 35N; Range 110W; generally described as being north of Sievers County Road 23-100 and west of State Highway 352.
2. Request for Change of Zoning District Boundary approval, pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Administration; by Philip Kos. The application proposes a change of zoning district boundary for a 6.3 acre parcel from Agricultural (one dwelling unit per 35 acres allowed) to Rural Residential (one dwelling unit per 2 net acres allowed) in order to divide the 6.3 acres into 2 lots. The parcel subject to the application for change of zoning district boundary is located in Section 29; Township 38N; Range 113W; generally described as 14473 U.S. Highway 189/191, being in the Bondurant area and on the west side of Highway 189/191approximately 0.5 mile(s) south of the intersection of Dell Creek Road and Highway 189/191.
3. Request for Minor Subdivision approval, pursuant to Chapter VI of the Sublette County Subdivision Resolution, entitled Minor Subdivision; by AMD Holdings LLC. The application proposes a two lot subdivision for a 17.24 acre parcel, which is within the Mobile Home Park and Light Industrial zoning districts. In the proposed Minor Subdivision application Lot 1 is 13.56 in size and will encompass the existing Mobile Home Park zoning district; with Lot 2 being 3.71 acres in size and encompassing the existing Light Industrial zoning district. The parcel subject to the proposed Minor Subdivision is located in Section 7, Township 29N, Range 111W; generally described as the “Daniel Trailer Court” located at 10411 U.S. Highway 189, being in the Big Piney area and on the west side of Highway 189 approximately 0.1 mile(s) south of the intersection of South Piney Road and Highway 189.
4. Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; planning staff proposes the following amendment to the text of the Sublette County Zoning and Development Regulations (deletions to current text contained in the Regulations are shown with a strikethrough and any proposed new language to the text is highlighted).

Accessory residential units shall conform to all applicable development standards contained in this Resolution and no accessory residential unit may exceed eight hundred (800) square feet of habitable floor area.
