OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
MAY 15, 2007
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Trey Wilkinson of the Sublette Examiner, Julia Stuble of the Pinedale Roundup, and Mary Lankford, County Clerk present.
The minutes of the preceding regular meeting of May 1, 2007, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Bousman. The motion carried.
Adrianne Peterson and Doug Vickrey, representing the Weed and Pest District, discussed the construction of a new building at the County Shop property. The current location of the old fuel system was discussed. The Board recommended that Peterson and Vickrey meet with Butch Penton at the site to discuss the location of any new buildings.
Butch Penton, Road & Bridge Superintendent, discussed rocks, surfacing the parking area at the County Shop, and Gun Club excavation.
Bill Budd and Randy Johnson, representing the Rural Health Care District, discussed the funding of the construction projects for the district by the County. The Board agreed to provide the funding for the Marbleton Ambulance Barn. It was decided that the Board will have an agreement drafted to reflect the funding agreement between the Board and the District, which will include the fact that the County will own the properties, the District will furnish and maintain them, and the District will repay the County the construction funds over time.
In accordance with the public notice published in the Sublette Examiner on April 19, 26, May 3, and 10, 2007, a public hearing was held for the renewal of the following liquor licenses and permits:
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the renewal applications for the following retail liquor licenses: Boulder Liquors, The Elkhorn, The Place, Inc., and White Pine Ski Area & Resort. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to approve the renewal applications for the following restaurant liquor licenses, when complete applications are received: Half Moon Lake Lodge, Lakeside Lodge, and Ft. William Recreation Area. The motion carried.
John Anderson and Tom Worden, residents of the Redstone Upper Green River Subdivision, commented on the renewal of the restaurant liquor license for Elk Ridge Lodge. Zoning issues were discussed. It was moved by Commissioner Bousman and seconded by Commissioner Linn to renew the restaurant license for Elk Ridge Lodge subject to compliance with all Zoning and Development Regulations, as well as, the Master Plan associated with the Change of Zoning District Boundary for Elk Ridge Lodge in 1989, with uses allowed by said Master Plan being further defined in a November 21, 2006 letter from Bart Myers to Elk Ridge Lodge. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the renewal applications for the following malt beverage permits: Hoback Village, Lakeside Beer Sales, and Daniel Junction. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the renewal application for a limited retail liquor license to the Pinedale Golf Club, Inc. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to accept the proposal from Chambers Design-Build for a garage at the Fairgrounds in the amount of $33,691.00. The motion carried.
Frank James, Fairgrounds Manager, discussed sod and sprinkling, and the sale of water to Guios for their steers.
Daphne Platts, John Carney, and John Fixter, representing the Library Addition project, reviewed the proposed plan, fees, parking, and drainage. Commissioner Linn questioned quantities, pricing, and fees. Fixter requested approval of the project, so that permitting can obtained, construction drawings can be completed and site preparation can begin. After more discussion of the project and its cost, it was moved by Commissioner Bousman and seconded by Chairman Cramer to approve the project for the amount of $3,775,483.00, which represents the base bid minus Alternative #4. The motion carried, with the vote being: Cramer-aye, Bousman-aye, and Linn-nay.
In accordance with the public notice published in the Sublette Examiner on April 19, 2007, public hearing was held for the following:
It was moved by Commissioner Linn and seconded by Chairman Cramer to approve a variance application by Brad Moore of Bar D Signs to allow a sign 50 square feet in size, where the limit is 40 square feet, located in Lot 1, Sleepy Hollow Industrial Park Subdivision. The motion carried with the vote being: Cramer-aye, Linn-aye, and Bousman-nay.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to deny a variance application by Michael Hart to allow a 25 foot front/street yard setback for a structure, where 50 feet is required, zoned A-1, located in Section 12, T33N, R109W. The motion carried.
The Board adjourned the meeting to visit the proposed construction site at the County Shop for the Weed and Pest construction project.
The Board reconvened the meeting.
Annie Sondgeroth, Public Health Nurse, requested the Board consider funding a public health nurse position. The Board referred Sondgeroth to the Rural Health Care District for funding the position, which would be a County position.
Martha Ptasnik discussed the Pinedale Beautification Project. Ptasnik reported that a non-profit corporation will be formed and that funds have been committed by the Town of Pinedale and Andres Enterprises. Initial projects will include coordination of lighting, street signs, and waste cans.
Paul Jensen, Rendezvous Pointe Director, discussed the planning grant application for low income senior housing. The Board expressed its opposition to the plan. The Board agreed to sponsor the application, if the applicant was changed to the Sublette Center and that the Sublette Center would provide the grant match.
Fes Krause, representing the Kendall Valley Fire Department, presented a proposal from Chambers Design-Build to design the Kendall Valley Fire Hall. The Board approved the proposal. The Board informed Krause that the property will need to be leased to Sublette County, if Sublette County is providing funding for the construction of the Fire Hall.
Rick Hoffman, Waste Management Supervisor, discussed the Integrated Solid Waste Plan and presented a draft resolution for adoption of the plan. Commissioner Linn expressed his opposition to the plan. It was moved by Commissioner Bousman and seconded by Chairman Cramer to adopt the Integrated Solid Waste Plan. The motion carried, with the vote being: Cramer-aye, Bousman-aye, and Linn-nay.
Commissioner Linn reported on garbage south of the Marbleton Landfill. Hoffman will have the garbage removed.
Todd Bishop, representing Kaiser and Company, reviewed the County’s investments. It was moved by Commissioner Linn and seconded by Commissioner Bousman to reaffirm the Sublette County Investment Policy being Resolution No. 06-898F. The motion carried.
The Class II Road Committee reported its acceptance of the draft regulations. The Board scheduled a public hearing on the regulations at 2 p.m. on June 5th.
Commissioner Bousman commented on promoting communications on the Wyoming Range Energy development and the Wild and Scenic Rivers proposal.
The Board approved and signed the proposal from Chambers Design-Build for the Big Piney Marbleton Airport Hangar.

PUBLIC NOTICE
The regularly scheduled meeting of the Sublette County Board of Commissioners will be held on June 19, 2007 at 1:00 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
1. Request for Change of Zoning District Boundary; pursuant to Chapter VIII of the Sublette County Zoning and Development Regulations, entitled Administration; by Amy Whitaker Merryman, Trustee of the Amy Whitaker Merryman Trust to rezone 35 acres from A-1 (Agricultural) to R-R (Rural Residential Two Acre Minimum). The purpose of the proposed change in zoning district boundary is a 15 lot subdivision. The parcel subject to the proposed change in zoning district boundary is located in Section 27, Township 34N, Range 109W; generally described as Fremont Lake Road CR 23-154 and being 0.3 miles west of Fremont Lake Road CR 23-154 and approximately 0.5 miles from the Pinedale town limits.
2. Request for Conditional Use approval, pursuant to Chapter V of the Sublette County Zoning and Development Regulations, entitled Conditional Uses, by Mark Noble. The application proposes a 5 year renewal for the gravel pit located on agriculturally zoned land near Cora. The parcel subject to the proposed Conditional Use is located in Section 28, Township 35N, Range 110W; generally described as Cora and being located approximately 12.6 miles from Pinedale, 0.3 miles from Highway 352 .
3. Request for Final Plat approval; pursuant to Chapter V of the Sublette County Subdivision Resolution, entitled Final Plat; for Wilderness Estates Subdivision to subdivide 201.67 acres into 20 lots, within the R-R 10/PUD (Rural Residential Ten Acre Planned Unit Development) zoning district (14 lots with an average lot size of 4.9 acres each and 6 lots with an average lot size of 20 acres each). The parcel subject to the application for Final Plat is located in Section(s) 1 and 6, Township 33N, Range108W and 109W; generally described as Stock Driveway County Road 23-220 and Badger Ridge Road and being 0.5 miles north of the Fayette Pole Creek Road and 2.56 miles east of the intersection of U.S. Highway 191 and Fayette Pole Creek Road.
4. Request for a Change of Zoning District Boundary; pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Change of Zoning District Boundary by Andrew Michael O’Neal. The applicant is requesting a change of zoning district boundary for 19.95 acres from RR-20 (Rural Residential-20 acres per dwelling unit) to RR-10 (Rural Residential-10 acres per dwelling unit). The purpose of the proposed change in zoning district boundary is a 2 lot subdivision. The O’Neal parcel is located in Section 2, Township 33N, Range 111W; generally described as 12886 US Highway 189 (Lot E – O’Neal Lot Division) and being located in the Daniel area approximately 2.7 miles south of the intersection of US Highways 191 and 189.
5. Request for a Variance, pursuant to Chapter VI of the Sublette County Zoning and Development Regulations, entitled Variances, by Enercrest Incorporated to allow a wind turbine of 67.5 feet in height in the Light Industrial zoning district, where the Sublette County Zoning and Development Regulations limit the height of an accessory structure to a maximum of 35 feet in the Light Industrial zoning district. The wind turbine is to provide for the generation of electricity and is permitted as an accessory use in the Light Industrial zoning district. The parcel subject to variance application is located in Section 8, Township 29N, Range 111W (Lot 4 Gopher Ridge Industrial Park Subdivision); generally described as 1 Gopher Ridge Lane and being approximately a 1.5 miles south of Big Piney on the east side of US Highway 189.

Sealed bids for improvements to the Miley Memorial Field Airport, AIP No. 3-56-0002-08, will be received by Big Piney-Marbleton Airport Board at Big Piney Town Hall at 401 Budd Ave, Big Piney, WY until June 19, 2007 at 10:00 a.m. MDT, and then opened and read aloud.
The work involved includes the following:

REHABILITATE APRON / WIDEN TAXIWAY
A complete set of Plans, Specifications and Contract Documents may be obtained at www.armstrongconsultants.com. A digital copy may be downloaded for $50.00. A hardcopy may be purchased for $100.00 for each set. There will be no refunds.
Each bid must be accompanied by a Certified Check or Cashier's Check in an amount not less than five percent of the total bid made payable to Big Piney-Marbleton Airport Board, or by a Bid Bond in like amount executed by a Surety Company.
The Bidder must supply all the information required by the proposal forms and specifications, and he/she must bid on all items of every schedule. Big Piney-Marbleton Airport Board reserves the right to waive any informality in or to reject any or all portions of the various bid items. No proposal may be withdrawn for a period of one-hundred twenty (120) days from the opening thereof.
All bidders are advised to examine the site to become familiar with all site conditions. The project will be shown to interested bidders at 10:00 a.m. MDT, on June 12, 2007 at the Miley Memorial Field Airport.
The proposed contract is under and subject to Executive Order 11246 of 24 September 1965, as amended, and to the equal opportunity clause and the Standard Federal Equal Employment Opportunity Construction Contract Specifications, including the goals and timetables for minority and female participation.
A Certification of Nonsegregated Facilities must be submitted prior to the award of the proposed contract, including any subcontracts in excess of $10,000.00.
The proposed contract is subject to the provisions of Department of Transportation Regulations 49 CFR Part 26 (Disadvantaged Business Enterprise Participation).
Minimum wage rates as established by the Secretary of Labor and State of Wyoming are applicable to all schedules awarded for this project.

BIG PINEY-MARBLETON AIRPORT BOARD

PUBLIC NOTICE
In accordance with the provisions of the Wyoming Environmental Quality Act and Chapter 1, Section 2(j) of the Solid Waste Rules and Regulations, the Jonah Gas Gathering Company has submitted a low hazard and low volume permit application for the Bird Canyon Compressor Station (51.049), Used Oil and Used Antifreeze Storage Facilities, Sublette County, Wyoming.
The facility is located approximately 79.3 miles NW of Rock Springs, Wyoming, off US Highway 191. More specifically, this facility is located in Sections 27 & 34, T27N, R111W, Sublette County, Wyoming. The proposed facility will provide for the storage of used oil and used antifreeze which have been generated within the facility. The total volumetric capacity of this facility is 2,100 gallons of used oil and 2,100 gallons of used antifreeze.
The Department of Environmental Quality, Solid and Hazardous Waste Division (DEQ) has determined that the permit application is generally complete and technically adequate. DEQ’s solid waste rules, in Chapter 1, Section 2 (j)(iii)(A), require that the applicant must provide public notice that a draft permit has been issued, and inform the public that there is an opportunity to comment on the draft permit before it is issued in final form. The notice is also required to indicate that the public may file formal written objections to issuance of a final permit. This publication provides notice of those opportunities.
Copies of the permit application, the DEQ’s review of the application, and the draft permit can be viewed at DEQ’s Lander office (510 Meadowview Drive, Lander, WY).
Any interested person has the right to either: provide comments on the draft permit, which DEQ will consider prior to taking final action on the permit application, or file formal written objections to the draft permit. The period for providing comments, or filing formal written objections to the draft permit, shall begin on Thursday, May 24th, 2007 and end on Friday, June 29th, 2007 at 5:00pm. Any comments or formal written objections must be received by 5:00 PM on the last day of the notice period. Comments or formal objections must be submitted in writing to the Department of Environmental Quality, John Corra, Director, 122 West 25th Street, Cheyenne, WY 82002. Formal written objections must be accompanied by a statement of the facts upon which the objection is based. If substantial written objections are filed, a contested case hearing will be held by the Environmental Quality Council.

PUBLIC NOTICE
In accordance with the provisions of the Wyoming Environmental Quality Act and Chapter 1, Section 2(j) of the Solid Waste Rules and Regulations, the Jonah Gas Gathering Company has submitted a low hazard and low volume permit application for the Falcon Compressor Station (51.050), Used Oil and Used Antifreeze Storage Facilities, Sublette County, Wyoming.
The facility is located approximately 30 miles SW of Pinedale, Wyoming off Highway 191. More specifically, this facility is located in Section 36, T30N, R108W, Sublette County,Wyoming. The facility will provide for the storage of used oil and used antifreeze which have been generated within the facility. The total volumetric capacity of this facility is 2,100 gallons of used oil and 2,100 gallons of used antifreeze.
The Department of Environmental Quality, Solid and Hazardous Waste Division (DEQ) has determined that the permit application is generally complete and technically adequate. DEQ’s solid waste rules, in Chapter 1, Section 2 (j)(iii)(A), require that the applicant must provide public notice that a draft permit has been issued, and inform the public that there is an opportunity to comment on the draft permit before it is issued in final form. The notice is also required to indicate that the public may file formal written objections to issuance of a final permit. This publication provides notice of those opportunities.
Copies of the permit application, the DEQ’s review of the application, and the draft permit can be viewed at DEQ’s Lander office (510 Meadowview Drive, Lander, WY).
Any interested person has the right to either: provide comments on the draft permit, which DEQ will consider prior to taking final action on the permit application, or file formal written objections to the draft permit. The period for providing comments, or filing formal written objections to the draft permit, shall begin on Thursday, May 24th and end on Friday, June 29th, 2007 at 5:00pm. Any comments or formal written objections must be received by 5:00 PM on the last day of the notice period. Comments or formal objections must be submitted in writing to the Department of Environmental Quality, John Corra, Director, 122 West 25th Street, Cheyenne, WY 82002. Formal written objections must be accompanied by a statement of the facts upon which the objection is based. If substantial written objections are filed, a contested case hearing will be held by the Environmental Quality Council.
In accordance with the Americans With Disabilities Act, special assistance or alternative formats will be made available upon request for individuals with disabilities.

Preference will be given to resident Wyoming Contractors in the amount of five percent (5%) of the low bid in accordance with Wyoming Statute 16-6-101, et. seq.

The Board of County Commissioners, Sublette County, Wyoming, will be accepting bids for the sale and removal of the large-log cabin located on Lots 5 and 6, Country Lane Addition to the Town of Pinedale. The cabin is located directly behind Country Lane Conoco Station. Sealed bids shall be submitted to the Sublette County Clerk, P.O.
