for the Draft Environmental Impact Statement (EIS) for the Pinedale Resource Management Plan (RMP) for Public Lands Administered by the Bureau of Land Management (BLM) Pinedale Field Office, Pinedale, Wyoming
The BLM will hold a series of public meetings and hearings in April to receive comments on the Draft EIS for the Pinedale RMP, released in February 2007. The locations, dates, and times of the meetings will be as follows:

ORDINANCE NO. __406________
AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING AMENDING SECTION 12.30.010 OF THE PINEDALE MUNICIPAL CODE BY AMENDING THE NAME OF THE BOARD CREATED THEREIN AND ADDING ADDITIONAL DUTIES.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT SECTION 12.30.010 OF THE PINEDALE MUNICIPAL CODE IS HEREBY AMENDED TO READ AS FOLLOWS:
12.30.020 Tree/Park Board.
A. There is hereby created and established a Tree/Park Board for the Town of Pinedale, which shall consist of five members, citizens and residents of this area, who shall be appointed by the Mayor with the approval of the Town Council. Members of the Board shall serve without compensation.
B. The term of the members of the Tree Board shall be three years, except that the initial term of two members shall be for one year and the term of two members shall be for two years. In the event a vacancy shall occur during the term of any member, a successor shall be appointed by the Mayor for the unexpired portion of the term.
C. The Tree/Park Board shall develop and administer a comprehensive community tree management program for the care of trees on public property.
D. The Tree/Park Board shall produce an annual work plan addressing planting, watering, fertilization, removal of dead and hazardous trees, safety, fine pruning and insect and disease control.
E. The Tree/Park Board shall recommend to the Town Council needed action to carry out its annual work plan. Any action approved by the Town Council shall be carried out by the Town.
F. The Tree/Park Board shall recommend to the Town Council needed action in regard to maintenance and improvements to the park system of the Town. Any action approved by the Town Council shall be carried out by the Town.
This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

The Town Council of the Town of Pinedale met in regular session Monday, February 26, 2007, at 5:30 p.m., in the Town Hall. Those present: Jim Parker, Pinedale Airport Manager; Dennis Fornstrom and Mark Eatinger, representing Rio Verde Engineering; Brian Gary, representing Worthington, Lenhart and Carpenter; Randy Hubbard, representing the Public Works Department; Roz Leslie; Bardy Bardin, Jim Whinnery and Hayes Randol, representing Sublette County Sheriff's Office; Ruth Neely, Pinedale Municipal Judge; Jeffrey Jacquet, Socioeconomic Analyst for the Sublette Community Partnership; Meghan Jacquet, Pinedale Planning and Zoning Administrator; Lauren McKeeer, Mayor's Assistant; and Annie O'Brien and Mike Fitzgerald, representing the Pinedale Roundup.
Mayor Smith brought the meeting to order.
Motion by House to approve the minutes of the February 12th meeting as written. Motion seconded. Heuck voted aye, Kunard voted aye, House voted aye and David Smith abstained. Motion carried.
Bardy Bardin, Jim Whinnery and Hayes Randol, representing the Sublette County Sheriff's Office, reported the monthly activities of the sheriff's office.
Julie Early, Animal Control Officer, reported the monthly activities of the animal control department.
Randy Hubbard, representing the Public Works Department, reported the monthly activities of the public works department. After discussion motion by David Smith to allow Public Works to purchase an ammonia probe and aerator for the Lagoon. Motion seconded. Motion carried unanimously.
Meghan Jacquet, the Planning and Zoning Administrator, reported the monthly activities of the planning and zoning department.
Jim Parker, Pinedale Airport Manager, presented the January Treasurer's Report and the February draft minutes for the airport board.
Ruth Neely, Pinedale Municipal Judge, discussed the inconsistencies in the Town of Pinedale Municipal Codes 5.04.070 thru 5.04.100 pertaining to minors and alcohol. Council directed Neely to work with the Town Attorney on changes to the ordinances.
Jeffrey Jacquet, Socioeconomic Analyst for the Sublette Community Partnership, presented an analysis of the costs of operating the town's water and sewer systems with the revenue generated, Jacquet reported the revenue generated from sewer and water systems does not come close to matching the cost of operating the two systems. Jacquet stated that Wyoming State Statues require municipalities to consider sewer and water separate systems, and they should be fiscally balanced. After discussion Council agreed to take the information under advisement.
Motion by David Smith to approve the Application for 24 Hour Catering/Malt Beverage Permit for the Corral Bar and the Bottoms Up Brewery for April 21st for the Rocky Mountain Elk Foundation, Sublette Chapter. Motion seconded. Motion carried unanimously.
Motion by David Smith to approve the Application for 24 Hour Catering/Malt Beverage Permit for the Wheel Inn Liquor for March 3rd for the Cattlemen's Association. Motion seconded. Motion carried unanimously.
Dennis Fornstrom, representing Rio Verde Engineering, presented the Petition for Annexation to the Town of Pinedale of the property contained with the J.M.O. Annexation, located within Lot 3, Section 4, T.33N., R.109W., of the 6th P.M., Sublette County, Wyoming and are contained within the corporate limits of the Town of Pinedale. Motion by Heuck finding the Petition for Annexation of the J.M.O. Annexation in compliance and refer it to the Pinedale Planning and Zoning Board for review. Motion seconded. Motion carried unanimously.
Dennis Fornstrom, representing Rio Verde Engineering, presented the Petition for Annexation to the Town of Pinedale of the property contained within Split Diamond Meadows Subdivision, located within the NW/4 and W/2 NE/4, Section 33, T.34N., R.109W., of the 6th P.M., Sublette County, Wyoming. Motion by Heuck finding the Petition for Annexation of the Split Diamond Meadows Subdivision in compliance and refer it to the Pinedale Planning and Zoning Board for review. Motion seconded. Heuck voted aye, Kunard voted aye, House voted aye and David Smith abstained. Motion carried.
Mayor Smith recommended the appointment of Robert Hallam to the Pinedale Airport Board. Motion by Kunard to appoint Robert Hallam to the Pinedale Airport Board. Motion seconded. Kunard voted aye, House voted aye, David Smith voted aye and Heuck voted nay. Motion carried.
Motion by House to approve Ordinance 401, an ordinance of the Town of Pinedale, Wyoming creating Chapter 13.09 of Title 8 of the Pinedale Municipal Code by establishing procedures for excavations within streets and alleys within the Town Limits of the Town of Pinedale, as presented on the third reading. Motion seconded. Motion carried unanimously.
Motion by Kunard to approve Ordinance 403, an ordinance annexing adjacent and contiguous land (Bloom Ranch Annexation) to the Town of Pinedale, Wyoming, and establishing zoning therefor, on the third reading. Motion seconded. Motion carried unanimously.
Motion by David Smith to approve Ordinance 404, an ordinance annexing adjacent and contiguous land (WYBAL Annexation) to the Town of Pinedale, Wyoming and establishing zoning therefor, on the third reading. Motion seconded. Motion carried unanimously.
Motion by David Smith to approve Ordinance 405, an ordinance of the Town of Pinedale, Wyoming creating Chapter 6.05 of the Pinedale Municipal Code relating to the control of cats within the Town of Pinedale, on the second reading. Motion seconded. Motion carried unanimously.
Motion by David Smith to approve Ordinance 406, an ordinance of the Town of Pinedale, Wyoming amending Section 12.30.010 of the Pinedale Municipal Code by amending the name of the Board created therein and adding additional duties, on the first reading. Motion seconded. Motion carried unanimously.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
MARCH 9, 2007
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Bill Cramer, John Linn, Joel Bousman, Trey Wilkinson of the Sublette Examiner, and Mary Lankford, County Clerk present.
Chairman Cramer led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of February 20, 2007, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Bousman. The motion carried.
The official bonds for Deborah Morley, Treasurer for the Mosquito Abatement District #2, in the amount of $25,000; Allen Luckow, Secretary/Treasurer for the Big Piney Marbleton Joint Powers Fire Board, in the amount of $20,000; and Howard White, Treasurer for the Fair Board, in the amount of $2,000, were approved and ordered filed with the County Treasurer.
Mark Eatinger, representing Rio Verde Engineering, requested a utility easement for sewer and water in Pinedale South County Road No. 23-123 for the Richardson development. The Board discussed the ditches and proposed bike path. It was moved by Commissioner Linn and seconded by Commissioner Bousman to approve the utility easement. The motion carried.
Butch Penton, Road and Bridge Superintendent, reported on hauling rocks, the crusher, the proposed purchase of a crack seal machine, and site work at the County Shop.
Rick Johnson, Bob McCarty, and Kristel Blair, members of the Class II Road Committee presented proposed standards and procedures for the Board to review. The Board requested that the County Clerk forward the information to John McKinley of Davis and Cannon for review.
John Etchepare, Director of the Wyoming Department of Agriculture, Terry Cleveland, Director of the Wyoming Game and Fish, John Emmerich, Deputy Director of the Wyoming Game and Fish, and Renee Dana and Steve Laster of the BLM, discussed the proposed Wyoming Landscape Conservation Initiative. Comments were received from Cotton Bousman, Darrell Walker, and John Andrikopoulos.
Randy Bolgiano presented a letter of request for the Board to explore the prospect of renaming the Sublette County Ag. Center in the memory of Lance Koppenhafer, due to his untimely death. Commissioner Bousman will prepare a resolution for the next meeting for adoption.
Gary Shriver, representing the Wyoming Department of Transportation, informed the Board that dead animals from the highway will be required by DEQ to be disposed of at the Marbleton Landfill, and requested that the fee be waived for this disposal. The Board approved the request.
The Board participated in a conference call with John McKinley of Davis and Cannon to discuss the Teton County Landfill Contract. The Board reviewed the existing contract and revisions, and discussed the formation of a Joint Powers Board or the development of a Joint Powers Agreement. The Board will forward a list of issues for the contract to McKinley, and he will prepare a draft for a future meeting.
Rick Hoffman, Waste Management Superintendent, discussed old well sites and correspondence from the DEQ. Hoffman presented cost information for electricity at the Pinedale Transfer Station. The Board discussed Pinedale recycling complaints.
Bart Myers, County Planner, reported on the Pinedale Planning and Zoning informational hearing on the Richardson application that will be heard by the County Planning and Zoning on March 14th.

The Chairman signed two Homeland Security Grant Awards.
It was moved by Commissioner Linn and seconded by Commissioner Bousman to adopt Resolution No. 07-975C appointing Mike D. Fuller, as a Special Prosecutor, to investigate, make a charging decision, and if indicated, to prosecute a criminal complaint against Garrett Wayne Bardin. The motion carried.
It was moved by Commissioner Bousman and seconded by Commissioner Linn to adopt Resolution No. 07-976C to notify the public and all persons claiming an interest in any lands to be altered by the Meeks Alteration of the Muddy Creek County Road No. 23-177. The motion carried.
Cecilia Richardson discussed affordable housing mechanisms with the Board. The Board, generally, discussed housing issues.
Shawn Jeter and Frank James discussed the facilities at the Fairgrounds for the Pig and Lamb Sale on April 7th. The Board directed them to resolve the issue.

PROPOSED ANNEXATION REPORT
J.M.O. ANNEXATION TO THE TOWN OF PINEDALE
In accordance with W.S. 15-1-402(c) the following may be reported:
1. A map of the area proposed to be annexed is attached.
2. The total estimated cost of infrastructure improvements required of all landowners by the annexing municipality: There are no costs required of the landowners as a result of the annexation. Any infrastructure improvements will be made at the election of the landowners within the annexed area but none are required of this annexation.
3. A list of basic and other services customarily available to residents of the Town of Pinedale and a timetable when these services will reasonably be available to the area proposed to be annexed is as follows: Customary services - Water, Sewer, Street Maintenance and Police Protection. Timetable – Water, Sewer, Street Maintenance and Police Protection are currently available to the proposed annexed area.
4. The projected annual fee or service cost for services described in Paragraph 3 above is:
Water – Commercial Hookup Fee - $500 to $3,000.00+
Quarterly Service Fee - $73.31 to $151.14
Sewer – Commercial Hookup Fee - $500 to $2,500.00
Quarterly Service Fee - $42.68 to $94.99
5. The current and projected property tax mill levies imposed by the Town of Pinedale: Mill Levy – 8 (statutory maximum)
6. The cost of the infrastructure improvements required within the existing boundaries of the Town of Pinedale to accommodate the proposed annexation: There are no additional infrastructure improvements required within the Town of Pinedale to serve the annexed area.

NOTICE TO APPROPRIATORS OF WATER
Public notice is hereby given that the following listed water users have completed the requirements of proof of appropriation and beneficial use of ground water for the following wells approved by the State Engineer. Pursuant to Section 41-4-511, Wyoming Statutes, 1977, the below listed proofs of appropriation will be held open for public inspection from 9:00 a.m. until 4:00 p.m. during April 23 through April 27, 2007, at the following location(s): 1. State Engineer's Office, Herschler Building, Cheyenne, Wyoming. 2. Office of the Division Superintendent, Town Hall, Cokeville, Wyoming. As allowed by Section 41-4-312, any person claiming a water right interest in the same sources of supply to which the below advertised proofs refer may inform the Water Division Superintendent of his desire to contest the rights of the person or persons seeking adjudication. The statement of contest shall be presented within fifteen days after the closing of the public inspection and shall state with reasonable certainty the grounds of the contest. The statement must be verified by the sworn affidavit of the contestant, his agent or attorney. If no contest is initiated, the advertised proofs will be submitted to the State Board of Control for consideration during its meeting beginning on May 14, 2007, with the Division Superintendent's recommendation that certificates of appropriation be issued.
