NOTICE OF APPLICATION
Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s Procedural Rules and Special Regulations, notice is hereby given of the application of Rocky Mountain Power a Power Cost Adjustment Mechanism (PCAM) rate increase in the amount of $2,837,251 pursuant to Rocky Mountain Power’s tariff Schedule 94.
Rocky Mountain Power (or the Company) is a public utility, as defined in W.S. § 37-1-101(a)(vi)(C), providing retail electric public utility service under certificates of public convenience and necessity issued by the Commission. Rocky Mountain Power is subject to the Commission’s jurisdiction under W.S. § 37-2-112.
The Company also provides retail electricity service under the name Rocky Mountain Power in the states of Utah and Idaho. The Company’s principal place of business in Wyoming is Casper. Rocky Mountain Power provides retail electricity service to approximately 132,000 customers in Wyoming.
On February 1, 2007, Rocky Mountain Power submitted an application, together with exhibits and revised sheets to its tariff Schedule 94, requesting a PCAM rate increase in the amount of $2,837,251 pursuant to the Company’s tariff Schedule 94 to reflect deferred Net Power Costs (NPC) for the period beginning July 1, 2006 through November 30, 2006. Rocky Mountain Power states that Deferred NPC have resulted from a number of factors including, but not limited to, higher Wyoming retail loads, higher coal prices, lower coal-fired generation during July 2006 when prices were very high, higher natural gas-fired generation and higher system balancing costs.
In the application, Rocky Mountain Power states that the Commission-approved stipulation in Docket No. 20000-230-ER-05 and tariff Schedule 94 require the Company to file its initial PCAM application on or before February 1, 2007 that compares adjusted actual total Company NPC for the time period beginning July 1, 2006 through November 30, 2006 to base total NPC of $336 million for this period.
Rocky Mountain Power states that, after giving effect to adjustments necessary for consistency with Commission-approved rate-making determinations of total Company NPC in previous rate cases, its total “Adjusted Actual NPC” for the period beginning July 1, 2006 and ending November 30, 2006 were approximately $396.8 million. Rocky Mountain Power’s application includes exhibits showing the Company’s calculation of its Deferred NPC Adjustment to rates pursuant to its tariff Schedule 94, including application of “Dead Band,” “Sharing Proportions,” and “Symmetrical Interest”; provision for an “Embedded Cost Differential Adjustment”; the allocation of the Deferred NPC Adjustment to Wyoming customers pursuant to the interjurisdictional allocation methodology known as the Revised Protocol; and the allocation of the adjustment to Rocky Mountain Power’s customer classes.

PUBLIC NOTICE
The regularly scheduled meeting of the Sublette County Board of Commissioners will meet on March 20, 2007 at 1:00 p.m. in the Sublette County Courthouse, Pinedale, Wyoming. At this time, a public hearing will be held to consider the following applications:
AGENDA
Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; planning staff proposes the following amendment to the text of the Sublette County Zoning and Development Regulations:
Chapter II Zoning Districts
Section 1. Zoning Districts.
Staff recommends the addition of the suffix FE to the zoning district in which a Family Exemption Division has occurred. The FE suffix will allow the lot created to be identified as a Family Exemption parcel; without changing the zoning district in which the parcel is located. Development standards applicable to the zoning district in which the Family Division lot is located remain unchanged, with the exception of Chapter III, section 18, as explained below.
Section 2. Authorized Uses.
Paragraph a., entitled “In any zoning district:”
Staff proposes the addition of subparagraph (4) to read, “Family Divisions; Family Divisions creating lots not less than 5 acres in size, shall be permitted.”
Chapter III Development Standards.
Staff proposes amending the language in Section 18. entitled “Minimum Site Area” to include lots created by Family Division shall not be less than 5 acres in size.
Chapter V Family Division of the County Subdivision Resolution
Section 3. Recordation
Change the language, which currently requires that following approval by the Board of County Commissioners the Record of Survey shall be recorded within 30 days. Staff recommends replacing Board of County Commissioners with Planning Department and Record of Survey to Map of Survey. Additionally, staff will recommend language be added to this Section requiring an Application of Family Division (application form to be available at the Planning Department) be submitted for review and approval by the Planning Department prior to the Map of Survey being recorded.
2. Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; planning staff proposes an amendment to the text of the Sublette County Zoning and Development Regulations reducing the setback requirements in Chapter III, Section 4, entitled “Setback Requirements” of the Sublette County Zoning and Development Regulations. Present setback requirements in the Rural Residential, Rural Residential 5, Rural Residential Mobile Home and Rural Residential Mobile Home 5 zoning districts are a 30 foot front setback - 10 foot side setback - 40 foot rear setback. Staff is prosing amending the current setback requirements for these zoning districts to a 25 foot front and rear setback and 10 foot side setback. In addition staff is prosing deleting the portion(s) of Chapter III, Section 4 allowing accessory structures to be setback 10 feet from a rear property line and providing for greater setbacks from the right of ways for State or federal Highways and County Roads.
3. Pursuant to Article VIII, Section 1 of the Sublette County Zoning and Development Regulations, entitled Administration; planning staff proposes an amendment to the text of the Sublette County Zoning and Development Regulations to change the definition of Guest House or Cabin, as provided in Chapter I, Section 6, entitled “Definitions” of the Sublette County Zoning and Development Regulations. The current definition provides a guest house or cabin as “An accessory, detached building, not exceeding 800 square feet in size which is designed, intended and used for the housing of nonpaying visitors or guests of the owners or occupants of the main dwelling on the site.” Staff proposes an amendment defining a guest house or cabin as “An accessory, detached building, not exceeding 1,100 square feet in size, inclusive of a basement or crawl space over 5 feet in height, which is designed, intended and used for the housing of nonpaying visitors, guests or family members of the owners or occupants of the main dwelling on the site.”

The Town Council of the Town of Pinedale met in regular session Monday, February 12, 2007, at 5:30 p.m., in the Town Hall.  Those present: Robert Brito, Barbara Boyce and Pam Curry, representing the Pinedale Planning and Zoning Board; Randy Hubbard, representing the Public Works Department; Aaron Seehafer, representing Rio Verde Engineering;  Keith Sunshine and Reed Armijo, representing Jorgensen Associates; James Rogers, representing Pinedale Properties; Jack Vogt, representing WYBAL, LLC;  Matt Thompson, representing Matt Thompson Construction, Inc;  K Thomas, representing TTCI; Brian Gray, representing Worthington,  Lenhart and Carpenter; Bill Sour; Laurie Latta, Community Development Coordinator; Pat Bozner, representing the Corral Bar; Carmel Kail; Albert Sommers, Chairman of the Sublette County Planning and Zoning Commission; Bill Lanning, representing the Bureau of Land Management; Annie O’Brien, representing the Pinedale Roundup; and Gail Kimberling, representing the Sublette Examiner.

Mayor Smith brought the meeting to order. Present on Roll Call: Gary Heuck, Stephen Smith, Nylla Kunard, Chris House and David Smith excused.

Motion by Heuck to approve the minutes of the January 22nd meeting as written.  Motion seconded.  Motion carried unanimously.

Matt Thompson, representing Matt Thompson Construction, Inc., requested a waiver of the frozen ground conditions ordinance for the First State Bank of Pinedale located at 61 East Pine Street to replace a sewerline located in the alley north of the bank.  After discussion motion by Kunard to allow Matt Thompson an emergency dig  following the One Call Rules and limited to a 48 hour time limit.   Motion seconded.  Motion carried unanimously.

Laurie Latta, Community Development Coordinator, asked the Council to approve a proposal to  host a tour conducted by the Wyoming Business Council Business and Industry Division as an effort to relocate out of state businesses to Wyoming.  Council was agreeable.

Pat Bozner, representing the Corral Bar, requested March 17th, St. Patrick’s Day, July 8th, Rendezvous Weekend, October 28th, Halloween and December31st, New Year’s Eve, as the four days each calendar year that retail liquor licensees may operate their dispensing rooms for a period of twenty-four hours.  Motion by Heuck to allow the four days for the 24 hour retail liquor sales as presented.  Motion seconded.  Motion carried unanimously.

Aaron Seehafer, representing Rio Verde Engineering, presented Albert M. and Carolyn M. Carollo’s request for plat approval of the Carollo Minor Subdivision’s,  Creation of Lots 1 & 2 and vacation of Tract 49 of the Cooley 6th Subdivision, which lies within one mile of the town limits.  Barbara Boyce,  representing the Pinedale Planning and Zoning Board, reported the Board voted unanimously  to approve the plat. Heuck discussed concerns with the septic and leach systems because of the property location in relation to Pine Creek.  After discussion motion by Heuck to approve the preliminary and final plat of the Carollo Minor Subdivision, Creation of Lots 1 & 2 and vacation of Tract 49 of the Cooley 6th Subdivision, provided the leach field and septic systems met the requirements of the Department of Environmental Quality.  Motion seconded.  Motion carried unanimously.

Jack Vogt, representing WYBAL, LLC, Reed Armijo, representing Jorgensen Associates,  presented for approval the preliminary plat for the Trails Creek Subdivision.  Armijo reviewed the conditions as discussed by the Pinedale Planning and Zoning Board: the applicant will confirm that the storm water runoff will be allowed to runoff into the Colorado Ditch, and that it will be cleaned.; town ordinance requiring curbs, gutters and sidewalks shall be followed; a note shall be included on the final plat indicating the soils contained within the lots along Pine Creek may not be suitable for roads or building as indicated in the Soil Conservation Service’s Soils Survey and that engineered building pads will be required; and buildings shall not be allowed in the FEMA Flood Zone A.  Robert Brito, representing the Pinedale Planning and Zoning Board, discussed the Board’s concerns.  Council discussed concerns with the development’s runoff going into the Colorado Ditch .  After discussion motion by Heuck to waive the Town’s ordinance requiring curbs, gutter and sidewalks for  5’ pathways and 8’ grass-lined swales.  Motion seconded.  Motion carried unanimously.  Council  discussed developers building in the flood zones. Ed Wood, Town Attorney, stated that the town’s masterplan states natural disasters should be avoided and proposed requiring developments built in the flood plan possess a flood elevation certificate.  Motion by Heuck to approve the preliminary plat with the conditions discussed:  the applicant will confirm that the storm water runoff be allowed to runoff in the Colorado Ditch and that it will be cleaned; a note shall be included on the final plat indicating that the soils contained within the lots along Pine Creek may not be suitable for roads or building as indicated in the Soil Conservation Services Soil Survey; and that engineered building pads will be required; and require an Elevation Certificate confirming that the finish floor of the structure is 1- foot above the BFE.  Motion seconded. Motion carried unanimously.

Bill Lanning, representing the Bureau of Land Management, requested a six month renewal for an Application for Temporary Use Permit for two temporary mobile homes on their lots on South Lincoln Avenue.  Motion by House to renew the Bureau of Land Management’s Application for Temporary Use for two temporary mobile homes on Lots 1-7, Block 6 Jones Addition.  Motion seconded.  Motion carried unanimously.

Albert Sommers, Chairman of the Sublette County Planning and Zoning Commission, discussed the  town and county zoning boards working together on standards and zoning in the one mile buffer.

Council agreed to amend Ordinance 401 and have the third reading at the next Council Meeting. 

Motion by House to approve Ordinance 402, an ordinance of the Town of Pinedale, Wyoming creating Section 10.20.040 of Chapter 10.23 of Title 10 of the Pinedale Municipal Code by prohibiting certain equipment on paved surface belonging to the Town within the Town Limits of the Town of Pinedale, on the third reading.  Motion seconded.  Motion carried unanimously.

Motion by Kunard to approve Ordinance 403, an ordinance annexing adjacent and contiguous land (Bloom Ranch Annexation) to the Town of Pinedale, Wyoming, and establishing zoning therefor, on the second reading.  Motion seconded.  Motion carried unanimously.

Motion by House to approve Ordinance 404, an ordinance annexing adjacent and contiguous land (WYBAL Annexation) to the Town of Pinedale, Wyoming and establishing zoning therefor, on the second reading.  Motion seconded.  Motion carried unanimously.

Motion by Kunard to approve Ordinance 405, an ordinance of the Town of Pinedale, Wyoming creating Chapter 6.05 of the Pinedale Municipal Code relating to the Control of cats within the Town of Pinedale, on the first reading.  Motion seconded.  Motion carried unanimously.

Motion by Kunard to hire Randy Simpson and Gary Stevens for the Public Works Department.  Motion seconded.  Kunard voted aye, House voted aye and Heuck abstained. Motion carried.

Motion by Kunard to adjourn the meeting.  Motion seconded.  Motion carried unanimously. Meeting adjourned at 7:30 p.m..
