NOTICE OF FINAL
PAYMENT TO CONTRACTOR
Notice is hereby given that Sublette County, Wyoming, has accepted work as completed according to the plans and specifications set forth in the agreement between Sublette County and HK Contractors, Inc., pursuant to the Project Manual for 2006 Sublette County Chip Seal Project, and that HK Contractors, Inc. is entitled to final settlement therefore. On December 27, 2006, being the forty-first day after the first publication of this notice, Sublette County will pay to HK Contractors, Inc. all amounts and balance due under said agreement.

The Board of County Commissioners of the County of Sublette has decided to alter or vacate part of the WILLOW CREEK COUNTY ROAD No. 23-110 through the E1/2SW1/4 and W1/2SE1/4, Section 33, T34N, R109W.
All objections thereto or claims for damages by reason thereof must be filed in writing with the County Clerk of said County, before noon on the 18th day of December 2006, or such road will be altered or vacated without reference to such objections or claims for damages.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
NOVEMBER 21, 2006
The Board of County Commissioners met in regular session in the Marbleton Town Hall in Marbleton, Wyoming, on this date at 9:00 a.m. with Betty Fear, Bill Cramer, John Linn, Joel Bousman, Commissioner-elect, Cat Urbigkit, representing the Sublette Examiner, Annie O’Brien of the Pinedale Roundup, and Mary Lankford, County Clerk present.
Chairman Fear led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of November 1, 2006, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Cramer. The motion carried.
The official bond for Sean E. Watts, Treasurer for the Big Piney Marbleton Airport Board, the amount of $10,000, was approved and ordered filed with the County Treasurer.
Butch Penton, Road & Bridge Superintendent, reported on the completion of the Paradise County Road project, snow plowing, gravel hauling, and speed limit studies.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to adopt Resolution No. 06-690F authorizing the Board to proceed with the alteration or vacation of Willow Lake Road No. 23-119. The motion carried.
Laurie Latta, representing the Transportation Plan, discussed costs of completing the plan. Butch Penton expressed his opposition to the plan. The Board decided to withdraw from the WYDOT agreement and directed the County Clerk to notify WYDOT.
Rick Hoffman, Waste Management Superintendent, reported on DEQ requirements for monitoring wells at closed County landfills, metal pile at the Marbleton Landfill, hazardous waste at the Pinedale Transfer Station, Freon removal, and the Integrated Solid Waste Plan. The Board approved ordering an 816 Compactor.
Jeffrey Jacquet, Socio-Economic Analyst, presented a Sales and Use Tax comparison report for the past five years. Future planning was discussed.
Eric Peterson and Steve James presented the Fairgrounds Master Plan. Peterson reviewed the process used to develop the plan. The Board discussed a feasibility study. It was decided to forgo a feasibility study and continue with the committee to pursue development.
Suzy Michnevich, representing the Sage Grouse Working Group, discussed carcass disposal to limit ravens and reported that the public hearing for the Sage Grouse plan will be January 11, 2007 from 6 p.m. to 8 p.m.

It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the preliminary and final plat for the Walter Minor Subdivision, to subdivide 35.05 acres, more or less, zoned R-R 10, located in Sections 19 and 24, T33N, R110W. The motion carried.
It was moved by Commissioner Linn and seconded by Commissioner Cramer to approve the preliminary and final plat for the Borzencki Minor Subdivision, to subdivide 40 acres, more or less, zoned R-R 20, located in the SW1/4SW1/4, Section 15, T34N, R110W. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 06-956F
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF JOHN AND PENNY CHRISMAN TO REZONE 5 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R 5 DISTRICT LOCATED IN SECTIONS 24 AND 25, T29N, R112W.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 06-957F
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF DONALD D. SHRIVER TO REZONE 10 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R 10 DISTRICT LOCATED IN THE NW1/4SW1/4 AND SW1/4SW1/4, SECTION 20, T34N, R109W.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the preliminary and final plat for the Kozeal Minor Subdivision, to subdivide 14.28 acres, zoned R-R 5, located in Section 3, T30N, R112W, with the condition that a road maintenance notation be placed on the plat. The motion carried and the Board will sign the plat, when the road maintenance notation has been completed.
It was moved by Commissioner Linn and seconded by Commissioner Cramer to approve and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 06-958F
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF LIFESTYLE DEVELOPMENT COMPANY TO REZONE 160 ACRES FROM RC DISTRICT TO RS-1 DISTRICT LOCATED IN SECTION 16, T39N, R110W.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve a variance request by Jay and Ann Fear to allow construction of an accessory building, which will be setback 20 feet from a front yard property line and 20 feet from a side yard property line, where 50 feet is required from both property lines, zoned A-1, and located in Section 34, T34N, R109W. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the preliminary plat for Duck Creek Subdivision, Patricia Sterck, applicant, to subdivide 66.09 acres into 11 lots, zoned R-R 5, located in Section 6, T33N, R109W. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve a request to vacate Lot 3, Caddy Minor Subdivision, and Lot 4, Caddy Minor Subdivision, First Amendment, by affidavit, located in Section 11, T36N, R113W. The motion carried.
Scott Scherbel discussed road maintenance agreements. The Board referred Scherbel to Bart Myers, County Planner.
Pam and Steve Fetzner inquired about being fined $2,000 for failure to have a building permit, and reviewed their situation. The Board discussed buildings without building permits and was advised by County Attorney Ralph Boynton on abatement or prosecution of building permit violations. It was moved by Commissioner Cramer and seconded by Commissioner Linn to abate the lack of a building permit by Fetzners for a fee of $500. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to recess the meeting for an Executive Session with County Attorney Ralph Boynton, County Planner Bart Myers, and Commissioner-elect Joel Bousman to discuss pending litigation. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to reconvene the meeting.

Bill Kellen requested that the Board consider locating a bowling center on 2.5 acres of the driving range at the Rendezvous Meadows Golf Course. The Board requested that Kellen contact the Golf Committee and neighboring property owners concerning his proposal.
Kim Shields, Director of the Yellowstone Development District, presented an overview of the District’s activities and possible funding for planning.
The Board discussed meeting with CenturyTel about no inter-county long distance charges.
The Board participated in a conference call with John McKinley and Mark Stewart of Davis & Cannon regarding establishing Class II County Roads. Stewart will develop process for designation of roads.
Mark Eatinger, representing Rio Verde Engineering, discussed the speed limit on Paradise County Road.
The Board approved Change Order No. 1 on the Paradise County Road Project for the amount of $70,118.80.
The Board approved and signed the Amended Joint Powers Agreement for the Lodging Excise Tax Joint Powers Board.
The Board reviewed a proposed easement from the Rock Mountain Elk Foundation and Linda Zager for the LaBarge Creek Road. The Board referred the easement to Paul Scherbel for review.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to designate 1st Bank as a County depository. The motion carried.

TOWN OF PINEDALE )
The Town Council of the Town of Pinedale met in regular session Monday, November 13, 2006, at 5:30 p.m., in the Town Hall.  Those in attendance: Matt Harber; Paul Rock and  Robert Brita representing the Pinedale Planning and Zoning Board; Brian Gray, representing Worthington, Lenhart and Carpenter; Mark Eatinger and Dennis Fornstrom, representing Rio Verde Engineering; Tim McKinney, representing The Dirt Road, LLC; Ben Cannon, representing the Pinedale Roundup and Jennifer Belknap representing the Sublette Examiner.
Mayor Smith brought the meeting to order.  Present on Roll Call: Gary Heuck, David Smith, Stephen Smith, Nylla Kunard and Chris House.   
Matt Harber, representing Favazzo West, LWI Investments, reported the proposed zone change had been tabled and he was going to have to return to the Pinedale Planning and Zoning.  
Dennis Fornstrom, representing Rio Verde Engineering, presented The Dirt Road, LLC’s request for plat approval of the Duck Creek Subdivision, which lies within one mile of the town limits.  Fornstrom reported the concerns of the Pinedale Planning and Zoning regarding the cul-de sac and the road easements had been addressed.  Heuck discussed his concerns with cul-de sacs.  Kunard discussed concerns with the angles of the roads.  Mayor Smith discussed working with the county on standards for the 1 mile radius with roads, water and sewer and long term issues.  Mark Eatinger, representing Rio Verde Engineering, discussed taking in consideration physical constraints and  natural barriers within the 1 mile radius which would effect future annexation.   Robert Brita, representing the Pinedale Planning and Zoning Board, discussed concerns when addressing developments within the 1 mile radius.  After lengthy discussion motion by David Smith to approve the preliminary plat of the Duck Creek Subdivision as presented stipulating joint approval of policy by the County Commissioners and the Town Council regarding the1 mile buffer line and notification to The Dirt Road, LLC  as soon as there is a decision.  Motion seconded.  Motion carried unanimously.
Dennis Fornstrom, representing Rio Verde Engineering, presented Bloom Ranch, LLC’s Petition for the Annexation to the Town of Pinedale of the property contained within the Park Lot Division, located in the SE/4 NE/4 and NE/4 SE/4, Section 4, T.33N., R.109W. Of the 6th P.M., Sublette County, Wyoming and contained within Lot 1, Park Lot Division, Sublette County, Wyoming.  Motion by David Smith to approve Resolution 2006-15, finding substantial compliance with Chapter 16.52 (Annexation) of the Ordinances of the Town of  Pinedale in the matter of The Petition for Annexation of Bloom Ranch, LLC.  Motion seconded.  Motion carried unanimously.
Dennis Fornstrom, representing Rio Verde Engineering, presented Vista Properties, LLC’s request for final plat approval of Country Lane Addition.  After discussion motion by Kunard to approve the final plat for Country Lane Addition stipulating a Letter of Credit in the amount of $102,600.00, contingent on installation of a valley pan with the town and Vista Properties, LLC sharing the cost of that valley pan.  Motion seconded.  Motion carried unanimously.
Robert Brita and Paul Rock, representing the Pinedale Planning and Zoning Board, discussed their meeting with the gas industry and the Bureau of Land Management concerning truck traffic on town streets.  Brita informed the Council industry needed to use Tyler Avenue in the winter months because it was the only access and they would visit with their employees about using the access during non-busy times of the day and the concerns with the traffic.  Heuck stated he wanted everyone to realize that Tyler Avenue is not the only street being discussed.  Brita stated he would speak with the companies and make them aware of that fact.  Rock requested the Council proceed with the ordinance regarding truck traffic.  After discussion Council agreed to wait to hear from the gas industry representatives before continuing on with the adoption of the ordinance.
Motion by Heuck to approve Ordinance 399, an ordinance of the Town of Pinedale, Wyoming amending Section 15.04.040 of Chapter 15.04 of the Pinedale Municipal Code to establish a time frame for filing building permit applications which must be referred to the Planning and Zoning Commission of the Town of Pinedale, on the third reading.  Motion seconded.  Motion carried unanimously.
Motion by Heuck to approve Resolution 2006-16, a resolution of the Town of Pinedale authorizing and reaffirming the execution of an application for Change of Zoning District Boundary regarding Ralph Wenz Field.  Motion seconded.  Heuck voted aye, Kunard voted aye, House voted aye and David Smith abstained.  Motion carried. The Council agreed to Sublette Center using Rendezvous Pointe’s accessory use garage. The Council acknowledged receiving the Pinedale Airport Treasurer’s report.
Kunard discussed the  fee for connection and water usage for the Pinedale Cemetery.   Mayor Smith informed the Council it was being worked on.
