The Board of County Commissioners of the County of Sublette has decided to alter part of the PARADISE COUNTY ROAD NO. 23-136 commencing at Station 297+39.6 in the NW1/4SE1/4, Section 10, T31N, R109W and thence running through the N1/2SE1/4 and SE1/4NE1/4 of said Section 10 and through the NW1/4SW1/4 and S1/2NW1/4, Section 11 terminating at Station 334+95.7;

All objections thereto or claims for damages by reason thereof must be filed in writing with the County Clerk, before 9 a.m. on the 1st day of November 2006, or such road will be altered without reference to such objections or claims for damages.

JOINT BIG PINEY-MARBLETON AIRPORT BOARD

BIG PINEY AIRPORT

SUBLETTE COUNTY, WYOMING

The Joint Big Piney-Marbleton Airport Board will accept proposals from Design-Build firms until 11 a.m. MDT, Tuesday, Nov. 14, 2006, for design and construction of a 150’ x 150’ facility for hangar and office space for the Big Piney Airport (BPI).

Proposals shall include professionally developed plans which include contact information for all involved parties, including all bidders, manufacturers, installers, contractors, etc. A minimum of five (5) copies of the proposal are required and proposals should contain the following:

- Building design and preliminary schematics

- Type of building

- Materials used in construction

- Exterior and roof colors

- Total design and construction cost

- Any other items for Joint Big Piney-Marbleton Airport Board consideration

This project shall consist of the design and construction of a single 150’ x 150’ facility that includes a 100’ x 150’ (15,000 SF) hangar area for aircraft storage and maintenance plus a 3,700 SF minimum area dedicated to maintenance operations and storage plus another 3,700 SF area dedicated to two-story FBO/office space. Exhibit 1 includes location information and Exhibit 2 includes information depicting the representative type, size, and style of the hangar desired. These supplemental exhibits can be obtained from Armstrong Consultants, Inc. at the address below.

After selection of a bidder, final improvement plans, reports, and specifications shall bear the seal and signature of the professional engineer responsible for their preparation. Vertical portions will be stamped by an architect, electrical, and mechanical engineer. These plans must contain details pertaining to site drainage, specific site layout, construction details, fire protection systems, utility improvement plans, building design, architectural profiles showing shape and colors, and any other specific items as may be reasonably required by the county. Bidder is responsible for obtaining all necessary permits.

The Joint Big Piney-Marbleton Airport Board reserves the right in its sole discretion to reject all or portions of any or all proposals, to waive irregularities and technicalities, to re-advertise, negotiate, or to proceed to provide the service otherwise in the best interest of the Board and the Big Piney Airport. The Joint Big Piney-Marbleton Airport Board may at its sole discretion modify or amend any and all provisions therein. The Joint Big Piney-Marbleton Airport Board may seek additional information it deems necessary from any proposer, and may require a bond or other guarantee deemed appropriate by the board. By submitting a proposal, the proposer acknowledges and agrees that it shall have no cause of action against the Joint Big Piney-Marbleton Airport Board or Sublette County, whatsoever, in regard to the evaluation and award of proposals herein.

Selection will be based on the determination by the airport board of the proposer most likely to deliver the project in a time frame, with time being of the essence, and at the best value and level of quality that is most advantageous to the Airport. Upon approval by the airport board, staff will notify the proposer that is most qualified and the Joint Big Piney-Marbleton Airport Board will immediately commence negotiations with the successful proposer. If an acceptable agreement cannot be negotiated with the successful proposer, negotiations will be terminated and will commence with the second highest-ranked proposer, and so on until the process is concluded.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS

OCTOBER 17, 2006

The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9:00 a.m. with Betty Fear, Bill Cramer, John Linn, Cat Urbigkit of the Sublette Examiner, representatives of the Pinedale Roundup, and Mary Lankford, County Clerk present.

Chairman Fear led those present in the Pledge of Allegiance.

The minutes of the preceding regular meeting of October 3, 2006, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Cramer. The motion carried.

The official bonds for Lynn Grassell, Treasurer for School District #1, in the amount of $25,000; Walt Bousman, Trustee for the Rural Health Care District, in the amount of $5,000; and Bill Stuble, Treasurer for the Redstone Upper Green River Road Improvement District, in the amount of $10,000, were approved and ordered filed with the County Treasurer.

Butch Penton, Road and Bridge Superintendent, reported on using rocks on Pape County Road, mitigation on the Industrial Site Road, maintenance on the Frontage Road in Bargerville at the bus stop, and culverts for LaBarge Creek.

The Board continued the hearing on the vacation of Runway Lane and Beacon Lane. Phelps Swift, representing Jennifer Binning, stated his continuing objection to the vacation, as he is still negotiating with the Pinedale Airport Board. It was moved by Commissioner Cramer and seconded by Commissioner Linn to continue the hearing until the November 1st meeting. The motion carried.

Bob McCarty, with County Attorney Ralph Boynton and Lt. Hayes Randol, discussed speed limits on Bargerville roads. Boynton informed the Board that speed limits can be set for enforcement by resolution and the subject roads are private roads with public access. Randol suggested “Yield” signs at three intersections. Later in the meeting, Boynton reported that a traffic study will need to be completed before the resolution can be adopted by the Board. The Board directed that the study be completed for the next meeting.

Robin Clover, director of SAFV, reported that the Home-Based Family Services funds, which the County has received for the past seven years, will not be available to the County this year. Clover requested, since the program is in place, County funds to continue the program. The Board approved the request.

Patty Burgin, representing the Sublette County Veteran Service Office, informed the Board that more office space is needed to continue to serve Sublette County veterans. The Board informed Burgin that it will pursue additional office space.

Pat Quealy, Deb Wood, and Ken Konicek, representing the Sublette Center, discussed providing financial support for the kitchen remodeling project. It was moved by Commissioner Cramer and seconded by Commissioner Linn to provide backup funding for the project. The motion carried.

The Board reviewed the petition for the enlargement of the Mosquito Abatement District #2 Improvement and Service District. The 30-day protest period ended on October 5, 2006, with no protests or modifications filed. In accordance with W.S. 22-29-109(f), it was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the petition, declaring the enlargement of the Mosquito Abatement District #2 Improvement and Service District, as presented in the petition, and directing that the question of enlargement of the district be submitted to the electors, by mail ballot, on December 5, 2006. The motion carried.

Bill Kellen presented a complaint about disposal of paint at the Pinedale Transfer Station. The Board will investigate the possibility of paint disposal at the Pinedale Transfer Station.

Steve Smith, Mayor of Pinedale, with Paul Rock, Pinedale Planning and Zoning Commission member, discussed banning commercial traffic over 26,000 pounds on Pinedale streets. The Board informed the group that it has worked on the situation for the past five years with no solution. It was determined that the BLM needs to be involved with a solution with the Game and Fish Department. Bill Lanning, representing the BLM, suggested a task group to work on a solution.

In accordance with the public notice published in the Sublette Examiner on September 21, 2006, public hearing was held for the following:

It was moved by Commissioner Linn and seconded Commissioner Cramer to approve a conditional use permit application by Stepp by Stepp, Inc. to contract and operate a worker’s camp on 4.93 acres, more or less, zoned I-H, being Lot 47, Sand Draw Industrial Park Subdivision, Second Filing, with the following conditions:

The Master Plan, as submitted by the applicant, must be followed.

A Permit to Construct from WYDEQ must be obtained prior to allow the man camp to operate.

Recommendations of the Workers Camp Task Force must be followed.

The conditional use shall expire one year from the date of approval, unless an application is submitted for review and renewal of the conditional use. Review and renewal shall require a public hearing with the Planning and Zoning Commission and a subsequent public hearing with the Board of County Commissioners.

The motion carried.

It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve a variance application by Bubba Larsen, to allow a guest house containing a total of 1,095 square feet of floor area, where the Sublette County Zoning and Development Regulations limit the size of a guest house to 800 square feet, on Lot 3A, Big River Subdivision. The motion carried. The issue of renting a guest house was raised, to which Mr. Larsen stated that he would not rent this house.

It was moved by Commissioner Linn and seconded by Commissioner Cramer to approve the Preliminary Plat for Tumbleweed Subdivision, Randy Reed applicant, located in the S1/2N1/2, Section 25, T34N, R111W, with the following conditions:

A note placed on the plat requiring wildlife-friendly fencing.

A note placed on the plat requiring enhanced wastewater treatment systems for Lots 1, 2, 3, 6, 7, 8, 9, 10, and 11.

The motion carried.

It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the Preliminary Plat for Culbertson Creek Subdivision, Dan Harrison and Earl Gabbard applicants, being Tract 1, Sheet 2, Hoback Ranches Subdivision, with the following conditions:

Building envelopes be identified on the plat.

A note placed on the plat requiring all new fencing to be wildlife-friendly, as recommended by the Wyoming Game and Fish Department.

A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND DENYING THE APPLICATION BY VLW, LLC TO RECLASSIFY AND REZONE 55 ACRES FROM A-1 DISTRICT TO R-R DISTRICT, LOCATED IN SECTION 27, T34N, R109W.

It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve a

conditional use permit application by Porta-Kamp, International to develop two 100 person temporary camps in the I-H district, being Lots 67 and 68, Sand Draw Industrial Park Subdivision, with the following conditions:

The approved sewage disposal system permitted by DEQ shall be installed and functional no later than July 1, 2007, or the conditional use permit is revoked.

The conditional use shall expire one year from the date of approval, unless an application is submitted for review and renewal of the conditional use. Review and renewal shall require a public hearing with the Planning and Zoning Commission and a subsequent public hearing with the Board of County Commissioners.

The motion carried.

County Attorney Ralph Boynton presented the approved Stipulation and Settlement agreement with Falers for the Board’s signature. It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve and sign the agreement. The motion carried.

It was moved by Commissioner Cramer and seconded by Commissioner Linn to appoint Betty Fear to continue on the Pinedale Anticline Working Group and the Sublette Community Association. The motion carried.

It was moved by Commissioner Cramer and seconded by Commissioner Linn to recess the meeting into Executive Session to discuss personnel with County Attorney Ralph Boynton and County Planner Bart Myers.

It was moved by Commissioner Cramer and seconded by Commissioner Linn to reconvene the meeting.

The Board announced that there is a vacancy for a Zoning Administrator in the Planning and Zoning Department.

It was moved by Commissioner Linn and seconded by Commissioner Cramer to purchase a 40 acre parcel for a gravel pit from Eastfork Livestock, Inc. for $400,000. The motion carried and the Board signed the purchase agreement.

NOTICE OF SPECIAL ENLARGEMENT ELECTION MOSQUITO ABATEMENT #2 IMPROVEMENT & SERVICE DISTRICT

A special enlargement election shall be held on Tuesday, December 5, 2006, to enlarge the MOSQUITO ABATEMENT #2 IMPROVEMENT & SERVICE DISTRICT and to elect three temporary directors of the proposed enlarged district to serve until the next regular election of the district. The election will be conducted by mail ballot. Ballots will be sent from the County Clerk’s Office by November 21, 2006.

The purpose of the proposed enlargement of the existing district will be to provide mosquito abatement.

A qualified voter is a person, who is an owner of land in the existing district and the proposed enlargement, or a qualified elector, including any corporation, partnership or association owning land in the district, provided the individual who casts the vote for a corporation, partnership or association presents written authorization to vote for the corporation, partnership, or association. No person is a qualified voter who is under eighteen (18) years of age, a mentally incompetent person, or who has been convicted of a felony and his civil rights have not been restored.

The boundaries of the proposed district, generally, are: T30N, R110W. Part of Sections 3, 10, 14, 15, 19, 20, 21, 22, 29, 30; T30N, R111W Part of Sections 2, 3, 10, 11, 12, 13, 14

A map of the specific areas to be included in the proposed enlargement is available for inspection at the Office of the County Clerk.

Absentee voting will be permitted. If a majority of the electors voting in the election favor enlargement of the district, the County Commissioners, by resolution, shall declare the district enlarged.

The election shall also be for the purpose of electing three (3) temporary directors for the enlarged district. Nominations are as follows:
