Town of Marbleton
Legal Notice
Notice is hereby given that the Town of Marbleton has accepted the work as substantially completed under a contract with A-Pleasant Construction, P.O. Box 783, Green River, Wyoming 82935; for the construction of the new town hall in Marbleton Wyoming. The contractor is entitled to final settlement. Therefore, on November 15, 2006, the 41st day after the publication of the first notice of substantial completion, the Town of Marbleton will pay to the contractor, A-Pleasant Construction, the full amount due under said contract. Nothing in this notice shall be construed as relieving the contractor in the securities on the contractor’s bond from any claim of claims for work or labor done or materials or supplies furnished in the execution of the contract. Any claims or objections by any party must be made to The Town of Marbleton prior to November 15, 2006.

PUBLIC NOTICE
The Sublette County Planning & Zoning Commission will meet on Thursday, Nov. 16, 2006, at 7 p.m. in the Sublette County Courthouse, Pinedale, Wyo. At this time, a public hearing will be held to consider the following applications:
AGENDA
1. Request for a change of zoning district boundary; pursuant to Chapter VIII, Section 2 of the Sublette County Zoning and Development Regulations, entitled Change of Zoning District Boundary and a request for a minor subdivision; pursuant to Chapter VI of the Sublette County Subdivision Resolution, entitled Minor Subdivision by John Kochever. The applicant is requesting a change in zoning district boundary for 24.05 acres from A-1 (Agricultural-35 acres per dwelling unit) acres to RR-20 (Rural Residential-20 acres per dwelling unit). The 24.05-acre parcel is part of a larger 47.66 acre parcel, with the additional 23.61 acre portion of the parcel being zoned recreational service and being developed with the Highline Trail RV Park. Approval of the change in zoning district boundary will allow a request for a minor subdivision to be considered for the 47.66-acre parcel to be subdivided into two lots, with lot 1 being the 23.61-acre parcel zoned recreational service and lot 2 being the 24.05-parcel zoned rural residential 20. The Kochever property is located in Section 15, Township 32N, Range 108W; generally described 8747 U. S. Highway 191 and being located on the east side of U. S. Highway 191 approximately 0.50 miles south of Wyoming state Highway 353.
2. Request for action on the final draft of the Sublette County Public Land Policy. The purpose of the Sublette County Public Land Policy is to convey the county’s position on various public land management issues and to ensure that the interest and concerns of the County are addressed in public land planning and management. Copies of the final draft of the Sublette County Public Lands Policy are available at the Sublette County Planning and Zoning Department, 21 S. Tyler Avenue, Pinedale, Wyo., 82941.

The town council of the Town of Pinedale met in regular session Monday, Sept. 25, 2006, at 5:30 p.m., in the town hall. Those in attendance: Jim Parker, airport manager; Julie James, Amy Hittle and Steve Green, representing Cattle Kate’s Spa; Hayes Randol, Wayne Bardin and Jim Whinnery, representing the Sublette County Sheriff’s Office; Julie Early, animal control officer; Rick Dolihite, representing GE Johnson; Aaron Seehafer, representing Rio Verde Engineering; Paul Rock, representing the Pinedale Planning and Zoning; Brian Gray, representing Worthington, Lenhart and Carpenter; Ron Brown, public works director; Ana Cuprill; Wes Wilson and Cheyenne Stone, representing Wilson Brothers Construction; Ben Cannon, representing the Pinedale Roundup; Jennifer Belknap, representing the Sublette Examiner.
Mayor Smith brought the meeting to order.  Present on Roll Call: Gary Heuck, David Smith, Stephen Smith, Nylla Kunard and Chris House.
Bill McCranie, a resident of Kentucky, presented Mayor Smith a plaque recognizing him as a commissioned Kentucky Colonel by the Commonwealth of Kentucky.
Motion by David Smith to approve the minutes of the Sept. 11 meeting as written. Motion seconded. David Smith voted aye, Kunard voted aye, House voted aye and Heuck abstained. Motion carried.
Julie Early, animal control officer, reported her monthly activities of the animal control department.
Ron Brown, public works director, reported the monthly activities of the public works department. 
Brown presented the vehicle bids: Frontier Ford $51,038.00; Fremont Motor $52,517.00; and Greiner Ford $53,09300. Brown recommended awarding the bid to Frontier Ford. Motion by Kunard to purchase the two vehicles from Frontier Ford in the amount of $51,038.00. Motion seconded.  Motion carried unanimously.
Wayne Bardin, Hayes Randol, and Jim Whinnery, representing the Sublette County Sheriff’s Office, reported the monthly activities of the sheriff’s office. Council discussed the concerns with traffic speed and pedestrian crossings. Council discussed the concerns with the vehicles parked on North Maybell Avenue.  
Public hearing for the issuing of a new restaurant liquor License for the China Gourmet, LLC was opened for discussion. No comments were received. Motion by Heuck to grant a restaurant liquor license to China Gourmet. Motion seconded. Motion carried unanimously.
Brian Gray, representing Worthington, Lenhart and Carpenter, presented the bids for the Fremont and Sublette Avenue Drainage Improvements: Rice Kilroy Construction $272,412; and Teletractors, Inc. $203,050. After discussion motion by David Smith to award the bid to Teletractors and to allow the Mayor to execute the necessary documents. Motion seconded.  Motion carried unanimously.
Amy Hittle, Julie James and Steve Green, representing Cattle Kate’s Salon and Spa, presented for approval the building permit for lot 2, Vista Addition. Motion by House to approve the building permit for Cattle Kate’s Salon and Spa on Lot 2, Vista Addition. Motion seconded. Motion carried unanimously.
Jim Parker, Pinedale Airport Manager, reported the monthly activities of the Pinedale Airport.
Aaron Seehafer, representing Rio Verde Engineering, gave an update on the Tyler Avenue Water Rehabilitation Project, Sublette Avenue Water and Sewer Rehabilitation Project and Sublette Avenue Valley Pan Project.  Seehafer discussed the change order requests from Wilson Brothers Construction to move the final completion dates to Oct. 15, 2006, for all three projects. After discussion motion by David Smith to allow until Oct. 15 as outlined in the letter. Motion seconded. Motion carried unanimously. 
Seehafer discussed  claims submitted for  property damage associated with the Sublette Avenue Water and Sewer Rehabilitation  Project. Council agreed to take it under advisement.
Paul Rock, representing the Pinedale Planning and Zoning Board, discussed the activities of the board. 
Motion by David Smith to approve Ordinance 398, an ordinance of the Town of Pinedale, Wyoming creating Section 9.16.060 of Chapter 9.16 of the Pinedale Municipal Code by restricting the use of mechanical exhaust devices or engine compression brakes in the Town of Pinedale, on the third reading. Motion seconded. Motion carried unanimously.
Motion by Kunard to approve the contract for services with Rendezvous Pointe for the sum of $25,000. Motion seconded. Motion carried unanimously.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
OCTOBER 3, 2006
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyo., on this date at 9 a.m. with Betty Fear, Bill Cramer, John Linn, Cat Urbigkit of the Sublette Examiner, Lindsey Ross of the Pinedale Roundup, and Mary Lankford, county clerk, present.
Chairman Fear led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of Sept. 5, 2006, were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Cramer. The motion carried.
Bob McCarty and Tim Wells, representing Bargerville, discussed health, safety and welfare issues related to the development’s roads and requested speed limit signs and enforcement. Commissioner Cramer discussed a proposal to establish a new road system with classification of county roads and rural roads. A committee would be appointed by the board to provide funding for rural roads in the form of grants. Later in the meeting, it was moved by Commissioner Cramer and seconded by Commissioner Linn to contract with Davis and Cannon, to research and advise the board on the proposal. The board referred McCarty to the county attorney and sheriff to discuss signage and speed enforcement.
Butch Penton, road and bridge superintendent, reported on roads and bike paths. Penton discussed snow catchers on BLM property.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to adopt Resolution No. 06-949F declaring the Highway 351 Alteration to the Paradise County Road No. 23-136 be declared a county road. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to adopt Resolution No. 06-948F declaring the Jensen Alteration to the Pocket Creek County Road No. 23-127 be declared a county road. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to adopt Resolution No. 06-947F directing the county clerk to publish a notice for a public hearing on the Jensen Alteration of the Paradise County Road No. 23-136 on Nov. 1, 2006. The motion carried.
Judi Adler, Barbara Burris and Pete Teller, representing Hoback Ranches Improvement and Service District, discussed winter parking. Last year the Forest Service granted a one-year lease to park inside the gate. Possible options for a long term solution were discussed. The board agreed to contact Greg Clark, district ranger, about the situation.
Doris Woodbury and Vern McAdams, representing School District No. 1, presented information on Constitutional Amendment B, which will be on the November 7th ballot. Passage of the amendment will reduce funds to Sublette County’s school districts.
In response to letters received from the local BLM Office and Terry Cleveland, state director, Wyoming Game and Fish, the board discussed the fence constructed along Paradise County Road. John Linn, project fence contractor, informed the board that the bottom wire is located at 16 inches, which is compliant with Game and Fish regulations, and that the top wire is higher, in an effort to keep livestock off the road. Bernie Holz, representing the Game and Fish, discussed the need for gates and panels on the state section. The comprehensive plan requirement for wildlife-friendly fencing was discussed. It was decided that the county will modify the state section of the fence and build gates and panels, and propose that the state open and close the gates and panels. Chairman Fear will contact Director Cleveland by letter with the proposal.
Sheriff Bardy Bardin, Undersheriff Jim Whinnery and Emergency Management Coordinator Bob Hanson, requested moving emergency management to the Road and Bridge Office, once the Road and Bridge personnel have moved into the new building. The board approved the request. The board approved a request to modify the sally port doors. It was moved by Commissioner Linn and seconded by Commissioner Cramer to approve the lease renewal with Pape Ranches, Inc. for a radio tower on Aspen Ridge. The motion carried.
The board agreed to contract with Proactive Rehabilitation for six months at $2,000 per month, effective Oct. 1, 2006, to provide access to exercise facilities for county employees.
Frank James, fairgrounds manager, reported on the need to rebuild the main gate, due to damage and rotten wood.
In accordance with the public notice published in the Sublette Examiner on Sept. 21, 2006, public hearing was held for the following:
1. It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 06-950F
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF SUBLETTE COUNTY TO AMEND THE SUBLETTE COUNTY ZONING AND DEVELOPMENT RESOLUTION.
1. It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve and sign the final plat for the Airport Industrial Park Subdivision. The motion carried.
The board discussed the MOU with the Department of Transportation for a County Transportation Plan. The board appointed Laurie Latta to represent the County on the committee.
County Planner Bart Myers discussed large-format copies. It was decided that the fee for these copies will be $5 per page, and no copyright materials will be copied.
Mike Miller, attorney representing Cecilia Richardson, informed the board that the Richardson family is not interested in allowing a road across the Richardson Ranch for access from U.S. Highway 191 to Pinedale.
Richard Thomas, Gloria Thomas, Walt Bousman, Alvin Mitchell and John Ball, representing the Sublette County Fire Board, discussed the upcoming vacancy in the Fire Warden position and funding. The board requested justification for full-time employment for the fire warden, before considering a full-time salary and benefits.
It was moved by Commissioner Linn and seconded by Commissioner Cramer to rescind Resolution No. 06-939F lifting the county partial fire ban. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to recess the meeting for an Executive Session with John McKinley, Davis and Cannon, to discuss litigation and the purchase of real estate. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to reconvene the meeting.
The following abatement petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Looney Bins, LLC, $228.51; Ultra Resources, Inc., $24,397.90; Wexpro Company, $343.67; Louis J. & Lori A. The Board of County Commissioners of the County of Sublette has decided to alter part of the PARADISE COUNTY ROAD NO. 23-136 commencing at Station 297+39.6 in the NW1/4SE1/4, Section 10, T31N, R109W and thence running through the N1/2SE1/4 and SE1/4NE1/4 of said Section 10 and through the NW1/4SW1/4 and S1/2NW1/4, Section 11 terminating at Station 334+95.7;
All objections thereto or claims for damages by reason thereof must be filed in writing with the County Clerk, before 9 a.m. on the 1st day of November 2006, or such road will be altered without reference to such objections or claims for damages.
