CALL FOR BIDS
The Town of Pinedale will be accepting sealed bids forproviding fuel supplies to the town. Bids are requested on the following:
Unleaded gasoline (minimum 85 octane)
Diesel fuel
A mixture of 60 percent No. 2 and 40 percent No. 1 duringwinter
100 percent No. 2 during summer
Propane
Bids are to be in accordance with terms and conditionscontained in the INFORMATION FOR BIDDERS and the proposed FUEL PURCHASEAGREEMENT, which are available from the Town Hall, 210 West Pine Street, duringregular business hours.
Bids must be received at the town hall no later than 5 p.m.on Monday, Aug. 14, 2006, at which time they will be opened and read aloud.Bids will be awarded at the regular council meeting at 6:30 p.m. on that day.Bids submitted by mail should be enclosed in a second envelope. The Town ofPinedale reserves the right to waive minor defects or irregularities in thebidding, or to reject all bids.

NOTICE OF FINAL
PAYMENT TO CONTRACTOR
Notice is hereby given that the Town of Pinedale, Wyominghas accepted work as completed according to the plans and specifications setforth in the agreement between the Town of Pinedale and Hydro ConstructionCompany, Incorporated, pursuant to the project manual for the PinedaleWastewater Treatment Facility Improvements Project, and that Hydro ConstructionCompany, Incorporated is entitled to final settlement thereof. On Sept. 6,2006, being the forty-first day after the first publication of the notice, theTown of Pinedale will pay to Hydro Construction Company, Incorporated allamounts and balance due under said agreement.

WHEREAS, the board of directors of the Sublette CountyMosquito Abatement District No. 1 met and held a public meeting at 38 PineCreek Drive on July 20, 2006, for the purpose of assessing for mosquitoabatement for the calendar year of 2007 and
WHEREAS, notice of said public hearing was given in theSublette Examiner on June 22, 2006;
NOW THEREFORE BE IT RESOLVED, by the board of directors ofthe Sublette County Abatement District No. 1, that the annual assessment formosquito abatement shall be as follows: $20 per business or residence in theSublette County Mosquito Abatement District Number 1.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JULY 17, 2006
The Board of County Commissioners met on this date at 8 p.m.in the Commissioners Meeting Room of the Sublette County Courthouse, for thefinal public hearing on the FY07 budget, in accordance with Wyoming Statute16-4-109(b), as amended, with Betty Fear, Bill Cramer, John Linn, Linsey Rossof the Pinedale Roundup and Mary Lankford, County Clerk present.
Commissioner Linn reported on the proposed purchase of ahelicopter by the State of Wyoming for Search and Rescue operations to beshared by Park, Teton, Sublette, Fremont and Lincoln Counties.
Chairman Fear discussed the formation of Joint Powers Boardswith the three towns and the reserve funds in the budget to fund the Boards.
There being no further comments, the meeting was adjournedat 8:25 p.m.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JULY 18, 2006
The Board of County Commissioners met in regular session inthe Commissioners Meeting Room of the Sublette County Courthouse on this dateat 9 a.m. with Betty Fear, Bill Cramer, John Linn, Cat Urbigkit of the SubletteExaminer Linsey Ross and Rob Shaul of the Pinedale Roundup and Mary Lankford,County Clerk present.
Chairman Fear led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of July 3,2006, were approved and ordered filed on motion by Commissioner Cramer andseconded by Commissioner Linn. Themotion carried.
The official bond for Betty Lou McLoughlin, Treasurer forthe Upper Green River Cemetery District, in the amount of $1,000, was approvedand ordered filed with the County Treasurer.
The Board reviewed the Final Budget Summary, theappropriation resolution and the resolution to provide income necessary tofinance the budget. It was movedby Commissioner Linn and seconded by Commissioner Cramer to adopt the FY07appropriation resolution and the FY07 resolution to provide income necessary tofinance the budget. The motioncarried, and the resolutions were signed.
BUDGET RESOLUTIONS
Butch Penton, Road & Bridge Superintendent, reported onchip sealing and discussed Mickelson Lane. Penton discussed the fencing on Industrial Site Road and theBoard agreed that no more approaches to the road will be granted.
The Board discussed the Reardon Draw relocation with JayMcGinnis. It is proposed that theCounty will move the road in exchange for gravel from McGinnis. It was moved by Commissioner Cramer andseconded by Commissioner Linn to adopt Resolution No. 06-925F authorizing theBoard to continue procedures for completing the alteration of Reardon DrawCounty Road No. 23-139 in accordance with applicable statutes includingconstruction, surveying and mapping, easements, other governmental permits anda final resolution. The motion carried.
Paul Scherbel discussed the legal description for theCottonwood Gravel Pit deed. TheCounty Clerk was directed to contact the parties to clarify the deed.
The Board signed Resolution No. 06-928F, which was adoptedat the July 3 meeting, regarding utility easements
Mark Eatinger, Rio Verde Engineering, presented the bidsreceived for asphalt for seven miles of Paradise Road. Chairman Fear declared a conflict andleft the meeting. Two bids werereceived with the apparent low bidder being McMurry Ready Mix. It was moved by Commissioner Linn andseconded by Commissioner Cramer to award the bid to McMurry Ready Mix for theamount of $3,046,877,897. Themotion carried.
Chairman Fear returned to the meeting.
Tony Chambers, representing Chambers Design-Build, reportedon the progress of the construction of the County Shop. Site work, floor, designated well forfire suppression, septic system, evaporation pond, trenching, fuel system, flagpoles and aprons were discussed. Penton informed the Board that he had Chambers design a concrete sandstorage building with three bays and a heated floor.
It was moved by Commissioner Cramer and seconded by CommissionerLinn to approve Change Order No. 4 for the amount of $23,152.50, due to theincrease in cost of concrete at $30 per yard from the original bid. The motion carried.
Lew Gage of Boulder Lake Ranch complimented the Road andBridge Department on road maintenance to Boulder Lake Ranch.
It was moved by Commissioner Cramer and seconded byCommissioner Linn to approve and sign the Special Use Authorization for theBondurant Shop, Firehouse and barbecue pit. The motion carried, and the permit signed.
It was moved by Commissioner Cramer and seconded byCommissioner Linn to adopt Resolution No. 06-929F appointing William H.Twichell as a Special Prosecutor to investigate, make a charging decision, and,if indicated, to prosecute a criminal complaint against Jeffery ClarkEllis. The motion carried.
It was moved by Commissioner Cramer and seconded byCommissioner Linn to issue a malt beverage permit to IXP Construction for ateam roping at the Pinedale Rodeo grounds on July 22 & 23, 2006. The motion carried.
The Board discussed the publication of its agenda, inresponse to a telephone call received by the County Clerk. It was decided that there is no goodsolution and took no action.
Chris House and Paul Ulrich, representing Encana, requesteda conditional use permit for a mancamp on BLM property to house 300workers. The Board referred themto the Planning and Zoning Department.

It was moved by Commissioner Linn and seconded byCommissioner Cramer to approve and act upon the recommendation of the Planningand Zoning Commission.
RESOLUTION NO. 06-926F
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNINGAND ZONING COMMISSION ANDAPPROVING THE APPLICATION BY JOHN AND WENDY WALTER TO RECLASSIFY AND REZONE 35.05 ACRES, MORE ORLESS, FROM A-1 TO RR-10 DISTRICT,LOCATED WITHIN LOTS 1 AND 2, SECTION 19, T33N, R108W AND THENE1/4NE1/4SE1/4NE1/4, SECTION 24, T34N, R109W.
It was moved by Commissioner Cramer and seconded byCommissioner Linn to approve a variance request by Tertia Leo, to allowconstruction of an addition with a rear setback of 32 feet where 40 feet isrequired, being Lot 2, Silver Sage Lot Division. The motion carried.
At the request of the applicant, it was moved byCommissioner Cramer and seconded by Commissioner Linn to table the final platapproval for Split Diamond Meadows Subdivision. The motion carried.
It was moved by Commissioner Linn and seconded byCommissioner Cramer to approve a variance request by Dean and Karen Clause, toallow the construction of an accessory building which will have a setback of 10feet from the right of way for Hopkins Lane, where 30 feet is required, beingLot 3, South Bench Subdivision. The motion carried. Theoriginal request was for 0 feet setback, which the Board increased to 10 feet.
It was moved by Commissioner Cramer and seconded byCommissioner Linn to approve and act upon the recommendation of the Planningand Zoning Commission. Upon vote,the motion carried, and the following resolution was adopted:
RESOLUTION NO. 06-927F
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING ANDZONING COMMISSION AND APPROVING THE APPLICATION BY JAMES GREENWOOD TORECLASSIFY AND REZONE 22 ACRES, MORE OR LESS, FROM A-1 TO R-R 5 AND R-R 20DISTRICT, LOCATED IN SECTIONS 23 AND 33, T30N, R110W. After discussion of waterissues and ponds, and at the request of the applicant, it was moved byCommissioner Linn and seconded by Commissioner Cramer to table the applicationof PDM Land Company to reclassify and rezone 60.5 acres from A-1 to R-R, locatedin Section 2, T33N, R110W. Themotion carried.
It was moved by Commissioner Linn and seconded byCommissioner Cramer to approve and act upon the recommendation of the Planningand Zoning Commission. Upon vote,the motion carried, and the following resolution was adopted:

A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING ANDZONING COMMISSION AND APPROVING THE APPLICATION BY SUBLETTE COUNTY PLANNING ANDZONING COMMISSION TO CHANGE THE TEXT OF THE SUBLETTE COUNTY ZONING ANDDEVELOPMENT REGULATIONS TO ALLOW FOR THE OPERATION OF SEXUALLY ORIENTEDBUSINESSES AS CONDITIONAL USES IN THE I-H DISTRICT.
A public hearing for the Matthew D. Miller Road Petition wasconducted by Bill Twichell, appointed Hearing Officer. County Attorney Ralph Boynton waspresent to represent Sublette County, Ed Wood was present to represent FrankNataros, Ann Nataros, Analind Corporation Ltd., and Willow Springs CattleCompany, and Bret King was present to represent Matthew D. Miller. The proceedings were reported by acourt reporter. Testimony wasreceived from witnesses and opening and closing arguments were conducted. It was moved by Commissioner Linn andseconded by Commissioner Cramer to recess the meeting for an Executive Sessionwith the County Attorney. It wasmoved by Commissioner Linn and seconded by Commissioner Cramer to reconvene themeeting. It was moved byCommissioner Cramer and seconded by Commissioner Linn to declare the petitionin order and appoint viewers. Twichell recessed the proceedings, with theCounty Attorney preparing the resolution for the Board and the partiessubmitting names of possible viewers for appointment. The viewers will be appointed at the next meeting on August2, 2006.
It was moved by Commissioner Linn and seconded by ChairmanFear to appoint Sean Watt to the Big Piney Marbleton Airport Board for a termof three years. The motioncarried.
It was moved by Commissioner Cramer and seconded by ChairmanFear to reappoint Dale Jensen to the Museum Board for a term of threeyears. The motion carried.
It was moved by Commissioner Cramer and seconded by ChairmanFear to appoint Jeff Kovac to the Lodging Tax Joint Powers Board for a term ofthree years. The motion carried.

APPROPRIATION RESOLUTION
WHEREAS, on the 18th day of JULY 2006
MARY L. LANKFORD, SUBLETTE
COUNTY CLERK
the budget making authority, prepared and submitted to theBoard a county budget for the 06-07 fiscal year ending June 30, 2007.
WHEREAS, such a budget was duly entered at large upon therecords of the Board and copy thereof was made available for public inspectionat the office of the County Clerk; and
WHEREAS, notice of a public hearing on such budget, togetherwith the summary of said budget, was published in
THE SUBLETTE EXAMINER
a legal newspaper published and of general circulation inthe county on the 13th day of July 2006 and
WHEREAS, a public hearing was held on such budget at thetime and place specified in said notice, as which time all interested partieswere given an opportunity to be heard; and
WHEREAS, following such public hearing certain alterationsand revisions were made in such proposed budget, all of which more fully appearin the minutes of the Board.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissionersthat the county budge, as so revised and altered, be adopted as the officialcounty budget for the fiscal year ending June 30, 2007.
BE IT FURTHER RESOLVED, that the following appropriations bemade for the 06-07 fiscal year ending June 30, 2007 and that the expendituresof each officer, department or spending agency be limited to the amount hereinappropriat-ed.
