A mandatory pre-bid meeting will be conducted at 10 a.m. local time on Feb. 28, 2006, at which time an onsite inspection of the proposed work will be conducted and special considerations will be discussed. The meeting will be held at the Pinedale Town Hall. All prospective bidders must attend this meeting.
Copies of the project manual and the design drawings specifying the work to be performed may be obtained from Rio Verde Engineering, upon payment of $50 for each set of documents. There will be no refunds for return of the documents. Copies are available for examination at the office of the engineer, Rio Verde Engineering.
Bidders shall be required to accompany each bid with a bid bond with sufficient surety, or a certified check, cashier’s check or bank draft upon some reputable bank payable to the Town of Pinedale for at least 10 percent of the total amount of the bid. The bond, check or bank draft shall be forfeited as liquidated damages, if the bidder, upon the letting of the contract to him, fails to enter into the contract within 15 days after it is presented to him for that purpose or fails to proceed with the performance of the contract. The bid bond, draft or check shall be retained by the Town of Pinedale until proper bond to secure performance of the contract has been filed and approved. All the above to be in accordance with 15-1-112, Wyoming Statutes, 1977, July 1980 Supplement.
The right is reserved by the Town of Pinedale to reject any and all bids, and to waive any irregularity or informality in the bidding. Bids may not be withdrawn for thirty days after the date of opening.

TOWN OF PINEDALE)
The town council of the Town of Pinedale met in regular session Monday, Feb. 13, 2006, at 5:30 p.m., in the town hall. Those present: Rose Skinner; Miriam Carlson; Nylla Kunard; Barbara Boyce and Gary Heuck. Also present: Meghan Thoreau; Paul Rock, representing the Pinedale Planning and Zoning Board; Mark Eatinger, representing Rio Verde Engineering; Jim Parker, Pinedale Airport Manager; Jim Berry and Jim McLellan, representing the Pinedale Airport Board; John Dahlke; Ed Wood, town attorney; Ron Brown, public works director; Noah Brenner, representing the Pinedale Roundup; and Isabel Rucker, representing the Sublette Examiner.
Mayor Skinner brought the meeting to order. Motion by Boyce to approve the minutes of the January 23rd meeting as written. Motion seconded.  Motion carried unanimously.
Motion by Heuck to approve the Corral Bar’s application for a 24-hour Catering/Malt Beverage Permit for February 18th at Rendezvous Pointe. Motion seconded. Motion carried unanimously.
John Dahlke, representing 36 South Tyler Avenue, presented a variance request for off-street parking for a new office building he plans to construct on lots 13 and 14, block 9 of Patterson First Addition. Dahlke stated the variance was asking for five off-street parking spaces instead of the 14 off-street parking spaces as required by the town’s parking ordinance. Paul Rock, representing the Pinedale Planning and Zoning Board, reported the board had recommended the approval of the variance request. After discussion, motion by Boyce to grant John Dahlke’s variance request for parking on lots 13 and 14, block 9 of Patterson First Addition. Motion seconded. Motion carried unanimously.   
Mayor Skinner presented Rob Shaul’s letter of request for the use of the Pinedale park on South Franklin Avenue and the American Legion Park to hold two events in the Green River Valley Winter Carnival. After discussion, motion by Kunard to allow the use of the town’s parks to hold the Green River Valley Winter Carnival events without a fee. Motion seconded. Motion carried unanimously.
Ed Wood, town attorney, gave an update on the new town shop/dog pound project.
Ed Wood, town attorney, presented the memorandum of agreement by and between the County of Sublette and the Town of Pinedale. Wood stated the purpose of the agreement is to set the agreement of the parties regarding the town shall undertake such steps and action as are legally  required to abandon Mill Street between South Tyler Avenue and South Fremont Avenue, the county shall contribute $3,600,000 towards the cost of the reconstruction of South Tyler Avenue and the ongoing upgrade and rehabilitation project on the sewer treatment system. Council was agreeable with the memorandum of agreement.
After discussion, motion by Kunard to go ahead and have Stantec do a proposal for the SCADA System. Motion seconded. Motion carried unanimously.
Mayor Skinner presented the 2006 Town of Pinedale South Main Sewer Trunk Line Project with an estimated cost of $4,932,350.  After discussion, motion by Boyce to have Rio Verde Engineering give a proposal for the 2006 Town of Pinedale South Main Sewer Trunk Line Project. Motion seconded. Motion carried unanimously.
Mayor Skinner presented the Pinedale Airport Board’s request to have signed an option agreement with  Joseph and Patricia Bozner for property in the airport subdivision.  Motion by Kunard to authorize the mayor to execute an extension of the option agreement to July 1, 2006, in form approved by Town Attorney Ed Wood. Motion seconded. Motion carried unanimously.
Jim McLellan and Jim Berry, representing the Pinedale Airport Board, introduced Jim Parker, the new airport manager.
Motion by Boyce to approve Resolution 2006-01, a resolution establishing Burzlander Memorial Park. Motion seconded. Motion carried unanimously.
Motion by Kunard to approve Ordinance 383, an ordinance of the Town of Pinedale, Wyo., creating chapter 9.05 to address and control the location of Sexually Oriented Businesses, on the third reading. Motion seconded. Motion carried unanimously.
Motion by Carlson to approve Ordinance 385, an ordinance amending the zoning map of the Town of Pinedale to reflect the amendment of the zoning classification of all lands located within the town limits of the Town of Pinedale which are located east of the east boundary line of Jackson Street and which are presently zoned R-2 to the R-2A zone district, on the first reading. Motion seconded. Motion carried unanimously.  
Motion by Heuck to approve Ordinance 384, an ordinance of the Town of Pinedale, Wyo., creating chapter 17.31 of the Pinedale Municipal Code to establish the R-2A zoning district within the Town of Pinedale, on the first reading. Motion seconded. Motion carried unanimously.
Mayor Skinner discussed participating in the formation of a coalition of Southwest Wyoming Elected Officials to unify and set priorities of the municipalities and to speak as a group when presenting these priorities and lobbying our state legislators. Council was agreeable with participating in the formation of the coalition.

ORDINANCE 05-384
AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING CREATING CHAPTER 17.31 OF THE PINEDALE MUNICIPAL CODE TO ESTABLISH THE R-2A ZONING DISTRICT WITHIN THE TOWN OF PINEDALE.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT CHAPTER 17.31 OF THE PINEDALE MUNICIPAL CODE IS HEREBY CREATED TO READ AS FOLLOWS:

17.31.010 Purpose. The R-2A district is intended to provide for a compatible mixture of single-family and multifamily dwellings not to exceed two dwelling units in the historic developed area of the Town of Pinedale at a density slightly higher than that for single-family districts alone, plus the accessory public and semi-public uses offering services to the surrounding area.
17.31.020 Permitted uses. Buildings shall be limited in height to not exceed two aboveground stories. The following uses may be operated as permitted uses in the R-2A district:
A. Single-family dwelling, which may include the rooming and boarding of up to two persons, provided no separate kitchen is involved;
B. Multifamily dwelling, not to exceed two dwelling units;
C. Church;
D. Community center, which may be public or private but not operated for gain;
E. Day care for up to eleven children;
F. Fire station;
G. Foster care for up to four children;
H. Library;
I. Nursing home or home for the elderly;
J. Public park, playground and other public recreational facilities;
K. Public and private pre-school and school for elementary and secondary education;
L. Essential public utility and public service installations. Such uses do not include business offices, repair, sales or storage facilities.
17.31.040 Accessory uses. Any use which complies with all of the following conditions may be operated as an accessory use to a permitted use in the R-2A district:
A. Is clearly incidental and customary to and commonly associated with the operation of the permitted use;
B. Is operated and maintained under the same ownership and in the same lot as the permitted use;
C. Does not include structures or structural features inconsistent with the permitted use;
D. Does not include residential occupancy;
E. If operated wholly or partially within the structure containing the permitted use, the gross floor area utilized by the accessory use shall not exceed thirty percent of the gross floor area of the permitted use;
F. If in a separate, detached structure from a permitted use, the gross floor area devoted to the accessory use shall not exceed the gross floor area of the permitted use. Separate, detached structures containing an accessory use shall be, at a minimum, ten feet from structures containing a permitted use.
17.31.050 Home occupations. Home occupations shall be allowed in the R-2A district provided all of the following conditions are met:,
A. Such use shall be conducted entirely within a dwelling unit and carried on by the inhabitants living there and no others.
B. Such use shall be clearly incidental and secondary to the use of the dwelling unit for dwelling purposes and shall not change the residential character thereof.
C. The total area used for such purposes shall not exceed twenty percent of the gross floor area of a single-family dwelling, or twenty percent of the gross floor area of the user’s dwelling unit in a multifamily dwelling.
D. There shall be no exterior storage on the premises of material or equipment used as a part of the home occupation.
E. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line.
F. A home occupation shall provide additional off-street parking of one parking space for each two hundred square feet of gross floor area occupied by the home occupation.
17.31.060 Lot area. The minimum area of a zone lot in the R-2A district is six thousand square feet.
17.31.070 Lot width. The minimum width of a zoning lot in the R-2A district is fifty feet at the front setback line.
17.31.080 Yards. Minimum yards for structures in the R-2A district:
A. Front yard, twenty feet; corner lots shall have a twenty-foot building setback from both streets;
B. Side yard, seven feet;
C. Rear yard:
1. Structures containing permitted uses, twenty feet or twenty percent of the
depth of the zone lot, whichever is smaller,
2. Structures containing accessory uses only, five feet.
17.31.090 Yard encroachments. In the R-2A district:
A. Belt courses, sills, lintels, exterior columns, chimneys and building accessories may project twenty-four inches into front and rear yards.
B. Open or unwalled porches, terraces, balconies and exterior stairways may project three and one-half feet into front and rear yards.
C. Cornices, overhangs, eaves and gutters may project two feet into all yards.
D. Carports shall be constructed leaving at least two sides open, and shall not project into minimum yards as listed in Section 17.31.080.
17.31.100 Height limit. The maximum height of structures in the R-2A district is thirty-five feet.
17.31.110 Open space. Required open space in the R-2A district shall be as follows:
A. Zone lots occupied by single-family dwellings shall maintain fifty percent of the zone lot as free and unobstructed open space.
B. Zone lots occupied by multifamily dwellings shall maintain one thousand five hundred square feet of free and unobstructed open space.
C. Area devoted to off-street parking shall not be counted as free and unobstructed open space.
17.31.120 Fences and walls. Any fence, wall or retaining wall in the R-2A district over three feet in height shall be erected only after application to and approval of a permit by the zoning administrator.
A. Fences, walls and retaining walls may he erected to a height of forty-eight inches only in the front yard and to a height of six and one-half feet on any part of the zone lot not in the front yard, except that on corner lots, no fence, wall, retaining wall or obstructing foliage shall be allowed within twenty feet of the point of intersection of the two intersecting property lines or, on curved property lines, the projected point of intersection of the two property lines extended.
B. No barbed wire or electrically charged fences shall be allowed.
C. Open-mesh fences of any height may be erected on zone lots containing schools, public parks and playgrounds.

ORDINANCE NO. 385
AN ORDINANCE AMENDING THE ZONING MAP OF THE TOWN OF PINEDALE TO REFLECT THE AMENDMENT OF THE ZONING CLASSIFICATION OF ALL LANDS LOCATED WITHIN THE TOWN LIMITS OF THE TOWN OF PINEDALE WHICH ARE LOCATED EAST OF THE EAST BOUNDARY LINE OF JACKSON STREET AND WHICH ARE PRESENTLY ZONED R-2 TO THE R-2A ZONE DISTRICT.
WHEREAS, the Town Council has determined that changing conditions within the Town of Pinedale support the limitation of multifamily residences being built within that portion of the Town zoned R-2 which are located east of Jackson Street; and,
WHEREAS, these changing conditions include the fact that this area of the Town has become heavily developed as single family residences and large three or four unit multifamily buildings are in the interest of the public health, safety and general welfare; and,
WHEREAS, it has been determined that this issue should best be addressed by the rezoning of all lands within the Town which are located east of Jackson Street and which are zoned R-2 to the R-2A zone district;
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE:
SECTION 1 All lands located in the Town of Pinedale, Wyoming, located east of the eastern boundary of Jackson Street and presently zoned R-2 are hereby rezoned to the R-2A zone district.
SECTION 2. The zoning map for the Town of Pinedale, Wyoming, is hereby amended to reflect the zoning classification of the annexed property.
This ordinance shall be in full force and effect from and after passage on three readings and publication according to law.
