Drainage drags

Sublette County Commissioners met Tuesday, first hearing from Mark Eatinger of Rio Verde Engineering about the drainage problem at Rendezvous Pointe.

With the county preparing to pave the street, surveyors arrived onsite last week, only to have officials from Faler's General Store order them to leave, according to Sublette County Clerk Mary Lankford.

Lankford pointed out that a court has already ruled that Faler's does not have an exclusive easement to the street separating the retirement center and the store.

County Attorney Van Graham advised that the county needs to have an accepted drainage plan in place before it begins work, Lankford said, in case the issue ends up in litigation once again.

Commissioner John Linn expressed an interest in having the county closely coordinate the drainage and paving work with Faler's, so that the store is not disrupted by the activity.

Eatinger pledged to contact Faler's representatives to try to coordinate the effort.

Faler's sold the property Magnolia Street is located on, but retained an easement for the road, Commissioner Bill Cramer said. The easement only provides for ingress and egress, Cramer noted.

"We can't keep postponing this," Commission Chair Betty Fear said, adding that it's her hope that Faler's will work with the county in getting the work completed.

"I hate to do business this way," Fear said. "But everything we've tried to do over there has been met with opposition."

Cramer made a motion to approve the drainage plan as presented by Eatinger. Linn asked to amend the motion to make the approval contingent on Faler's having the opportunity to weigh-in on the plan. Cramer declined to allow his motion to be amended, so Linn refused to second the motion. Fear seconded the motion, which was successful, with Linn voting in opposition.
