INVITATION FOR BIDS
UPPER GREEN RIVER CEMETERY
DISTRICT
MUNICIPAL WATER SERVICE
FOR THE PINEDALE CEMETERY
Sealed bids are requested for work described in the project manual for the municipal water service for the Pinedale Cemetery for the Upper Green River Cemetery District, dated June 13, 2005, prepared by Rio Verde Engineering, 201 West Pine Street, P.O. Box 642, Pinedale, Wyo., 82941. Copies of the project manual and the design drawings specifying the work to be performed may be obtained from Rio Verde Engineering.
Bids will be received by Rio Verde Engineering, at their office, until 2 p.m. local time on June 30, 2005, at which time said bids will be publicly opened and read aloud.
The work consists of 500 LF of 8" DIP, 900 LF of 6" DIP, three fire hydrants, 1-4" water service, 1-3/4" copper water service, miscellaneous appurtenances and street repair.
Bidders shall be required to accompany each bid with a bid bond with sufficient surety, or a certified check, cashier's check or bank draft upon some reputable bank payable to the Upper Green River Cemetery District for at least ten (10) percent of the total amount of the bid. The bond, check or bank draft shall be forfeited as liquidated damages if the bidder, upon the letting of the contract to him, fails to enter into the contract within ten (10) days after it is presented to him for that purpose or fails to proceed with the performance of the contract. The bid bond, draft or check shall be retained by the Upper Green River Cemetery District until proper bond to secure performance of the contract has been filed and approved. All the above is to be in accordance with 15-1-112, Wyoming Statutes, 1977, July 1980 Supplement.
The right is reserved by the Upper Green River Cemetery District to reject any and all bids and to waive any irregularity or informality in the bidding. Bids may not be withdrawn for thirty (30) days after the date of opening.

INVITATION FOR BIDS
Sealed bids, entitled Plainview Cemetery - Pump Station & Supply Line Replacement, Big Piney, Wyo. - will be received by CARL THUESEN ASLA, 1925 Grand Avenue, Suite 105, Billings, Mont., 59102 until 2 p.m. mountain standard time, July 14, 2005 in accordance with the plans, specifications and other contract documents.
At said place and time, and promptly thereafter, all proposals that have been duly received will be publicly opened and read aloud. No bid may be withdrawn within a period of thirty (30) days after the scheduled time for the opening of bids, which is 2 p.m. mountain standard time, July 14, 2005.
The scope of the project shall generally include, but not necessarily be limited to:
Removal of existing pump station, enclosure, supply line and installation of new intake structure, pump station, enclosure and supply line.
All bidders must submit documentation and evidence of successful installation of two pump stations of similar flow capabilities and design, acceptable to the owner. Documentation of experience shall accompany all bids.
A pre-bid conference will be held at the Plainview Cemetery Office, 436 County Road 151, Big Piney, Wyo., beginning at 8:30 a.m. on July 7, 2005. Attendance at the pre-bid conference is mandatory for all contractors wishing to bid the project as a prime contractor.
The contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin.
Plans and specifications may be examined in the Plainview Cemetery office or in the architect's office. Copies of said documents may be obtained from the Landscape Architect, Carl Thuesen ASLA, 1925 Grand Avenue No. 105, Billings, Mont., 59102, telephone 406-252-5545, for a non-refundable reproduction charge of $75.00 per set.
Each bid or proposal must be accompanied by a certified check, cashier's check or bid bond payable to Big Piney Cemetery District, Wyo., in an amount not less than five percent (5%) of the total amount of the bid. Successful bidder(s) shall furnish an approved performance bond, labor and material payment bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance as required shall be obtained by the successful bidder(s) and a certificate of that insurance shall be provided.
The right is reserved to reject any or all proposals received, to waive informalities, to postpone the award of the contract for a period of not to exceed thirty (30) days and to accept the bid that is in the best interests of the Big Piney Cemetery District.

DESCRIPTION OF PROJECT:
The project consists of the construction of a new town hall for the Town of Marbleton, Wyo. The building will be one story. This facility will be constructed on a new site consisting of 3/4 of a block within the city. Phase 1 of the project is accomplished and consisted of developing the site for construction and preparation of some of the utilities. The building construction will consist of concrete work, masonry, engineered wood studs, wood truss framing and metal roofing. The interior will generally be painted gypsum board, carpet and tile flooring, wood and plastic laminate casework and gypsum and acoustic tile ceilings. Civil site work, Mechanical HVAC and plumbing and electrical will be included.

The following matters will come before this Commission on TUESDAY, JULY 19, 2005, at 9 a.m. or as soon thereafter as the matters may be heard, or between the hours of 8 a.m. and 5 p.m. on any of the subsequent days during which the Commission remains in session at the office of the State Oil and Gas Supervisor, 2211 King Boulevard, Casper, Wyoming.
Cause No. 3, Order No. 2, DOCKET NO. 308-2005, brought on the application of BP America Production Company for an order authorizing the drilling of forty-six (46) additional infill wells, to be drilled on a five-acre density and to test and produce from the Jonah Field Lance Pool in the SE1/4, E1/2 SW1/4 of Section 28, Township 29 North, Range 108 West, 6th P.M., and the N1/2, N1/2 S1/2 of Section 36, Township 39 North, Range 108 West, 6th P.M. (or lots or tracts substantially equivalent thereto); each of said proposed wells will be an increase in the density of wells to the Jonah Field Lance Pool over and above that currently authorized and at locations other than those currently provided for under the Commission's prior orders in Dockets No. 228-98, No. 90-2000 and No. 521-2004; such additional wells requested to be located anywhere on the surface, but at the producing interval, no closer than 330 feet to the boundary of the involved 80-acre drilling and spacing units as more particularly described in the application; and to authorize unrestricted production from each such additional well from any portion of the Jonah Field Lance Pool, as defined by the Commission's order in Docket No. 84-2003, all in the Jonah Field, Sublette County, Wyoming.

NOTICE OF PUBLIC HEARING
RELATING TO WATER RIGHTS
IN THE MATTER OF petition docket IV-2005-2-7 by Dan Huish of Wapika Ranch before the Wyoming State Board of Control for a 361-acre portion of the Half Moon Lodge water right appropriation recorded as diverting from Surveyor Creek (a tributary of Half Moon Lake, which is a tributary of Pole Creek) with priority of September 14, 1927.
The petition seeks to CHANGE THE POINT OF DIVERSION AND MEANS OF CONVEYANCE of Permit 17269 (Proof 20075) from Surveyor Creek in Section 5 to a pump point on Half Moon Lake called Wapika Pipeline in Section 8, T34N R108W, east of Pinedale Wyoming.
Said petition has been referred to the undersigned for public hearing to satisfy consents as provided for by law under Wyoming Statute 41-3-114.
NOW THEREFORE, a public hearing will be held in the Council Room of the Pinedale Town Hall at 210 West Pine Street on Tuesday, Aug. 2, 2005 at 1 p.m., at which time anyone whose recorded water right will be injured by the granting of said petition may appear and submit testimony in protest.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JUNE 21, 2005
The Board of County Commissioners met in regular session in the commissioners meeting room of the Sublette County Courthouse, Pinedale, Wyo., on this date at 9 a.m. with Betty Fear, Bill Cramer, John Linn, Cat Urbigkit of the Sublette Examiner, Noah Brenner of the Pinedale Roundup and Mary Lankford, county clerk, present.
Chairman Fear led those present in the Pledge of Allegiance.
The minutes of the preceding regular and special meetings of June 7, 8 and 9, 2005 were approved and ordered filed on motion by Commissioner Linn and seconded by Commissioner Cramer. The motion carried.
The official bonds for Anita Mae Bartosh, treasurer for the Town of Marbleton, in the amount of $50,000; and Bill Stuble, treasurer for the Redstone Upper Green River Road Improvement District, in the amount of $10,000 was approved and ordered filed with the county treasurer.
Butch Penton, road & bridge superintendent, reported on soil stabilization, gravel pit sites and acquisition of a bridge at Farson.
Chairman Fear reported on the LaBarge Creek road.
Adrianne Peterson, Sublette County Weed & Pest, invited the board to a work day at Pine Grove Ridge on July 6, 2005.
Jay Fear, representing High Mountain Real Estate, and Bill Kellen presented information on the sale of the Pinedale Entertainment Center. The board expressed no interest in purchasing the facility.
It was moved by Commissioner Linn and seconded by Commissioner Cramer to recess the meeting into executive session with Sheriff Hank Ruland and Undersheriff Henry Schmidt to discuss a personnel matter.
It was moved by Commissioner Linn and seconded by Commissioner Cramer to reconvene the meeting.
It was moved by Commissioner Linn and seconded by Commissioner Cramer to set a hearing for a contested case by Ernie Kawa on July 19, 2005, at 3 p.m. The motion carried.
Sheriff Ruland and Undersheriff Schmidt discussed the law enforcement metro agreements and were informed by the board that it plans to waive the fees to the towns this year. Leasing property for Tip Top Search and Rescue was discussed, but no action was taken. Schmidt discussed a contact for himself for grant services. The board took no action.
The board received the following budget requests, subject to final approval:

It was moved by Commissioner Cramer and seconded by Commissioner Linn to renew the restaurant liquor license for Half Moon Lake Lodge. The motion carried.
Rose Skinner and Miriam Carlson, representing the Town of Pinedale, discussed funding shortages for the Tyler and lagoon projects and informed the board that the town is considering abandoning Mill Street. A survey will be placed in the upcoming water bills. An alternate route to divert traffic from Tyler Avenue was discussed.
In accordance with the public notice published in the Sublette Examiner on May 26, June 2, 9 & 16, 2005, public hearing was held for the application by Vista Properties LLC to transfer and renew the retail liquor license for Country Lane Liquor. There being no objections, it was moved by Commissioner Cramer and seconded by Commissioner Linn to transfer and renew the license. The motion carried.
In accordance with the public notice published in the Sublette Examiner on May 19, 2005, public hearing was held for the following:
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the preliminary and final plat for the Aitken Homestead minor Subdivision/Noble to create one 20.42 acre lot, more or less, zoned R-R 20, located in the NW1/4SE1/4, Section 29, T34N, R110W with two conditions:
Access permit from the state highway be obtained.
Game and Fish comments be added to the plat.
The motion carried, with the vote being: Fear-aye, Cramer-aye and Linn, nay.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the preliminary and final plat for the Big Country Ranches Third Minor Subdivision of Lot 10/Reints to subdivide 20.04 acres, more or less, zoned R-R MH 10 into two residential lots, located in the NE1/4, Section 32, T33N, R108W. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, and the following resolution was adopted:

A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF JOHN AND VIRGINIA DOYLE TO RECLASSIFY AND REZONE 10 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R 10 DISTRICT, LOCATED IN THE SW1/4SW1/4, SECTION 2, T33N, R109W.
It was moved by Commissioner Linn and seconded by Commissioner Cramer to approve and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 05-844F
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF JEFF STINSON TO RECLASSIFY AND REZONE 1 ACRE, MORE OR LESS, FROM CH-1 DISTRICT TO RM DISTRICT BEING LOT 3, BLOCK 1, DANIEL MEADOW COMMERCIAL LOTS SUBDIVISION.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the application by Sublette County to operate a gravel pit with washing, screening and crushing on approximately 78.06 acres, more or less, zoned A-1, located in the W1/2NE1/4, Section 14, T33N, R113W, with the following conditions:
The hours of operation are restricted to daylight hours.
The gravel pit shall be reclaimed to Wyoming State Specifications. The surface of the reclaimed pit above the water table shall be top soiled and seeded in accordance with Wyoming State Specifications.
There shall be no stockpile of materials at the completion of the gravel pit.
The conditional use permit for the gravel pit, washing, screening and crushing shall expire in five years from the issuance of the Zoning and Development permit, being June 21, 2010.
The operation shall be kept neat and orderly to minimize the visual impact.
All operations and activities shall be set back a minimum of 300 feet from the Cottonwood-Ryegrass County Road No. 23-117 and 50 feet from other property boundaries.
Sublette County Weed and Pest shall inspect the extraction area prior to the issuance of a zoning and development permit and the extraction area shall be free of noxious and designated weeds, according to Wyoming Weed and Pest Control Act of 1973 regional forage certification standards.
All extraction areas and equipment shall be subject to ongoing inspections by the Sublette County Weed and Pest. If the extraction area or equipment is found to be in violation of the Wyoming Weed and Pest Control Act of 1973, regional forage certification standards, it shall be subject to quarantine.
The seven criteria for gravel pit development listed in Chapter III, Section 38, Sublette County Zoning and Development Resolution shall be complied with by the applicant.
All necessary DEQ permits shall be in order before crushing can begin.
The reseeding of the grass mixture to be used will be in compliance with the recommendation from the NRCS.
The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to approve the variance request by the industrial division sign committee, David Jenkins, to place a directory sign with eighteen, eight square-foot placards and a 56 square-foot heading at the intersection of U.S. Highway 191 and the industrial site county road No. 23-190, with the following conditions:
The sign will have no illumination.
The sign will hold a maximum number of eighteen, eight square-foot placards.
The motion carried.
Chairman Fear read a letter from the Sublette County Republican Central Committee recommending Wayne T. (Bardy) Bardin, Jim Whinnery and Alan Ziegler to fill the vacancy created by the resignation of Sheriff Hank Ruland, effective at noon, June 30, 2005.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to recess the meeting into executive session to interview the three recommended candidates for sheriff. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Linn to reconvene the meeting and receive comments from the public concerning the appointment before voting. No comments were received. The board voted by secret ballot and the ballots were counted by County Clerk Mary Lankford, with the vote being: 3 votes for Wayne M. (Bardy) Bardin. It was moved by Commissioner Cramer and seconded by Commissioner Linn to appoint Bardy Bardin to fill the vacancy effective at noon on June 30, 2005. The motion carried.
In response to a request from Ralph E. Wood, representing Main Pass, LLC, for a contested hearing and a continuance, and with agreement from Douglas Mason, representing Mantle Ranch Real Estate LP, it was moved by Commissioner Cramer and seconded by Commissioner Linn to grant the request from a continuance and schedule a contested hearing for July 19, 2005, at 9:30 a.m. The motion carried.
Robyn Clover, representing SAFV, discussed the confidentiality of a safe house location and the CDBG application. It was moved by Commissioner Linn and seconded by Commissioner Cramer to authorize the chairman to sign the Certification of the Applicant and Participation Plan forms for the grant application. The motion carried.
Joe Ahlstrom discussed the progress on the recreation center project for Big Piney.
The following abatement petition and affidavit of abatement of taxes were presented on petition from the county assessor and the State of Wyoming Board of Equalization: ACS Communications, Inc., $592.47; Bridger Enterprises, $6.45; and Shell Rocky Mountain Production LLC, $1,054.66.
