JAN BANKS, a/k/a MARIE JANNETT NESTOR-BANKS, a resident of Fresno County, State of California, died on Aug. 5, 2002, in Fresno, California, and that said decedent died seized of an interest in the following described real estate:
An undivided one-half (1/2) interest in that certain Mortgage Deed With Release of Homestead as recorded at Book 62 of Mortgages, Page 102, in the office of the County Clerk, Sublette County, Wyoming.
A parcel of land located in the E1/2SE1/4 of Section 13, Township 37 North, Range 110 West of the 6th P.M., Sublette County, Wyoming and more particularly described as follows:
Beginning at a point on the east line of said E1/2SE1/4, said point being located North, 1006.46 feet from the Southeast corner of said Section 13;
Thence S.75°15'16"W., a distance of 140.11 feet;
Thence S.35°25'04"W., a distance of 86.88 feet;
Thence West, a distance of 685.64 feet to a point on the east right of way of Wyoming State Highway No. 352;
Thence northeasterly along the arc of a curve on said right-of-way, said curve having a delta of 4°37'08", a radius of 2789.79 feet and an arc length of 224.90 feet;
Thence from the end of said curve N.18°36'57"E., along said east right-of-way a distance of 1628.18 feet to the north line of said E1/2SE1/4;
Thence S.89°22'00"E., along the north line of the E1/2SE1/4 a distance of 288.35 feet to the east 1/4 corner of said Section 13;
Thence S.00°11'42"E., along the east line of the said E1/2SE1/4, a distance of 80.27 feet to the west 1/4 of Section 18, Township 37 North, Range 109 West;
Thence south along the east line of said E1/2SE1/4 of Section 13, a distance of 1568.87 feet to the point of beginning;
The petition prays that the above court enter its decree determining the time of death of the decedent, determining the heirs of decedent and determining the right of descent of the above-described interests in the above-described real property.
This petition will come on for hearing before the above court, in the Sublette County Courthouse, Pinedale, Wyoming, on Feb. 10, 2005, at 10 a.m. for final determination and entry of Decree.

The Board of County Commissioners of the County of Sublette has decided to alter the PARADISE COUNTY ROAD NO. 23-136 through Section 29, T31N, R109W.

NOTICE IS HEREBY GIVEN pursuant to Wyoming statutes, annotated, sections 34-4-104 and 34-4-105 (2004), that a certain mortgage dated April 4, 2002, which was executed and delivered by Josephine M. The bids must be prepared on forms supplied by the Owner and filed with the Engineer, GDA Engineers, P.O. Box 338, 1508 Stampede Ave., Cody, Wyoming, 82414 not later than 2 p.m., Feb. 17, 2005.The bids will be publicly opened and read aloud at the said GDA Office in Cody, in the presence of the bidders and their representatives at that time and date.
The Bidder (proposer) must supply all the information required by the bid or proposal forms and specifications.
No bids will be received after the specified hour and date, and bids which are not prepared and filed in accordance with proposal requirements and conditions of the specifications may be rejected.
All bids must be accompanied either by a certified check, payable to the Pinedale Airport Board in the amount of five percent (5%) of the bid, or by a Bid Bond in a like amount and executed by an approved surety company. The check or bond will be retained by the Owner as liquidated damages if the successful bidder refuses or fails to enter into contract and provide the required bonds in accord with his bid within fifteen (15) days after date of notification of award.
The Wyoming Prevailing Wage Act of 1967 [§ 27-4-401 et seq] is applicable to this project, as well as all other applicable wage statutes and shall be complied with by the Contractor.
The proposed construction contract, together with detailed drawings and specifications for the construction of the work are available for inspection at the Pinedale Town Hall in Pinedale, Wyoming and may be inspected and obtained from the Engineers, Graham, Dietz and Associates, 1508 Stampede Avenue, P.O. Box 338, Cody, Wyoming 82414, upon payment of One Hundred Dollars ($100.00) non-refundable.
Bids may not be withdrawn after the time fixed for opening them. The Owner reserves the right to waive irregularities in the bids and reject any and all bids.
In accordance with the provisions of Section 16-6-102 and 16-6-103, Volume 3, Title 9 of the Wyoming Compiled Statutes, 1977 and Chapter XI - Rules of practice and procedure before the commissioner of labor concerning certification of resident contractors on Public Works Construction Projects filed May 15, 1990, with the Wyoming Secretary of State, preference will be given to Resident Wyoming Contractors in the manner outlined therein
Preference is hereby given to materials, supplies, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitor outside of the state. A successful resident bidder shall not subcontract more than twenty percent (20%) of the work covered by his contract to non-resident contractors.
The Bidder is advised that construction site aviation safety is of paramount importance. There is a Construction Operations Plan that is part of the project requirements and the Contractor will need to conduct his/her operations in strict compliance with this plan. There are penalty provisions outlined in the Construction Operations Plan for noncompliance by the Contractor's personnel. All costs associated with the Contractor's compliance with this operational plan will be considered incidental to and included in the prices bid for the actual work items of the bid schedule.
All bidders are advised to examine the site to become familiar with all site conditions. The Airport Board has made arrangements with WYDOT to have available for use a nearby source (gravel) should the Contractor want to make use of this source. This pit will also be utilized for a State overlay project. The project will be shown to interested Bidders on February 8, 2005 at 2 p.m. local time, beginning at the Airport.

The Town Council of the Town of Pinedale met in regular session, Monday, Jan. 10, 2005, at 6:30 p.m., in the town hall. Those present: Rose Skinner, Barbara Boyce, Nylla Kunard, Miriam Carlson and Gary Heuck. Also present: Ed Wood, town attorney; Kay Oakley; Susan Gulbranson; Tim Kerback; Elaine Barlow; Bardy Bardin, representing the Sublette County Sheriff's Office; Julie Early, animal control officer; Alberta McAndrews; Paul Rock; Tina Rock; Aaron Seehafer and Mark Eatinger, representing Rio Verde Engineering; Robert E. Johnson, representing JFC; Jim and Jeri McFarlane; John Smith; Ron Brown, public works director; Anna Gustafson, representing the Pinedale Roundup; and Rhonda Swain, representing the Sublette Examiner.
Meeting was brought to order. Motion by Carlson to approve the minutes of the December 13th meeting as written with the correction of the date. Motion seconded. Motion carried unanimously.
Julie Early, animal control officer, reported the monthly activities of the animal control department.
Ron Brown, public works director, reported the monthly activities of the public works department.
Bardy Bardin, representing the Sublette County Sheriff's Office, reported the monthly activities of the sheriff's department.
Ward Wise, mayor's assistant, reported his monthly activities. Wise discussed the need to raise water and sewer connection fees and building standards and requirements.
Motion by Boyce to move the second council meeting of January to Jan. 31. Motion seconded. Motion carried unanimously. Council agreed to have a workshop to discuss water and sewer rate increases after the council meeting.
Aaron Seehafer, representing Granite Peaks Estates Second Filing Subdivision, presented a request for approval of the zoning change of 35 acres from A-1 to R-R, a subdivision which lies within one mile of the town's limits. Ward Wise, representing the Pinedale Planning and Zoning Board, reported the board had recommended the approval of the zoning change. Motion by Boyce to approve Granite Peaks Estates Second Filing of a zoning change of 35 acres from A-1 to R-R. Motion seconded. Motion carried unanimously.
Mayor Skinner presented Pinedale Emergency Medical Council's request for privately-owned vehicles used by member of a fire department or emergency services organization while performing or traveling to perform assigned firefighting or emergency service duties are authorized emergency vehicles. After discussion, motion by Carlson that the town authorize privately owned vehicles to be qualified emergency vehicles as defined by W.S. 35-5-101 provided that said privately owned vehicles comply with the requirements of W.S. 31-5-101 and W.S. 31-5-928. Motion seconded. Motion carried unanimously.
Motion by Heuck to approve the application for a Twenty-Four Hour Catering/Malt Beverage Permit for Corral Bar, Wednesday, Jan. 19, 2005, at Rendezvous Pointe. Motion seconded. Motion carried unanimously.
Motion by Carlson to approve Ordinance 367, an ordinance of the Town of Pinedale, Wyoming, amending Section 17.51.050 of the Pinedale Municipal Code by amending the types of allowed signs in certain zoning districts, on the second reading. Motion seconded. Motion carried unanimously.
Mark Eatinger, representing Kay Buston, presented a zoning change request for the northeast corner of the Buston property from R-2 to C-1; the proposed acreage is .66 and would be used for a dental office and teaching facility. Wise, representing the Pinedale Planning and Zoning Board, reported the board recommended the approval of the parcel where the dentist office is proposed as a non-conforming use in an R-2 zone as a conditional use permit for a professional business practice as a variance. Concerns with the additional traffic on Lake Avenue were discussed. Jim McFarlane, the dentist interested in leasing the facility when built, discussed the proposed dental practice would perform two types of dentistry, routine and high-end and the dental school would teach short-term, high-end dentistry once or twice a month for two or three days, adding the use would be low volume and low impact. After lengthy discussion motion by Boyce to grant a variance for a professional building with the stipulation that an easement is granted for matching up Hennick Street for future extension and the Pinedale Planning and Zoning approve the plans for the building. Motion seconded. Boyce voted aye, Kunard voted aye, Heuck voted aye, Skinner voted aye and Carlson voted nay. Motion carried.
Motion by Boyce to go into executive session to discuss legal matters and personnel. Motion seconded. Motion carried unanimously.
Motion by Carlson to return to regular session. Motion seconded. Motion carried unanimously.
Motion by Boyce to accept JFC's proposal to beef-up the old shop for the cost of $2,000.00. Motion seconded. Motion carried unanimously.
Motion by Heuck to authorize Mr. Wood to write a letter to KM Construction of Jackson, Wyoming, releasing him of any liability over the strengthening of the old town shop by JFC. Motion seconded. Motion carried unanimously.

TAKE NOTICE that WILLIAM T. PRATHER and SUZANNE M. PRATHER, have filed a Complaint in the District Court, Ninth Judicial District, Sublette County, Wyoming sitting in the Town of Pinedale, to quiet title to Lot Thirty-Nine (39), Half Moon Mountain Subdivision, Fourth Filing, Sublette County, Wyoming, as fee simple owner of said lot naming you as Defendant, alleging that you claim estates, rights, titles, liens and interests therein which are adverse to those of the Plaintiffs, further alleging that the mortgage you hold in and to said real property has been paid and satisfied; and that Plaintiffs are seeking to have their title to said real property forever quieted, the mortgage you hold in and to said real property declared released and satisfied and a judicial determination that you have no estates, rights, titles, liens or interests therein.
FURTHER, you are notified that you are required to answer Plaintiff's Complaint on or before March 29. 2005, by filing the same with the Clerk of this Court; otherwise, said Complaint shall be taken as true and judgment shall be rendered against you accordingly.
