INVITATION FOR BIDS
SUBLETTE AVENUE SEWER & WATER REHABILITATION
For the
TOWN OF PINEDALE
Sealed bids are requested for work described in the project manual for the Sublette Avenue Sewer and Water Rehabilitation for the Town of Pinedale, dated January 6, 2005, prepared by Rio Verde Engineering, 201 West Pine Street, P.O. Box 642, Pinedale, Wyo., 82941.
Bids will be received by the Town of Pinedale at 210 W. Pine Street, P.O. Box 709, Pinedale, WY, 82941, until 10 a.m. local time on Jan. 21, 2005, at which time said bids will be publicly opened and read aloud.
The work consists of replacing 3,350 LF of 8-inch PVC, 1,400 LF of 10-inch PVC, 380 LF of 15-inch PVC, 430 LF of 16-inch PVC sewer line; 3,100 LF of 8-inch DIP and 400 LF of 6-inch DIP waterline; 12 fire hydrants, 23 manholes and misc. appurtenances along with 21,000 SY of street repair.
A mandatory pre-bid meeting will be conducted at 10 a.m. local time on Jan. 18, 2005, at which time an on-site inspection of the proposed work will be conducted and special considerations will be discussed. The meeting will be held at the Pinedale Town Hall. All prospective bidders must attend this meeting.
Copies of the project manual and the design drawings specifying the work to be performed may be obtained from Rio Verde Engineering, upon payment of $50 for each set of documents. There will be no refunds for return of the documents. Copies are available for examination at the office of the engineer, Rio Verde Engineering.
Bidders shall be required to accompany each bid with a bid bond with sufficient surety, or a certified check, cashier's check or bank draft upon some reputable bank payable to the Town of Pinedale for at least 10 percent of the total amount of the bid. The bond, check or bank draft shall be forfeited as liquidated damages, if the bidder, upon the letting of the contract to him, fails to enter into the contract within 15 days after it is presented to him for that purpose or fails to proceed with the performance of the contract. The bid bond, draft or check shall be retained by the Town of Pinedale until proper bond to secure performance of the contract has been filed and approved. All the above to be in accordance with 15-1-112, Wyoming Statutes, 1977, July 1980, supplement.
The right is reserved by the Town of Pinedale to reject any and all bids and to waive any irregularity or informality in the bidding. Bids may not be withdrawn for 30 days after the date of opening.

You are hereby notified that on Jan. 3, 2005, a Petition For Determination of Heirship was filed with the Ninth District Court, Sublette County, Wyoming. This Petition alleges that M. JAN BANKS, a/k/a MARIE JANNETT NESTOR-BANKS, a resident of Fresno County, State of California, died on Aug. 5, 2002, in Fresno, California, and that said decedent died seized of an interest in the following described real estate:
An undivided one-half (1/2) interest in that certain Mortgage Deed With Release of Homestead as recorded at Book 62 of Mortgages, Page 102, in the office of the County Clerk, Sublette County, Wyoming.
A parcel of land located in the E1/2SE1/4 of Section 13, Township 37 North, Range 110 West of the 6th P.M., Sublette County, Wyoming and more particularly described as follows:
Beginning at a point on the east line of said E1/2SE1/4, said point being located North, 1006.46 feet from the Southeast corner of said Section 13;
Thence S.75°15'16"W., a distance of 140.11 feet;
Thence S.35°25'04"W., a distance of 86.88 feet;
Thence West, a distance of 685.64 feet to a point on the east right of way of Wyoming State Highway No. 352;
Thence northeasterly along the arc of a curve on said right of way, said curve having a delta of 4°37'08", a radius of 2789.79 feet, and an arc length of 224.90 feet;
Thence from the end of said curve N.18°36'57"E., along said east right of way a distance of 1628.18 feet to the north line of said E1/2SE1/4;
Thence S.89°22'00"E., along the north line of the E1/2SE1/4 a distance of 288.35 feet to the east 1/4 corner of said Section 13;

The petition prays that the above court enter its decree determining the time of death of the decedent, determining the heirs of decedent and determining the right of descent of the above-described interests in the above-described real property.
This petition will come on for hearing before the above court, in the Sublette County Courthouse, Pinedale, Wyoming, on Feb. 10, 2005, at 10 a.m. for final determination and entry of Decree.

NOTICE OF FORECLOSURE SALE
NOTICE IS HEREBY GIVEN pursuant to Wyoming statutes, annotated, sections 34-4-104 and 34-4-105 (2004), that a certain mortgage dated April 4, 2002, which was executed and delivered by Josephine M. Lain to Rock Springs National Bank, and recorded in the county clerk's Office, Sublette County, State of Wyoming, on April 11, 2002, in Book 90 of Mortgages at page 343 as Record No. 289907 and was then assigned to Wyoming Community Development Authority on April 4, 2002, and recorded in the county clerk's office, Sublette County, State of Wyoming, on April 11, 2002, in Book 90 of Mortgages at page 352 as Record No. 289908, will be foreclosed by a sale to the highest bidder at a public auction of the premises described pursuant to a power of sale contained in the mortgage.

Cause No. 4, Order No. 1, DOCKET NO. 38-2005, brought on the application of ExxonMobil Production Company for approval to commingle production in the Fogarty Creek Unit T26X-32G well, located 1915 feet FSL and 821 feet FWL, from the Frontier and Muddy Formations underlying Lot 14 of Section 32, Township 28 North, Range 114 West, 6th P.M.; Sublette County, Wyoming.

Cause No. 3, Order No. 1, DOCKET NO. 73-2005, brought on the application of Encana Oil & Gas (USA) Inc. for an order approving the drilling of additional wells as a 5-acre pilot project to the Lance Formation underlying the drilling and spacing units in Section 25, Township 29 North, Range 108 West, Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 80-2005, brought on the application of BP America Production Company for an order authorizing the drilling of the proposed Stud Horse Butte No. 41-20 well to test and produce from the Lance Formation, as defined by the Commission's order in Docket No. 84-2003, very near the east-west dividing line between the NE1/4 of Section 19 and the NW1/4 of Section 20, Township 29 North, Range 108 West, 6th P.M., as a cooperative leaseline well with a surface location anywhere within the NE1/4 of said Section 19, and a bottomhole location at the producing interval in the Lance Formation, 2260 feet FNL and 50 feet FWL, Section 20, Township 29 North, Range 108 West, 6th P.M., with a tolerance of 50 feet in the north-south direction and 100 feet in the east-west direction, and to authorize unrestricted production from such additional well from any portion of the Lance Formation, as defined by the Commission in Docket No. 84-2003, all in the Jonah Field area, Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 83-2005, brought on the application of Ultra Resources, Inc. for an order authorizing an exception location for the Warbonnet 6B-14D well, to be located at the surface 2090 feet FNL and 468 feet FWL, and at a bottomhole location 1650 feet FNL and 1650 feet FWL, and drilled to an Unnamed Formation underlying the SW1/4 NW1/4 of Section 14, Township 30 North, Range 108 West, 6th P.M.; Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 84-2005, brought on the application of Ultra Resources, Inc. for an order authorizing an exception location for the Warbonnet 5D-15D well, to be located at the surface 2304 feet FNL and 1121 feet FWL, and at a bottomhole location 2310 feet FNL and 990 feet FWL, and drilled to an Unnamed Formation underlying the SW1/4 NW1/4 of Section 15, Township 30 North, Range 108 West, 6th P.M.; Sublette County, Wyoming.
Cause No. 11, Order No. 1, DOCKET NO. 88-2005, brought on the Commission's own motion to ask Stone Energy Corporation to show cause as to why fines and penalties should not be levied for its failure to obtain approval from the Commission prior to drilling its Rainbow 10-31D well in derogation of Chapter 3, Section 8(a) and for failure to call in the spud in derogation of Chapter 3, Section 22(c), in Section 31, Township 30 North, Range 107 West, 6th P.M., Sublette County, Wyoming.
Any interested party is entitled to appear at the aforesaid time and place to be heard by the Commission. The applications may be inspected in the office of the undersigned, 2211 King Boulevard, Casper, Wyoming, or on the Oil & Gas Commission website at http://wogcc.state.wy.us. If there are any protests, please make such known to the State Oil and Gas Supervisor at least three (3) working days before the hearing by filing a written objection.

AN ORDINANCE OF THE TOWN OF PINEDALE, WYOMING AMENDING SECTION 17.51.050 OF THE PINEDALE MUNICIPAL CODE BY AMENDING THE TYPES OF ALLOWED SIGNS IN CERTAIN ZONING DISTRICTS.
NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT SECTION 17.51.050 OF THE PINEDALE MUNICIPAL CODE IS HEREBY AMENDED TO READ AS FOLLOWS:
17.51.050 Permitted signs by district. Only the following signs and no others shall be erected and maintained in the zoning districts enumerated:

The bids must be prepared on forms supplied by the Owner and filed with the Engineer, GDA Engineers, P.O. Box 338, 1508 Stampede Ave., Cody, Wyoming, 82414 not later than 2 p.m., Feb. 17, 2005.The bids will be publicly opened and read aloud at the said GDA Office in Cody, in the presence of the bidders and their representatives at that time and date.
The Bidder (proposer) must supply all the information required by the bid or proposal forms and specifications.
No bids will be received after the specified hour and date, and bids which are not prepared and filed in accordance with proposal requirements and conditions of the specifications, may be rejected.
All bids must be accompanied either by a certified check, payable to the Pinedale Airport Board in the amount of five percent (5%) of the bid, or by a Bid Bond in a like amount and executed by an approved surety company. The check or bond will be retained by the Owner as liquidated damages if the successful bidder refuses or fails to enter into contract and provide the required bonds in accord with his bid within fifteen (15) days after date of notification of award.
The Wyoming Prevailing Wage Act of 1967 [§ 27-4-401 et seq] is applicable to this project, as well as all other applicable wage statutes and shall be complied with by the Contractor.
The proposed construction contract, together with detailed drawings and specifications for the construction of the work are available for inspection at the Pinedale Town Hall in Pinedale, Wyoming and may be inspected and obtained from the Engineers, Graham, Dietz and Associates, 1508 Stampede Avenue, P.O. Box 338, Cody, Wyoming 82414, upon payment of One Hundred Dollars ($100.00) non-refundable.
Bids may not be withdrawn after the time fixed for opening them. The Owner reserves the right to waive irregularities in the bids and reject any and all bids.
In accordance with the provisions of Section 16-6-102 and 16-6-103, Volume 3, Title 9 of the Wyoming Compiled Statutes, 1977, and Chapter XI - Rules of practice and procedure before the commissioner of labor concerning certification of resident contractors on Public Works Construction Projects filed May 15, 1990, with the Wyoming Secretary of State, preference will be given to Resident Wyoming Contractors in the manner outlined therein
Preference is hereby given to materials, supplies, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitor outside of the state. A successful resident bidder shall not subcontract more than twenty percent (20%) of the work covered by his contract to non-resident contractors.
The Bidder is advised that construction site aviation safety is of paramount importance. There is a Construction Operations Plan that is part of the project requirements and the Contractor will need to conduct his/her operations in strict compliance with this plan. There are penalty provisions outlined in the Construction Operations Plan for noncompliance by the Contractor's personnel. All costs associated with the Contractor's compliance with this operational plan will be considered incidental to and included in the prices bid for the actual work items of the bid schedule.
All bidders are advised to examine the site to become familiar with all site conditions. The Airport Board has made arrangements with WYDOT to have available for use a nearby source (gravel) should the Contractor want to make use of this source. This pit will also be utilized for a State overlay project. The project will be shown to interested Bidders on February 8, 2005 at 2:00 P.M. local time, beginning at the Airport.
