PAYMENT TO CONTRACTOR
Notice is hereby given that Sublette County, Wyoming, has accepted work as completed according to the plans and specifications set forth in the agreement between Sublette County and Teletractors, Incorporated, pursuant to the project manual for Senior Citizen Center Dirtwork, and that Teletractors, Incorporated, is entitled to final settlement therefore. On November 10, 2004, being the forty-first day after the first publication of this notice, Sublette County will pay Teletractors, Incorporated, all amounts and balance due under said agreement.

The Town Council of the Town of Pinedale met in regular session, Monday, Sept. 13, 2004, at 6:30 p.m., in the Town Hall. Those present: Rose Skinner, Barbara Boyce, Gary Heuck, Miriam Carlson and Nylla Kunard. Also present: Bardy Bardin, Henry Schmidt, David Ryan Siefkes, Stephen Dunning, Melvin Bradish, KC Lehr, M.L. The meeting was brought to order. Motion by Carlson to approve the minutes of the August 23rd meeting as written. Motion seconded. Motion carried unanimously.
Julie Early, animal control officer, reported the monthly activities of the animal control department.
Ron Brown, public works director, reported the monthly activities of the public works department. After discussion motion by Kunard to allow Brown to put out for bid the leveling, sprinkler system, sod and boarder around the playground equipment in the Boyd Skinner Town Park. Motion seconded. Motion carried unanimously. Brown presented the bids for the lawn mower: Rocky Mountain. Turf $11,148.00 and United Service $11,421.00. Brown recommended accepting the bid from Rocky Mountain Turf. Motion by Boyce to purchase a new lawn mower from Rocky Mountain Turf for $11,148.00. Motion seconded. Motion carried unanimously.
Bardy Bardin, representing the Sublette County Sheriff’s Department, reported the monthly activities of the sheriff’s department.
Ward Wise, mayor’s assistant, gave his monthly activities report.
Public hearing for the applications for mineral royalty grants to the Office of State Loan and Investments was opened for discussion. Mark Eatinger, representing Rio Verde Engineering, presented the Tyler Avenue Sewer and Water Lines Reconstruction Project - Phase II. No comments were received.
Motion by Carlson to approve Resolution 2004-10, a resolution authorizing submission of a Federal Mineral Royalty Capital Construction Account Grant Application to the State Loan and Investment Board on behalf of the Governing Body for the Town of Pinedale for the Purpose of Sewer and Water Line Reconstruction. Motion seconded. Motion carried unanimously.
Randy Hubbard, representing the public works department, presented the Pinedale Wastewater Lagoon Treatment Facility Improvements Project. No comments were received. Motion by Kunard to approve Resolution 2004-9, a resolution authorizing submission of a Federal Mineral Royalty Capital Construction Account Grant Application to the State Loan and Investment Board on behalf of the Governing Body for the Town of Pinedale for the purpose of improving the Town’s Wastewater Treatment Facility to meet more stringent effluent discharge requirements from DEQ. Motion seconded. Motion carried unanimously.
Motion by Heuck to go into executive session to discuss personnel. Motion seconded. Motion carried unanimously.
Motion by Heuck to return to regular session. Motion seconded. Motion carried unanimously.
Ann Noble, Delsa Allen, Janet Montgomery and Clint Gilchrist, representing the Sublette County Historic Preservation Board, presented the town council with historic photos of Pinedale and a CD containing town meeting minutes from the first recorded meetings through 2003 in honor of the town’s 100th birthday.
Bonnie Chambers, representing the Pinedale Planning and Zoning Board, presented Redstone Corporation’s preliminary plat for the Country Club Meadows Addition. Chambers reported the board had made a motion to approve the preliminary plat with the change being made on changing the names of the streets and avenues to be consistent with the existing streets and avenues. Motion by Boyce to accept the preliminary plat of the Country Club Meadows Addition. Motion seconded. Motion carried unanimously.
Chambers, representing the Pinedale Planning and Zoning Board, presented Summit Investments’ preliminary plat for Amended Lots 6 and 7, Block 9 Jones Addition. Chambers reported the board had made a motion to approve the preliminary plat. Motion by Carlson to approve the preliminary plat for Amended Lots 6 and 7, Block 9 Jones Addition. Motion seconded. Motion carried unanimously.
Chambers, representing the Pinedale Planning and Zoning Board, presented Robert Draper’s side setback variance request for Lot 5, Block 2 Cooley 9th Addition. Chambers reported the board approved a rear setback variance from 12.5’ to 11’. Motion by Boyce to grant Robert Draper a 1’ rear setback variance. Motion seconded. Motion carried unanimously. Chambers reported the board had recommended the council grandfather in the commercial use of his business as long as he owns it. Motion by Boyce to grandfather in Mr. Draper’s use of his lot for his business. Motion seconded. Motion carried unanimously.
Chambers, representing the Pinedale Planning and Zoning Board, presented Pinedale Natural Gas’s request for a lighted business sign at 108 North Jackson Avenue. Chambers reported the board approved the request. Motion by Boyce to grant Pinedale Natural Gas a variance at 108 North Jackson Avenue to light their sign. Motion seconded. Motion carried unanimously.
Chambers, representing the Pinedale Planning and Zoning Board, presented Gary Wilson’s rear setback variance for Lot 1, Block 7 Cooley 2nd Addition. Chambers reported the board recommended the approval of the variance request with a letter of approval from the neighbor. Motion by Heuck to approve Gary Wilson’s rear setback variance to 10’ instead of 12’. Motion seconded. Motion carried unanimously.
Julie Morrell, representing Whisper Creek Log Homes, presented the proposed Willow’s Whisper Condominium Development, Lots 1-5, Block 3 Triangle Addition. Motion by Boyce to accept Willow’s Whisper Condominium Development by Julie Morrell. Motion seconded. Motion carried unanimously.
Chambers, representing the Pinedale Planning and Zoning Board, discussed recommendations changing zoning definitions. Council agreed to take under advisement.
Don Schooley, representing the Cemetery District, presented a request to tap into the town water system for the sprinklers at the Pinedale Cemetery. After discussion motion by Heuck to have public works do a flow study and table the matter until results are found. Motion seconded. Motion carried unanimously.
Randy Hubbard, representing the 2004 Sewer Lagoon Rehabilitation Project, discussed Inberg-Miller Engineers proposal for subsurface exploration services for soil and groundwater information to develop geotechnical engineering recommendations for the proposed wastewater treatment plant improvements, the cost of the proposed scope of services to be $5,950.00 and additional test boring cost of $395.00. Motion by Kunard to have bore testing done by Inberg-Miller Engineers. Motion seconded. Motion carried unanimously.
Aaron Seehafer, representing the 2003 Valley Pan Project, gave an update on the project.
Aaron Seehafer, representing Sublette County, presented Sublette County Courthouse Project Mill Street Parking Area. Seehafer recommended perpendicular parking because people coming from either direction can pull into the space. Ron Brown, public works director, questioned whether the street was wide enough to accommodate perpendicular spaces. Ken Konicek, representing Tegeler and Associates/Allen Agency, stated the plan would improve the parking in the area. Andy O’Neal, maintenance person for the county, stated the proposal would clean up the congestion in the area. Janet Montgomery, Sublette County assessor, stated parking had always been an issue and this was the first viable solution they have seen. Mary Lankford, Sublette County clerk, discussed the parking area.
After lengthy discussion, motion by Kunard to accept Sublette County Courthouse Project Mill Street Parking Area between South Tyler Avenue and South Fremont Avenue with perpendicular parking. Motion seconded. Motion carried unanimously.
Ward Wise, mayor’s assistant, presented Pinedale Airport Board activities. Motion by Carlson to approve the new contract with ASMI for maintenance of the AWOS and NDB NavAids for term expiring Sept. 30, 2007, at the rate of $550 monthly on form negotiated by WYDOT for state wide use. Motion seconded. Motion carried unanimously. Motion by Carlson to approve the new sign space lease to Wild Horse Realty for $400 annually for one side or $600, $200 additional, for sign on both side of same posts on airport property. Motion seconded. Motion carried unanimously. Motion by Carlson to approve assignment of ground lease for hangar Lot 20 to Lee Lieberman for its remaining term, expiring Dec. 31, 2005, plus at his option the right to a new lease for a term of not more that 26 years expiring Dec. 31, 2030, 30 years from when the hangar was constructed, with reversion at end of initial term of new lease. Motion seconded. Motion carried unanimously. Motion by Carlson to approve monthly pasture lease to Ray Gentry and/or Donna Steele of Boulder for horse grazing at $12 per head monthly, minimum 10 horses, $120 a month, for Lot 5, Airport Subdivision. Motion seconded. Motion carried unanimously.
Tim Bohan, representing Lots 1-8 Triangle Addition, asked the council to reconsider its decision to make him fill spaces between the townhouses, Bohan added his utilities will be located in that area there. After lengthy discussion, motion by Boyce to allow Mr. Bohan to box in 3’ between the building toward the front to keep his utilities from freezing. Motion seconded. Boyce voted aye, Heuck voted aye, Kunard voted aye and Carlson voted nay. Motion carried.
Motion by Carlson to approve Ordinance 366, an ordinance of the Town of Pinedale, Wyoming amending Chapter 16.28, Section 16.28.050, of the Pinedale Municipal Code by removing cul-de-sacs as an allowed street option, on the first reading. Mark Eatinger, representing Rio Verde Engineering, stated removing cul-de-sacs would lengthen roads and decrease the amount of land available. John Sulenta, representing Redstone Properties, stated using cul-de-sacs cuts the cost of lots. After lengthy discussion motion seconded. Motion carried unanimously.
Motion by Carlson to approve the application for the 24-hour catering /malt beverage permit by Bottoms Up Brewery for Rendezvous Pointe, Sept. 25th. Motion seconded. Motion carried unanimously.
Motion by Kunard to waive the American Legion Cooley Park fee for the Chamber of Commerce’s Pinedale Half Marathon for the town’s centennial celebration. Motion seconded. Motion carried unanimously.
Motion by Boyce to allow Wise to grant Mr. Bohan a building permit if it complies with all the town ordinances and the few variances the Council have granted. Motion seconded. Motion carried unanimously.

Those present: Rose Skinner, Barbara Boyce, Gary Heuck, Miriam Carlson and Nylla Kunard. Also present: Eric and Kathy Sechrist, representing the Pinedale Area Chamber of Commerce; Aaron Seehafer, representing Rio Verde Engineering; Missy McAmis and Barbara Hodges, representing Wild Horse Realty; Ward Wise, mayor’s assistant; Ron Brown, public works director; Tim Ruland, representing the Pinedale Roundup; and Rhonda Swain, representing the Sublette Examiner.
The meeting was brought to order.
Mayor Skinner presented the quote for the flag banners and Christmas display. After discussion, motion by Carlson to order the Christmas display and banners for a total of $3,581.50. Motion seconded. Motion carried unanimously.
After discussion motion by Heuck to deny KM Construction’s substitution request of the interior paneling in the new town shop. Motion seconded. Motion carried unanimously.
Motion by Boyce to have the mayor sign the ccontract for services with the Greater Wyoming Big Brothers Big Sisters Sublette County Branch. Motion seconded. Motion carried unanimously.
Kathy Sechrist, representing the Pinedale Chamber of Commerce, gave an update on the Pinedale Centennial celebration. Sechrist asked the council to support the lodging tax. Motion by Carlson to support the lodging tax initiative. Motion seconded. Motion carried unanimously. Sechrist advised the council of the proposed upcoming Christmas celebrations.
Missy McAmis, representing Wild Horse Realty, presented a request for a proposed sign to be located on airport property. Motion by Boyce to approve the proposed sign for Wild Horse Realty to be located at the airport. Motion seconded. Motion carried unanimously.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
OCTOBER 5, 2004
The Board of County Commissioners met in the Commissioners Meeting Room of the Sublette County Courthouse on this date at 9 a.m. with Gordon Johnston, Bill Cramer, Betty Fear, Cat Urbigkit of the Sublette Examiner, Noah Brenner of the Pinedale Roundup, and Tracey L. Hoover, deputy county clerk, present. Mary Lankford, county clerk, was absent.
Chairman Johnston led those present in the Pledge of Allegiance.
The minutes of the proceeding regular meeting of Sept. 16, 2004, were approved and ordered filed on motion by Commissioner Cramer and seconded by Commissioner Fear. The motion carried.
The official bonds for Paul C. Hagenstein, treasurer for the museum board, in the amount of $1,500; and Elizabeth N. Cheeney, treasurer for the recreation board, in the amount of $5,000, were approved and ordered filed with the county treasurer.
Travis Sour, road and bridge superintendent, discussed ongoing road projects, soil stabilization and bridge work. Commissioner Johnston signed the architectural and construction administration (at-risk) services contract with Chambers Design-Build, Inc. for the county shop.
Marilyn Filkins, deputy county attorney, requested donated sick leave for Becky Manning. The board approved the request with a limit of two days of donated sick leave per employee.
Steve James, representing the Sublette County Fair Board, presented a draft caretaker contract and caretaker-housing addendum. Commissioner Johnston stated the fairgrounds needs a manager who would be a county employee, hired by the Board of County Commissioners. James stated that the fair board does not favor the idea. After discussion of the manager position, it was moved by Commissioner Fear and seconded by Commissioner Johnston to advertise the manager position.
Ken Konicek of Tegeler and Associates discussed health savings accounts and a retiree health proposal. It was moved by Commissioner Fear and seconded by Commissioner Cramer to accept the HSA and retiree health proposal effective January 1, 2005. The motion carried.
Sheriff Hank Ruland and Undersheriff Henry Schmidt discussed a second mancamp proposal, increased calls in Pinedale, and installation of the White Pine radio system. Commissioner Johnston signed a COPS grant, which will provide funding for an additional deputy in Pinedale. Commissioner Johnston also signed a lease agreement between Wind River Resorts, Sublette Communications and the Sublette County Sheriff’s Office on the White Pine radio project.
Kathy and Eric Sechrist, representing the Sublette County Chamber of Commerce, discussed locations and renting vs. buying property for the chamber. They advised the board they would have a proposal ready for the next commissioners’ meeting.
Ward Wise stated he attended the Scenic Byway meeting, at which it was stated portals will be installed at Daniel and Hoback junctions to tie in with the historical markers.
The following abatement petition and affidavit of abatement of taxes were presented on petition from the county assessor and the State of Wyoming Board of Equalization: Redstone Corporation, $374.04; Daniel Sports Center, $15.37; Gasco Energy, $158.47; Gilman Ordway, $454.69; Riverview Rentals, $35.76, Crown Oil & Gas Company, Inc., $111.37; EOG Resources, $629.03; and Chevron USA, Incorporated, $10,428.66.
Rick Hoffman, waste management superintendent, and Frank Grimes, Nelson Engineering, discussed the progress of the bale facility. Trash cages were discussed. Commissioner Fear suggested signs regarding trash cages. Hoffman also discussed equipment and personnel.
Robin Clover, SAFV, discussed the TANF grant.
