NOTICE OF APPLICATION FOR RESTAURANT LIQUOR LICENSE
Notice is hereby given that on the 1st day of September, 2004, Michel and Lorraine Gatzke applied for an application for a renewal of a restaurant liquor license in the office of the Clerk of the Town of Big Piney, Wyoming, for the following described place and premises, to wit: Wood building located on lots 13, 14 and 15, block 12, of the C.P. McGlashan 1st Addition to the Town of Big Piney, Wyoming, and protests, if any, against the issuance of this license will be heard Oct. 5, 2004, at 7 p.m. at the Town Hall in the council chambers in Big Piney, Wyo.

NOTICE OF PUBLIC HEARING
PURSUANT TO W.S. 15-1-112 (B) FOR SALE OF TOWN PROPERTY WITHOUT BID PROCESS
Notice is hereby given that on the 11th day of October, 2004, at 7:15 p.m., the Town of Pinedale, Sublette County, Wyoming will hold a public hearing at the Pinedale Town Hall pursuant to W.S. 15-1-112 (b) to consider the sale of a portion of the Town of Pinedale's storage water rights (4,800 acre feet under State Engineer Office Permit No. 4452 Res.) stored Fremont Lake to the State of Wyoming - Wyoming Water Development Commission without bid. The appraised value of said storage water rights is $10. The terms of the proposed contract with the State of Wyoming - Wyoming Water Development Commission - is for a payment of $10 by the State of Wyoming - Wyoming Water Development Commission and the granting of a right to re-purchase said storage water rights at the same price at any time during the 30 years from the date of the contract. This re-purchase right being at the election of the Town of Pinedale. The re-purchase right may be extended for an additional 30 years. Any person wishing to make comments in regard to said matter can be heard at said time at the Town Hall, 210 West Pine Street, Pinedale Wyoming.

PAYMENT TO CONTRACTOR
Notice is hereby given that the Town of Pinedale, Wyoming, has accepted work as completed according to the plans and specifications set forth in the agreement between the Town of Pinedale and EHC, L.L.C., pursuant to the Project Manual for 2003 Town of Pinedale Waterline Looping Project, and that EHC, L.L.C. is entitled to final settlement therefore.
On Oct. 27, 2004, being the forty-first day after the first publication of this notice, the Town of Pinedale will pay to EHC, L.L.C. all amounts and balance due under said agreement.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
SEPTEMBER 16, 2004
The Board of County Commissioners met in the Commissioners Meeting Room of the Sublette County Courthouse on this date at 9 a.m. with Gordon Johnston, Bill Cramer, Betty Fear, Cat Urbigkit of the Sublette Examiner, Tim Ruland of the Pinedale Roundup and Mary Lankford, county clerk, present.
Chairman Johnston led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of Sept. 7, 2004, were approved and ordered filed on motion by Commissioner Cramer and seconded by Commissioner Fear. The motion carried.
The official bonds for Patrick C. Mattimoe, secretary/treasurer for the Shelter Park Improvement District, in the amount of $25,000; and Lynn Grassell, treasurer for School District No. 1, in the amount of $25,000, were approved and ordered filed with the county treasurer.
Travis Sour, road and bridge superintendent, reviewed three architectural proposals for a new county shop building. It was moved by Commissioner Cramer and seconded by Commissioner Fear to accept the proposal from Chambers Design-Build, Inc. The motion carried.
Sour reported on road maintenance. Commissioner Cramer reported on searching for a gravel source in the Hoback area.
Susan Kramer and Nancy Reno expressed their concerns about the traffic on Pinedale South County Road No. 23-123. The board referred them to Sheriff Hank Ruland to discuss speed enforcement and informed them that it is aware of the issue and is seeking alternatives.
Kari Bousman, 4-H coordinator, thanked the board for its support of the program and updated it about recent activities.
The board signed the TANF/CPI contract.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to abate taxes owed by the county on Lot 6, Redstone Country Club Commercial Addition to the Town of Pinedale. The motion carried.
Kathy Sechrist and Cyd Goodrich, representing the Sublette County Chamber of Commerce, discussed immediate and long-term locations for the chamber.
The board recessed the meeting for an executive zession with County Attorney Van Graham to discuss personnel and property.
The board reconvened the meeting.
The board approved Change Order No. 10 for the senior center project, as presented by Tony Chambers, for the amount of $75,342.91, for additional work not included in the original contract.
In accordance with the public notice published in the Sublette Examiner on Aug. 26, 2004, public hearing was held for the following:
1. It was moved by Commissioner Fear and seconded by Commissioner Cramer to approve and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 04-828J
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION BY THE SUBLETTE COUNTY PLANNING AND ZONING COMMISSION TO REZONE BLOCK 8, BARGER SUBDIVISION, THIRD FILING FROM R-R TO R-RMH, LOCATED IN THE SW1/4, SECTION 28, T33N, R108W.
1. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the conditional use permit application by Mountain Village Parks, Daniel L. Alexander, agent, to construct and operate a workers camp on 30.04 acres, more or less, zoned I-L, being Pollywog Subdivision, located in the N1/2SW1/4, Section 8, T29N, R111W, with the following conditions:
a. When the population reaches 500, the conditional-use permit must be renewed.
c. The applicant is to present a protocol on security, alcohol, firearms and other social issues to the Board of County Commissioners and cooperate with a proposed task force regarding rules and regulations and implementation of suggestions for additional conditions for workers camps.
d. Speed limit signs must be posted prior to resident population increase.
e. Useable fire hydrants must be on site.
f. Applicant to hold an informational hearing in Big Piney before the Board of County Commissioners Sept. 16, 2004, meeting, with the meeting being publicized. This item was completed.
g. A permit to construct from WYDEQ must be obtained prior to allowing any additional buildings to be placed on the site.
h. No more than 71 residents will be allowed to reside on the site (or the equivalent number of people generating 15,859 gallons per day of sewage) until such time as WYDEQ allows a higher number of residents or higher amount of septic generation treatment. Numbers include Daniel's Mobile Home Park.
2. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the conditional-use permit application by Bill Fiant of Ponderosa Environmental Services LLC and Anticline Disposal Company, to test, construct and operate additional waste water treatment processes, such as reverse osmosis process, thermal compression and/or ion exchange system, to supplement the existing evaporative mechanisms and to use a cross country pipeline delivery, on 40 acres, more or less, located in the SW1/4SW1/4, Section 18, T31N, R108W. with the following conditions:
a. All existing treatments and the new treatment to be placed under one conditional-use permit.
b. Approval subject to WYDEQ approval of pilot process and final process submittals.
c. Site of handle oil and gas production wastewater - produced and frac water only, no drilling muds.
d. The applicant shall provide copies of WYDEQ permits to the Sublette County Planning and Zoning Office.
e. Conditional-use permit to run for 25 years only from date of county commissioner approval.
3. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve a variance request by Charlotte Keyser to place a log home on a .484 acre, more or less, lot where a site of one acres is required, zoned R-R, being Tract 12, Riverside Subdivision. The motion carried.
Tony Hoyt, representing DEQ Air Quality, discussed dust suppression requirements, imposed by DEQ, on a county road, due to complaints by a resident. The board informed Hoyt that the DEQ is prohibited from imposing regulations on county roads.
Steve James, representing the Sublette County Fair Board, discussed the need for housing for a groundskeeper and proposals for the housing. The board informed James that if a groundskeeper were hired, he would be a county employee, hired by the Board of County Commissioners. James stated that the fair board would not favor the idea. After discussion of the groundskeeper position and review of the housing plans, it was moved by Commissioner Cramer and seconded by Commissioner Fear to advertise to transfer funds to purchase the housing and directed James to order the house. The motion carried.
The following abatement petition and affidavit of abatement of taxes were presented on petition from the county assessor and the State of Wyoming Board of Equalization: Texaco Exploration & Production, Inc., $2,717.15; McMurry Oil Company, $634.51; Ultra Resources, Inc., $2,160.71; and J Two LLC, $116.17.
Rick Hoffman, waste management superintendent, reviewed equipment for the new balefill facility. The board approved the purchase of the equipment and directed Hoffman to order the equipment.
It was moved by Commissioner Fear and seconded by Commissioner Cramer to advance $250,000 to the Sublette County Recreation Board. The motion carried.
