Notice is hereby given that on the 1st day of September, 2004, Michel and Lorraine Gatzke applied for an application for a renewal of a restaurant liquor license in the office of the Clerk of the Town of Big Piney, Wyoming, for the following described place and premises, to wit: Wood building located on lots 13, 14 and 15, block 12, of the C.P. INVITATION FOR BIDS
TOWN OF BIG PINEY
ELEVATED WATER STORAGE TANK PROJECT
Bids are invited for the Big Piney Elevated Water Storage Tank Project for the Town of Big Piney, Wyoming.
The project includes a 200,000-gallon welded steel elevated multi-column water storage tank, tank foundations, appurtenances, water main connections and other related work.
Notice is hereby given that the Town of Big Piney will receive sealed bids prior to 2 p.m. MST on Friday, Oct. 8, 2004, at the Big Piney Town Hall, 401 Budd Avenue (P.O. Box 70), Big Piney, Wyo., 83113, for the Big Piney Elevated Water Storage Tank Project.

A $50 deposit is required for each copy of the contract documents. The deposit will be refunded for contract documents returned in good condition within ten (10) days after the bid opening.
Bids shall be accompanied by a bid bond or certified check in the amount of five percent (5%) of the maximum bid amount. Bid must be submitted upon the provided bid forms.
No pre-bid meeting is scheduled at this time.
The successful bidder shall provide performance and payment bonds for the full amount of the contract.
In accordance with State of Wyoming statutes, a five percent (5%) bid preference will apply to bids from Wyoming resident contractors.
Qualified Disadvantaged Business Enterprises (DBEs) are encouraged to submit bids on this project. Contractors that use a subcontractor(s) are required to make a good faith effort at soliciting DBE subcontractor participation. Bidder good faith effort documentation shall be included in the bid, or the bidder may be considered non-responsive. Pursuant to W.S. 16-6-106, "preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state."
The owner reserves the right to reject any or all bids and to waive informalities and irregularities in the proposals.

TOWN OF PINEDALE )
The Town Council of the Town of Pinedale met in regular session Monday, Aug. 23, 2004, at 6:30 p.m., in the Town Hall. Those present; Rose Skinner, Barbara Boyce, Gary Heuck, Miriam Carlson and Nylla Kunard. Also present: Eric and Kathy Sechrist, representing the Sublette County Chamber of Commerce; Meredith Oates Peterson; Jral Fae; Ron Brown, Public Works Director; Dawn Ballou, representing Pinedale Online; Aaron Seehafer, representing Rio Verde Engineering; Jud Faler; Ridge Larson; Noah Brenner, representing the Pinedale Roundup; and Rhonda Swain, representing the Sublette Examiner.
The meeting was brought to order. Motion by Carlson to approve the minutes of the August 2nd, 9th and 12th meetings as written. Motion seconded. Motion carried unanimously.
Kathy Sechrist, representing the Sublette County Chamber of Commerce, presented the tentative calendar of events for the Pinedale Centennial Celebration.
Mayor Skinner presented the bids for fuel: Country Lane Gas and Groceries, gasoline, posted pump price minus the Federal Excise Tax minus $.12 per gallon, diesel, posted pump price minus the Federal Excise Tax minus $.13 per gallon; Pinedale Sinclair, posted pump price minus $.11 per gallon. Motion by Carlson to award the fuel bid to Country Lane Gas and Groceries for gasoline minus $.12 per gallon and diesel minus $.13 per gallon off posted pump price. Motion seconded. Motion carried unanimously.
Mayor Skinner presented the proposals for the official newspaper: Sublette Examiner, display advertising $2.50 per column inch, legals $1.75 per column inch; Pinedale Roundup, display advertising $2.75 per column inch, legals $2.75. Motion by Carlson to make the Sublette Examiner the official newspaper with display advertising $2.50 per column inch and legals $1.75 per column inch. Motion seconded. Motion carried unanimously.
Aaron Seehafer, representing Sublette County, discussed concerns with Magnolia Street between Faler Avenue and east to behind the Forest Service Building. Seehafer discussed the concerns with the traffic on the street in that area and the concerns with safety and the possibility of making it a one-way street. Jud Faler discussed his concerns with the safety of the traffic and stated the area between the U.S. Forest Service Building and the store is private property. Ron Brown, Public Works Director, discussed his concerns with the snow removal. Council agreed to take it under advisement agreeing the area is still part of the county.
Aaron Seehafer, representing Redstone, informed the council the reverse curve proposed for Fox Willow Park II had been modified to a smooth curve. Aaron Seehafer, representing the North Tyler Avenue Sidewalk Project, gave an update on the project.
Mayor Skinner presented a letter from Caroline Sulenta regarding her appointment to the board of directors for the Sublette Citizens for Recycling had expired, Skinner recommended her re-appointment to the board. Motion by Boyce to re-appoint Caroline Sulenta to the Sublette Citizens for Recycling board. Motion seconded. Motion carried unanimously.
Motion by Kunard to have the mayor sign the contract for services with the Sublette Hi-Country Senior Citizens. Motion seconded. Motion carried unanimously.

NOTICE OF PUBLIC HEARING
PURSUANT TO W.S. 15-1-112 (B) FOR SALE OF TOWN PROPERTY WITHOUT BID PROCESS
Notice is hereby given that on the 27th day of October 11th 2004, at 7:15 p.m., the Town of Pinedale, Sublette County, Wyoming will hold a public hearing at the Pinedale Town Hall pursuant to W.S. 15-1-112 (b) to consider the sale of a portion of the Town of Pinedale's storage water rights (4,800 acre feet under State Engineer Office Permit No. 4452 Res.) stored Fremont Lake to the State of Wyoming - Wyoming Water Development Commission without bid. The appraised value of said storage water rights is $10. The terms of the proposed contract with the State of Wyoming - Wyoming Water Development Commission - is for a payment of $10 by the State of Wyoming - Wyoming Water Development Commission and the granting of a right to re-purchase said storage water rights at the same price at any time during the 30 years from the date of the contract. This re-purchase right being at the election of the Town of Pinedale. The re-purchase right may be extended for an additional 30 years. Any person wishing to make comments in regard to said matter can be heard at said time at the Town Hall, 210 West Pine Street, Pinedale Wyoming.

Cause No. 9, Order No. 1, DOCKET NO. 528-2004, brought on the commission's own motion to review a previous order of the commission identified as Cause No. 9, Order No. 2, Docket No. 455-2003, regarding treatment of drilling reserve and other produced water retention pits by Flare Construction, Inc. in Lincoln, Natrona, Sublette, Sweetwater and Uinta counties, Wyoming.
Cause No. 9, Order No. 1, DOCKET NO. 529-2004, brought on the application of Monosep Corporation for an order approving the treatment of drilling reserve and other produced water retention pits in Lincoln, Sublette and Sweetwater counties, Wyoming.

Cause No. 3, Order No. 1, DOCKET NO. 508-2004, brought on the application of Anschutz Pinedale Corporation for an order authorizing the drilling of additional wells to test and produce from the Lance Pool, as defined in the Commission's Order in Docket No. 136-2003, each such additional well proposed to be an increase in the density of wells permitted and provided by Commission Rules, Chapter 3, Section 2, from one well per quarter-quarter section (or lots of tracts substantially equivalent thereto), each such additional well to be located at the producing interval with the Lance pool, anywhere on the affected quarter-quarter section, not closer than 200 feet to the exterior boundary of the quarter-quarter section, and not closer than 400 feet to the producing interval within the Lance pool of any other well drilled to and producing from such Lance pool, such additional wells to be located, one such additional well on each quarter-quarter section (or lot or tract substantially equivalent thereto), within Lots 1 through 12 (W1/2) of Section 18, Lots 1 through 12 (W1/2) of Section 19 and all of Section 23, Township 32 North, Range 109 West, 6th P.M., and all of Section 16, Township 33 North, Range 109 West, 6th P.M., and to authorize unrestricted production from each such additional well from any portion of the Lance pool, as defined, all in the Pinedale Anticline area, Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 509-2004, brought on the application of Anschutz Pinedale Corporation for an order deleting the restriction contained in paragraph 5. of the Findings of Fact and in the next to the last paragraph of the Order of the Commission in Cause No. 3, Order No. 1, Docket No. 413-2003, as stipulated and agreed to by Questar Exploration & Production Company, the party who requested such restriction, and the applicant, Anschutz Pinedale Corporation, in a written stipulation, which agrees that the restriction previously ordered by the Commission on the additional, in-fill locations proposed to be drilled by the applicant to the Lance pool, as defined in Docket No. 136-2003, in portions of Sections 21, 22 and 28, Township 32 North, Range 109 West, will be removed, thereby allowing such additional, in-fill wells authorized in Docket No. 413-2003. to be location at the producing interval within the Lance pool anywhere on the affected quarter-quarter section, not closer than 200 feet to the exterior boundary of the quarter-quarter section, and not closer than 400 feet to the producing interval within the Lance pool of any other well drilled to and producing from such Lance pool, as to the following quarter-quarter sections: NE1/4 SE1/4 of Section 21, NW1/4 SE1/4 of Section 21, SW1/4 SE1/4 of Section 21, NE1/4 SE1/4 of Section 22, NW1/4 SE1/4 of Section 22, NE1/4 SW1/4 of Section 22, NW1/4 SW1/4 of Section 22, and NW1/4 NE1/4 of Section 28, all in Township 32 North, Range 109 West, 6th P.M., Pinedale Anticline area, Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 517-2004, brought on the application of Petrogulf Corporation for an order authorizing additional wells so that there will be a density of two wells per approximate 40-acre quarter-quarter section in the Lance pool as defined in Docket No. 126-2003 for the W1/2 of Section 36, Township 32 North, Range 109 West, 6th P.M., Pinedale Field, Sublette County, Wyoming.
Cause No. 3, Order No. 1, DOCKET NO. 521-2004, brought on the application of McMurry Oil Company, a wholly owned subsidiary of EnCana Oil & Gas (U.S.A.), Inc. for an order (1) Approving the drilling of additional wells to the Lance pool for the Jonah Field, allowing up to eight (8) wells in each 80-acre drilling and spacing unit in Sections 2 through 5, E1/2 of Section 7, Sections 8 through 12, Section 14 through 17, Sections 20 through 24, Sections 26 through 29, NE1/4, W1/2 SE1/4 of Section 18, and Sections 32 through 36, Township 29 North, Range 108 West, 6th P.M.; Sections 12 and 13, N1/2 of Section 23, Township 28 North, Range 109 West, 6th P.M.; and Section 7, N1/2 of Section 8, NW1/4 of Section 9, and W1/2 of Section 18, Township 28 North, Range 108 West, 6th P.M.; and allowing up to six (6) wells in each 60-acre drilling and spacing unit in Section 1, Township 28 North, 109 West, 6th P.M.; N1/2 NW1/4 of Section 3, and Sections 4 through 6, Township 28 North, Range 108 West, 6th P.M.; provided that each well must be at least 150 feet from the exterior boundary of a drilling and spacing unit and 300 feet from any other well; (2) Establishing certain 10-acre drilling and spacing units in the lands described above, for wells drilled within 330 feet of the boundary of drilling and spacing units with differing ownership of proceeds of production; and (3) Authorizing the supervisor, after notice, to approve directional drilling of the additional wells; all in Sublette County, Wyoming.
Any interested party is entitled to appear at the aforesaid time and place to be heard by the commission. OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
SEPTEMBER 7, 2004
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9 a.m. with Gordon Johnston, Bill Cramer, Betty Fear, Cat Urbigkit of the Sublette Examiner, Tim Ruland of the Pinedale Roundup, and Mary Lankford, County Clerk present.
Prior to convening the regular session, the board met with Elizabeth Greenwood, Jud Faler, Claire Faler, Harold Faler, Ridge Larson, and Mark Eatinger and Aaron Seehafer, representing Rio Verde Engineering, to discuss drainage and the easement for Magnolia Street near Rendezvous Pointe. Greenwood reviewed the situation and reported that Faler's engineer, Bob Harrower, does not agree with Rio Verde's proposed solutions to the drainage issues. After discussion, the board decided to appoint a third-party engineer to review and address the drainage issues. The board requested that Greenwood submit suggestions for the third engineer. Greenwood agreed.
Chairman Johnston led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of Aug. 20, 2004, were amended to include "landscaping" before "conduit" in paragraph 29, and approved as amended, and ordered filed on motion by Commissioner Cramer and seconded by Commissioner Fear. The motion carried.
The official bond for Catherine Summerall, treasurer for the Redstone Upper Green River Road Improvement District, in the amount of $10,000 was approved and ordered filed with the county treasurer.
Sealed bids were opened for the mowing of barrow pits. Two bids were received. It was moved by Commissioner Cramer and seconded by Commissioner Fear to award the bid to Darrell Snyder for the amount of $28.99 per mile for 80 lane miles, totaling $2,319.20. The motion carried.
Travis Sour, road and bridge superintendent, reported on crushing gravel, drainage of the Horse Ranch Road and the Ogden approach. The board reviewed a proposal for the purchase of an asphalt plant and related equipment. Commissioner Cramer directed Sour to install a culvert in the Urbigkit approach. Commissioner Cramer reported that the Little Jenny Ranch was unwilling to contract with the county for gravel crushing, but that he will check with other property owners in the area.
A representative of High Meadow Ranches requested snowplowing in the Big Country Ranches Subdivisions. The subject roads are not county roads. Sour will tour the roads with a representative of the area to discuss county road standards.
Skylar Wilson, representing Wilson Land Surveying, discussed a defective easement received from the Town of Pinedale by the county for an access south of the Pinedale Airport, and the location of a game fence in the easement. The board referred the matter to the county attorney.
The board recessed the meeting for a conference call in executive session with Kate Fox of Davis and Cannon to discuss ongoing litigation.
The board reconvened the meeting.
Randy Bolgiano, representing the Upper Green River Joint Powers Water Board, reported on the activities of the joint powers board.
The following petition and affidavit of abatement of taxes was presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Brent Vodopich, $119.31; EOG Resources, $8.961.28; Shell Rocky Mountain LLC, $33.03; and EnCana Oil & Gas Inc., $874.60.
The board approved a request for leave from School District No. 1 for Jim Malkowski on Sept. 21, 2004, to attend a Wyoming School Boards Association regional training workshop in Evanston, and for Malkowski and Cathy Saxton on Nov. 16 - 19, 2004, to attend the Wyoming School Boards Association Conference in Casper.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to adopt Resolution No. 04-823J authorizing the Board of County Commissioners to apply for a Federal Land Policy and Management Act right of way and authorizing the Chairman, Gordon R. Johnston, to sign the application for the Erramouspe County Road No. 23-225. The motion carried.
It was moved by Commissioner Fear and seconded by Commissioner Cramer to adopt resolutions for State Land and Investment Grants with the following priority:
Resolution 04-825J for $200,000 for a fire truck for the Daniel Volunteer Fire Department
Resolution 04-826J for $120,000 for an ambulance for Big Piney-Marbleton EMS
Resolution 04-827J for $7.1 million for County Clinic Addition and Replacement
The motion carried, with the vote being: Johnston-aye, Fear-aye, and Cramer-nay.
John Erramouspe discussed the county's FLPMA application for the Erramouspe County Road. Erramouspe informed the board that his land purchase was still "on hold." The Board discussed possible legislation.
In accordance with the public notice published in the Sublette Examiner on Aug. 26, 2004, public hearing was held for the following:
1. It was moved by Commissioner Fear and seconded by Commissioner Cramer to approve the final plat for Old Brazzill Ranch Subdivision, Second Filing, by Jack and Cecilia Richardson, owners, to subdivide 33.47 acres, more or less, zoned R-R, into 14 lots, located in the S1/2NE1/4 and N1/2SE1/4, Section 10, T33N, R109W. The motion carried and the plat was signed.
2. It was moved by Commissioner Fear and seconded by Commissioner Cramer to approve the final plat for Rendezvous Ridge Subdivision, by MG Land and Livestock, LLC, to subdivide 169.43 acres, more or less, zoned R-R 5 and R-R 10, into 22 lots, located in the NW1/4, Section 27, and the SE1/4SW1/4, Section 22, T34N, R111W. The motion carried and the plat was signed.
Joe Moore, Director for the State Homeland Security program, reported on the progress of the program.
Bob Reese reported on the Pinedale Anticline Working Group. Seven staff task groups have been established.
Tony Chambers, representing Chambers Design-Build, and Brad Waters, representing Providence Architecture, reported that the project is basically finished. The punch list and final fire marshal inspection is scheduled for this week. Waters expressed approval of the project. The board approved a change order for the completion of additional outside site work. It was moved by Commissioner Fear and seconded by Commissioner Cramer to authorize up to $100,000 for additional items per the proposal presented. The motion carried.
Rick Foley, representing Hogan and Associates, and Brad Waters, representing Providence Architecture, reported on the courthouse construction project. Work is on schedule. Work of the segment A punch list is continuing. The board approved the proposal for the location of a backup generator.
Rick Hoffman, waste management superintendent, reported on the progress of the construction of the balefill. Hoffman reported on a trip to the Casper bale facility and discussed equipment for Sublette County's facility, and reviewed a time study.
Steve James, representing the fair board, discussed the purchase of housing for the fairgrounds, and presented two proposals. The board discussed management of the grounds and management of the fair. The board took no action on the proposal and requested James to return to the next meeting.
Kathy Sechrist, representing the Sublette County Chamber of Commerce, reported that the hut's electricity and telephone service was disconnected by the construction project. The board suggested alternative locations.
Steve James inquired about levy maintenance. The board referred the inquiry to Travis Sour.
The board signed the Town of Marbleton Metro Law Enforcement contract.

On Oct. 27, 2004, being the forty-first day after the first publication of this notice, the Town of Pinedale will pay to EHC, L.L.C. all amounts and balance due under said agreement.
