Call for Bids
The Town of Pinedale will be accepting sealed bids for providing fuel supplies to the town. Bids are requested on the following:
1. Unleaded gasoline
2. Regular gasoline
3. Diesel fuel
a. A mixture of 60 percent (%) No. 2 and 40 percent (%) No. 1 during winter
b. 100 percent (%) No. 2 during summer
4. Propane
Bids are to be in accordance with terms and conditions contained in the INFORMATION FOR BIDDERS and the proposed FUEL PURCHASE AGREEMENT, which are available from the Town Hall, 210 West Pine Street, during regular business hours.
Bids must be received at the town hall no later than 4 p.m. on Monday, Aug. 23, 2004, at which time they will be opened and read aloud. Bids will be awarded at the regular Pinedale Town Council Meeting at 6:30 p.m. on that day. Bids submitted by mail should be enclosed in a second envelope. The Town of Pinedale reserves the right to waive minor defects or irregularities in the bidding, or to reject bids.

You are hereby notified that on 8/2/04, LESLIE KECK filed an Application For Decree Establishing Right And Title To Real Property requesting that the Court enter a Decree setting over certain real property from SALLY SONDER, A/K/A SALLY SONDERS to LESLIE KECK, as Successor Trustee of the Sonder Family Living Trust, Dated January 8, 1992.

5. That no application for appointment of a personal representative for the estate of the Decedent is now pending or has been granted in any jurisdiction.

8. That there are no other distributees or heirs of the Decedent having any right to succeed to said real property under probate proceedings.

PUBLIC NOTICE
The Sublette County Planning & Zoning Commission will meet on Thursday, September 23, 2004, at 7:00 p.m., in the Sublette County Courthouse in Pinedale, Wyoming. At this time, a public hearing will be held to consider the following application:
AGENDA
1. Zone change request by MG Land and Livestock, LLC, (Tom Worden, Managing Member) to rezone 3.4 acres, more or less, from Agricultural (A-1) to Light Industrial (I-L). The property is located in the SW4NW2 of Section 2, T34N, R111W, 6th P.M., Sublette County. It is south of Daniel Junction and east of US Highway 189. The purpose of the request is to rezone to Light Industrial and allow an oil and gas production company to use the existing shop and to place a manufactured home on the site for use as a manager's residence.
2. Zone change request by John M. Sulenta to rezone 44.79 acres, more or less, from Agricultural (A-1) to Heavy Industrial (I-H). The property is located in Section 25, T33N, R109W, Sublette County. It is north of the Pinedale airport along U.S. Hwy. 191. The purpose of the request is to develop a larger heavy industrial parcel.
3. Preliminary Plat approval for Granite Peaks Estates Subdivision by Granite Peaks, LLC, (Tim McKinney, Managing Member), to subdivide 64.02 acres, more or less, zoned R-R (Rural Residential Minimum Two Acres) and R-R 5 (Rural Residential Minimum Five Acres) into sixteen (16) lots. The property is located in the E 1/2 of Section 29 and W 1/2 of Section 28, T34N, R109W, 6th p.m., Sublette County. The purpose of the request is to create a residential subdivision. The property is east of BB Village and Fox Hollow Subdivisions, east of Ehman Lane and north of the Town of Pinedale.
4. Preliminary Plat approval for Hoback Ranches, Tract 10 and Tract 16-4 (E ? Tract 16) of Sheet 7, to be known as Hoback Ranches, Fourteenth Filing, by Jim Linebarger, Tim Key, David Haight, and William B. Hyde (Titleholders), John R. Batson, Nelson Engineering (Agent), to subdivide 29.03 acres into two lots. The property is located within Section 1, T36N, R113 W, 6th P.M., Sublette County. It is located within Hoback Ranches Subdivision and is accessed from Rim Road, off Highway 189/191. The purpose of the request is to create one ten (10) acre, residential lot for sale.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
AUGUST 3, 2004
The Board of County Commissioners met in regular session in the commissioners meeting room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9 a.m. with Gordon Johnston, Betty Fear, Casey Dean of the Sublette Examiner, Noah Brenner and Josh Davidovich of the Pinedale Roundup, and Mary Lankford, county clerk, present. Commissioner Bill Cramer was absent.
Chairman Johnston led those present in the Pledge of Allegiance.
The minutes of the budget hearing of July 19, 2004, and the preceding regular meeting of July 20, 2004, were approved and ordered filed on motion by Commissioner Fear and seconded by Chairman Johnston. The motion carried.
Travis Sour, Road & Bridge Superintendent, reported on discussing improvement projects for the Daniel Merna and Calpet Roads with the Wyoming Department of Transportation. The projects could be scheduled for 2006. The county would be able to do the shoulder work on the Calpet Road.
Ken Konicek, representing Tegeler and Associates, discussed the county's health insurance renewal and possible plan design changes to include health savings accounts for the employees. Retiree health insurance was discussed and could be incorporated with a new plan design. The board decided that any plan design changes would occur on January 1st, and requested Konicek to prepare a proposal for presenting HSAs to the county employees.
Sheriff Hank Ruland and Undersheriff Henry Schmidt discussed security at the Marbleton Annex, which Schmidt will pursue, and reported that the department had been contacted about letters of support for area mancamps. The department will not issue letters of support, at this time.
Lorraine Leavitt, representing Child Care Finder, presented the needs assessment and applications for TANF funding. The requests were: High Country Counseling and Resource Centers, $5,628; Child Care Finder, $28,444; Our Families Our Future, $34,800; and SAFV, $16,447. The board approved all requests, to be included in the county's application for funding. The board encouraged cooperation and coordination between the agencies.
Tony Chambers, representing Chambers Design-Build, and Brad Waters, representing Providence Architecture, discussed completion of the project and sitework. The board approved two change orders, one for an additional 15 days on Chambers' contract for additional work, outside of the original contract and the other for additional materials for proposed additional work.
Rick Foley, representing Hogan & Associates, and Brad Waters, representing Providence Architecture, reported on the courthouse construction project. A new schedule of work was presented with a report that the project is ahead of schedule. Hogan has six new people on site. The reorganization of Sublette Electric was discussed and the board decided to contract with Sublette Electric, directly, for the completion of the project. Waters will prepare the contract and forward to the county attorney. The board decided to replace the old roof on the courthouse. It was moved by Commissioner Fear and seconded by Chairman Johnston to accept the bid from general communications for the amount of $425,000 for audiovisual equipment for the senior center, circuit court, district ccourt and courthouse.
The motion carried.
The board recessed the meeting for a conference call in executive session with Kate Fox of Davis and Cannon to discuss ongoing litigation.
The board reconvened the meeting.
Jocelyn Moore, county planner, reported that the road maintenance agreement for Fox Hollow Subdivision and the adjacent three subdivisions had been signed. The board approved and signed a contract for services with the Sonoran Institute.
Requests for proposal from two auditing firms were reviewed. It was moved by Commissioner Fear and seconded by Chairman Johnston to hire Leo Riley and Company of Casper for $23,000, for the FY04 financial audit. The motion carried.
Annie Sondgeroth, Sublette County Public Health Nurse, presented her department budget for signature for submission to the State. Chairman Johnston signed the budget.
The following petition and affidavit of abatement of taxes was presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Wyoming Wireless.com, $594.00 (assessed value); Wyoming Wireless.com, $743.00 (assessed value); White Wolf Creations, $100.00 (assessed value); Western Wyoming Hearing, $475.00 (assessed value); BP America Production Company, $464.61; EOG Resources, $4,024.09; and McMurry Oil Company, $693.40.
Lance Koppenhafer, representing the Ag Center, presented a proposal from Alta Construction, Inc. to re-roof the lean to at the Ag. Center. It was moved by Commissioner Fear and seconded by Chairman Johnston to accept the proposal for the amount of $37,700.00. The motion carried. Koppenhafer, Annie Espenscheid and Ross DeGraw discussed the addition to the south side of the Ag Center. It was decided to purchase the steel and metal for the project now. Commissioner Fear suggested a public meeting by the Ag Center Committee to review the addition plans.
It was moved by Commissioner Fear and seconded by Chairman Johnston to recess the meeting for an executive session with Dan Budd and Calvin Ragsdale to discuss a county road easement and pending litigation. The motion carried.
The board continued the executive session with Sheriff Hank Ruland, Undersheriff Henry Schmidt, and County Attorney Van Graham to discuss pending litigation.
The board reconvened the meeting.
It was moved by Commissioner Fear and seconded by Chairman Johnston to deny a claim by Tanna Jones against Dwayne Burson, Hank Ruland, Sublette County Sheriff, in his personal and official capacity; and the Sublette County Sheriff's Office in the amount of $1,000,000. The motion carried.
It was moved by Commissioner Fear and seconded by Chairman Johnston to deny a claim by Patricia L. Ellis against the Sublette County Sheriff's Department, Toby Terrell, Andrew Mackenzie, Scott Winer, and any other officer or supervisor who was involved in the search of 410 South Jackson, Pinedale, Wyoming, on Aug. 23, 2003 in the amount of $1,000,000. The motion carried.
Rick Hoffman, Waste Management Superintendent, reported on the DEQ permit amendment at the Marbleton Landfill, construction, staffing, equipment, and groundwater monitoring. It was decided to renew the burn permit at the Pinedale Transfer Station with DEQ Air Quality.
Susan Kramer, representing Sublette Citizens for Recycling, discussed a storage addition to their building. The addition will need to be approved by the Town Planning and Zoning.

NOTICE OF INTENT TO SUBDIVIDE
Notice is hereby given that, in accordance with Chapter 18-5-306, Wyoming Statutes 1977, as amended, that Jim Linebarger, Tim Key, David Haight and William B. Hyde intend to apply for a permit to subdivide in Sublette County. A public hearing for said permit will occur at a regular meeting of the Sublette County Commissioners. Please contact the Sublette County Planning and Zoning Commission at 367-4375 for the scheduled meeting date. The proposed subdivision contains 2 residential lots, which average 14.52 acres per lot. The project is located on 29.04 acres, generally described as Tract 10 and Tract 16-4, of Sheet 7, of the Hoback Ranches Subdivision, located within Section 1, Township 36 North, Range 113 West, 6th P.M., Sublette County, Wyoming. INVITATION FOR BIDS
MILL STREET REMEDIATION
SUBLETTE COUNTY, WYOMING
Sealed BIDS are requested for work described in the Project Manual for the Mill Street Remediation Project, located in Pinedale, dated Aug. 11, 2004, prepared by Rio Verde Engineering, 201 West Pine Street, P. O. Box 642, Pinedale, Wyoming 82941, (307)367-2826.
BIDS will be received by Rio Verde Engineering, at their office, until 10 a.m., local time on Aug. 20, 2004, at which time said BIDS will be publicly opened and read aloud.
The work consists of 1,650 tons of hot mix bituminous pavement, 782 LF of 3 foot valley pan, 207 LF of 6 foot valley pan, 636 LF of 5 foot sidewalk & curb, 264 LF of 8 foot sidewalk & curb, and associated work.
Copies of the Project Manual and the Design Drawings specifying the work to be performed may be obtained from Rio Verde Engineering.
BIDDERS shall be required to accompany each bid with a BID Bond with sufficient surety, or a certified check, cashier's check or bank draft upon some reputable bank payable to the Town of Pinedale for at least ten percent of the total amount of the BID. The bond, check or bank draft shall be forfeited as liquidated damages, if the BIDDER, upon the letting of the contract to him, fails to enter into the contract within ten days after it is presented to him for that purpose or fails to proceed with the performance of the contract. The BID Bond, draft or check shall be retained by Sublette County, until proper bond to secure performance of the contract has been filed and approved. All the above to be in accordance with 15-1-113, Wyoming Statutes, 1977, July 1980 Supplement, or as amended.

2004 Primary Election
VOTERS IN THE FOLLOWING PRECINCTS WILL VOTE FOR STATE REPRESENTATIVE, DISTRICT 22: Pinedale 1-1, Pinedale-West 1-3, Boulder 1-4, Marbleton-North 2-4, Cora 4-1, Daniel 4-2, and Bondurant 5-1.
VOTERS IN THE FOLLOWING PRECINCTS WILL VOTE FOR STATE REPRESENTATIVE, DISTRICT 20: Big Piney 2-1, and Marbleton 2-2.
You may register to vote at the polls if you are qualified and have proper identification. Proper identification is your Wyoming driver's license or your Social Security number and photo identification.
If you require assistance to vote by reason of blindness, disability, or inability to write, a person of your choice may give you assistance. Also, if you have questions regarding the accessibility of your polling place, please contact your county clerk.
Any person who expects to be absent from his place of residence on election day, or who cannot be present at his precinct polling place on election day because of illness, injury, disability, old age or tenets of his religion, may apply for an absentee ballot in person, in writing, or by telephone, at the Office of the County Clerk, Sublette County Courthouse, P.O. Box 250, Pinedale, Wyo., 82941, 367-4372, 276-3827, or sbcc@state.wy.us. Absentee ballots may be requested through Aug. 16, 2004, at your County Clerk's Office.
Names of candidates will be rotated on the official ballot and will not always appear in the order indicated on the sample ballots.
