OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JULY 6, 2004
The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse in Pinedale, Wyoming, on this date at 9 a.m. with Gordon Johnston, Bill Cramer, Betty Fear, Cat Urbigkit of the Sublette Examiner, Noah Brenner of the Pinedale Roundup, and Mary Lankford, county clerk, present.
Chairman Johnston led those present in the Pledge of Allegiance.
The minutes of the preceding regular meeting of June 15 and budget session, June 16, 2004, were approved and ordered filed on motion by Commissioner Fear and seconded by Commissioner Cramer. The motion carried.
The official bonds for Rex Poulson, treasurer, Library Board, in the amount of $5,000; Betty Lou McLoughlin, treasurer, Upper Green River Cemetery District, in the amount of $1,000; Gloria Thomas, treasurer, Sublette County Firefighters, in the amount of $50,000; Dawn Mitchell, treasurer, Ice Rink Committee, in the amount of $5,000; Judith R. Adler, chairman/treasurer, Hoback Ranches Service and Improvement District, in the amount of $5,000; Jon Boroff, treasurer, Daniel Volunteer Fire Company, in the amount of $25,000; Millie Pape, secretary/treasurer, Sublette County Historical Society, in the amount of $1,500; Cathy Saxton, chairman, School District No. 1 BOCES, in the amount of $25,000; Donna Lozier, director, School District No. 1 BOCES, in the amount of $25,000; and Lynn Grassell, clerk, School District No. 1 BOCES, in the amount of $25,000, were approved and ordered filed with the county treasurer.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to designate the Sublette Examiner as the official newspaper for the ensuing year, ending June 30, 2005, at a rate of $1.75 per column inch. The motion carried.
Rick Hoffman, waste management superintendent, discussed a recent letter of violation from the DEQ on the Marbleton Landfill.
Travis Sour, road and bridge superintendent, discussed the maintenance on Pinedale East and Middle Piney. Sour reported on meeting with Jane Adamson from Fremont County and the hiring of Butch Penton as his assistant. Commissioner Cramer reported that he had contacted Jack Richardson about an easement to possibly re-route traffic to the Mesa.
Paul Scherbel presented a petition for establishment of the extension of the First North County Road No. 23-224 in Meadow Canyon Estates Subdivision. It was moved by Commissioner Cramer and seconded by Commissioner Fear to adopt Resolution No. 04-819J accepting the Extension of First North County Road No. 23-224 into the county road system. The motion carried.
Laurie Hartwig requested funding for the Museum of the Mountain Man for archive area renovation in the amount of $53,580. The Board tentatively approved the request.
The board recessed the meeting into executive session with Sheriff Hank Ruland and Undersheriff Henry Schmidt to discuss a personnel matter.
The board reconvened the meeting.
Dave Bell and Betty Cheeney, representing the recreation board, requested funding in the amount of $746,769.76. The board tentatively approved the request.
In accordance with the public notice published in the Pinedale Roundup, public hearing was held for the transfer of funds in the amount of $336,040.22 from the following accounts: Depreciation Reserve - Landfill Reserve, $294.389.20; Depreciation Reserve -Transfer Station, $1,500.00; and Equipment Reserve, $40,151.02 to the following accounts: Transfer Station -Transfer Contract, $1,500.00; Sanitary Landfill, heavy Equipment $40,151.02; and Sanitary Landfill, Bale Facility, $294,389.20. It was moved by Commissioner Cramer and seconded by Commissioner Fear to adopt Resolution No. 04-820J authorizing the transfer of funds. The motion carried.
In accordance with the public notice published in the Pinedale Roundup on June 24, 2004, public hearing was held for the following:
It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the final plat for West Ridge Estates Subdivision. The motion carried.
It was moved by Commissioner Fear and seconded by Commissioner Cramer to approve the preliminary plat for Old Brazzill Ranch Subdivision, Second Filing by Jack and Cecilia Richardson, to subdivide 33.47 acres, more or less, zoned R-R, creating 14 lots, located in the S1/2NE1/4 and N1/2SE1/4, Section 10, T33N, R109W. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the preliminary plat for Rendezvous Ridge Subdivision by MG Land and Livestock, LLC to subdivide 169.43 acres, more or less into 22 lots, zoned R-R 5 and R-R 10, located in the NW1/4, Section 27, and SE1/4SW1/4, Section 33, T34N, R111W. The motion carried with the following conditions:
Text to be added to the plat showing the location of the intermittent stream and that all septic system locations require a minimum 50' setback area from the stream.
"No feeding of ungulates" added to the plat.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to deny the variance application by James Washam on Lot 11, Block 4, Shelter Park Subdivision. The motion carried.
Jocelyn Moore, county planner, discussed the proposed Uniform Development Code and the extension of the Planned Unit Development moratorium. The board requested that the Planning and Zoning Commission propose the extension of the moratorium.
Carol Chidsey discussed junk.
Steve James and Randy Belton, representing the fair board, discussed the cost of adding camper hookups to accommodate 24 spaces at the fairgrounds. It is estimated that the addition will cost $40,000.
Lance Koppenhafer, Annie Espenscheid and Ross DeGraw discussed an addition to the south side of the Ag Center. It is estimated that the addition will cost $400,000.
Rick Foley, representing Hogan & Associates, and Brad Waters, representing Providence Architecture, reported on the construction project. The foundation for the juvenile pod will be poured on July 15th. Roof problems in the justice building and the detention center and the detention doors were discussed.
Tony Chambers, representing Chambers Design-Build, Brad Waters, representing Providence Architecture, and the Senior Center Building Committee discussed completion of the project by August 1st, excavation and furnishings. Maintenance and cost of equipment and furnishings was discussed.
The board recessed the meeting for a conference call in executive session with John McKinley of Davis and Cannon to discuss ongoing litigation.
The board reconvened the meeting.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to authorize Davis and Cannon to take any and all actions necessary to intervene in the State Board of Equalization appeals, 2004-84 and 2004-85, by Exxon-Mobil. The motion carried.
County Attorney Van Graham discussed his letter to Dan Budd and will send another letter to his attorney and request a response by July 20th. Graham advised the board to have the Ag Center roof fixed. Graham reported that he is scheduled for a conference call with the Tenth Circuit Court on July 14th on the Erramouspe Road appeal and requested a special meeting with the board on July 9th at 3 p.m. to discuss the county's position on the matter.
The following petition and affidavit of abatement of taxes was presented on petition from the county assessor and the State of Wyoming Board of Equalization: William E. & Mary Ann Branson, dba Iron Mike's Muscle & Fitness, $2130 (assessed value); Ultra Resources, Inc., $9,669.23; EOG Resources, $3,830.76; Gary & Nancy Burstad, $2138 (assessed value); and Jonah Energy Company, $193.75 and $3237 (assessed value).
Lary Lozier presented a petition for the formation of the Boulder Mosquito Abatement District. County Clerk Mary Lankford reported that she has certified the petition. The board directed the county clerk to schedule the hearing for the petition on August 20, 2004.
Travis Sour discussed an access from the Urbigkit property on the Paradise Road.
Pursuant to W.S. 22-29-402, County Clerk Mary Lankford, representing the District Directors for Dissolution, presented the Finding of Facts and Proposed Plan of Dissolution for the Cora Y Mosquito Abatement District. It was found that the county treasurer holds $1,885.72 in collected taxes from the district, and recommended that the taxes be returned to the county's general fund. It was moved by Commissioner Cramer and seconded by Commissioner Fear to dissolve the Cora Y Mosquito Abatement District and return the taxes to the county's general fund. The motion carried.
It was moved by Commissioner Fear and seconded by Commissioner Cramer to appoint Amy Bell for a three-year term to the library board. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to re-appoint Judi Adler and Suzy Michnevich for three-year terms to the Planning and Zoning Commission. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to re-appoint John Hodges and appoint Bob Maxam for three-year terms to the golf committee. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to issue malt beverage permits to the Sublette County Sporting Association for the Rendezvous Rodeos on July 8, 9 and 10, and the Cowboy Shop Classic on August 29, 2004, at the Pinedale Rodeo Grounds. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to issue a malt beverage permit to the Pinedale Lions Club for the Rendezvous Pageant on July 11, 2004, at the Rendezvous Grounds. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to issue a malt beverage permit to -A + C4 Rodeo Company for a rodeo on August 20, 2004, at the Pinedale Rodeo Grounds. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to deny the Amended Notice of Claim by Donna S. Ecklund for $1,000,000, plus wages losses, past and present, as well as any punitive damages that may be allowed under the law. The motion carried.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to waive the temporary merchant's fee for Rendezvous Weekend of July 8, 9, 10 and 11, 2004. The motion carried.
The board signed the contract for the TANF/CPI planning mini grant with the Department of Family Services for the amount of $10,000.
The board signed the grant documents for the WCCA OJJDP non-participating grant for the amount of $40,000.
The board signed the Request for Conveyance for 17.58 acres adjacent to the Pinedale Shooting Range in Lot 5, Section 7, T33N, R109W.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JULY 9, 2004
The Board of County Commissioners met in special session on this date at 3 p.m. in the Commissioners Meeting Room of the Sublette County Courthouse with Gordon Johnston, Bill Cramer, Betty Fear, Bill Boender of the Sublette Examiner, Noah Brenner of the Pinedale Roundup and Mary Lankford, County Clerk present.
County Attorney Van Graham reviewed the Erramouspe Road case, decision, and appeal with the board. The board discussed RS 2477 road actions, generally, and with respect to this case.
It was decided that Graham should participate in the Tenth Circuit Court appeal conference call on July 14th. After reviewing all of the facts, the board decided to not pursue the appeal.
The board discussed the FLPMA process and stated that it is not interested in pursuing access through this process, due to possible revocation, fees, and conditions.
Commissioner Cramer stated that he felt that the Wyoming Supreme Court is wrong in this matter and that the board should pursue a new case and appeal to the Wyoming Supreme Court, due to the importance to the county, as well as to the State of Wyoming.
The board directed Graham to research a new state court case.
There being no further business, the meeting was adjourned at 3:40 p.m.
