TO ALL PERSONS INTERESTED IN SAID ESTATE:
You are hereby notified that on May 15, 2003, Don. F. Day and Antonine Day, a/k/a Antionene Day, husband and wife, filed an Application for Decree Establishing Right and Title to Real Property requesting that the court enter a decree setting over certain real property from Mary Jane Day.
In said application Don F. Day alleges:
That the Decedent, Mary Jane Day, died on April 9, 1993, in Lewis County, State of Washington, leaving real property owned in her name in Sublette County, Wyoming;
That Don. F. Day and Antonine Day, a/k/a Antionene Day, husband and wife, are the sole legatees under the Last Will and Testament of the Decedent who died testate.
3. That the Decedent left no surviving spouse.
4. That thirty (30) days have elapsed since the death of the Decedent.
5. That the entire estate of the Decedent, both real and personal, did not exceed one-hundred-fifty thousand and no/100 ($150,000) dollars.
6. That no application for appointment of a personal representative for the estate of the Decedent is now pending or has been granted in any jurisdiction.
7. That the Decedent owned certain real property in Sublette County, Wyoming, to-wit:
Lot ninety-eight (98), Block Three (3) of the Barger Subdivision, Sublette County, Wyoming;
TOGETHER WITH all improvements and appurtenances thereunto appertaining.
8. The value of this property is less than one-hundred-fifty-thousand and no/100 ($150,000) dollars.
9. That Don. F. Day and Antonine Day, a/k/a Antionene Day, husband and wife, are entitled to have said real property set over to them due to the terms of the Decedent's Last Will and Testament.
10. That there are no other distributees or heirs of the Decedent having any right to succeed to said real property under probate proceedings.
Anyone having an objection to said Application should file it with the Clerk of District Court, Sublette County, Wyoming, prior to June 5, 2003.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
MAY 20, 2003
The Board of County Commissioners met in regular session on this date at 9 a.m. with Gordon Johnston, Bill Cramer, Betty Fear, Cat Urbigkit of the Sublette Examiner, Joe Wilhelm of the Pinedale Roundup, and Mary Lankford, county clerk, present.
Chairman Gordon Johnston led those present in the Pledge of Allegiance.
The minutes of the preceding meeting of May 6, 2003, were approved and ordered filed on motion by Commissioner Cramer and seconded by Commissioner Fear. The motion carried.
The official bonds for Lisia Hueckstaedt, treasurer, Firefighters Association of Sublette County, in the amount of $50,000; and Lynn Grassell, clerk, Sublette County Board of Cooperative Educational Services, in the amount of $25,000, were approved and ordered filed with the county treasurer.
Dan Holgate, road and bridge superintendent, reported that the county attorney had approved the proposed drug and alcohol testing policy for signature. Chairman Johnston signed the policy. Holgate discussed improvements on the South Piney Road and their approval from Dan Budd, gravel hauling on the Paradise Road, progress on the Industrial Site Road, and the completion of GASB 34.
Lewis Gage inquired about the status of the Boulder Lake Road this year.
Les Burrough presented information on West Nile Virus and discussed options for mosquito abatement. The board requested more information from Burrough for their next meeting.
Sue Ziegler discussed requesting minutes from the PDR Working Group. Commissioner Fear offered to contact Penny Chrisman about minutes. Chairman Johnston reported that the board will be advertising for the Citizens Review Committee and coordinator.
Sheriff Hank Ruland and Undersheriff Henry Schmidt reported on the submission of a Homeland Security Grant for $152,318.
In accordance with the public notice published in the Sublette Examiner on April 17, 2003, public hearing was held for the following:
1. It was moved by Commissioner Cramer and seconded by Commissioner Fear to accept and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 03-768J
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF RICHARD ROHRER TO RECLASSIFY AND REZONE 0.5 ACRES, MORE OR LESS, FROM R-R DISTRICT TO R-R MH DISTRICT, LOCATED IN A PORTION OF SECTION 15, T32N, R108W.
2. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve a variance request by Charles Hunt to place a well and septic system on less than one acre and to have a rear property setback of 20 feet where 40 feet is required, located on Lot 4, Boulder second Filing. The motion carried.
3. It was moved by Commissioner Cramer and seconded by Commissioner Fear to accept and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 03-769J
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND DENYING THE APPLICATION BY JP RANCH, INC. TO RECLASSIFY AND REZONE 40 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R 10 DISTRICT ON 14.5 ACRES, MORE O LESS, AND R-R 20 DISTRICT ON 25.5 ACRES, MORE OR LESS, LOCATED IN SECTION 12, T33N R109W, ALSO KNOWN AS TRACT 4, DIAMOND T ESTATES LARGE TRACT DEVELOPMENT.
4. It was moved by Commissioner Fear and seconded by Commissioner Cramer to approve and sign the Wilderness Estate Large Tract development by First Citie Capitol Corporation, being 201.66 acres, more or less, zoned A-1, located in portions of Section 6, T33N, R108W, and Section 1, T33N, R109W.
5. It was moved by Commissioner Fear and seconded by Commissioner Johnston to reverse and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, with the vote being: Cramer-aye, Fear-aye, Johnston-nay, and the following resolution was adopted:
RESOLUTION NO. 03-770J
A RESOLUTION REVERSING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION BY JACK RICHARDSON TO RECLASSIFY AND REZONE 43.1 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R 10 DISTRICT, BEING LOT 1, OLD BRAZZILL RANCH LARGE TRACT DEVELOPMENT.
6. It was moved by Commissioner Cramer and seconded by Commissioner Fear to accept and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, and the following resolution was adopted:

7. It was moved by Commissioner Cramer and seconded by Commissioner Fear to accept and act upon the zone change application by Bubba Larsen, without a recommendation from the planning and zoning commission. Upon vote, the motion carried, and the following resolution was adopted:

A RESOLUTION APPROVING THE APPLICATION BY BUBBA LARSEN TO RECLASSIFY AND REZONE 4 ACRES, MORE OR LESS, FROM R-R MH-PUD DISTRICT, C-1/PUD DISTRICT, AND R-R MH10 DISTRICT TO CH-1/PUD DISTRICT, C-1/PUD DISTRICT, AND R-R MH/PUD DISTRICT, BEING A PORTION OF LOT 3, BIG RIVER SUBDIVISION.
8. It was moved by Commissioner Cramer and seconded by Commissioner Fear to grant a two-year extension on reversal of the zoning on property owned by Scott Leeper on 97 acres, more or less, zoned R-R10, located within Section 33, T38N, R113W. The motion carried, with the vote being: Cramer-aye, Fear-aye, and Johnston-nay. The board advised Leeper that the zoning will revert, if a final plat is not filed within the next two years.
9. It was moved by Commissioner Fear and seconded by Commissioner Cramer to adopt Resolution No. 03-774J rescinding a portion of Resolution No. 83-25B, being a zoning reversal, on 156 acres more or less, within Sections 10 and 11, T34N, R112W, owned by William J. Koch. The motion carried.
The board discussed the apparent attitudes of the planning and zoning commission and the need for findings used to deny applications.
Walt Bousman, representing the rural health care district, informed the board that the district will consider funding mental health.
Mike McGinnis, waste management superintendent, reported that the bid opening for the cell excavation will be June 3rd, and that the baler will arrive on June 26th. The board directed McGinnis to prepare responses to the DEQ violation letters for Chairman Johnston to review. The board discussed non-submission of Eiden vouchers.
The board directed the county clerk to advertise for a county coordinator and members of a Citizens Review Board for the PDR Pilot Program. The board decided that the review board will be comprised of five members, with county geographic distribution representing agriculture, business, and conservation interests.
It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the renewal applications for the following retail liquor licenses: Green River Bar, Boulder Liquors, Elkhorn Bar, The Place, and Country Lane Liquor. The motion carried. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the renewal applications for the following restaurant liquor licenses: Lakeside Lodge, Fort William Recreation Area, and Half Moon Lake Lodge. The motion carried. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the renewal applications for the following malt beverage permits: Hoback Village, Lakeside Beer Sales (and transfer), Stanley's Junction, and White Pine Ski Area & Resort. The motion carried. It was moved by Commission Fear and seconded by Commissioner Cramer to approve the renewal application for a limited retail liquor license to the Pinedale Golf Club, Inc. The motion carried. The license for Elk Ridge Lodge, Inc. was not renewed, due to lack of fee and proper application.The license for Stanley's was not renewed, due to lack of purchase of the required quantity of malt beverage and the business' non-operational status.
In accordance with the public notice published in the Sublette Examiner on April 24, May 1, 8, and 15, 2003, public hearing was held for the issuance of a restaurant liquor license to Stuart Thompson dba White Pine Grub Steak, located at 692 Skyline Road, in a portion of Section 28, T35N, R108W. There being no protests, it was moved by Commissioner Cramer and seconded by Commissioner Fear to issue the license. The motion carried.
