PUBLIC NOTICE
Notice is hereby given that a second Public Hearing will be held by the State Engineer to receive comments and evidence, as required by Wyoming Statute 41-3-1006(e) prior to granting or denying State-held instream flow water right applications. The public hearing will be held on July 28, 2003, in Pinedale, Wyoming, beginning at 9 a.m. at the Sublette County Library, 155 S. Tyler Ave., in the large meeting room (Lovatt Room). The State Engineer requests that anyone requiring auxiliary aids for disabilities contact the State Engineer's Office in advance by calling the Surface Water Division in Cheyenne at 777-6475 (mailing address: Herschler Building 4E, Cheyenne, WY 82002).
This is a re-hearing involving two (2) applications submitted to the State Engineer which encompasses the following:
TF No. 31 4/105, Pine Creek Instream Flow Segment Number 1, held by the Wyoming Water Development Commission; priority date of June 4, 2002 for 40 cfs throughout the entire year when natural direct flows are available at or near the downstream end of the stream segment, which segment is described as beginning at the base of Fremont Lake Dam in the SW1/4SW1/4 of Section 23, T.34N., R.109W., thence down Pine Creek to the point of ending at the confluence with the West Fork New Fork River in the NW1/4SE1/4 of section 15, T.33N., R.109W., for a total stream distance of 8.18 miles.
TF No. 31 5/70, Pine Creek Instream Flow Segment No. 1, held by the Wyoming Water Development Commission; priority date of April 2, 2002. This is a secondary application to use stored water to help maintain up to a 40 cfs flow rate throughout the entire year. The stored water will come from 952.95 acre-feet owned by the Game and Fish Commission in Fremont Lake and 4,800 acre-feet of the Town of Pinedale's storage in Fremont Lake during a valid lease term when flows are not available at or near the downstream end of the stream segment, which segment is described as beginning at the base of Fremont Lake Dam in the SW1/4SW1/4 of Section 23, T.34N., R.109W., thence down Pine Creek to the point of ending at the confluence with the West Fork New Fork River in the NW1/4SE1/4 of section 15, T.33N., R.109W., for a total stream distance of 8.18 miles.
This second hearing for the Pine Creek Instream Flows are scheduled due to questions regarding sufficient public notice for the December 19, 2002 hearing, as required by Wyoming Statute 41-3-1006(e). Public comments made during the December 19, 2002 hearing are of record and will be used in the decision making process. This re-hearing will be to gather only new public comment that was not heard at the December 19, 2002, hearing.

Order setting hearing
John D. Walter III, James P. Meiring, and Jack Roberts, the duly elected, qualified and acting commissioners of Highland Irrigation District, having filed their report pursuant to the requirements of Section 41-7-402, Wyoming Statutes, 1977, showing that each landowner in the district should be assessed a minimum of $30 for the current expenses and a further assessment of $2.50 per acre upon the benefited lands of the district for the purpose of raising funds for new work, maintenance and current expenses, and that each landowner should also be assessed an additional assessment of a minimum of $5 and a further assessment of $1.50 per acre upon the benefited lands of the district for the purpose of loan amortization of said district, in the fiscal year beginning July 1, 2003.

BEFORE THE OIL AND GAS CONSERVATION COMMISSION OF THE STATE OF WYOMING
The following matters will come before this Commission on Tuesday, August 12, 2003, at 9 a.m. or as soon thereafter as the matters may be heard, or between the hours of 8:00 a.m.. and 5 p.m. on any of the subsequent days during which the commission remains in session at the office of the State Oil and Gas Supervisor, 777 West First Street, Casper, Wyoming:
Cause No. 3, Order No. 2, Docket No. 295-2003, brought on the application of BP America Production Company for an order from the commission to authorize the drilling of four additional wells to test and produce from the Jonah Field Lance Pool as defined by the commission's order in Docket No. 84-2003, each of which wells will be an increased density well on lands spaced or affected by the Commission's prior orders in Docket Nos. 228-98 or 90-2000, such wells being identified and located on the following quarter sections of land, at the distances and otherwise in the manner more particularly described as the Cabrito No. 9-30A located in the SE1/4 of Section 30, Township 29 North, Range 107 West, 6th P.M., the Corona No. 11-31A located in the SW1/4 of Section 31, Cabrito No. 9-25A located in the SE1/4 of Section 25 and the Stud Horse Butte No. 30-20A located in Section 20; all in Township 29 North, Range 108 West, 6th P.M., and to authorize unrestricted production from each such additional well from any portion of the Jonah Field Lance Pool, all in the Jonah Field, Sublette County, Wyoming.
Cause No. 1, Order No. 2, Docket No. 296-2003, brought on the application of BP America Production Company for an order from the commission amending the commission's prior order in Docket No. 90-2000, so as to include all of Section 25, Township 29 North, Range 108 West, 6th P.M, as being included in the "Buffer Acreage" (under Docket No. 228-98) approved for 40-acre in-fill drilling in Docket No. 90-2000, and, further to the extent required, confirming that Section 25, Township 29 North, Range 108 West, is subject to the terms of the Commission's recent order in Docket No. 84-2003, defining the Lance Pool for the Jonah Field, all in the Jonah Field, Sublette County, Wyoming.
Cause No. 1, Order No. 2, Docket No. 303-2003, brought on the amended application of Infinity Oil and Gas of Wyoming, Inc. for an order establishing two 643.63 acre drilling and spacing units, one for the coal zone stratigraphic equivalent of 3,255' to 3,266' of the Mesaverde Formation and one for the coal zone at the stratigraphic equivalent of 3,623' to 3,630' of the Mesaverde Formation as found in the Thompson 6-4-29-113 for the purpose of drilling a pilot multi-lateral horizontal wellbore in each drilling and spacing unit for the SW1/4 of Section 6, and the NW1/4 of Section 7, Township 29 North, Range 113 West; the SE1/4 of Section 1 and the NE1/4 of Section 12, Township 29 North, Range 114 West, with one multi-lateral horizontal well to be drilled from the existing Thompson 6-4-29-113, located in the SW1/4 of Section 6, to the coal zone at the stratigraphic equivalent of 3,255' to 3,266', and the second multi-lateral horizontal well to be drilled from the Thompson 6-4-29-113 at the stratigraphic equivalent of 3,623' to 3,630' or from the existing Thompson 1-3-29-114, located in the SE1/4 of Section 1 for the coal zone at the stratigraphic equivalent of 3,623' to 3,630' as found in the Thompson 6-4-29-113 or 3,258' to 3,265' in the Thompson 1-3-29-114 and to vacate any existing drilling and spacing orders; Sublette County, Wyoming.
Cause No. 4, Order No. 1, Docket No. 326-2003, brought on the application of Stone Energy Corporation for an order authorizing the commingling of production from the Erickson Formation and the Lance Pool as defined in Docket 136-2003 for the Rainbow 15-32 well, located in Township 30 North, Range 107 West, Section 32, SW1/4SE1/4, Pinedale Anticline area, Sublette County, Wyoming.
Any interested party is entitled to appear at the time and place aforesaid to be heard by the commission. The applications may be inspected in the office of the undersigned, 777 West First Street, Casper, Wyoming. If there are any protests, please make such known to the State Oil and Gas Supervisor at least three (3) working days before the hearing by filing a written objection.
