OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JUNE 17, 2003
The Board of County Commissioners met in regular session on this date at 9 a.m. with Gordon Johnston, Bill Cramer, Betty Fear, Cat Urbigkit of the Sublette Examiner, Joe Wilhelm of the Pinedale Roundup, and Mary Lankford, county clerk, present.
The minutes of the preceding meeting of June 3, 2003, and budget sessions of June 2 and 6, 2003, were ordered filed on motion by Commissioner Cramer and seconded by Commissioner Fear. The motion carried.
The official bonds for Betty Lou McLoughlin, treasurer for the Upper Green River Cemetery District, in the amount of $1,000, and Peggy Winters, treasurer for the Mosquito Abatement District No. 1, in the amount of $1,000, were approved and ordered filed with the county treasurer.
Dan Holgate, road and bridge superintendent, reported on the purchase of chips, pothole repair on the Horse Creek Road, mag water application on the Reardon Draw Road, completion of the Paradise project, and soil stabilization on the Upper Hoback Road. Holgate reported that work on the Industrial Site Road has started.
Lew Gage questioned the completeness of the May 20th minutes concerning grading of the Boulder Lake Road. County Clerk Mary Lankford reported on a review of the meeting tape and requested the board clarify its directions on the road maintenance. Commissioner Cramer proposed grading the Forest Service portion of the road whenever the county portion is graded. The board agreed. Dan Holgate reported on his discussion with Cindy Stein of the Forest Service about a maintenance agreement. Later in the meeting, Holgate returned with Craig Trulock, district ranger, with a maintenance agreement, which the board approved and signed. Lance Koppenhafer, representing the Ag Center, reported on the roof repair. It was moved by Commissioner Cramer and seconded by Commissioner Fear to authorize Koppenhafer to hire Alta Construction to make the necessary roof repairs. The motion carried.
Mitchell Johnson and Dick Kirkpatrick, representing DSG, reported that their company had been hired by School Districts No. 1 and No. 9 to determine the feasibility of installation of fiber optics in the county, and inquired if the board would be interested in participating in a joint powers board with the school districts to facilitate the project. The board agreed to participate.
The board discussed the PDR Citizens Review Committee with Tom Davenport and Bernie Holz. The board will discuss a resolution to form the committee with County Attorney Van Graham, later in the meeting. Six applications have been received and appointments will be made, once the resolution is adopted.
The board directed the county clerk to schedule interviews with the applicants for the coordinator position on the evening of July 1st or 2nd.
Les Burrough presented information on mosquito abatement, and reported that he would recommend that the county purchase traps and establish a task force for surveying and monitoring. The board requested Burrough to lead the task force and order the traps.
The board will budget $10,000 for mosquito monitoring.
Randy and Shawna McNinch discussed weed spraying with the members of the weed and pest district board present, and competition with private enterprise. Doug Vickrey of the weed and pest district board invited the McNinches to its board meeting. Chairman Johnston informed McNinches that the next weed and pest board meeting will be June 30th.
The board discussed the county sanitarian salary request with Keith Raney. The board requested that Raney consider the tires around the county and their possible health hazard.
Chairman Johnston discussed wood burning and possible cost sharing with Teton County on the purchase of the baler.
The following petitions and affidavits of abatement of taxes were presented on petition from the county assessor and the State of Wyoming Board of Equalization: Williams Production Rocky Mountain Company, $735,837.66; Questar Exploration & Production Company, $3,186.57; Lance Oil & Gas Company, Inc., $1,695.17; Wexpro Company, $6,277.47; Universal Compression, Inc., $19,243 (Assessed Value), and Dru & Tawny Roberts, $1,042.57.
In accordance with the public notice published in the Sublette Examiner, on May 29, 2003, public hearing was held for the following:
1. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the conditional use permit application by the U.S. Postal Service to construct a new post office on land leased in Boulder, zoned A-1, owned by the Donna Steele Living Trust, and located in a portion of Section 16, T32N, R108W. The motion carried.
2. It was moved by Commissioner Fear and seconded by Commissioner Cramer to approve the conditional use permit application by Mark and Renee Jones to do crushing at a gravel pit located on ten acres in a portion of Section 19, T31N, R106W, zoned A-1, with the following conditions:
a. The hours of operation are restricted to daylight hours.
b. The gravel pit shall be reclaimed to Wyoming State Specifications. The surface of the reclaimed pit, above water table shall be top soiled and seeded in accordance with Wyoming State specifications.
c. There shall be no stockpile of materials at the completion of the gravel pit.
d. The conditional use permit for the gravel pit, washing, screening, and crushing, shall expire in five years from the issuance of the zoning and development permit.
e. The operation shall be kept neat and orderly to minimize the visual impact.
f. All operations and activities shall be set back a minimum of 50 feet from the property boundaries.
g. Sublette County Weed and Pest shall inspect the extraction area prior to the issuance of a zoning and development permit, and the extraction area shall be free of noxious and designated weeds, according to the Wyoming Weed and Pest Control Act of 1973 regional forage certification standards.
h. All extraction areas and equipment shall be subject to ongoing inspections by the Sublette County Weed and Pest. If the extraction area or equipment is found to be in violation of the Wyoming Weed and Pest Control Act of 1973 regional forage certification standards, it shall be subject to quarantine.
i. All standing water within the pit area shall be considered a pond and permitted through the State Engineer's Office.
j. The applicant will comply with the seven criteria under development standards for gravel pits in the Sublette County Zoning Resolution, Chapter III, Development Standards, Section 38.
k. All necessary DEQ permits shall be in place before crushing can begin.
The motion carried.
3. It was moved by Commissioner Cramer and seconded by Commissioner Fear to accept and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 03-775J
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF JACKLIN HUNT TO RECLASSIFY AND REZONE 0.84 ACRES, MORE OR LESS, FROM CH-1 DISTRICT TO C-1 DISTRICT, LOCATED IN A PORTION OF SECTION 2, T33N, R111W.
4. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the variance application by Jacklin Hunt allowing a 0.84 acre parcel to be zoned C-1 when the minimum site area in that zoning district is 2 acres. The motion carried.
5. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the preliminary plat for Glacier Hills Subdivision, with the following conditions:
a. Language is added to the plat or all offers, solicitations, advertisements, contracts, and agreements relating to the subdivision, advising potential buyers that: The agent, subdivider and/or future lot owners are advised to hire a reputable well drilling contractor and construct the proposed wells within guidelines described in State Engineer's Office Rules and Regulations, Part II, Water Well Minimum Construction Standards. An approved permit from Wyoming State Engineer's Office is required prior to drilling of a water well.
b. Language is added to the plat or all offers, solicitations, advertisements, contracts, and agreements relating to the subdivision, advising potential buyers that: As recommended by the developer's consultant, domestic wells drilled in this subdivision shall be completed to a minimum total depth of 200 below land surface and shall be produced from the confined Wasatch/Green River formation.
c. An agreement with the Homeowners Association of Carmichael Hills and Broken Subdivisions to contribute to the maintenance and repair of Broken Hills which will be used by Glacier Hills Subdivision owners for ingress and egress.
d. Final plat to show the location of two leachfield sites per lot.
e. Covenants to include Game and Fish wildlife concerns.
f. Consideration will be given to fire suppression strategies as recommended by the county fire marshal.
The motion carried.
6. It was moved by Commissioner Fear and seconded by Commissioner Cramer to accept and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 03-776J
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF KEN AND KAREN TAYLOR TO RECLASSIFY AND REZONE 10 ACRES, MORE OR LESS, FROM R-R 10 DISTRICT TO R-R 5 DISTRICT, LOCATED IN A PORTION OF SECTION 15, T30N, R110W.
7. It was moved by Commissioner Cramer and seconded by Chairman Johnston to reject and act upon the recommendation of the planning and zoning commission. Upon vote, the motion carried, with the vote being: Johnston-aye, Cramer-aye, and Fear-recused, the following resolution was adopted:
RESOLUTION NO. 03-777J
A RESOLUTION REJECTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND DENYING THE APPLICATION OF GARY ESPENSCHEID TO RECLASSIFY AND REZONE 84 ACRES, MORE OR LESS, FROM A-1 DISTRICT TO R-R DISTRICT, LOCATED IN A PORTION OF SECTION 29, T34N, R109W.
8. It was moved by Commissioner Cramer and seconded by Commissioner Fear to approve the preliminary plat to amend the Swingers Greens Second Filing Subdivision by Budd Ranches, Inc. and Valjean Snyder to vacate Lots 5 and 6 and create Lots 7 and 8. The motion carried.
The board approved a request to fund the proposed Outdoor Capital Improvement Project presented by Laurie Hartwig for the Museum of the Mountain Man in the amount of $19,558.23.
The board reviewed the fair board budget, and will confer with the Treasurer Karla Holloway before approving it.
Mary Lynn Worl, Nylla Kunard and Mary Brodie, representing the Hi-Country Senior Citizens, discussed the estimated cost of construction of the new senior center.
The board received the following budget requests, subject to final approval:

Commissioner Cramer left the meeting.
The board accepted a proposal from Bob Reese, KJ&B Enterprises, to represent the county commissioners at various meetings, review documents, and develop recommendations.
County Attorney Van Graham reviewed his budget, will advise Brandon Jensen of Budd-Falen Law Office to request a 30-day extension for discovery in the Erramouspe case, and will prepare a resolution outlining the PDR Citizens Review Committee.
It was moved by Commissioner Fear and seconded by Chairman Johnston to deny a request from Flying A Ranch for a fireworks display. The motion carried.

PROPOSED AMENDMENTS
TO SUBLETTE COUNTY SUBDIVISION RESOLUTION
1. Amend Chapter 1, Section 6 to read:
Section 6. SUBDIVISION PERMIT REQUIRED. No person shall subdivide land located in Sublette County, or commence construction of a subdivision without securing a subdivision permit in the manner prescribed in this Resolution. Such subdivision permit shall be signed by the Board of County Commissioners indicating approval of the subdivision. No subdivision permit shall be issued unless and until the requirements of this resolution have been complied with. A subdivision permit may be transferred upon sale of the subdivision. Unless the method of sale is adopted for the purpose of evading the provisions of this resolution, this resolution shall not apply to any subdivision of land that:
A. Is a Family Division as defined in this resolution;
B. May be created by any court of this state pursuant to the law of eminent domain, by operation of law or by order of any court in this state;
C. Is created by a lien, mortgage, deed of trust or any other security instrument, easements and rights of way;
D. Concerns lands located within incorporated cities or towns;
E. Is created by the sale or other disposition of land to the State of Wyoming or any political subdivision thereof;
F. Affects railroad rights of way;
G. Is a sale or other disposition of land for agricultural purposes or affects the alignment of property lines for agricultural purposes;
H. Is created by boundary line adjustments where the parcel subject of the sale or other disposition is adjacent to and merged with other land owned by the grantee.
I. Creates cemetery lots;
J. Is created by the acquisition of an interest in land in the name of the husband and wife or other persons in joint tenancy or as tenants in common, and the interest shall be deemed for purposes of this subsection as only one (1) interest.
This section shall not apply to the sale or other disposition of land where the parcels involved are thirty-five (35) acres or larger, subject to the requirement that ingress and egress and utility easements shall be provided to each parcel by binding and recordable easements of not less than forty (40) nor more than sixty (60) feet in width to a public road unless specifically waived by the grantee or transferee in a binding and recordable document."
2. Amend Chapter 1, Section 9, Fees, to delete the following:
"Each application for a lot division permit shall be accompanied by a fee of seventy-five dollars ($75.00).
3. Delete the definition of Lot Division under Chapter 1, Section 10.
4. Amend the definition of Subdivision under Chapter 1, Section 10 to read:
"Subdivision means the creation or division of a lot, tract, parcel or other unit of land for the immediate or future purpose of sale, building development or redevelopment, for residential, recreational, industrial, commercial or public uses. The word "subdivide" or any derivative thereof shall have reference to the term subdivision, including mobile home courts, the creation of which constitutes a subdivision of land;
5. Amend Chapter II, Section 1 to read:
"Section 1. REQUIRED PROCEDURES. The procedures prescribed in this chapter shall be followed to secure a subdivision.
6. Amend Chapter II, Section 3, C, last sentence to read:
The application shall be accompanied by ten (10) copies of the preliminary plat, the accompanying material prescribed in Chapter III, page 14, and the required application fee.
7. Amend Chapter II, Section 4 to read in part:
Copies of the plat shall be transmitted to the Plat and Map Review Committee (consisting of the County Geographic Information Coordinator, County Planning and Zoning Administrator, appointed surveyor, and appointed abstractor), appropriate Fire Department, Conservation District, and School District, and may be transmitted to any other public agency that may be affected by the proposed subdivision.
8. Amend Chapter II, Section 12 to read:
Section 12. Plat and Map Review Committee Action: Final Plat. The applicant shall submit five (5) copies of the final plat to the Administrator for review by the Plat and Map Review Committee. The Committee consists of the County GIS Coordinator, County Planning and Zoning Administrator, appointed surveyor, and appointed abstractor. The Plat and Map Review Committee shall complete its review within thirty (30) days of receipt of the final plat.
9. Amend Chapter III, Section 3, F 1 c to read in part:
c. If individual wells are proposed, the subdivider of a minor subdivision shall submit with the application, a hydrology study by a Wyoming professional geologist specializing in hydrology providing evidence that adequate water supply and quality meeting all State requirements will be accessible to the proposed subdivision. ... With the exception of a minor subdivision, all proposed subdivisions must comply with State Department of Environmental Quality water quality requirements prior to submitting the preliminary plat application for public hearings before the County.
10. Delete current Chapter V, Lot Division Permit.
11. Create a new Chapter V, Family Division to read:
Section 1. FAMILY DIVISION DEFINED. A Family Division is a division of land made outside of platted subdivisions for the purpose of a single gift or sale to a member of the landowner's immediate family, subject to the following requirements:
A. IMMEDIATE FAMILY MEMBER: A member of the immediate family is limited to any person who is a natural or adopted child, stepchild, spouse, sibling, grandchild, grandparent or parent of the landowner;
B. PURPOSES: The purpose of the division is to provide for the housing, business or agricultural needs of the grantee;
C. TITLE: Parcels created under this paragraph shall be titled in the name of the immediate family member for whom the division is made for a period of not less than one year unless such parcels are subject to involuntary transfer including, but not limited to, foreclosure, death, judicial sale, condemnation or bankruptcy;
D. ACREAGE FOR REDIVISION: No parcel smaller than 5 acres created under this Chapter shall be further divided unless the owner obtains a subdivision permit pursuant to this Resolution.
A Family Division that meets the administration requirements set out below shall be exempt from the subdivision permit requirement of this Resolution.
Section 2. ADMINISTRATION.
A. AFFIDAVITS OF FAMILY EXEMPTION: The owners or agents of a property owner seeking to record deeds, records of survey, contract for deeds, or other types of instruments that divide land pursuant of a Family Division, present to the County Clerk an affidavit of family exemption to be recorded with the instrument. Affidavits for family exemption shall be in a form approved by the Sublette County Attorney;
B. RESOLUTION OF NON-EVASION: The original grantee of a family exemption parcel shall obtain a "Resolution of Non-Evasion Concerning Resale of Family Division Parcel" from the Commission prior to grantee conveying the parcel. The Commission shall grant the resolution if it finds that the proposed conveyance would not violate the Subdivision Resolution. The grantee shall record the resolution with the deed of conveyance. If the conveyance would violate the Subdivision Resolution, the Commission shall deny the resolution and require a subdivision permit to allow the conveyance. Failure to obtain the resolution prior to conveyance shall be a violation of these regulations.
C. CHANGE OF PURPOSE FOR FAMILY DIVISION: The original grantee of a family exemption may change the stated purpose (housing, business or agriculture) for the exemption by recording an instrument that nullifies the original Affidavit of Family Subdivision and filing a new Affidavit of Family Subdivision appropriate to the new purpose. The nullification instrument shall be in a form approved by the County Attorney.
D. RECORD OF SURVEY REQUIRED: A Record of Survey shall be recorded with, or if already recorded referenced, all conveyances of parcels of property conveyed as a Family Division parcel.
E. SPECIFICATIONS FOR RECORD OF SURVEY:
i. Records of survey shall be legibly drawn, printed or reproduced with permanent ink, and shall meet the requirements of W.S. § 33-29-139(a);
ii. The record of survey shall show or contain on its face, or on separate sheets referenced on its face, the following information:
a. A title block including the township, range, principal meridian, county and state of the surveyed land. A Record of Survey shall not bear the title "plat", "subdivision", or any title other than "Record of Survey;"
b. Space shall be provided on the record of survey for the clerk and recorder's filing information;
c. Date survey was completed;
d. North arrow and scale or scale bar;
e. All monuments found, set, reset, replaced or removed describing their kind, size, location and giving other data related thereto;
f. The location of any corners of sections or divisions of sections pertinent to the survey;
g. The bearings, distances, and curve data of all perimeter boundary lines shall be indicated;
h. Data on all curves sufficient to enable the re-establishment of the curves on the ground;
i. Lengths of all lines shown to at least one-hundredth (1/100) of a foot, and all angles and bearings shown to at least the nearest second;
j. All parcels created by the survey and dimensions and area of each parcel;
k. A Certificate of Surveyor signed by a land surveyor registered under l.
l. A Certificate of Owner by the owner of record, fee simple or contract for deed. The certificate shall conform to the requirements of W.S. § 34-12-103;
m. Acknowledgement of Certificate of Surveyor and Certificate of Owner.
n. The means of legal access to the parcel which shall not be less than thirty (30) feet in width along with recordation information of such easement or access;
o. Sheet size shall be 24"x36" or 22"x36"."
12. Adopt Chapter VII, Minor Subdivision to read:
CHAPTER VII
MINOR SUBDIVISION
Section 1. A Minor Subdivision is a subdivision that contains no more than two (2) lots. A subdivision shall not be classified as a minor subdivision if any of the following apply:
A. The land to be subdivided is within a platted subdivision or is a lot or part of a lot created under lot division under prior regulations.
B. The land to be subdivided is a parcel created under Chapter V, Family Division of this Subdivision Resolution.
Section 2. An owner shall have the right to create one minor subdivision for each lot, tract or parcel of land. Further divisions on that lot, tract, or parcel of land in lots 35 acres or less shall result in the need to go through the full subdivision process, including DEQ approval.
Section 3. A Minor Subdivision is exempt from the provisions of Wyoming Statute W.S. § 18-5-306(c) (Laws 2000)."
