Instream flow to be re-heard

An official with the Wyoming State Engineer's Office said in an interview Wednesday, June 18, that the two applications aimed at establishing an instream flow for Pine Creek will be the subject of another hearing, set for 9 a.m. on July 28.

The instream flow issue is going to have to be reheard due to improper advertising of the original hearing that took place last December.

Staff of the State Engineer's Office had been busy preparing the decision document, but when the Pinedale Roundup couldn't produce the proof of publication for the two weeks of legal advertising the agency had ordered be placed in December, state officials learned the Roundup hadn't actually run the ads.

Although the Examiner wasn't the newspaper the state agency had solicited for the legal advertising for the hearing notice, the Examiner published the legal ad in the form of an article one week in December, then published a front-page notice of the hearing the next week.

Jeffrey Geyer of the State Engineer's Office said his agency will soon issue an announcement about the rescheduled hearing. Since transcripts were made of the hearing last December, people will not need to re-appear to repeat their testimony, but new evidence or information should be presented at the July hearing.

The Examiner will publish notice of the hearing, as well as the legal ads for the state, as soon as that information becomes available.
