TAKE NOTICE that Elaine S. Kitch has filed a petition for admission of California probate proceedings as a probate of the estate in Wyoming. The petition will be heard on January 31, 2003, at 10 a.m., or as soon thereafter as it may be heard, following publication of this notice for three weeks as required by law, and any protest thereto, or any claims against the estate not previously considered in the California probate must be presented at such hearing or they shall be barred and the relief requested shall be granted.

REQUEST FOR BIDS
Hereby take notice that the Pinedale Airport Board, acting on behalf of the Town of Pinedale, is requesting bids for the salvage rights and removal for all structures, interior fencing and corral from lot five (5) of the Airport Subdivision, Sublette County, Wyoming. Bids will be opened on Feb. 11, 2003, at 2 p.m. at the Pinedale Town Hall. All bids must be on the authorized Bid Form and received at the Pinedale Town Hall no later than 5 p.m. on Feb. 10, 2003, to be considered. Removal must be completed by Oct. 1, 2003. Within five business days of notice of award, the successful bidder will be required to enter into a written contract with the Pinedale Airport Board for the successful reclamation of the concerned lot after salvage and removal of the concerned structures, interior fencing and corral in a form attached to the Specifications. Specifications for this contract and Bid Forms are available at the Pinedale Town Hall. Telephone (307)-367-4136 for mailing of a bid package.
Structures include: Two-story log home with 3 bedrooms, 2 baths, attached double garage, detached barn and detached shed located at 24 Runway Lane, about 5 miles SE of Pinedale off Highway 191. Interior fencing includes pole fencing and corral. In case of conflict between the terms of the Request and the Specifications, the Specifications shall control.

NOTICE OF APPICATION FOR DECREE
Notice is hereby given that an Application for Decree of Ownership of Real Property has been filed in the Ninth Judicial District Court in Pinedale, Sublette County, Wyoming, where Ruth Clare Johnson claims to be the sole heir under the Last Will and Testament of Clare R. Axtell, who died in Thermopolis, Hot Springs County, Wyoming, on July 22, 1991. In said application, Ruth Clare Johnson claims she is entitled to the real property further described as follows:
A 7.555555% (1/9th of 68%) interest in the oil, gas and minerals in the following describe real property:
Township 31 North, Range 109 West of the 6th P.M., Sublette County, Wyoming;
Section 15: Lots 3, 4, 5, 6 and 9, SW1/4SW1/4
Section 21: Lots 1, 4, 5, 7, 8, 10, E1/2NE1/4
RUTH CLARE JOHNSON further claims all income due and owing as a result of litigation on the above-described mineral rights; the last known amount due was a total of $79.53 as a result of said litigation.
YOU ARE FUTHER NOTIFIED that anyone having an objection must file an objection on or before Feb. 10, 2003, at 10 a.m., at which time the district judge shall hold a hearing and if the facts of said application are not in dispute, the court will enter a decree establishing the right and title to the property in Ruth Clare Johnson.

Tri-Town Join Powers Recycle
January 14, 2003
To all contractors, vendors and employees.
This is your notification that there exists no written agreement with Marjorie Guio of Big Piney, Wyoming, not with her personally nor with Crosstimbers Recycling in Marbleton, Wyoming.
This Tri-Town Joint Powers Recycle Agreement is to inform you that any and all actions, contract, agreements, promises or commitments, made between you and Marj Guio are of no part, interest, concern or obligation of the Tri-Town Join Powers Recycle Board. All agreements whether written or verbal do not involve the Tri-Town Recycle effort.
Marj Guio is not a member of this board of directors and has no control of its finances or contracts.
The Tri-Town joint powers board is a completely separate entity from Marj Guio and/or Crosstimbers Recycle Business and its building and properties.
Absolutely no bills will be paid by Tri-Town Joint Powers in regard to commitments made by Marj Guio.

COMMISSIONERS PROCEEDINGS
JANUARY 21, 2003
The Board of County Commissioners met in regular session on this date at 9:00 a.m. with Gordon Johnston, Bill Cramer, Cat Urbigkit of the Sublette Examiner, Joe Wilhelm of the Pinedale Roundup, and Mary Lankford, County Clerk present. Commissioner Betty Fear was absent.
The minutes of the preceding meeting of January 6, 2003, was approved and ordered filed on motion by Commissioner Cramer and seconded by Chairman Johnston. The motion carried.
The official bonds for Lilymae Penton, treasurer for the Pinedale Airport Board, in the amount of $1,000; William Krieger, treasurer for School District No. 9, in the amount of $50,000; B. Weldon Shelley, Superintendent, School District No. 9, in the amount of $50,000; and Roxanna Jensen, Sublette County Treasurer, in the amount of $100,000; were approved and ordered filed with the County Treasurer and County Clerk, respectively.
Todd Bishop of Kaiser and Company, and County Treasurer Roxanna Jensen reviewed the county's current investments.
Debi Morley and Keyth Ann Palmer, representing Tri-Town Recycling, reported that Gordon Mickelson has resigned and that Scott Scherbel would like to be appointed by the Town of Marbleton. The board discussed a proposed rental agreement with Marge Guio, a disclaimer letter, and proposed the purchase of the Pacific Power building for recycling. It was moved by Commissioner Cramer and seconded by Chairman Johnston to allocate funds for the purpose of purchasing property for recycling in the Big Piney-Marbleton area and authorize the Tri-Town Recycling Board to pursue purchase of the Pacific Power Building in the name of the county. The motion carried.
Sue Sommers, representing the Pinedale Fine Arts Council, presented an invitation to a performance on Jan. 31 by Dorene Ludwig.
Sheriff Hank Ruland and Undersheriff Henry Schmidt reported that two deputies have been deployed by the service. It was moved by Commissioner Cramer and seconded by Chairman Johnston to pay the difference between Tom Hueckstaedt's military salary and county salary while he is gone. The motion carried. Schmidt reported that he had filed an incident report about a complaint from Perry Binning regarding his access road. The board discussed radio maintenance and directed Schmidt to request a statement of work from Sublette Communications. Schmidt informed the board about a computer upgrade.
Dave Doorn, director of the Sublette Center, discussed the final plat approval for the property sale to the county. The board agreed to approval of payment, if the final plat is approved before the next meeting.
Chairman Johnston reported on a meeting with Craig Trulock, district ranger, concerning a land sale by the Forest Service of an isolated tract near the Willow Creek Guard Station. Johnston discussed the Pinedale Resource Management Plan, the bleachers, proposed legislation by Hoback Ranches, and the Shaul suit.
Mike McGinnis, waste management, and Frank Grimes, representing Nelson Engineering, reviewed plans for a building and for DEQ permitting of the Marbleton Landfill as a balefill. McGinnis discussed opening the transfer station on Mondays. The board requested Eiden to be scheduled for the Feb. 4 meeting to discuss the proposed opening.
In accordance with the public notice published in the Sublette Examiner on Dec. 26, 2003, public hearing was held for the following:
1. It was moved by Commissioner Cramer to approve the variance request by the Sublette County Weed and Pest Control Board for three signs that are 11 feet in height where 8 feet is allowed and 32 square feet in face area were 24 square feet is permitted. The motion died due to lack of a second and was tabled until the Feb. 4 meeting.
2. It was moved by Commissioner Cramer to approve a variance request by Donald Kendall to allow an extra guest house that is greater than 800 square feet of living are on 40 acres zoned A1. The motion died due to lack of a second and was tabled until the Feb. 4 meeting.
3. It was moved by Commissioner Cramer and seconded by Chairman Johnston to accept and act upon the recommendation of the Planning and Zoning Commission. Upon vote, the motion carried, and the following resolution was adopted:
RESOLUTION NO. 03-758C
A RESOLUTION ADOPTING THE RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION AND APPROVING THE APPLICATION OF CARL E. AND AUDREY L. BUDD TO RECLASSIFY AND REZONE 10 ACRES FROM A-1 DISTRICT TO R-R 10 DISTRICT, LOCATED WITHIN THE NE1/4SE/4 OF SECTION 8, T29N, R114W.
4. It was moved by Commissioner Cramer to accept and act upon the recommendation of the Planning and Zoning Commission to amend the Zoning and Development Regulations Resolution to create a new zoning category for Large Tract Developments. The motion died due to lack of a second and was tabled until the Feb. 4 meeting.
Lance Koppenhafer and John Fear discussed the roof at the Ag Center, and an outstanding bill from Spiegelberg. It was moved by Commissioner Cramer and seconded by Chairman Johnston to reappoint Lance Koppenhafer to the Ag Center Committee.
The board discussed continuing with a pilot program for Purchase of Development Rights with the PDR working group. Comments against continuing were received from Bob Harrower, John Mackey, Ed Wardell and Karen Harrower. It was moved by Commissioner Cramer and seconded by Chairman Johnston to approve and budget for the continuation of the pilot project and reappoint Tom Davenport, Bernie Holz, Jo Crandall, and Nancy Espenscheid to the PDR Working Group. The motion carried.
County Treasurer Roxanna Jensen discussed signing a letter of disclosure and interest on taxes.
It was moved by Commissioner Cramer and seconded by Chairman Johnston to re-appoint Carl Robillard to the Sublette County Recreation Board for a five-year term. The motion carried.
