PUBLIC NOTICE
The Sublette County Planning and Zoning Commission will meet Thursday, October 17, 2002, at 7:30 p.m. in the County Courthouse in Pinedale, Wyoming. At this time public hearing will be held for the following applications:
AGENDA
1. Zone change application by Melvin Bagley to rezone 35 acres from A-1 (Agricultural) to R-R (Rural Residential). The property is Tract 2 of Glacier Ridge Large Tract Development, located northeast of Orcutt Hill Unit IV Subdivision and west of Broken Hills and Carmichael Hills 2nd Filing Subdivisions. The purpose of the zone change is to subdivide into 14 parcels.
2. Zone change application by Susan Pape to rezone 3.87 acres, more or less, from R-R 10 (Rural Residential Ten Acre Minimum) to R-R (Rural Residential). The property is located in a portion of Lot 2, Millennium Lot Division, Section 27, T34N, R111W. It is located south of State Hwy 354 approximately 1/2 mile from the Daniel Junction. The purpose of the zone change is to create a lot and grant property to an immediate family member for her home site.
3. Zone change application by Curtis Flug to rezone 18 acres from I-L (Light Industrial) to I-H (Heavy Industrial). The property is located in lots 17, 18, 19, and 20 of Sand Draw Industrial Park. The industrial park is at the intersection of U.S. Hwy 191 and State Hwy 351 (the Big Piney Cut-off). The purpose of the zone change is to build a bioremediation facility to treat hydrocarbon contaminated waste.
4. Zone change application by Charles (Bucky) Neely to rezone .68 acre, more or less, from R (Residential) zoning to MFR (Multiple Family Residential). The property includes Lots 32 and 33, Block 5 Amended, Shelter Park Subdivision and is accessed by Valley Road CR 23-212. The purpose of the zone change is to use the second floor of the house as a separate rental unit.
5. Zone change application by Jack Richardson to rezone 28.1 acres, more or less, from A-1 (Agricultural) to R-R (Rural Residential) and C-1 (General Commercial on 2.73 acres). The property is located in the SE1/4 of Section 10, T33N, R109W, directly north of Aspen Storage and Giebel Subdivision. The purpose of the zone change is to subdivide the property into 11 residential lots and 1 commercial lot.
6. Zone change application by Doug Sterck to rezone 38.34 acres, more or less, from A-1 (Agricultural) to R-R 10 and R-R 20. The property is located in part of Lot 2, Section 6, T33N, R109W, located south of U.S. Hwy 191 and directly west of Bloom Subdivision. The purpose of the zone change is to rezone two non-conforming parcels that will be created as the result of a new county road.
7. Zoning Resolutions Amendment to allow up to 10 children in a day care service provided as a home occupation. The current standard allows up to 6 children. The amendment will make the county standard the same as the State of Wyoming standards. The proposed amendment is shown in bold:
Section 22. Home Occupation Standards. Home occupations and professional offices, incidental to the principal residential use of a structure shall be permitted in any zoning district and shall conform to the following standards:
d. [First sentence has no change.] Second sentence is amended to: Letting or renting of rooms to roomers or boarders, and the providing of day care service for 1 to 6 10 children shall be considered a home occupation as described in this section,...

NOTICE OF PUBLIC HEARING
RELATING TO WATER RIGHTS
IN THE MATTER OF a petition by the Wyoming Game and Fish Department before the State Board of Control, Docket No. IV-2002-2-40, to AMEND their 952.95 acre-foot portion of the CERTIFICATES for annual storage they hold in Fremont Lake Reservoir for fish propagation. The two (2) appropriations - of which Game and Fish holds only a 476.475 acre-foot portion of each - are the Fremont Lake Reservoir Association appropriations storing water from Pine Creek, tributary West Fork New Fork River, under Permit 4453R with priority of September 15, 1931 and Permit 4465R with priority of November 20, 1931, with the Game and Fish portions established under Board of Control Order Record 36 Page 151.
The petition seeks to have the Board of Control delete restrictive language regarding the use, release, regulation, and protection of Game and Fish's storage water right. Additionally, it seeks Board of Control authorization to allow this water to be released for supporting fisheries in Pine Creek below the Fremont Lake Reservoir at any time during the year as needed rather than only during the period of October 1 through May 30. It also requests regulation and protection of this release. The dam for Fremont Lake Reservoir is located in the SW1/4 SW1/4 of Section 23, T34N R109W.
Said petition has been referred to the undersigned for public hearing as provided for by law under Wyoming Statute 41-4-514(d) and (e).
NOW THEREFORE, a public hearing will be held in the Sublette County Library in Pinedale, Wyoming on Wednesday, October 16th, 2002 at 8:00 a.m., at which time anyone whose water right will be injured by the granting of said petitions may appear and submit testimony in protest.

INVITATION TO BID
The Board of County Commissioners of Sublette County is requesting bids for cleaning services and outside maintenance at the Marbleton Annex. Sealed bids should be submitted to the Sublette County Clerk's Office at the Courthouse in Pinedale, Wyoming, no later than 5 p.m. on Monday, September 30, 2002. Bid opening will be at the regular meeting of the Board of County Commissioners at 10:15 a.m. on Tuesday, October 1, 2002. Detailed bid specifications are available on request at the Marbleton Annex and the Sublette County Clerk's Office.

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
SEPTEMBER 3, 2002
The Board of County Commissioners met in regular session on this date at 9:00 a.m. with Bill Cramer, Gordon Johnston, Betty Fear, Cat Urbigkit of the Sublette Examiner, Joe Wilhelm of the Pinedale Roundup, Dan Holgate, and Mary Lankford, County Clerk present.
The minutes of the preceding regular meeting of August 23, 2002, were approved and ordered filed on motion by Commissioner Johnston and seconded by Commissioner Fear. The motion carried.
The official bond for Catherine Summerall, treasurer for the Redstone Upper Green River Road Improvement District, in the amount of $10,000, was approved and ordered filed with the county treasurer.
Daphne Platts, county librarian, requested use of the county van for library staff to attend meetings. The board approved the request for trips, for more than one person, when it is not being used by county officials.
Platts discussed the use of the Pinedale Pathway and the need for blinders on the stop signs and more "No motorized vehicles" signs.
Dan Holgate, road and bridge superintendent, reported on the Paradise project, the reapplication of soy soil stabilization product on the Guio road by Walker Agri-Service at no cost, mag water and its performance, bus routes, and the Industrial Site road. The Sterck deed is prepared and should be recorded this week.
Holgate recommended more maintenance next year and no reconstruction projects.
Randy Bolgiano, Stan Murdock, and Dan Budd, members of the Green River Basin Advisory Group, encouraged the board to participate in the proposed joint powers agreement with Carbon, Sweetwater, Lincoln, and Uinta counties. The board expressed its continued support of the proposed joint powers agreement. The board will refer the proposed joint powers agreement to the county attorney.
It was moved by Commissioner Fear and seconded by Commissioner Johnston to appoint John Copeland to the Weed and Pest Board for an unexpired term of 18 months. The motion carried.
Doug Vickrey requested signs for the Dickinson Ditch and inquired about the removal of cattleguards on Pape County Road.
Stella McKinstry, extension service, reported on State Fair and the increased numbers of participants from Sublette County. The board reviewed County and State Fair expenses for participants and McKinstry and Eric Peterson. The board decided that it would pay the vouchers, this year, but the budget would be set for next year and new criteria for payment will need to be considered.
In accordance with the public notice published in the Sublette Examiner on August 22, 2002, public hearing was held for the following:
1. It was moved by Commissioner Fear and seconded by Commissioner Johnston to approve the conditional use permit application by William and Laura Fenn to construct and rent storage units on an entire three acres zoned C-1 located in the NE1/4 of Section 15, T33N, R109W, with the following conditions:
a. A sign permit will be obtained for signage advertising the business.
b. Prior to issuing a permit for the commercial development, a landscaping plan shall be submitted and approved by the County Planning and Zoning Office. One plant unit of landscaping shall be planted. Landscaping shall survive two years from planting or be replaced.
c. Access approvals be obtained from Wyoming Department of Transportation.
d. Any future lighting face away from the residential area and be directed downward. The motion carried.
2. It was moved by Commissioner Fear and seconded by Commissioner Johnston to approve the variance application by William and Laura Fenn to have a front highway setback of 30 feet from the U.S. Hwy 191 right-of-way line where 50 feet is required, located in the NE1/4 of Section 15, T33N, R109W, with the following conditions:
a. A sign permit will be obtained for signage advertising the business.
b. Prior to issuing a permit for the commercial development, a landscaping plan shall be submitted and approved by the County Planning and Zoning Office. One plant unit of landscaping shall be planted. Landscaping shall survive two from planting or be replaced.
c. Access approvals be obtained from Wyoming Department of Transportation.
d. Any future lighting face away from the residential area and be directed downward.
3. It was moved by Commissioner Fear and seconded by Chairman Cramer to approve the conditional use permit application by Kurt and Jennifer Meeks for screening and operating a portable batch plat at a gravel pit on property owned by Donna Steele located in a portion of Section 16, T32N, R108W, and zoned A-1, with the following conditions:
a. The hours of operation are restricted to daylight hours.
b. The gravel pit shall be reclaimed to Wyoming State Specifications. The surface of the reclaimed pit, above water table shall be top soiled and seeded in accordance with Wyoming State Specifications.
c. There shall be no stockpile of materials at the completion of the gravel pit.
d. The conditional use permit for the gravel pit, screening, batch plant, and hauling shall expire on September 3, 2004 (two years from county commissioners' approval).
e. The operation shall be kept neat and orderly to minimize the visual impact from U.S. Highway 191.
f. All operations and activities shall be set back a minimum of 50 feet from the property boundaries, with a 300-foot front setback from the U.S. Highway 191 right-of-way line.
g. Sublette County Weed and Pest shall inspect the extraction area prior to the issuance of a zoning and development permit, and the extraction area shall be free of noxious and designated weeds, according to the Wyoming Weed and Pest Control Act of 1973 regional forage certification standards.
h. All extraction areas and equipment shall be subject to ongoing inspections the Sublette County Weed and Pest. If the extraction area or equipment is found to be in violation of the Wyoming Weed and Pest Control Act of 1973 regional forage certification standards, it shall be subject to quarantine.
i. All standing water within the pit area shall be considered a pond and permitted through the State Engineer's Office.
j. The applicant will meet the seven criteria under development standards for gravel pits in the Sublette County Zoning Resolution, Chapter III, Development Standards, Section 38.
k. The volume of the reverse beepers on the equipment will be decreased to the lowest allowable level.
l. A dry vacuum system, with sprinklers to control the dust, will be installed.
m. The pit will be limited to a concrete batch plant, no asphalt or crushing will be allowed.
n. A bag-house system will be installed.
The motion carried, with the vote being: Cramer-aye, Fear-aye, and Johnston-nay.
Sheriff Hank Ruland and Undersheriff Henry Schmidt discussed the drug court and will provide more information to the board.
The board signed the funding documents for emergency management.
It was moved by Commissioner Fear and seconded by Commissioner Johnston to adopt Resolution No. 02-744C authorizing submission of a transportation enterprise fund grant by the Rural Health Care District for a wheelchair lift passenger van for the Sublette Center, in the amount of $46,295, and Resolution No. 02-745C authorizing the submission of a Federal Mineral Royalty Capital Construction Account Grant application for the construction of an addition to the Big Piney-Marbleton Volunteer Fire Hall, in the amount of $200,000. The motion carried.
The board reviewed a depository pledge agreement submitted by Community First National Bank, but refused to sign the agreement.
The board signed a contract with the Maternal Child Health and the Public Health Nurse.
The board participated in a conference call with Karen Budd-Falen.
It was moved by Commissioner Fear and seconded by Commissioner Johnston to request full payment according to PL 106-393 (HR 2389) for U.S. Forest Service Reserve payments. The motion carried.
