PUBLIC NOTICE
The Sublette County Planning and Zoning Commission will meet Thursday, August 15, 2002, at 7:30 p.m. in the County Courthouse in Pinedale, Wyoming. At this time public hearing will be held for the following applications:
AGENDA
1. Zoning district boundary change application by James and Margret Noble to rezone and reclassify 20.41 acres from A-1 (Agricultural) to R-R 20 (Rural Residential Twenty Acre Minimum). The property is located in a portion of Section 29, T34N, R110W. It is approximately 1 1/2 miles west of the intersection of State Hwy 352 and US Hwy 191, on the north side of US Hwy 191. The purpose of the zone change is to subdivide one lot for a home site.
2. Proposed amendment to the County Zoning and Development Regulations Resolutions to establish a large tract development (LTD) zoning category. Persons creating a large tract development consisting of two or more lots between 35 and 80 acres would be required to obtain a zone change to Large Tract Residential (LTR) before filing a Large Tract Development map.

CHAPTER II - ZONING DISTRICTS
Section 1. Zoning Districts.
Large Tract Residential (LTR): This district provides areas in the rural portions of the County for residential development and uses. A thirty-five (35) acre minimum parcel is required.

    (2) Livestock shall be maintained in accordance with Chapter III, Development Standards, Section 32 of the Zoning and Development Regulations

CHAPTER IIIA - DEVELOPMENT STANDARDS FOR LARGE TRACT DEVELOPMENTS
Section 2. Definition. A large tract development is a division of a parcel of land of any size where two or more of the resulting parcels are 35 acres or larger but less than 80 acres. If all of the tracts resulting from a division of a tract or parcel are greater than 80 acres in size, the requirement hereof shall not apply.
Section 3. Development Standards.
a. A zoning district boundary change to a zoning district other than A-1 is required before the development standards listed below are completed.

Notice of Hearing on Declared Weeds
Notice is hereby given that a public hearing on Black Henbane (Hyoscyamus niger L.) and Scentless Chamomile (Anthemis arvensis L.) to be the Declared Weeds for 2002 will be held at the Weed & Pest Office, 12 South Bench Road, Pinedale, WY 82941 at 7:30 p.m. Thursday, the 18th of July 2002. Any and all persons interested may appear and be heard regarding the declared weeds at that time.

Notice is hereby given that a public hearing on the proposed budget of the Sublette County Weed and Pest Control District for the fiscal year ending June 30, 2003, which is now being considered by the board, will be held at the Weed & Pest Office, 12 South Bench Road, Pinedale, Wyoming at 8 p.m., Thursday, the 18th of July 2002. Any and all persons interested may appear and be heard regarding such budget at that time. A summary of the budget follows:

OFFICIAL COUNTY COMMISSIONERS PROCEEDINGS
JULY 2, 2002
The Board of County Commissioners met in regular session on this date at 9:00 a.m. with Bill Cramer, Gordon Johnston, Betty Fear, Cat Urbigkit of the Sublette Examiner, Rob Shaul of the Pinedale Roundup, Mike McGinnis, Dan Holgate, and Mary Lankford, County Clerk present.
The minutes of the preceding meeting of June 24, 2002, were amended to include the following: Paragraph 10, insert "ever" after "they would", then it moved by Commissioner Fear and seconded by Commissioner Johnston to approve the amended minutes and order them to be filed. The motion carried.
The official bond for Robert W. Maxam, Secretary Treasurer for the Pinedale Volunteer Fire Department, in the amount of $25,000, was approved and ordered filed with the County Fire Board.
The board recessed the meeting into executive session to discuss personnel with Mike McGinnis and Dan Holgate.
The board reconvened the meeting.
The chairman announced that Mike McGinnis has been appointed and accepted the position of Superintendent of the Landfill and Transfer Station.
Irv and Robin Lozier discussed directional signs along the New Fork Willow Creek Road. The board requested photographs and locations of signs, and informed Loziers that the sign posts would need to be able to break away. It was moved by Commissioner Johnston and seconded by Commissioner Fear to allow four (4) directional signs in the county right-of-way for the Box R Ranch. The motion carried. A permit will be issued for the four locations.
It was moved by Commissioner Fear and seconded by Commissioner Johnston to grant permission to Veritas Land Surveys to conduct 3-D seismic activities on lands owned by Sublette County in Section 23, T34N, R111W. The motion carried.
John Erramouspe reported on a letter received from the BLM concerning the imposition of trespass on their property. Erramouspe requested the board provide financial assistance to employ Budd-Falen Law Offices. Signs of endangered species on the property was discussed. The board decided to contact Karen Budd-Falen for a proposal to consider.
In accordance with the public notice published in the Pinedale Roundup on June 27, 2002, public hearing was held for the transfer of funds in the amount of $2,327,439.00 from the following accounts: Unanticipated Revenue $8,052.00; Depreciation Reserve-Building Project, $2,020,187.00; Depreciation Reserve-Landfill Reserve, $50,000.00; Cash Reserve, $18,000.00; County Commissioner-Vehicle Reserve, $4,000.00; County Assessor-Vehicle Reserve, $4,700.00; Planning & Zoning-Vehicle Reserve, $2,500.00; Law Enforcement- Vehicle Reserve, $45,000.00; Road & Bridge-Equipment Reserve, $175,000.00 to County Treasurer-Office Supplies, $266.00; County Attorney-Prosecution, $30.00; Courthouse- Government Facilities, $2,000,000.00; Communications-Equipment, $38,187.00; County Health-Best Beginnings, $750.00; County Health-Vaccine, $4,300.00; County Health- Mileage, $106.00; Transfer Station-Recycling, $1,600.00; Landfill-Heavy Equipment, $50,000.00; General Fund-New Fork Willow Creek Road, $1,000.00; and Equipment Reserve, $231,000.00. It was moved by Commissioner Fear and seconded by Commissioner Johnston to adopt Resolution No. 02-732C authorizing the transfer of funds. The motion carried.
Frank Grimes of Nelson Engineering reported on the re-permitting of the Marbleton Landfill. A draft permit has been received with the final permit expected by September 1st.
John Blaha, County Fire Warden, discussed enacting a partial fire ban, due to extremely dry conditions. It was moved by Commissioner Johnston and seconded by Commissioner Fear to adopt Resolution No. 02-733C enacting a partial closure of open burning of fires in Sublette County due to extreme fire danger, effective commencing July 2, 2002, at 10 a.m. The motion carried.
It was moved by Commissioner Johnston and seconded by Commissioner Fear to designate the Sublette Examiner as the official newspaper for the ensuing year, ending June 30, 2003, at a rate of $2.00 per inch. The motion carried.
Dan Holgate, Road & Bridge Superintendent, thanked the Board for its trust and for his recent appointment as superintendent. Holgate reported that the Forty Rod project will be completed in the next couple of weeks and that the department will move to the Paradise project. Holgate plans to do as much maintenance as possible and complete pending projects, and is seeking recommendations for reorganization.
It was moved by Chairman Cramer and seconded by Commissioner Johnston to issue malt beverage permits to the Sublette County Sporting Association for the following dates: July 11, 12, & 13, 2002, for the Rendezvous Rodeos and August 31, 2002, for the Labor Day Rodeo, at the Pinedale Rodeo grounds. The motion carried.
It was moved by Commissioner Johnston and seconded by Commissioner Fear to issue a malt beverage permit to the Pinedale Lions Club for the Rendezvous BBQ at the Rendezvous Grounds on July 13, 2002. The motion carried.
It was moved by Commissioner Johnston and seconded by Commissioner Fear to waive the Temporary Merchant's fee for the upcoming Rendezvous weekend of July 12, 13, & 14, 2002. The motion carried.
It was moved by Commissioner Johnston and seconded by Commissioner Fear to re-appoint Paul Hagenstein for a three-year term to the museum board. The motion carried.
It was moved by Commissioner Fear and seconded by Commissioner Johnston to re-appoint Pat Schueler for a three-year term to the library board. The motion carried.
It was moved by Commissioner Fear and seconded by Commissioner Johnston to re-appoint Jay Anderson for a three-year term and appoint Albert Sommers for a three-year term to the Planning and Zoning Commission. The motion carried.
It was moved by Commissioner Johnston and seconded by Commissioner Fear to re-appoint Chris Hoefer and ML Baxley for three-year terms to the golf committee. The motion carried.
It was moved by Commissioner Fear and seconded by Commissioner Johnston to award its renewal scholarship to Nick Smith, with Silas Davidson, first alternate, and Danyell Bates, second alternate. The motion carried.
County Assessor Janet Montgomery discussed the loss of vacation by Buzz Esterholt. Due to Esterholt's health, the board waived the requirement to use the vacation by June 30th.
The following petitions and affidavits of abatement of taxes were presented on petition from the County Assessor and the State of Wyoming Board of Equalization: Patrick Pfisterer, $128.52, and Questar Exploration & Production Company, $98,197 (assessed value).
Stan McKee, Pam Lewis, and Patricia Hamilton of the BLM, and the State BLM office by conference call, discussed the Erramouspe road and trespass enforcement. McKee offered the board a free FLPMA right of way and assured the board that granting a FLMPMA right-of-way would not interfere with a RS2477 right-of-way. Chairman Cramer informed McKee that the board would take no action to harm Erramouspes, and that the board was not prepared to accept or reject McKee's offer. McKee informed the board that a trespass will hold up the land transfer, but that he will delay the trespass enforcement until the BLM hears from the board.
The board discussed the Erramouspe matter with Karen Budd-Falen, by conference call.
The board contacted Stan McKee by telephone and requested a FLMPA right-of-way application.
Keith Raney, Larry Braun, Larry Proud, and Jim Meiring, representing the Pinedale Hockey Association, discussed funding for an indoor hockey facility. The board informed the association that it would consider $500,000 for the facility.
The board reviewed landfill and transfer station budgets with Mike McGinnis and the road and bridge budget with Dan Holgate.
The board decided to reimburse Tri-Town Recycling for the invoice from Schmid Oilfield Service for clean-up at the Marbleton Recycling Center.
